Brokerage Licence Renewal

Section 5 (b) and (c) of the Rules made pursuant to the Real Estate Act (the Rules) states:

   5. A real estate brokerage licence issued by the Council under these Rules:
      (b) expires on September 30 following its issuance unless it is terminated, suspended
          or cancelled prior to that date; and
      (c) may be renewed by the brokerage by submitting a completed renewal application to
          the executive director in a form prescribed by the executive director, together with
          any fees, premiums or levies established by the Council, by September 30 of the
          current licensing year.

Section 7 (b) and (c) of the Rules made pursuant to the Real Estate Act (the Rules) states:

   7. A mortgage brokerage licence issued by the Council under these Rules:
      (b) expires on September 30 following its issuance unless it is terminated, suspended
          or cancelled prior to that date; and
      (c) may be renewed by the brokerage by submitting a completed renewal application to
          the executive director in a form prescribed by the executive director, together with
          any fees, premiums or levies established by the Council, by September 30 of the
          current licensing year.


Industry Professional (Broker, Associate Broker & Associate) Registration Renewal

Section 25 of the Rules states:

   25. A registration certificate issued by the executive director expires on September 30
       following its issuance unless it is terminated or cancelled prior to that date.


Commencement of Authorization Renewals

Once the status lights in RECA ONLINE change from green to yellow in mid-August, brokers
may commence the renewal process for the brokerage and broker authorizations, and
associate broker and associate authorizations, if applicable.

Confirmation of Successful Authorization Renewal Transactions

Authorization renewal transactions are completed only when a certificate for the 2012-2013
licensing period has been generated through the RECA ONLINE licensing system. Certificates
generated by the broker must be printed or saved electronically to the brokerage’s electronic
record keeping system.
     Printed authorization certificates – must be printed for the brokerage, broker and
       associates/associate brokers, if applicable, and attached to the original related
       application.
     Electronic authorization certificates – must be correlated to the renewal applications.

On October 1, 2012, the broker must verify that authorization renewals have been processed
before the brokerage and registered industry professionals commence trading in real estate or
dealing in mortgages, as the case may be. Authorization status can be verified online at
www.reca.ca through the “Search for an Industry Member” tool.


Confirmation of Payment Transactions

Once the brokerage, broker, and associate/associate broker (if applicable) authorization
renewals have been processed on RECA ONLINE, verify the payment transactions have been
processed with the correct fees applied. Refer to the brokerage statement (located on the
brokerage details screen under the action bar of the “Brokerage Transactions” section). If there
are any discrepancies please contact RECA.


Failure to Renew Authorization

If an industry professional’s authorization renewal is not processed by the September 30, 2012
deadline, the industry professional will no longer be authorized to trade in real estate or deal in
mortgages, as the case may be, and must cease activities immediately. Unauthorized activity is
a breach of the Real Estate Act, and may be considered conduct deserving of sanction by
RECA.

Renewal Process

The authorization renewal process involves the completion of three steps for each the
brokerage, broker and each of the associate/associate brokers registered to the brokerage, if
applicable:

It is important that all steps and instructions contained in this guide are understood and
followed. If clarification is required, please do not hesitate to contact RECA prior to proceeding
with the online renewal process.

STEP 1: Printing Renewal Applications


Prior to commencing with the online processing of brokerage and industry professional
authorization renewals through the RECA ONLINE licensing system, appropriate applications
must first be printed and completed.

The authorization renewal applications for the 2012/2013 licensing period are as follows:

                             Brokerage

                            •Brokerage Licence Renewal Application 2012/2013

                             Broker

                            •Broker Application for Registration 2012/2013

                             Associate/Associate Broker

                            •Associate/Associate Broker Application for
                             Registration 2012/2013


To ensure correct applications are completed, download and print the pre-populated
applications through RECA ONLINE. Depending on your browser’s settings, this download may
be blocked by your pop-up blocker. Please enable pop-ups on your browser.

