FESTIVAL VENDOR AGREEMENT
The Heritage Explorer Bike Tour includes an all-day Festival at Mellow Park that is free and open to the public. The Festival runs from
11 a.m. to 4 p.m., and it is open to Bike Tour riders, their families and friends, and members of the community. Proceeds from the event
will support the development of the Lackawanna River Heritage Trail. Thank you for your support.
DEADLINE - THE DEADLINE FOR APPLICATIONS IS FRIDAY, JUNE 1, 2012.
Vendors must submit this completed Agreement Form, a Certificate of Liability Insurance, and payment to reserve a space at
the Festival. Applications after June 1 will be subject to a $25 late fee.

All vendors must provide a Certificate of General Liability Insurance coverage from an insurance company in good standing, with minimum
policy limits of $1,000,000 per occurrence and $2,000,000 in all.

Festival Vendor Agreement
The event will be held rain or shine. There are no refunds or transfers. However, if the vendor would like to withdraw its application, LHV
will convert the application fee into a donation to support its non-profit mission. LHV will send the vendor a receipt for tax deduction purposes.

SPACES & ASSIGNMENTS
Spaces are available at 10’x10’ or 20’x10’. The vendor is responsible for providing a tent, chairs, tables, commercial type extension
cords, or any other equipment that the vendor desires at their location. All materials must fit within the dimensions of the rented
space. Electricity is available at an extra charge of $25. Vendor space assignments at the Festival will be the sole responsibility and
discretion of the Heritage Explorer Bike Tour and Festival Planning Committee.
SET-UP & TEAR DOWN
The vendors are to keep their exhibit open and staffed at all times during the Festival hours from 10 a.m. to 4 p.m. on Saturday, June 16,
2012. Set-up begins at 7 a.m., and it must be completed by 9:30 a.m. Tear down may not start earlier than 4 p.m., and it must be completed
by 7 p.m. The vendor agrees to leave the space in its original condition, and to be responsible for the clean-up of all materials and trash, as
well as the repair of any damage caused by dismantling.
The Heritage Explorer Bike Tour and Festival seeks to increase awareness of environmental stewardship in Northeastern
Pennsylvania. Wherever possible, reduce, reuse, and recycle. There will be several recycling, composting, and trash receptacles
throughout Mellow Park.
Here is what you can do to be environmentally friendly:
Plan ahead to reduce the use of disposable products.
Reuse materials where feasible.
Place paper, cardboard, glass, aluminum, and plastic in the designated containers in the park.
Place all food products in the composting containers.
The following items are not permitted: It is suggested that you use the following items:
Styrofoam. Paper products made with recycled content materials.
Plastic shopping bags. Paper bags or reusable bags.
Your support is an important part of making the event one that promotes an environmentally friendly culture. If you have trouble complying

PRODUCTS AND EXHIBITS
No products bearing the names, logos, or reference to the Lackawanna Heritage Valley National and State Heritage Area (LHV), Heritage
Valley Partners, Inc., (HVP) or Heritage Explorer may be sold or distributed without written permission from LHV. LHV reserves the right to
restrict or prohibit the sale, display, or promotion of any item deemed objectionable, and may evict a vendor who does not comply with this
request. Should such an eviction be enforced, LHV will not be held liable for refunding rental fees.
No alcoholic beverages are permitted on the Lackawanna River Heritage Trail, public streets, or in Mellow Park.
FIRE, SAFETY, & HEATLH REGULATIONS
The vendor agrees to comply with local, city, and state laws, ordinances and regulations, and the regulations of the owner, with regard to fire,
safety, health, and all other matters. All vendor equipment and materials will be reasonably located within the rented space and should be
protected by safety guards and devices where necessary. The vendor agrees to take all necessary fire precautions.
Leaving any merchandise, property, or personal belongings unattended in any area is not recommended. LHV will not be liable for loss or
damage to the property from theft, fire, accident, or any other cause. The vendor agrees to indemnify, protect, defend and save, and hold
harmless the Lackawanna Heritage Valley and its officers, directors, and staff; the Heritage Explorer Bike Tour and Festival and its
organizers, staff, and volunteers; Blakely Borough, Mellow Park, and its owners, agents, and representatives; or employees of the above from
all claims, demands, damages, and liability of whatsoever kind or character, asserted by any person or persons on account of: damage to
property or the leased premises arising out of the use of the leased premises by the vendor or the negligence or willful misconduct of a vendor
or its agents, employees, or invitees, or a breach of this contract by the vendor or its agents, employees, or invitees. The vendor, by agreeing
to this liability exclusion, expressly releases the aforementioned from all claims for loss, damage, or injury.
