                 KENTUCKY GENERAL ASSEMBLY AMENDMENT FORM

                                    2008 REGULAR SESSION

                                Amend printed copy of SB 29/HCS

     After the title but before the enacting clause insert the following:

     "WHEREAS, there is a shortage of health care providers in some areas of Kentucky; and

     WHEREAS, people in underserved areas may benefit if prosthetists, orthotists, pedorthists,

and orthotic fitters work with licensed health care practitioners to improve access to medical care

in those areas; and

     WHEREAS, prosthetists, orthotists, pedorthists, and orthotic fitters are valued health care

providers; and

     WHEREAS, recent news reports on the poor health of Kentuckians in general highlight the

role that licensed prosthetists, orthotists, pedorthists, and orthotic fitters may play in providing

increased health care services in the state; and

     WHEREAS, patients have been effectively served by the practice of prosthetics, orthotics,

and pedorthics, which involves evaluating, measuring, designing, fabricating, assembling, fitting,

adjusting, or servicing appropriate devices to correct or alleviate neuromuscular or

musculoskeletal dysfunction, disease, injury, or deformity; and

     WHEREAS, the expertise of qualified prosthetists, orthotists, pedorthists, and orthotic

fitters is crucial to the long-term progress, recovery, and changing needs of their patients; and
     WHEREAS, patients could suffer permanent damage or disability if inadequately trained

and unregulated persons attempt to practice prosthetics, orthotics, and pedorthics; and

      WHEREAS, prosthetists, orthotists, pedorthists, and orthotic fitters are certified by national

organizations and are recognized by a variety of federal, state, and private entities, including the

Veterans Administration and insurance companies throughout the United States; and

      WHEREAS, at least 12 states, including three of Kentucky's border states, license the

practice of prosthetics, orthotics, and pedorthics;

      NOW, THEREFORE,"; and

      On page 1, line 1, to page 21, line 23, delete Sections 1 to 17 in their entirety and insert the

following in lieu thereof:

      "Section 1.     The staff of the Legislative Research Commission shall study the issues

associated with licensed and unlicensed prosthetists, orthotists, pedorthists, and orthotic fitters.

The study shall identify the advantages and disadvantages of licensing prosthetists, orthotists,

pedorthists, and orthotic fitters. The analysis undertaken shall:

      (1)    Compare and contrast the services prosthetists, orthotists, pedorthists, and orthotic

fitters in other states are authorized to provide by statute in those states;

      (2)    Compare the employment patterns of prosthetists, orthotists, pedorthists, and orthotic

fitters in states with, and without, licensing requirements;

      (3)    Analyze qualification and licensing trends regarding the practice of prosthetics,

orthotics, and pedorthics;

      (4)    Identify the major entities that certify or accept the practice of prosthetics, orthotics,

and pedorthics; and

      (5)    Gather information, testimony, and opinions from affected persons and groups in and

out of Kentucky regarding the advantages and disadvantages of licensing prosthetists, orthotists,

pedorthists, and orthotic fitters in the Commonwealth.

      Section 2.    Staff shall complete the study and transmit the final report by December 15,
2008, to the Legislative Research Commission for referral to the appropriate interim joint

committee.

     Section 3. Provisions of this Act to the contrary notwithstanding, the Legislative Research

Commission shall have the authority to alternatively assign the issues identified herein to an

interim joint committee or subcommittee thereof, and to designate a study completion date.".