The following is an outline of the required steps to print the applications for the brokerage,
broker and associates/associate brokers (if applicable).

Step 1: Log in to RECA ONLINE
   □    Go to www.reca.ca and select “Online Licensing”. Enter the broker’s RECA ID and
        password.
   □    Brokers who may have forgotten their login information can retrieve this information by
        clicking on the “Forgot Login Information” link.
   □    For further assistance, click on the “Login FAQ” link on the “Online Licensing” login
        screen.



   Important         RECA Online login information is case sensitive.

Step 2: Print the pre-populated renewal application for the brokerage
       In the ‘Brokerage Transactions’ section of the brokerage details screen, select
        ‘Download Renewal Application’ located below the name of the brokerage. Print a
        paper copy of this application.



Step 3: Print the pre-populated renewal application for the broker
   □    In the ‘Broker Transactions’ section of the brokerage details screen, select ‘Download
        Renewal Application’ located below the name of the broker. Print a paper copy of this
        application.



Step 4: Print the pre-populated renewal applications for associates and/or associate
        brokers, if applicable
   □   Select the link that reads ‘Download All Associate Renewal Applications’ located above
       the “Brokerage Transactions” section on the left hand side of the brokerage details
       screen.
             Alternatively, one renewal application may be downloaded at a time by selecting
               the ‘Download Renewal Application’ link located under the name of each
               industry professional registered with the brokerage.
   □   Select “open” on the pop-up window and print paper copies of the application(s) once
       they appear. Please be patient, this may take a few minutes.
   □   If there are any problems generating and/or downloading the bulk applications, please
       update your version of Adobe Acrobat Reader. This can be obtained as a free
       download from www.adobe.com. If there are any other/additional problems, please
       send an email to brokerinfo@reca.ca.

STEP 2: Completing Renewal Applications


The authorization renewal applications downloaded through RECA ONLINE will print with many
fields already completed. Fields not automatically completed must be manually completed by
the industry professional before the renewal can be processed online.

All applications must be completed in full and must be sworn by affidavit prior to processing
them on RECA ONLINE.

It is important to distribute the printed applications to any associates/associate brokers
registered to the brokerage well in advance of the renewal deadline (September 30th) to ensure
adequate time for completion and swearing of the application.



                      The brokerage must maintain the original paper copy of each signed

Completion of the Brokerage Licence Renewal Application

The Brokerage Licence Renewal Application is to be completed by the broker, according to the
steps outlined below:

   □ If there have been any changes to the pre-populated information contained in Section B.
      Legal Entity Information, or Section C. Brokerage Information, contact RECA for further
      direction.
       If there have been any changes to the pre-populated information, do not process the
        brokerage/broker authorization renewals online unless an email from RECA specifically
        authorizing online processing is received.


Step 2: Broker provides accurate responses to suitability questions
   □ If any of the questions in Section D. Information Respecting Suitability are answered
      positively the Brokerage Licence Renewal Application AND the Broker Application for
      Registration must be forwarded to RECA for processing.
       Applications with positive responses to the suitability questions must never be processed
        online and must be forwarded to RECA no later than September 4, 2012.
       Applications can be forwarded to RECA electronically provided they are sent from the
        broker’s or brokerage’s email or fax number as registered on RECA ONLINE.
       Applications received after September 21, 2012, may not be processed before the renewal
        deadline and may result in a lapse in authorization.

Step 3: Brokerage Acknowledgement is completed by authorized individual, if required
   □ If the broker has less than 50% controlling interest in the ownership of the brokerage,
      Section H. Brokerage Acknowledgement, must be completed by a partner; director or
      officer of the brokerage capable of making the submission. If the broker has greater than
      50% controlling interest, Section H. may be skipped and the broker may proceed to
      Section I. Affidavit.

Step 4: Broker swears affidavit
   □ Once Section H. Brokerage Acknowledgement has been completed, if required, the
      broker must complete the affidavit in Section I.

