COMENTS
City Department/Division Comments:
The following Departments/Divisions from the City have reviewed this request and have the
following comments:

     1. Engineering (George Ott): The placements of these pedestals are in the public way, a
        Public Way Permit will be needed for this work.

     2. Property Management (Catherine Holbrook): This request falls under the scope of the
        Qwest Corporation franchise agreement.

     3. Public Utilities (Peggy Garcia): Blue Stakes will need to be contacted to avoid any
        conflict with any utility laterals and that the placement of the cabinets may need to be
        adjusted accordingly.

     4. Transportation (Barry Walsh): The proposed site is located in the park strip with a
        proper setback from the curb and does not conflict with clear sight zones for driveways or
        intersections

Community Council Comments:
Ralph Vigil presented this request to the East Liberty Park Community Council on August 23,
2007, and no significant objections were raised.

ANALYSIS AND FINDINGS
The Hearing Officer has final decision authority with respect to this request unless appealed to
the Planning Commission. The following standards are used to make a decision.

21A.54.080 Standards for Conditional Uses

A. The proposed development is one of the conditional uses specifically listed in this title;

     Analysis: Private/Public utility buildings and structures are listed as a conditional use in the
     21A.24.190 Table of Permitted and Conditional Uses for Residential Districts.

     Finding: Staff finds the proposed development is one of the conditional uses
     specifically listed in this title.

B. The proposed development is in harmony with the general purposes and intent of this
    title and is compatible with and implements the planning goals and objectives of the
    city, including applicable city master plans;

     Analysis: This project compliments the goals set forth in the in the Central Community
     Master Plan by maintaining and enhancing existing public facilities and utilities. The
     cabinets will contribute to the applicant’s ability to provide telecommunication service in the
     immediate area.

     Finding: Staff finds the proposed development is in harmony with the general purposes and
     intent of this title and is compatible with the planning goals and objectives of the city.

C. Streets or other means of access to the proposed development are suitable and adequate
   to carry anticipated traffic and will not materially degrade the service level on the
   adjacent streets;

     Analysis: Utility cabinets generate a minimal amount of traffic.

     Finding: The utility cabinets will not change the existing traffic level.

D. The internal circulation system of the proposed development is properly designed;

     Analysis: An internal circulation system is not required for this development.

     Finding: This standard is not applicable.

E. Existing or proposed utility services are adequate for the proposed development and are
   designed in a manner that will not have an adverse impact on adjacent land uses or
   resources;

     Analysis: The immediate impact will be limited in scope and the proposed cabinets will
     enhance the telecommunication service in the area.

     Finding: Staff finds existing and proposed utility services are adequate for the proposed
     development.

F. Appropriate buffering is provided to protect adjacent land uses from light, noise and
    visual impacts;

     Analysis: The site does not create any light or audible disturbances. Yet the issue of graffiti
     may become a problem, as the cabinets are a convenient target for vandalism. Qwest has
     implemented a graffiti hotline in the past that has worked to a limited extent, and will place
     notifications of the graffiti hotline on these cabinets. Landscape screening is not
     recommended due to safety issues.

     Finding: Staff finds adjacent land uses will not be affected by light or noise, but will be
     impacted visually.

G. Architecture and building materials are consistent with the development and compatible
   with the adjacent neighborhood;

     Analysis: The proposed utility cabinets are metal boxes measuring 4’ to 4’8” tall x 3’ wide,
     as noted on the elevation drawings (Exhibit D.) The cabinets shall be painted a flat medium
     gray.

     Finding: Staff finds that the materials are consistent with the development and is compatible
     with the adjacent neighborhood.

H. Landscaping is appropriate for the scale of the development;

     Analysis: Vegetation should be added to the proposed site to reduce the visual impact
     imposed by this development.

     Finding: Staff finds that additional screening vegetation should be added to the proposed site
     to reduce the visual impact imposed by this development.

I. The proposed development preserves historical, architectural and environmental
    features of the property;

     Analysis: The site is not located in a locally designated historic district; therefore, review by
     the City’s Historic Landmark Commission is not necessary. There are no known
     environmental features requiring preservation.

     Finding: This standard is not applicable.

J. Operating and delivery hours are compatible with adjacent land uses;

     Analysis: The site will not require regular deliveries or service outside of the normal
     parameters of routine maintenance and upkeep.

     Finding: This standard is not applicable.

K. The proposed conditional use or, in the case of a planned development, the permitted
   and conditional uses contained therein, are compatible with the neighborhood
   surrounding the proposed development and will not have a material net cumulative
   adverse impact on the neighborhood or the city as a whole;

     Analysis: The investment in technology has become a basic infrastructure need in many
     homes today. However, the addition of utility cabinets has a visual impact on the streetscape,
     and the location and scale of this project on the park strip makes mitigation difficult.

     Finding: Staff finds the proposed conditional use will have a negligible material net
     cumulative adverse impact on the neighborhood or the City as a whole.

L. The proposed development complies with all other applicable codes and ordinances.

     Analysis: Approval of this application is based on compliance with all applicable City
     building permits and codes prior to installation.

     Finding: Staff finds the proposed conditional use complies with all other applicable codes
     and ordinances.
