Asbestos Abatement Program (Statewide)

Bill Text: Provide funds to abate asbestos in various State facilities.


Program Description: This program provides funding for the abatement of asbestos which poses
imminent health hazards to State employees and the people they serve. Projects are identified
through asbestos surveys or routine inspections of facilities. Each year a prioritized list of facilities in
which asbestos poses a health hazard is submitted for funding. Funds requested will be used for
design, abatement, industrial monitoring, and waste removal of asbestos at various State facilities.


Program Performance Analysis: The effectiveness of the program is measured by the number of
asbestos projects completed. Since inception of the program in fiscal 1996, a total of 299 projects
have been funded at various State facilities.


Comments: The fiscal 2009 request is for $2.0 million to fund 15 asbestos abatement projects at
various State facilities. Building materials containing asbestos are present in State-owned buildings.
When disturbed by contact (such as during building maintenance), damage, or deterioration, the
materials are deemed to pose a health risk by releasing airborne asbestos fibers. Effective risk
management requires abatement, restriction of areas with imminent health hazard conditions, and
removal of asbestos. The Asbestos Management Oversight Committee (AMOC) updates the plan
annually with facility/department input to select projects with conditions which have the greatest
negative impact on facility function. Abatement costs associated with facilities being renovated/
demolished are included in the individual capital project budget; special maintenance costs are
covered by individual department operating budgets. The backlog of asbestos abatement projects
totals almost $4.7 million. Since AMOC annually reviews and updates the project list, yet to be
discovered, hazardous conditions could surface and be added to the backlog list.


Asbestos Abatement at Lowe House Office Building
        The proposed list of fiscal 2008 projects includes an $800,000 earmark for asbestos abatement
work in the Lowe House Office Building. This work has been anticipated to be necessary with any
future renovation of the older portions of the building that were not renovated during the most recent

addition to the building. As introduced, the fiscal 2009 capital plan provides $700,000 for the design
of the Lowe House Building renovation project. The 2008 Capital Improvement Program earmarks
$8.2 million for construction in fiscal 2010. The estimated construction cost submitted by the
Department of General Services (DGS) includes $800,000 for asbestos remediation. Since the larger
project anticipates the need for asbestos abatement funding, it appears unnecessary to include the
$800,000 for asbestos abatement on the list of fiscal 2008 Asbestos Abatement Program projects.
One option would be to reduce the fiscal 2009 authorization to $1.2 million to reflect the additional
$800,000 that would be available from fiscal 2008 because the Lowe House Building asbestos
abatement is part of the larger renovation project. Alternatively, since there is currently a backlog of
asbestos abatement projects estimated at $4.7 million, the funds earmarked for the Lowe House
Building could be re-programmed to fund additional projects from the project backlog.


Re-opening of Victor Cullen Academy
         During summer of 2007, the Department of Juvenile Services re-opened the Victor Cullen
Academy on an emergency/expedited basis. As part of the estimated $20 million cost to renovate the
facility, which had been closed for several years, DGS contributed $138,000 from the Asbestos
Abatement Program for asbestos remediation work.
