Citibank Online Credit Card and Citibank Ready CreditTM Campaign Terms and Conditions ("these Terms and Conditions") The Campaign 1. This Citibank Berhad (Co. No. 297089-M) ("Citibank") “Citibank Online Credit Card and Citibank Ready CreditTM Campaign” ("Campaign") will run from 2 July 2012 to 12th August 2012 (both dates inclusive) ("Campaign Period"). All applications must be made within the Campaign Period. Eligibility 2. Subject to these terms and conditions, the Campaign is open to any of the following persons applying for principal Citibank Credit Cards during the Campaign Period via “Citibank Online” or via “SMS”: (a) New-to-bank applicants applying for at least Two (2) principal Citibank credit cards via Citibank Online or short messaging service (“SMS”); or (b) Existing Citibank Cardholders applying for at least ONE (1) new principal Citibank credit card AND ONE (1) Citibank Ready CreditTM facility via Citibank Online or SMS; and (c) All applicants must apply for Citibank’s E-Statement service. 3. For all applicants, “Citibank Online” or via “SMS” is more particularly described as follows: a) Applications made via Citibank Online at www.citibank.com.my (“Website”) i) by filling out and/or completing an electronic online Citibank credit card application form and submitting it via Citibank Online on the Website; and ii) subsequently completing and submitting a physical credit card application form (together with all supporting documents) to Citibank by mail or facsimile before the deadline set out in Clause 7 below; or b) Applications made via SMS i) By sending a short messaging service text (“SMS”) to Citibank’s 36700 SMS channel to express interest in applying for a Citibank Credit Card or Citibank Ready CreditTM facility ; and ii) Subsequently completing and submitting a physical application form (together with all supporting documents) to Citibank by mail or facsimile before the deadline set out in Clause 7 below. For the avoidance of doubt, tel-co charges may apply for sending the SMS. For purposes of this terms and conditions, all applicants will be referred to as “Customer”. 4. The following persons are not eligible to participate in the Campaign: (a) Permanent and/or contract employees of Citibank (including its subsidiaries and related companies) and their immediate family members; (b) Representatives and/or agents (including advertising and promotion agents) of Citibank, VISA and MasterCard and their immediate family members; (c) Any Customer who is in default of repayment of sums due under the Customer’s Citibank Credit Card Account, Citibank Ready CreditTM CRC Account and/or any other facilities with Citibank, which includes being overdue in payment and exceeding the Customer’s credit limit at any time during the Campaign Period; (d) A Customer who has cancelled his/her Citibank credit card(s) or Citibank Ready CreditTM facility within the last two (2) years prior to the commencement date of the Campaign Period, i.e. 2 July 2012 and is re- applying for the same facilities under the Campaign; (e) All supplementary Citibank Credit Card applicants; and/or (f) Any person who has committed or is suspected of committing any fraudulent or wrongful acts in relation to the Card, Citibank Ready CreditTM facility and/or any other Citibank services or facilities. Approval of Applications 5. For the avoidance of doubt in relation to Citibank Credit Card applications, "successfully approved" means that the Customer's credit card application has been approved by Citibank and a Citibank credit card is being or has been issued to the said Customer. For Citibank Ready CreditTM applications, “successfully approved” means that the Customer’s application has been approved and a Letter of Approval is being or has been issued to the said Customer. Conditional approvals of Citibank credit card and/or Citibank Ready CreditTM applications which may informed to or has been received by a Customer from Citibank are not deemed to be successfully approved. 6. Citibank reserves the right as it deems fit to approve or reject any credit card applications, Citibank Ready CreditTM application and/or the supporting documents as requested by Citibank. For the avoidance of doubt, Citibank reserves the right as it deems fit to determine if the supporting documents are sufficiently clear for purposes of the approvals. The Reward 7. The physical credit card application forms together with all supporting documents must be dispatch to Citibank at E Business at Level 14, Menara Citibank 165, Jalan Ampang, 50450 Kuala Lumpur or by facsimile at 03- 2383 9090 or by courier and must be physically received by Citibank not later than 6th August 2012. For the avoidance of doubt: a) If your application or supporting documents are dispatched by facsimile, proof of transmission does not mean proof of receipt by Citibank; and b) If your application or supporting documents are dispatched by courier, Citibank will not be responsible for any mishandling or misdirection of any courier. The Applicants (“Successful Applicants”) are those who (a) Have their Citibank Credit Card applications successfully approved on or before 31 August 2012. (b) Use each of their Citibank Credit Cards for a minimum of 3 (three) times within 60 days from the card approval date. 9. All Successful Applicants will receive Ringgit Malaysia 50 Cash Back which will be credited into the new account on the second statement of the account. 