     INSTRUCTIONS TO TENDERERS REGARDING TENDER FORMS
                 DOWNLOADED FROM INTERNET

1. Tender document is to be down loaded from the internet and printout is to be
   taken on A4 size paper and details are to be entered by the tenderer at the
   various locations in the document. It is advisable that the downloaded tender
   document is printed through laser/ inkjet printer only. Submission of Xerox or
   photocopy of the tender document is prohibited.

2. This downloaded Tender document in full along with the various documents
   are required to be submitted as per the tender conditions in a sealed cover
   duly subscribing the name of the work, tender notice no. and date etc and the
   same shall be dropped before the stipulated date and time in the tender box
   as specified in the tender notice.

3. The cost of the Tender document as indicated in the Tender Notice will have
   to be deposited by the Tenderer in the form of bank draft in favour of Senior
   Divisional Finance Manager South Western Railway, Bangalore - 560 023
   along with the Tender document. This should be enclosed as a separate
   Demand Draft. A single demand draft for the cost of tender document and
   Earnest Money Deposit will not be accepted. Tenders not accompanied with
   the demand draft towards the cost of the tender document will be summarily
   rejected.

4. The Earnest Money Deposit required for this work as stipulated in the tender
   document is to be submitted separately.

5. Tenderers are advised to download the tender documents well in advance
   and submit the tender before the stipulated time. It is the responsibility of the
   tenderer to check any correction or any modifications published subsequently
   in Web site and the same shall be taken into account while submitting the
   tender. The Tenderers shall download corrigendum (if any), print it out, sign
   and attach it with the main tender document. Tender documents not
   accompanied by published corrigendum(s) are liable to be rejected. Railways
   will not be responsible for any postal delay/ delay in downloading of tender
   document from the internet.

6. The tenderers may please note that the rates/ single percentage for schedule
   items shall be written in figures and words. Each page of the tender document
   shall be signed by the tenderer.

7. Tenderers are free to download the tender document at their own risk and
   cost, for the purpose of perusal as well as for using the same as tender
   document for submitting the offer. Master copy of the tender document is
   available in the Railway office as specified in the tender notice. After the
   award of work an agreement will be prepared based on the master copy of
   tender document available in the above office. In case of any discrepancy
   between the tender document downloaded from the internet and the master
   copy, the latter shall prevail and will be binding on the tenderers. No claim on
   this account will be entertained.

1. I/We have read the General conditions of Tender/ Terms and conditions of the proposed
contract and I/We shall abide by the said rules and conditions in the event of my/our tender
being accepted.

of Bangalore City Railway station and other areas for a period of one year.

6. The rate quoted by me/us is in full satisfaction of all claims.

7 The full value of the full earnest money shall stand forfeited without prejudice to any other
   rights or remedies if,
   a) I / We resile from my/our offer within the validity period of tender; or
   b) I do not execute the contract documents within 7 (SEVEN) DAYS after receipt of notice issued
   by the Railway that such documents are ready; or
   c) I / We do not commence the work within 15 (FIFTEEN DAYS) after receipt of orders to that
   effect; or
   d) I/We do not sign the agreement within 15 (FIFTEEN) DAYS after the issue of LOA.

8. The tender offer submitted by me/us shall remain open for a period of 90 days from the
date of submission of the tender and I/We also agree that in the event of withdrawal of the
said offer by me / us the amount deposited towards earnest money is liable to be forfeited by
the Railway administration and my / our tender shall not be considered for acceptance.

9 This tender is submitted on the understanding that if it is accepted, I/We shall within 15
days from the date of intimation of acceptance of the tender by the Railway administration:-
i] Execute the Agreement in the form prescribed, with or without modifications to those set
out in the Tender Schedule with all its enclosures , for carrying out the work according to the
South western Railway GCC and standard specifications , and
ii] Take up the work as prescribed in the Agreement. I/We ,further agree that in default of
my/our taking up the work within a period of 15 (fifteen) days from the date of intimation of
acceptance of the tender by the Railway administration,/ I/We shall have no claim on the
forfeiture of the EMD deposited by me/us.
iii] Until a formal agreement is prepared and executed acceptance of this tender shall
constitute binding contract between us subject to modifications as may be mutually agreed to
between us and indicated in the letter of acceptance of my / our offer for this work.

