Travis Benjamin is a special counsel in Baker & McKenzie’s global tax practice. He has more than a
decade of experience in advising on international tax planning and tax controversy matters. Mr. Benjamin
also advises clients anti-money laundering legal and regulatory matters. Mr. Benjamin is a frequent
speaker on tax and AML issues in Asia. He has written extensively on topics related to his field for
several publications, including Asia Pacific Tax Bulletin, China Tax Intelligence, International Tax
Review, Tax Notes International and Tax Planning International. Mr. Benjamin also co-authored key
chapters in International Guide to Money Laundering Law and Practice and Anti-money Laundering
International Law and Practice.

Steven Sieker is a partner in Baker & McKenzie’s global tax practice. Mr. Sieker focuses his practice on
Hong Kong, Canadian and Asian regional tax advisory work, tax and estate planning - especially for
high-net worth individuals - and tax litigation. Mr. Sieker frequently represents clients in tax disputes
with the Inland Revenue Department in Hong Kong. He is recognized as a leading individual in tax as
well as private client and wealth management by Chambers Asia Pacific, Citywealth Leaders List and
Guide to the World’s leading Tax Advisers.

Hong Kong's Anti-Money Laundering and Counter-Terrorist Financing (Financial Institutions)
Ordinance came into force on 1 April 2012. Among other things, the new Ordinance subjects insurance
companies, banks and other institutions authorised/licensed by the Hong Kong Monetary Authority,
Securities and Futures Commission and Office of the Commissioner of Insurance to a uniform set of
requirements for customer due diligence and record-keeping. The Ordinance also sets up new criminal
and supervisory sanctions (including imprisonment and fines) for non-compliance.

The Ordinance represents a significant change in Hong Kong's approach to anti-money laundering issues
and marks the authorities determination to force compliance with international standards.

In this session, the speakers will:
      Provider a refresher on Hong Kong's anti-money laundering regime;
      Explain what's different from the customer due diligence regimes the Ordinance replaces;
      Outline how the Ordinance works, including the application of criminal and supervisory
         sanctions; and
      Clarify the gaps in the Ordinance and suggest an approach to address the same.