Broker/Brokerage Authorization Renewal

Once the brokerage and broker authorization renewal applications have been completed and
sworn by affidavit and provided that none of the brokerage information has changed AND there
are no positive responses to the suitability questions, the broker may proceed to process the
brokerage and broker authorization renewals using RECA ONLINE.

Renewing the brokerage/broker authorizations online is a four part process.

Part 4: Print or save the certificates and receipts

Once the brokerage and broker authorization renewals have been processed online, the user’s
computer will prompt to download the authorization certificates. Depending on your browser’s
settings, this download may be blocked by your pop-up blocker. Please enable pop-ups on
your browser.

   Authorization certificates
   □   Print and/or save the authorization certificates once downloaded. Note: if this step is skipped,
       certificates can be printed and/or saved at a later time – refer to the RECA ONLINE User
       Manual for further instruction.
   □   Once the certificates have been printed and/or saved, close the attachment to return to RECA
       ONLINE. The user will return to the “Request Has Been Processed” screen.
   Receipts
   □   Receipts will be generated for the brokerage’s records at this time. Click on the “Print Receipt”
       link to print and/or save the receipts.
   □   **Note: If a receipt is not printed or saved at this time, the user will not be able to generate it
       later, however, the “Brokerage Statement” will show the transaction (refer to the RECA
       ONLINE User Manual for further instruction).
   □    Once the receipts have been printed and/or saved return to the main brokerage details screen
        by selecting the “Return” link.

The brokerage and broker status lights in RECA ONLINE will have changed to green if the
authorization renewals have been processed correctly.

Ensure the signed and completed original paper copies of the Brokerage Licence Renewal
Application and Broker Application for Registration are kept on file at the brokerage.

Associate/associate broker authorization renewals may now be processed online, if applicable.

Associate/Associate Broker Authorization Renewal

Once the brokerage and broker authorization renewals have been processed online, and the
associate/associate broker application(s) have been completed and sworn by affidavit AND
provided there are no positive responses to the suitability questions, the broker may proceed to
process associate/associate broker authorization renewals using RECA ONLINE.

Renewing associate/associate broker authorization online is a three part process.

bar and select ‘Go’.

Part 3: Print the certificates and receipts
Once the associate/associate broker authorization renewal has been processed online, the

Authorization Renewal Fees

Licensing and registration fees, including authorization renewal fees, are determined by
Council on an annual basis and were not increased for the 2012-2013 licensing period. The
REIX premium for individual real estate professionals however was increased by $100.

Renewal fees for the 2012-2013 licensing period are as follows:



                     Brokerage

                     • Real Estate Brokerage: $400
                     • Mortgage Brokerage: $300

                     Broker

                     • Real Estate Broker: $725
                     • Mortgage Broker: $450

                     Associate/Associate Broker

                     • Real Estate Associate/Associate Broker: $725
                     • Mortgage Associate: $450




A full list of licensing fees for the 2012-2013 licensing period are contained in the Fee Schedule
& Payment Form which is available on RECA’s website at www.reca.ca under “Forms”,
“Licensing and Registration Forms”.


Payment of Renewal Fees

   Payment Online:

      RECA ONLINE includes a calculator that allows the user to enter the type and number
      of transactions they wish to process. The calculator will tell the user the amount required
      to complete these transactions. The user will have the option to pay the fee(s) online
      using the broker’s or an associate’s credit card.

   Payment by Cheque:

      If the brokerage would like to make an advance payment the brokerage must submit
      payment by cheque or cash to RECA. Please allow for 3-5 business days for processing
      once the cheque has been received by RECA.

   Confirmation of Payment:

      Confirmation that fees have been posted to the brokerage’s RECA ONLINE account can
      be obtained by clicking on the Brokerage Statement option in the drop down menu of the
      Action Bar under the brokerage section of the brokerage details screen.


