Now in their tenth year, the 2012 Premier's Sustainability Awards
recognise and reward Victorian businesses, institutions, communities
and individuals that are leading the way to a sustainable Victoria.

Premier’s Recognition Award
The Premier’s Recognition Award is chosen by the Honourable Ted
Baillieu MP, Premier of Victoria.

The Award is made to one of the winners of the nine award
categories which, in the Premier’s opinion, showcases exemplary
leadership and innovation in sustainability, and has shown particular
determination in overcoming difficult obstacles.

Large Business Award
Outstanding achievements by a large business in adopting and
implementing sustainability principles.

Eligible Entries

   Businesses employing 200                 The majority of demonstrable results must have

Premiers Sustainability Awards (“Awards”)
Terms and Conditions of Entry
1. The information and instructions in this Entry Kit form part of these terms and Conditions. By submitting an
   Entry, Entrants agree to be bound by these Terms and Conditions.

2. Entries become the property of Sustainability Victoria and will not be returned.

3. Entries must be submitted in accordance with the Entry Kit, including format, content, lodgement method
   and closing time. Illegible, incomplete, late or non compliant Entries are invalid and will not be accepted.

4. Entrants warrant that that the information in the Entry and attachments is to the best of their knowledge true
   and correct, and does not contain any defamatory or offensive content or infringe third party intellectual
   property rights and that they will notify Sustainability Victoria of any changes to the information and any
   circumstances that may affect the Entry. Sustainability Victoria reserves the right to verify the validity of
   Entries and may disqualify an Entrant or an Entry if it discovers or determines that an Entry does not comply
   with these Terms and Conditions, an Entrant has provided dishonest or incorrect information in its Entry or
   that an Entry contains defamatory or offensive content or infringes third party intellectual property rights.

5. Sustainability Victoria employees and their immediate families and Sustainability Victoria’s contractors
   associated with the Awards are not eligible to submit Entries.

6. Entrants must carry on business in Victoria and demonstrate that the activities and results associated with
   the entry subject are within Victoria. Entrants must comply with the eligibility criteria in the Entry Kit.

7. Entrants may only submit one Entry per category.

8. Eligibility of Entries and the awarding of the Awards are solely within Sustainability Victoria’s discretion. In
   the case of disputes, the judges’ decision is final and no correspondence will be entered into. Sustainability
   Victoria reserves the right to change the category of an Award, omit the awarding of winners for a category
   or award joint winners. Sustainability Victoria’s failure to enforce any of its rights at any stage does not
   constitute a waiver of those rights.

9. Sustainability Victoria, its partners, sponsors, judges, staff and contactors shall not be held liable for any
   reason whatsoever resulting from its adjudication in good faith of Entries made in any of the Awards.

10. If the Awards are interfered with in any way, are not capable of being conducted as reasonably anticipated
    due to any reason beyond Sustainability Victoria’s reasonable control or where Sustainability Victoria is
    required or directed to so by the Victorian Government, Sustainability Victoria reserves the right, in its sole
    discretion, to the fullest extent permitted by law to modify, suspend, terminate or cancel the Awards, as
    appropriate. Where Sustainability Victoria reasonably believes any changes will have a negative impact,
    Sustainability Victoria will use reasonable endeavours to provide Entrants with up to two weeks prior written
    notice.

11. Entrants agree that if they are a finalist, they will have a representative attend the Awards event to receive
    the award in the event that they win.

12. Sustainability Victoria may require the finalists and winners of the Awards to participate in marketing and
    promotional activities, including but not limited to media exposure and promotion of future Awards without
    any further payment or other compensation. If requested, finalists and winners will provide all reasonable
    assistance and cooperation to Sustainability Victoria in the preparation of case studies and other material or
    promotion of the Awards or Sustainability Victoria’s use generally.

13. Winners and finalists may promote themselves as winners or finalists of the Awards (as applicable) by use
    of the Awards logo in accordance with Sustainability Victoria’s directions and guidelines.

14. Entrants acknowledge that Sustainability Victoria is subject to the Freedom of Information Act 1982. If a
    Freedom of Information request is made, Sustainability Victoria will consult with the Entrant before any
    decision is made to release the Entry or supporting documentation.

