LICENSING ACT 2003

APPLICATION FOR THE VARIATION OF A PREMISES LICENCE

Wroxham Masonic Club, The Masonic Hall, Wroxham, Norwich
NR12 8RY.

1     SUMMARY

1.1   This report details an application to Vary a Premises Licence.


2     INTRODUCTION

2.1   The Sub-Committee is requested, in accordance with the delegation of
      licensing functions contained in the Broadland District Council Statement of
      Licensing Policy to consider an application to Vary a Premises Licence in
      respect of The Wroxham Masonic Club, The Masonic Hall, 108 Norwich
      Road, Wroxham, Norfolk NR12 8RY.

2.2   The premises are currently licensed for the sale of alcohol, normal standard
      hours as conferred by a transitional/conversion premises licence issued
      pursuant to grandfather rights.

2.3   The Converted Licence authorises the sale by retail of intoxicating liquor in
      accordance with the following special conditions:-

      1.    a) members of the Wroxham Masonic club and their bona fide guests
            and members of other Norfolk Masonic Lodges.

            b)persons attending private meetings or functions conferences,
            seminars, exhibitions, dinners or other similar events held on the
            premises.

      2. There shall be no occasional licences

      3. There shall be no off sales

      Undertakings:

      Assurances were given that club rules would be amended for the sale of
      alcohol to be restricted to the control of the licensee only.

3     THE APPLICATION

3.1   An application has been received from Mr. J. Lambert secretary on behalf of
      Wroxham Masonic Club, The Masonic Hall, 108 Norwich Road, Wroxham,
      Norfolk NR12 8RY. to Vary the Premises Licence.

3.2   The application to Vary consists of the following proposals contained within
      the Operating Schedule:-

          Licensable Activity –

         A. Performance of Plays (indoors), this would include the regular
          ceremony of Masonic meetings and would include occasional and
          irregular performances such as but would not be limited to, Masonic and
          ordinary plays, murder mystery nights etc.

          Monday to Sunday 00.00 to 00.00

          Non Standard Timings in addition to the above

          The usage of our building is many, varied and diverse and this application
          is to enable the premises to be utilised for such licensable activity at all
          and any times during any day.

         B. Exhibition of Films. (indoors), This would include occasional and
          irregular showing of films such as, but would not be limited to, business
          seminar, and other professional training films and films of an informative,
          Masonic or entertainment nature.

          Monday to Sunday 00.00 to 00.00

          Non-Standard Timings in addition to the above

          The usage of our building is many, varied, and diverse and this application
          is to enable the premises to be utilised for such licensable activity at all
          and any times during any day.

         C. Indoor Sporting Events. This would include occasional and irregular
          indoor sporting events such as, but would not be limited to, short mat
          bowls, table tennis, dart matches, and card competitions.

    The usage of our building is many, varied and diverse and this application
    is to enable the premises to be utilised for such licensable activity at all
    and any times during any day.

   E. Live Music. (Indoors), this would include a variety of performances of
    amplified and unamplified live music, such entertainment would include,
    but would not be limited to, karaoke, solo artist or ensembles, with or
    without any musical accompaniment.

    The usage of our building is many, varied, and diverse and this application
    is to enable the premises to be utilised for such licensable activities at all
    and any time during any day.

   F. Provision of recorded music (indoors), the provision of recorded
    music provided as background music or discotheque or karaoke etc

    The usage of our building is many, varied, and diverse and this application
    is to enable the premises to be utilised for such licensable activity at all
    and any times during any day.

   G. Performances of Dance (indoors and outdoors), performances of
    dance of various types by performers, and the performance of dance by
    patrons, including, for example but not limited to, formal, and disco
    dancing.

    The usage of our building is many, varied, and diverse and this application
    is to enable the premises to be utilised for such licensable activity at all
    and any times during any day.

   H. Anything of a Similar Description to that falling in (E) Live Music
    (F) Provision of recorded music or (G) Performances of Dance. From
    time to time the premises are the venue for performances by artists and

    other general entertainment which might not easily fall within the definition
    of a licensable activity, for example, but not limited to, historical re-
    enactment’s, children’s parties, fancy dress and theme nights.

