Consignment Contract

Busy Bodies Playnasium 130 Augustine Avenue, #46 Charles Town, WV 25414 304-579-4133 Consignment Contract Busy Bodies Playnasium allows the placement of handmade crafts and original works of art for sale in the retail entrance of the Playnasium. The following conditions must be met by each artist. 1. Each person allowed to show on consignment must be approved by the owner(s) of the Playnasium, and must sign the consignment contract contained herein. 2. Display of consignment pieces will be on a space available basis which will be determined by the owners of the Playnasium. No consignment person will be granted permanent or exclusive space in the retail area. With permission of the owners, consignment artists may supply their own display equipment, such as cases, shelves, tables, or whatever is necessary to adequately display the craft. 3. Consignment artists will be assessed a commission of (choose either a. or b.) a. $10 per month, due by the 5th day of each month, and 10% per piece sold through the Playnasium and a 5% commission on special orders through the Playnasium. b. Or, 20% per piece sold through the Playnasium and a 10% commission on special orders through the Playnasium. c. The commission will be deducted from the consignee’s monthly check. Payment to the consignee will be due on the last day of the month and will be payable by the 15th of the next month. The amount of the commission is subject to change at the discretion of the Playnasium, following a 30-day written notice to the consignee. If payment due is less than $5.00, no check will be written that month and the amount will be carried over to the next month. 4. Items are consigned for 30 day periods. Should the monthly fee, if applicable, not be paid by the 5th of the month, items will be removed from sale and will become the property of Busy Bodies Playnasium if they are not picked up by the 10th of the month. 5. Neither the Playnasium nor its individual owners or staff will be held responsible for loss, theft, or damage from fire, water, or breakage of the consignment pieces. Items are consigned at the owner’s risk. 6. Other conditions affecting this contract may be imposed at any time by the Playnasium. 7. The Playnasium asks that the artist or craftsman send an itemized list of all pieces, including prices and any biographical information, care instructions or any other selling information they may have. In addition, each consignment item is to be marked with the name of the company or individual craftsman / artist along with an address and / or phone number and/or email address. 8. Direct buyers having problems or expressing dissatisfaction of the commissioned product will be directed to contact the artist. If the customer reports receiving poor customer service they are to contact Busy Bodies Playnasium. Multiple complaints may result in termination of this contract. 9. We do not accept repeats of what is already in the store, copies of other artists’ work, kits, or imports. We request that the product be handcrafted a minimum of 50% by the craftsman / artist. 10. Holiday items must be removed no later than 5 days after the holiday. 11. Consigners may not consign items for another artist / craftsman.