      GENERAL CONDITIONS OF THE TENDER FOR MECHANISED CLEANING OF
            BANGALORE CITY RAILWAY STATION AND OTHER AREAS

Tender should be addressed to the President of India acting through The President of India,
Representing the South Western Railway through Chief Medical Superintendent, South
Western Railway, Bangalore, and submitted on the prescribed forms only purchased from the
offices as mentioned in the tender notice, or downloaded from internet.

1. Eligibility Criterion:
For bidders to participate in the above following conditions/ criterion are essential to qualify
for consideration.

2. Technical Criterion: (All documentary proof to be submitted)
The contractor shall have following minimum criterion to participate in the tender:
 A. The tenderer shall have three years experience in carrying out similar mechanised
     service contract preferably in Railway stations, Bus Station, Airports, Ports, Hotels,
     Hospitals etc.
 B. The tenderer should provide satisfactory evidence acceptable to the Railway to show
     that:
     1) The tenderer/firm should be a reputed one which under takes the works similar to
         the subject tender and has adequate technical knowledge and experience
         preferably in Railways.
     2) The tenderer has all the mechanised systems, tools and tackles as per Annexure –
         A & B of this document.
     3) The tenderer has an established proper supervisory control organization to ensure
         that there is adequate control at all stages of execution of the contract.

 C. For the above the Contractor/s must submit along with his/her tenders:-
    1) List of works completed in last 3 financial years giving description of work,
       organization for whom executed, approximate value of the contract at the time of
       award, date of award & date of schedule completion of work. Date of actual start,
       actual completion & final value of the contract should also be given. Necessary
       certificates in this regard from the authorities that made the payments for three
       preceding years should be enclosed duly attested.
    2) List of works on hand indicating description of work, contract value, and approximate
       value of balance work yet to be done and date of award.
    3) List of Personnel organization available on hand & proposed to be engaged for the
       subject work.
    4) List of Plant & Machinery available on hand (owned) & proposed to be inducted
       (owned & hired to be given separately) for the subject work
    5) The tenderer shall have complete technical know-how of mechanised cleaning
       systems, its operating procedures and work methods to get the required job done
       with minimum possible resources. A proof to substantiate this shall be enclosed
       along with tender.
    6) The tenderer shall use all the resources such as cleaning machines, materials &
       manpower strictly as per specifications laid down in tender document. Any offer made
       of contract resource not meeting the specifications as given in these conditions shall
       be rejected.

3. Financial Criterion (All documentary Proof to be submitted):

 1) Tenderer should have completed at least one work of similar nature for a minimum value
    of 35% of the advertised tender value against each work of the tender notice in the last 3

    (three) financial year (i.e. current year and three previous financial years). Tenderer has
    to produce supporting documents/ certificates from the organization with whom they have
    worked along with the offer. Certificates from private individuals for whom such works are
    executed shall not be accepted.

 2) Total contract amount received by the tenderer during the last 3(three) financial years and
    the current financial year should be a minimum of 150% of the advertised tender value
    against each work. Tenderer has to produce attested certificates from the employer
    /client, audited balance sheet duly certified by the Chartered Accountant etc along with
    the offer. In the absence of such a certificate the tender may not be considered.
 3) Tenderer not submitting the requisite information as above may note that his/their offer is
    liable to be ignored. Tender papers are not transferable.