    The usage of our building is many, varied, and diverse and this application
    is to enable the premises to be utilised for such licensable activity at all
    and any times during any day.

   I. Provision of Facilities for Making Music. This would include but not
    be limited to, the provision of musical instruments, karaoke machine, and
    sound amplification equipment.

    The usage of our building is many, varied, and diverse and this application
    is to enable the premises to be utilised for such licensable activity at all
    and any times during any day.

   J. Provision of facilities for Dancing. (indoors) The premises has
    spacious accommodation which can facilitate dancing in various parts of
    the building, but generally it is confined to the dining/multi function room.

    The usage of our building is many, varied, and diverse and this application
    is to enable the premises to be utilised for such licensable activity at all
    and any times during any day.

   K. Provision of facilities for entertainment of a similar description to
    that falling within I or J (indoors), From time to time the premises is the
    venue for performances by artistes, and other general entertainment,
    which might not easily fall within the definition of a licensable activity, for
    example, but not limited to, fashion/wedding shows, specialty entertainers
    and magicians.

           The usage of our building is many, varied, and diverse and this application
           is to enable the premises to be utilised for such licensable activity at all
           and any times during any day.

          L. Provision of late night refreshment (indoors), Provision of hot food
           and beverages for all patrons and for consumption on the premises, as
           supplied from the kitchen and bar areas.

           Monday to Friday 23.00 to 02.00

           Saturday 23.00 to 03.00

           Sunday 23.00 to 00.00

          M. Supply of Alcohol (for consumption on and off the premises).

           Monday to Sunday 00.00 to 00.00

           Provision of hot food and beverages for all patrons and for consumption
           on the premises, as supplied from the kitchen and bar areas

3.3   It is proposed that the premises will be kept open 00.00 to 00.00. Non
      standard timings in addition to the above: the usage of our building is many,
      varied, and diverse and this application is to enable the premises to be
      utilised for such licensable activity at all and any times during any day.

3.4   The applicant has also identified the following conditions, terms or restrictions
      currently imposed on the converted licence that could be removed as a
      consequence of the proposed variation:

          1. To remove all of the conditions on this conditional licence i.e. Condition
             1 (a), (b), 2 & 3 thus allowing the sale of alcohol by retail, on or off the
             premises, to any category of person.

          2. To remove all of the embedded restrictions applicable to the present
             licence as detailed in the Licensing Act 1964 (as amended)

          3. To remove the present limitations of the permitted hours.

3.5   The Designated Premises Supervisor will be Alfred John Melon.

3.6   The application outlines the additional steps the applicant intends to take to
      promote the four licensing objectives copy attached at Appendix One.

3.7   A plan showing the location of Wroxham Masonic Club, and the surrounding
      area is attached at Appendix Two.


4     RELEVANT REPRESENTATIONS

4.1   All relevant representations have to relate to one or more of the Licensing
      Objectives.

         The Prevention of Crime and Disorder

         The Protection of Children From Harm

         The Prevention of Public Nuisance

         Public Safety

4.2   The responses from the Responsible Authorities are as follows:-

         Police – no representations

         Environmental Health – no representations

         Health and Safety – no representations

         Fire Officer – objects

         Planning Officer – no representations

         Area Child Protection Committee – no representations

      The representations are attached at Appendix Three of this report and are
      relevant to Public Safety and Crime and Disorder


5     INTERESTED PARTIES

5.1   No representations have been received from Interested Parties.

6        POLICY CONSIDERATIONS

6.1      The Sub-Committee must determine this application with a view to promoting
         the Licensing Objectives.

6.2      In making its decision, the Sub-Committee must have regard to guidance
         issued under Section 182 of the Licensing Act 2003 (National Guidance) and
         the Council’s Licensing Policy. The Sub-Committee when considering the
         Licensing Policy will in particular wish to have regard to those sections of the
         Council’s Licensing Policy detailed at Appendix four. The Sub-Committee
         must also have regard to all of the representations made and the evidence
         placed before it.


7        OPTIONS

7.1      The Sub-Committee must take such steps as it considers necessary for the
         promotion of the licensing objectives:

            Grant the application.

            Modify the conditions of the licence, altering or omitting or adding to them.

            Reject the whole or part of the application.