                      The fee payment detail section has been removed from all licence and
                      registration application forms and has been replaced with a check box
                      for the broker to indicate to RECA staff that payment has been posted
                      to the brokerage’s RECA Online account in the event the application is

                      online processing. Now that this section has been removed, brokers
                      may wish to create and implement an in-house credit card
                      authorization form for this purpose. Alternatively, associates/associate
                      brokers can note their credit card information at the bottom of the form.



Refund of Renewal Fees

If the registration of an associates or associate broker is renewed and subsequently terminated
from the brokerage prior to October 1, 2012, the renewal fee will refunded to the brokerage. A
written request for the credit must be submitted to RECA by the broker indicating the name of
the particular associate or associate broker.


                       With the exception of the above, all other licensing and
                       registration fees are Non-Refundable
   Important
   Notice              All licensing and registration transactions completed in RECA ONLINE
                       are instant and final and cannot be post-dated or back-dated. RECA will
                       not issue refunds to brokerages that have processed new associate
                       licence and registration applications online prematurely.

Associate/Associate Broker Transfers


An associate/ associate broker wishing to cancel their registration with their current brokerage
and register with a new brokerage on October 1, 2012 must complete an Associate/Associate
Broker Registration Cancellation form and an Associate/Associate Broker Application for
Registration both to be processed by their new brokerage on October 1, 2012.

    If the cancellation and registration are both processed on October 1st only the renewal
     fee will apply. The $52.50 reinstatement fee will not apply for this one day only.


An associate/associate broker wishing to cancel their registration with their current brokerage
and register with a new brokerage prior to October 1, 2012 must complete an
Associate/Associate Broker Registration Cancellation form and an Associate/Associate Broker
Application for Registration, both to be processed by the brokerage to complete the transfer.
Additionally, the associate or associate broker would be required to complete an additional
Associate/Associate Broker Application for Registration to complete the renewal.

    In this case, a reinstatement fee of $52.50 will be required in addition to the renewal fee


An associate/associate broker who has already been renewed with their current brokerage
that wishes to cancel their registration with their current brokerage and register with a
new brokerage prior to October 1, 2012 must complete an Associate/Associate Broker
Registration Cancellation form and an Associate/Associate Broker Application for Registration,
both to be processed by the brokerage using RECA ONLINE. Additionally, the new brokerage
will then be required to renew the associate/associate broker with their brokerage prior to
October 1, 2012 including the renewal fee.

    In this circumstance, a reinstatement fee of $52.50 will be required from the new
     brokerage to reinstate the associate/associate broker’s registration for the current
     licensing period. The renewal processed by the associate/associate broker’s former
     brokerage will be expunged and the renewal fee will be credited to their former
     brokerage.

Re-licensing Education Requirements

    All real estate professionals must complete the Real Estate Update 2011-2012 course
     in order to renew their registration by the September 30, 2012 deadline.

    All mortgage brokerage professionals must complete the Mortgage Broker Update
     2011-2012 course in order to renew their registration by the September 30, 2012
     deadline.

be accessed through the “RECA Education” button.

Frequently Asked Questions

1.      What should I do if an industry professional has answered “yes” to one of the
        suitability questions on the renewal application?