10. In addition, the first 1000 Successful Applicants will also receive 1 (one) of the following as a reward: Reward No. of Rewards 24 inch Santa Barbara Polo & Racquet Club trolley bag 1000 11. Over and above the clauses above, applicants whose Citibank Credit Card or Citibank Ready CreditTM (whichever applicable) applications are successfully approved will enjoy a one (1) year annual fee waiver, provided the approved Citibank Credit Card or Citibank Ready CreditTM is used for a minimum of three (3) times within sixty (60) days from approval date. 12. The following terms and conditions apply to the Reward: (a) The Reward will be delivered to the Customer’s mailing address as stated in the application form within four (4) to six (6) weeks from the fulfillment of all the terms and conditions listed. (c) In the case of any dispute or non-receipt of the Reward the Customer should contact Citiphone latest by 31 September 2012 to commence an inquiry. (d) In the event the Reward is delivered to the wrong postal as stated by the Customer on the credit card application form, delivery of the Reward may be delayed for a period of 2 weeks and the Customer will have to bear a delivery charge of RM30 to have the Reward delivered to the Customer’s correct address; (e) If Citibank’s suppliers delay or is unable to supply the same exact make and model of the Reward to Citibank, Citibank reserves the right as it deems fit to substitute the Reward with another product of similar retail value; (f) The Reward is awarded on an "As Is" basis; (g) The Reward is exclusive of any accessories or items shown in advertisements and promotional materials which are for photography purposes only; (h) The Reward is not exchangeable for cash, credit or kind, in part or in full; (i) The Reward will be given to the principal cardholder (and not the supplementary cardholder); (j) The Customer takes title in the Reward and any risk of loss or damage to the Reward passes to the Customers upon physical delivery of the Reward to the Customers. Citibank is not responsible, liable for or obliged to recognise or replace any defective, lost, damaged or stolen Reward where such defect, loss, damage or defect in respect of the Reward is due to the fault and/or negligence of the Customers. Furthermore Citibank will not be responsibility or liable for any inherent defect(s) in the Reward. In the event of late delivery of the Reward or queries in relation to the Reward, Customers may contact CitiPhone; and (k) For the avoidance of doubt, the Reward is supplied by Echotex Marketing Sdn Bhd or their authorized dealers. Citibank is not responsible for any defect or any other loss or damage that may be suffered in connection with such Reward. Any dispute in relation to the warranty or quality of such Reward or any terms and conditions in relation must be settled directly between the relevant winning Customer and any authorized dealer in Malaysia. Citibank will bear no responsibility for resolving any dispute and the winning Customer must liaise directly with Echotex Marketing Sdn Bhd or their authorised dealers in Malaysia, and not Citibank in this regard. 13. Each Customer is only entitled to receive the one (1) Reward. 14. Citibank reserves the right as it deems fit to disqualify such person from receiving any Reward of such person is not a Customer or who, for any reason whatsoever, ceases to fulfill the eligibility criteria specified in Clause 4 above. 15. In the event that a Reward is awarded to a person who is not eligible to participate in the Campaign in accordance with Clause 4 above and/or has committed or is suspected of committing any fraudulent or wrongful acts in relation to their use of any Citibank services or facilities (including Citibank Online), Citibank reserves the right to disqualify such person from participating in the Campaign and/or receiving the Reward. Disclaimers 16. To the fullest extent permitted by law, by participating in this Campaign, each and every participant is agreeing that he/she will not hold Citibank and its officers, servants, employees, representatives and/or agents (including without limitation, any third party service providers that Citibank may engage for the purposes of this Campaign), liable for any loss or damages that he/she may incur, in connection with the Campaign. 17. To the fullest extent permitted by law, Citibank gives no representation or warranty with respect to the Reward provided under the Campaign. In particular, Citibank gives no warranty with respect to the quality or merchantability of the Reward or their suitability or fitness for any purpose. Miscellaneous 18. Citibank’s decision on all matters relating to the Campaign will be final and binding. 19. Citibank reserves the right not to disclose its reasons for not approving any credit card or Citibank Ready CreditTM application. 20. Citibank reserves the right as it deems fit to vary or change any of these terms and conditions with notice. These terms and conditions may be varied or changed by Citibank by way of posting on Citibank Facebook Webpage or in any other manner deemed suitable by Citibank. Participants who had participated in the Campaign are deemed to have accessed Citibank Facebook Webpage and/or Citibank’s website at www.citibank.com.my (“Website”) and to have knowledge of and to have agreed to any changes or variations to these terms and conditions. Participants agree that their continued participation in the Campaign will constitute their acceptance of these terms and conditions (as varied or changed). 21. Citibank will not be liable for any default due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm, epidemic, pandemic, technical or system failure or any event beyond the reasonable control of Citibank. 22. Citibank reserves the right to cancel, revise, terminate or suspend the Campaign with notice. For the avoidance of doubt, any cancellation, revision, termination or suspension by Citibank of the Campaign shall not entitle any Participant and/or Customer to any claim or compensation against Citibank for any and all loss or damage suffered or incurred by any Eligible Person, Participant and/or Winner as a direct or indirect result of the act of cancellation, revision, termination or suspension. 23. By participating in this Campaign, the Participants or Customers agrees to be bound by these Terms and Conditions and, to the fullest extent permitted by law, consent to and authorise Citibank to disclose their particulars to the third party service providers engaged by Citibank for the purposes of the Campaign (if any). Citibank warrants that the disclosure of such particulars to any third party service providers will be limited to the Customer's name, address and telephone number and will be used only in relation to and for the purposes of the Campaign. 24. These Terms and Conditions are governed by and construed under the laws of Malaysia.
