Estate Planning Issues During Pregnancy If pregnant women are like the rest of the population, a majority of them do not have estate plans. While estate planning may not be at the top of your list once you learn you are pregnant, you should give some thought to what might happen to you, and your child, and how an estate plan could be helpful. Medical Directives As a pregnant woman, you are no longer making medical decisions which will only impact yourself. Your choices will have now have to take into account your child, as will the choices you make in your medial directives. If you've made an advance directive, or are planning on making one, you'll want to speak to your estate planning attorney first. Many states have specific limitations on pregnancy and medical directives, so you'll have to ensure yours complies with state law. Guardians A guardian is a person who will act as parent over your child should you lose your ability to do so. As a parent, you can select who this person is. As long as the person is a competent adult who accepts the position, you can choose anyone you wish. However, you must formalize your choice in a legally recognized manner, such as by including your nomination in your will. If you fail to write the Will properly, a court might ignore your choice and select someone you wouldn't want. Experienced estate planning attorneys Port St. Lucie FL of the Robert J.