15. Entrants agree that Sustainability Victoria may contact them during and after the Awards to seek
    information or comments about the Awards. Entrants acknowledge that Sustainability Victoria may refer
    Entries to external experts or other Government Departments for assessment, reporting or advice. Entrants
    acknowledge that Sustainability Victoria collects, uses and discloses their personal information as specified
    in the Awards website and the Entry Kit, in order to process Entries and in accordance with its Privacy
    Statement. Sustainability Victoria’s Privacy Statement is available from
    www.sustainabilityawards.vic.gov.au.

16. Sustainability Victoria owns all intellectual property rights in the Entry documents (including the Entry form
    and any attachments) and may use, modify, adapt and reproduce the Entry documents in the future,
    including in publications and promotional material relating to Sustainability Victoria and the Awards (except
    confidential information). Entrants warrant that (except where identified as confidential) Entries do not
    contain any confidential information and that they hold or have obtained all necessary rights, consents and
    permissions to all intellectual property in the Entry documents and assign the intellectual property in the
    Entry documents to Sustainability Victoria. Entrants must clearly identify any confidential information in their
    Entries. For the avoidance of doubt, except to the extent necessary to exercise its rights granted by this
    clause over the Entry documents, Sustainability Victoria has no rights over any ideas, information or
    intellectual property owned by the Entrants and contained in the Entry documents.

17. Entrants are required to declare all actual or potential conflicts of interest in their Entry and advise
    Sustainability Victoria immediately if they become aware of any conflict of interest that arises subsequently.

18. Sustainability Victoria accepts no responsibility for late, lost or misdirected Entries or for any technical
    difficulties or periods of unavailability of the Awards website.

19. Sustainability Victoria shall not be liable for any loss or damage whatsoever (including but not limited to
    direct or consequential loss) or for any personal injury suffered or sustained, whether in contract, tort
    (including negligence), breach of statutory duty, or otherwise, in connection with the conduct of the Awards
    except for any liability which cannot be excluded by law.

20. Entrants must advise Sustainability Victoria of any penalties or notices they have received from the
    Environment Protection Authority or WorkSafe or any breaches of the Environment Protection Act 1970,
    Occupational Health and Safety Act 2004, Accident Compensation Act 1985 or of any other environmental,
    OH&S, safety or other legislation or regulations (“Safety Laws”) in the last 10 years or any current
    investigations, notices, prosecutions or enforcement action against them arising out of a possible breach of
    any Safety Laws. This obligation continues for a year after the Award event. Entrants acknowledge that
    Sustainability Victoria may, if the Entry is short listed as a finalist for an Award, undertake confidential
    checks with EPA, WorkSafe or other regulators about their environmental, OH&S, safety or other regulatory
    performance.

21. Entrants must not do anything that may damage, bring into disrepute or ridicule Sustainability Victoria’s
    name, messages or reputation, or attract public or media attention which may be prejudicial or otherwise
    detrimental to Sustainability Victoria's name, messages or reputation. In particular, Entrants must ensure
    compliance with all equal employment, occupational health and safety and environmental laws.

22. Entrants agree to an independent third party financial viability check if required by Sustainability Victoria.

23. While all care has been taken in preparing the Entry Kit, Sustainability Victoria does not warrant the
    accuracy of the Entry Kit and accepts no liability for any deficiency within the Entry Kit.

Entries open on Monday 21 May 2012 and close at 2 pm Friday 13
July 2012.
     No late submissions will be accepted.
     All entries must be submitted via email. Please note the email size limit.
     Only one entry is to be submitted per category. Select the category that best suits your entry
       by reading the Award requirements.
     You may enter more than one category.
     Entries remain the property of Sustainability Victoria and will not be returned.
     Entries are considered confidential; all judges sign confidentiality agreements.

ENTRY RECEIPT AND THE SUBSEQUENT JUDGING PROCESS

   Upon receipt of an email entry, you will be sent a return email providing a registration
    number. This number will be used in all future submission-related correspondence.
   Judging of each Award will take place in July and August by panels of independent judges.
   Finalists will be announced on Friday 31 August 2012.
 Winners will be announced at the Awards ceremony in October 2012.
