ORDER
               The original RTI request for information is dated 20.01.1012. The
information demanded pertains seeking copy of post mortem report of Ms. Paramjit Kaur
wife of Sh. Avtar Singh. The complaint with the Commission is dated 27.02.2012.
               Sh. Lakhbir Singh, A. S. I., who appeared on behalf of the Respondent,
submits that information sought for by the complainant – Sh. Major Singh, Could not be
supplied to him due to the fact that challan in connection with that particular FIR has
been presented in the court-concerned on 22.02.2012.
               After examining the documents placed on record, it emerges that
complainant – Sh. Major Singh has moved his application under RTI on 20.01.2012 and
challan has been presented in the court-concerned on 22.02.2012, hence the respondent-
PIO was having enough time to reply the same.
               The complainant – Sh. Major Singh is not present in today’s hearing due to
ill-health.
               Sh. Yograj, Inspector-S.H.O., Police Station – Kharar, is directed to submit
his explanation in the form of affidavit that why the requisite information has not been
supplied to the complainant. He is also directed to appear in person on the next date of
hearing alongwith the information supplied to the complainant.

ORDER

               The original RTI request for information is dated 13.01.2012. The
information demanded pertains to ten points regarding mutation of his land in Ferozepur.
The complaint with the Commission is dated 07.03.2012.
               The complainant – Sh. Mankuljit Singh, alleges that respondent-PIO
concerned has been willfully denying him the requisite information in connection the
application moved by him under RTI on 13.01.2012 so far.
               He also states that he has sought information on ten points through his RTI
application and the respondent-PIO concerned has supplied him incomplete information
in connection with item no. 4 and 5 of his RTI application.
               He points out that the application moved by him under the RTI Act was
transferred to the Financial Commissioner, Animal Husbandry, Fisheries and Dairy
Development by General Administration Department of the Government of Punjab on
24.01.2012.    He further points out that    the department of Revenue transferred        his
application     to i) Divisional Commissioner, Ferozepur, ii) Deputy Commissioner,
Ferozepur ; iii) Director, Land Record, Jalandhar iv) Naib Tehsildar, Talwandi Bhai, on
14.02.2012.

              After examining the documents placed on record it is found that a letter
was written by the Additional Deputy Commissioner, Ferozepur to District Sainik Welfare
Officer, Ferozepur, Naib Tehsildar and Sadar Kanungo on 30.05.2012 with the directions
that requisite information must be supplied to the complainant within the stipulated time
and to appear before the Commission on that date of hearing which has been fixed in
this case.
              The District Sainik Welfare officer-cum-PIO, Ferozepur through a letter
which was received in the Commission through Diary No. 9720 dated 15.06.2012
informed that no information which has been sought for by Sh. Mankuljit Singh is
available in that office. He also mentioned that the information seeker has been informed
in this regard.
              The Additional Deputy commissioner (General)-cum-PIO write a letter dated
06.06.2012 to the complainant – Sh. Mankuljit Singh, a copy of which was received in the
Commission vide Diary No. 9724          dated 15.06.2012 to inform that the requisite
information has been sent to the complainant alongwith that letter.
              Ms. Paramjit Kaur, Sr. Asstt. submits in writing that relevant record in
connection of which the information has been sought for by the complainant is not
available in the office of Land Records, Punjab and hence no information could be
supplied to the complainant.
              Sh. Gurmel Singh, Additional Deputy Commissioner-cum-PIO is directed to
give point-wise reply to the RTI applicant in the shape of        an affidavit alongwith
supporting documents and send a copy of the covering note to the Commission. Any
laxity shown on his part, would attract action against him, under the provisions of the
RTI Act.

               The complainant - Sh Sukhdev Singh alleges that information in connection
with application dated 13.09.2010 moved by him under RTI Act was supplied to him by
the respondent PIO concerned yesterday only. He submits that he has yet to examine
the information supplied to him so that he can point out deficiencies, if any, in the
information. He states that      Sh. Roop Singh was the BDPO when he moved his
application.
               Ms. Manjit Kaur, Supdt., who appeared on behalf of the Respondent
submits that relevant record, in connection of which the information has been sought for
by the complainant, is in the custody of Sh. Gurjit Singh , Clerk, and he has not handed
over the same in the office of B. D. P. O., Fatehgarh Sahib . She Submits that now Sh.
Narpinder Singh Grewal is B.D.P.O, Amloh.
               Sh. Narpinder Singh Grewal who is B.D.P.O., Amloh is directed to give a
point wise reply to the queries raised by the complainant in his application in the form of
an affidavit and explain in writing that why information could not be supplied to the
complainant within stipulated period.

the complainant under RTI, now working as B. D. P. O., Roopnagar, is also directed to
explain why   information could not be supplied to the complainant within stipulated

              The complainant – Sh. Sukhdev Singh pleads that he is suffering
from heart problem and be exempted from personal appearance on the next date of
hearing.

              The original RTI request for information is dated    06.02.2012.   The
information demanded pertains to seeking copy of complaint filed by Sh. Vipan Kansal,
resident of Kotkapura. The complaint with the Commission is dated 12.03.2012.
              The respondent-PIO vide his letter dated 82 dated 14.02.2012 has informed
the complainant – Sh. Amar Nath that information pertaining to para 1 and 2 of his
application can not be supplied to him under the provisions of Section 18(h) of the RTI
Act. In so far as information para 3, 4 and 5 are concerned, the respondent has directed
the complainant to obtain the said information from Punjab School Education Board in
respect of para 1, Police Department in respect of para 2 and District Administration in
respect of para 3.
              After examination of the documents placed on record it is found the the
respondent PIO has failed to spell out the reasons to claim that information pertaining
to item no. 1 and 2 of RTI application cannot be supplied to the complainant according
to the provisions made under section 18(h) of the RTI Act when no such provision exists
in the RTI Act, 2005.
              The respondent PIO has advised the complainant that he must approach
the Punjab School Education Board, Police Department and District Administration and
collect the information mentioned in item nos. 3, 4 & 5 of his RTI application. The
respondent PIO has failed to transfer the RTI application of the complainant to the PIOs
of these departments under section 6(3) of the RTI Act.                   Contd..2/-

             The respondent PIO is directed to give point wise reply to all the queries
raised by the applicant in his RTI application and also file a written reply why he has
failed to transfer the RTI application to the PIOs of departments concerned in respect of

the Commission in this order.
             The Complainant is absent from today’s hearing without any intimation to
the Commission. He is advised to represent his case on the next date of hearing on his
own or through his representative.

                     The Respondent-PIO is directed to provide the requisite
information to the complainant within three weeks from today, failing which action would

              Both the PIOs, Sh. Jaswant Rai Dani      and Sh. Paramjit Singh Sahota are
directed to submit their explanation within two weeks in the form of an affidavit that why