4. Performance guarantee:
a) The successful bidder shall submit a Performance Guarantee in the form of an irrevocable
bank guarantee amounting to 5% of the contract value in any of the following forms:
   i) A deposit in cash.
   ii) Irrevocable Bank Guarantee.
   iii) Government Securities including state loan bonds at 5 % below market value.
   iv) Deposit receipts, pay orders, demand drafts, guarantee bonds. These forms of
         performance of performance guarantee could be either of SBI or any of the
         nationalized banks.
   v) Guarantee bonds executed or deposit receipts tendered by all scheduled banks.
   vi) A deposit in the post office Savings Bank.
   vii) A deposit in the National Savings Certificates.
   viii) Twelve years National Defence Certificate.
   ix) Ten years Defence deposits.
   x) National Defence Bonds.
   xi) Unit Trust Certificate at 5 % below market value or at the face value whichever is less.

b) The Performance guarantee should be furnished by the successful tenderer after letter of
acceptance has been issued, but before the signing of agreement. The agreement should
normally be signed within (15) fifteen days after the issue of LOA and performance guarantee
shall also be submitted within this time limit. This guarantee shall be initially valid up to the
stipulated date of completion plus 60 days beyond that. In case the time for completion of
work gets extended, the contractor shall get the validity of performance guarantee extended
to cover such extended time for completion of work plus 60 days.

C) The performance guarantee shall be released after physical completion of work based on
the (completion certificate) issued by the competent authority stating that the contractor has
completed the works in all respects satisfactorily. The Security deposit shall however be
released after the expiry of the maintenance period and after passing the final bill based on
the “No Claim Certificate”.

d) Wherever the contracts are rescinded the security deposit shall be forfeited and
performance guarantee shall be en-cashed and the balance work should be got done
independently without risk and cost of the failed contractor. The failed contractor shall be
debarred from participating in the tender for balance work. If the failed contractor is a JV or a
partnership firm, then every member/ partner of such a JV or a partnership firm shall be
debarred from participating in the balance work either in his/her individual capacity or as a
partner of any other JV/partnership firm.

e) The Railway Administration shall not make a claim under the Performance guarantee
except for amounts which the President of India is entitled under the contract  (not

withstanding and / or without prejudice to any other provision in the contract agreement) in
the event of:
  1. Failure of the successful tenderer to extend the validity of the performance guarantee as
     described herein above, in which event the Railway Administration may claim the full
     amount of the performance guarantee

 2. Failure by the successful tenderer to pay President of India any amount due, either as
    agreed by the successful tenderer or determined under any of the clauses/conditions of
    the agreement within 30 days of the service of notice to this effect by Railway
    Administration
 3. The contracts being determined or rescinded under provision of the GCC the
    Performance Guarantee shall be forfeited in full and shall be absolutely at the disposal
    of the President of India.

 4. Provided further, that if the Railway is not satisfied that the works can be completed by
    the successful tenderer and in the event of failure on the part of the successful tenderer
    to complete the work within further extension of time allowed as aforesaid, the Railway
    shall be entitled, without prejudice to any other right or remedy available in that behalf,
    to appropriate the successful tenderers security deposit and rescind the contract,
    whether or not actual damage is caused by such default.

 5. The successful tenderer shall be required to execute an agreement in the prescribed
    form within 14 days from the date of issue of Letter of Acceptance & commence the
    work of cleaning.

 6. The successful tenderer should not damage the electrical fittings, cables and
    equipments etc which will be entrusted to him for his work. If any damages are found on
    account of the successful tenderer then he is liable to pay damages for electrical fittings
    etc., provided for work during the tenure of contract as raised by Senior Divisional
    Electrical Engineer, South Western Railway, Bangalore. If the successful tenderer failed
    to pay such damage charges, the same will be recovered from the bill payable for the
    work. In this connection the decision of Railway Administration is final.

5. CONDITIONS
   a) The tenderer(s) is/ are required of declare his/ their age to the satisfaction of the
      Railway Administration. No contract will be allotted to a minor/ minors under any
      circumstances.
   b) The amount in tender should be legibly written in ink in figures and in words. This is not
      inclusive of ground rent, water charges, electricity charges etc.
   c) Tenders containing erasures or alterations without proper attestations or with an
      omission of such attestation are liable to be rejected.