     A. DO NOT PROCEED                  WITH      ONLINE       RENEWAL          FOR      THIS     INDUSTRY

     B. Forward the application to RECA for processing along with the following additional
        documentation:

        a.     a letter of explanation from the industry professional detailing the circumstances
               of what he or she is declaring, to be sworn by affidavit, AND
               i.      in the case of refused registration, denied authorization, industry
                       withdrawal or lifetime ban, registration/licence/authorization suspension or
                       revocation, a copy of any correspondence sent to the industry professional
                       from the regulatory body or organization regarding the event
               ii.     in the case of discipline, a copy of the decision/discipline that was issued
                       by the regulatory body or organization
               iii.    in the case of a judgment, a copy of the judgment
               iv.     in the case of bankruptcy, a copy of the complete “Summary
                       Administration”. This is issued by the trustee in bankruptcy
               v.      in the case of criminal conviction, a copy of the conviction/ sentencing
                       report
               vi.     in the case of criminal proceedings, a copy of the criminal charges and
                       police report.
        NOTE: The above outline is to be used as a guide only. RECA may request further information and/or
        documentation from the industry professional regarding any of the above situations at any time. The
        requirement to provide supporting documentation is waived if it has been previously provided to RECA. An
        industry professional who has answered “yes” on a previous application is not required to restate this
        response. Questions are to be answered in terms of occurrences since the date of the industry
        professional’s last application or Notification Pursuant to S. 40(1) of the Real Estate Act Rules.

2.      Why does an industry professional’s licensing status indicate a red status light
        instead of a yellow status light in RECA ONLINE?

     This industry professional has a special circumstance. Please have the industry
     professional contact RECA directly for further information.
         The industry professional will then be advised as to the special circumstance and the
           steps that need to be taken, if any, to allow the application to be processed.
         If the special circumstance can be removed, the application will be processed by the
           broker online. If the special circumstance cannot be removed the application must be
           sent to RECA for processing.
         If the application is processed by RECA the authorization certificate will be forwarded
           to the industry professional and the broker by email.

3.      I wasn’t able to print authorization certificates.

     A. Authorization certificates can be printed at any time using RECA ONLINE.

     B. Refer to the RECA ONLINE User Manual available for download on the main brokerage
        details screen for further instructions.

4.      I forgot to print payment receipts. Am I able to get them from RECA?

     A. RECA does not provide copies of receipts. RECA ONLINE currently affords users only
        one opportunity to print a transaction-specific receipt upon completion of the licensing
        transaction.

     B. If the receipt is not printed at the time of the licensing transaction, refer to the brokerage
        statement in RECA ONLINE. Refer to the RECA ONLINE User manual available for
        download on the main brokerage details screen for further instructions.

Common Errors

The following are some common errors to watch for. Brokers must reject applications
containing any of the errors listed below.

   GENERAL ERRORS
   Incorrect Application                    The application used is not for the 2012/2013 licensing period.
                                            Ensure applications are current by downloading them from
                                             www.reca.ca as needed. Do not keep old blank applications on
                                             file.
                                            Ensure the industry professional has completed the correct
                                             application for licence and registration or application for
                                             registration according to their current licence status.
   INDIVIDUAL INFORMATION ERRORS
   Legal Name                               Incomplete and/or illegible name information.
                                            Applications without a complete legal first name, legal middle
                                             name and last name cannot be processed.
                                            New industry professionals must provide identification to their
                                             broker along with their application. Acceptable identification
                                             includes a legible birth certificate or certificate of Canadian
                                             citizenship.
                                            The broker must verify all information contained in the
                                             application prior to processing. Once this has been done, return
                                             the identification to the industry professional.
   Residential Address                      Incomplete and/or illegible address.
                                            A postal office box number is not acceptable for an industry
                                             professional’s residential address. A PO box can be used as a
                                             mailing address, however.
                                            Ensure that the address is complete and legible.
   Birth Date                               Birth date left blank or incomplete.
                                            This information must be complete for RECA’s records. RECA’s
                                             privacy policy can be found at www.reca.ca if the industry
                                             professional has concerns.
   Email Address                            Email address left blank or incomplete.
                                            All industry professionals are required to provide an e-mail
                                             address to RECA.
                                            If an industry professional does not have an email address, they
                                             may use the brokerage email address providing the brokerage
                                             is willing to undertake distributing information sent by RECA to
                                             the industry professional.
   SUITABILITY ERRORS
   Blank answers                            Industry professionals must clearly check either “yes” or “no” on
                                             each of the suitability questions asked before the application is
                                             sworn by a Commissioner of Oaths.
   “Yes” answers                            If the industry professional has answered “yes” to any of the