6. Security Deposit: The security deposit for the work shall be fixed in accordance with
     clause 16 (1) of the General conditions of contract of SWR as below. The Earnest
     money deposited by the contractors with his tender will be retained by the railways as
     part of the security for the due and faithful fulfillment of the contract by the contractor.

     The balance to make up the security deposit the rates are for which are given below
     may be deposited by the contractor in cash or may be recovered by percentage
     deduction from the contractors “On Account Bills” providing also that in case of the
     defaulting   contractor the Railway may retain any amount due for payment to the
     contractor on the pending “On Account Bills” so that the amount so retained may not
     exceed 10% of the total value of the contract. Unless otherwise specified

      in the special conditions if any, the security deposit/ rate of recovery/ more of recovery
      shall be as under:
      a) Security deposit for each work should be 5% of the contract value
      b) The rate of recovery should be at the rate of 10% of the bill amount till the full security
         deposit is recovered
      c) Security deposit will be recovered only from the running bills of the contract and no
         other mode of collecting SD such as SD in the form of instruments like BG, FD etc.
         shall be accepted towards security deposit.
Security deposit shall be returned to the contractor after physical conditions of the work and
after completion of the maintenance period and after passing of the final bill as certified by
the competent authority. The competent authority shall normally be the authority who is
competent to sign the contract, if this competent authority is of the rank of lower than JA
grade, then a JA Officer concerned with the work should issue the certificate. The certificate
should inter alia mention that the work has been completed in all respects and that the
contractor has fulfilled all the contractual obligations and that there is no due from the
contractor to the railways against the contract concerned. Before realizing the SD an
unconditional and unequivocal no claim certificate from the contractor concerned should be
obtained.

7. The tenderer shall be required to deposit requisite Earnest Money Deposit (EMD) as
   specified in the Tender Notice and to keep the Offer open till acceptance/rejection of the
   offer is communicated by the Railway Administration or till ninety days from the date of
   opening of tenders whichever is earlier.

8. Tenders will not be considered unless the Earnest Money is deposited and Annual Sales
   turnover statement. Experience Certificate and other credentials are submitted along with
   the Tender.

9. It shall be understood that the tender documents have been sold/ issued to the tenders
   and only that tenderer is permitted to tender in conservation of the stipulation. After
   submission of his tender, he/ they should not resile the offer or modify the terms and
   conditions thereof in a manner not acceptable to the Railway Administration. If the
   tenderer fails to observe or comply with the said stipulation, the aforesaid Earnest Money
   Deposit amount shall be liable to be forfeited to the Railway.

10. No interest shall be allowed on the Earnest Money Deposit or on any advance payment
    made by the tenderer to the Railways under any stipulation.

11. The Earnest Money Deposit of the unsuccessful tenderers will be refunded after the
    tenders have been disposed of.

12. Tenders submitted without properly and fully complying with the tender requirements
    would be disqualified.

13. The tender is valid for a period of 90 days from the date of opening of tender. The
    Railway Administration reserves the right to extend the validity of tenders at its discretion
    if necessary. Further the Railway Administration reserves to itself the right to accept/
    negotiate with any of the tenderer needless of the priority of the offer the particular
    tenderer had made.

14. The Railway Administration reserves to itself the right to reject all or any of the tenders
    without assigning any reason and is not bound to accept the highest.

15. No separate communication relating to the tender must be addressed by the tenderer to
    the officer or any other person in the Railway Administration but all explanatory or
    qualifying remarks which the tenders may desire to make must be recorded in the tender
    form itself in the space provided for the purpose.

16. If the tenderer withdraws his offer before the Railway Administration accepts or rejects
    the same or before ninety days from the date of opening of tender whichever is earlier.
    The Earnest Money Deposit will be forfeited to the Railway Administration as ascertained
    liquidated damages.

17. The successful tenderer shall be required to execute an agreement before taking up the
    contract.

18. The successful tenderer should have technical competence. He should be prepared to
    demonstrate his expertise to Railway and experience in the relevant field for performing
    the said work and authorities if required. Necessary proof regarding technical
    competence and experience to be attached along with the tender failing which, the tender
    will be summarily rejected.

19. The successful tenderer should also fulfill the special conditions attached to the tender.

20. The Railway Administration will reserve the right to terminate contract at any time by
    giving a notice of not less than 30 days. The advice of acceptance of the tender will be
    sent to successful tenderer by Registered Post with acknowledgement due.

21. Identity cards should be issued only by the successful tenderer for his labourers.

22. Variation in Quantities:
 a) The works shown in the Annexure are intended only to give a rough and general idea
      of the location and rough details of work to be done. No claim whatsoever will be
      admissible in respect of any alteration/addition/deletion/change in the type of works
 b) The quantities of various items given in the schedule for the works to be executed are
      only approximate and are only for the guidance of the contractor. As far as possible,
      they have been assessed correctly but are likely to vary during the execution of the
      work. The contractor’s attention is drawn to clause 42 of the General conditions of
      contract dealing with variation in quantities.
 c)   In the event of any reduction in the quantities to be executed for any reason
      whatsoever the contractor shall not be entertained for any compensation but shall be
      paid only for the actual quantity of work done at the agreemental rates.
 d) Payments will be as per the variation seen.

23. Vitiation Clause: This clause shall be treated as an expected matter in terms of para 63
    of the GCC of SWR “in the event of vitiation occurring due to increase or decrease in
    quantities among the first, second and third lowest valid tendered, the vitiation shall be to
    contractors account. The total value of the work done shall be calculated at the rate
    offered by those tenders and the amount payable shall be limited to the all variation in the
    quantities”. The vitiation will be worked out at every on account bill stage and payment
    will be regulated accordingly.

24. Inspection:

   a) Inspection shall be carried out by the inspection officer as nominated by Railway. The
      cost of inspection will be on Railway’s account subject to other provisions herein
      contained.

   b) The inspecting officer shall have the following powers:
   1. Before any equipment or part thereof during or after manufacturing are submitted for
      inspection to certify that they are not in accordance with the contract owing to the
      adoption of any unsatisfactory method of manufacture.
   2. To reject the equipment or part thereof submitted as not being in accordance with the
      requirement of the tender document.
   3. To reject the whole of the installment tendered for inspection, if after inspection of such
      portion thereof, as he may in his discretion think fit he is satisfied that the same is
      unsatisfactory.
   4. To mark the rejected equipment with a rejection mark so that they may be easily
      identified if re-submitted.
   5. The inspecting officer’s decision as regards the rejection shall be final and binding on
      the contractor.
   6. Measure of quality of cleanliness shall mean almost near / akin to original / new shade
      or colour or shining.
   7. Measurement of performance shall as laid out in the Special terms and condition.

25. Incomplete tender shall be liable for cancellation and rejection and Railway reserves the
    right to accept or reject any or all the tender applications without assigning any reason
    thereof and is not bound to accept the lowest bid/offer.
26. Tender containing erasures and alternations of the tender documents are liable to be
    rejected. Any corrections made by the tenderer in his entries must be attested by him.
27. It shall not be obligatory on the Railway Administration to accept the lowest tender and
    no tenderer/tenderers shall demand any explanation for the cause of rejection of his/their
    tender. If the tenderer deliberately gives/tenders wrong information in his/their tender or
    creates circumstance for the acceptance of his/their tender, the Railway reserves the
    right to reject such tender at any stage.
28. If the tenderer expires after the submission of his tender or after acceptance of his tender
    the Railway shall deem such tender as cancelled. If a partner of a firm expires after the
    submission of their tender or after acceptance of their tender the railway shall treat such
    tender as cancelled unless the firm retains its character.
29. The Railway reserves the right to not invite tenders for any work or to invite open or
    limited tender and when tenders are called, to accept a tender in whole or in part or reject
    any tender or all tenders without assigning reasons for such action.
30. Tenderer must specify the rates in figures as well as in words below or above the
    departmental value in the appropriate column in the Tender Schedule. The rates must be
    inclusive of all other charges and taxes leviable as per specifications laid down for the
    same in special terms and conditions of this tender.
31. The Tenderer's signature must be affixed at the bottom of each page of the tender
    document. No tender which is unattested and/or contains erasure or alteration of the
    tender document made by intending tenderer/tenders will be considered.
32. Only experienced firms/ agencies having facilities of Mechanized Cleaning/House
    Keeping with previous credentials for doing such work for major reputed establishments
    may participate.
33. Before submitting tender, the tenderer/tenderers will be deemed to have satisfied
    himself/themselves regarding the nature of work/contract. The submission of a tender by
    tenderer implies that he has read and will abide by the conditions under which work will
    be entrusted. Non-compliance with any of the conditions set forth herein is liable to result
    in the tender being rejected.

34. SUBMISSION OF OFFERS:
  a) All offers shall be written neatly without correction and over writings.
  b) Any individual(s) signing the tender or other documents connected therewith shall
     specify whether he is signing.

      i. As sole proprietor of the concern.
      ii. As a partner or partners of the firm.
      iii. As a Director, Manager or Secretary of a Limited company duly authorized by a
      resolution passed by the Board of Directors or in pursuance of the authority conferred
      by memorandum of association

35. All prices and other information like document sets having a bearing on the price shall be
    written both in FIGURES & WORDS in the prescribed offer form and duly signed and
    stamped.
36. All the copies of the annexure duly serialled and enclosed with the tender paper should
    be duly filled in by the tenderer and submitted along with the tender duly signed and
    stamped on each page.
37. The tenderer should avoid ambiguity in his offer e.g. his offer is to his standard
    sizes/lengths/dimensions. He should specifically state them in details without any
    ambiguity. Brief descriptions such as “Standard lengths” etc. should be avoided in the
    offer.
38. LOCAL CONDITIONS:
    It will be imperative for each tenderer to fully acquaint him-self with all the local
    conditions and factors which would have any effect on the performance of the contract
    and the cost of item of works. The “Railways” shall not entertain request for clarification
    from the tenderer regarding such local conditions. No request for change of price or time
    schedule of completion of work shall be entertained after the “Railways” accepts the
    offer. The tenderer can visit the place of proposed work to understand the site conditions
    and correct appreciation of nature and volume of work to be done.

39. RATE: The prices are to be quoted by the tenderer in the offer as a total cost basis
    unless otherwise specified. The rates quoted must be inclusive of the following:
    a) Cost of Manpower, Cost of Mechanized system, Cost of maintenance, Cost of
       Consumables and other Housekeeping items, Cost of Supervision and Training.
    b) All taxes and levies etc. like sales tax, excise duty, works contract tax, service tax etc.
       as applicable and insurance including third party liability etc.
    c) Cost of all auxiliary equipment, consumables for completing the job.
    d) Cost of maintenance of these mechanized systems.
    e) Any other cost direct or hidden not mentioned above.

40. PAYMENT TERMS: The standard payment terms subject to recoveries as mentioned in
    the agreement or of any amount under the liquidated damages clause of contract will be
    as under:
    a. On account payment will be made to the firm/contractor based on the daily score card
    (Annexure – G).
    b. Payment as above shall be subject to any deductions of any amount for which the
    contractor is liable under the contract against this tender including penalty and fine as
    specified in work evaluation and penalty clause or any other contract in respect of which
    the President of India is the contracting authority.
41. LAST DATE FOR RECEIPT OF THE TENDER:
   a) The offers complete in all respect should be dropped in the tender box kept in the
   office of Chief Medical Superintendent, Divisional Railway Hospital, Okalipuram,
   Bangalore City – 560023, not later than the scheduled time for closure of the tender box
   as mentioned in the Tender Notice.

   b) The tenders received shall be opened in the presence of such of the tenderers or their
   representative, who may like to be present at the scheduled time of the opening.

42. ASSIGNMENT OR SUBLETTING OF CONTRACT:
    The contractor shall not assign or sublet the contract or any part thereof or allow any
    person to become interested therein in any manner whatsoever without the special
    permission in writing of the Railway. Any breach of this condition shall entitle the Railway
    to rescind the contract and also render the contractor liable for payment to the Railway in
    respect of any loss or damage arising or ensuing from such cancellation, Provided
    always that execution of the details of the work by petty contractor under the direct and
    personal supervision of the contractor or his agent shall not be deemed to be sub-letting
    under this clause. The permitted subletting of work by the contractor shall not establish
    any contractual relationship between the sub-contractor and Railway and shall not relieve
    the contractor of any responsibility under the contract.

43. ALTERATIONS:
     The “Railways” may require such alteration to be made on the work, during its progress,
    as deemed necessary. Should these alterations be such that either party to the contract
    considers an alteration in price justified, such alterations shall not be carried out until
    accepted by the “Railway(s)”. Should the contractor proceed and execute such alteration
    without obtaining the consent in writing of the “Railways” to an amended price, he shall
    be deemed to have agreed to execute the contract at a price as may be considered
    reasonable by the Railways or without any extra price if considered reasonable by the
    Railways.
44. CORRUPT GIFT AND PAYMENT OF COMMISSION:
    Any bribe, commission, gift or advantage given, premises offered by or on behalf of the
    contractor, his agents or servants or any one on his/their behalf to any employee,
    representative of the Railways or any persons on his behalf in relation to the execution of
    this or any other contract, the Railways shall in addition to the criminal liability under the
    laws in force, subject the contractor to cancellation of this and all other contracts with the
    Railways and also to payment of any loss resulting from any such cancellations and the
    Railways shall be entitled to deduct the amount so payable from any money otherwise
    due to the contractor under this or any other contract. Any question or dispute as to the
    commission of any offence under the present clause shall be settled by the railways in
    such manner as may be deemed fit and sufficient and Railways’ decision shall be final
    and conclusive on the matter.

45. (a) Compliance to Railways' Instructions: - The Railway or his representative shall direct
    the order in which the several parts of the works shall be executed and the Contractor
    shall execute without delay all orders given by the Railway or his representative from time
    to time but the Contractor shall not be relieved thereby from responsibility for the due
    performance of the works in all respects.
    (b) Alterations to be authorized: - No alterations in or additions to or omissions or
    abandonment of any part of the works shall be deemed authorized, except under
    instructions from the Chief Medical Superintendent, Bangalore City, and the Contractor
    shall be responsible to obtain such instructions in each and every case in writing from the
    Chief Medical Superintendent..
    (c) Extra Works: - Such works over and above those included in the contract require to be
    executed at the site; the Contractor shall have no right to be entrusted with the execution
    of such works which may be carried out by another Contractor or Contractors or by other
    means at the option of the Railway.

46. DAMAGE TO RAILWAY PROPERTY OR PRIVATE LIFE AND PROPERTY:

   The Contractor shall be responsible for all risk to the work and for trespass and shall
   made good at his own expense all loss or damage whether to the works themselves or
   to any other property of the Railway or the lives, persons or property of others on
   account of any negligence of contractor in connection with the works until they are taken
   over by the Railway and in case the Railway shall be called upon to make good any
   costs, loss or damages, or to pay any compensation, including that payable under
   the provisions of the Workmen’s Compensation Act or any statutory amendments
   therefore to any person or persons sustaining damages as aforesaid by reason of any
   act, or any negligence or omissions on the part of the Contractor the amount of any
   costs or charges including costs and charges in connection with legal proceedings, which
   the Railway may incur in reference thereto, shall be charged to the Contractor. The
   Railway shall have the power and right to pay or to defend or compromise any claim of
   threatened legal proceedings or in anticipation of legal proceedings being instituted
   Consequent on the action or default of the Contractor, to take such steps as may be
   considered necessary or desirable to ward off or mitigate the effect of such proceedings
   charging to Contractor, as aforesaid, any sum or sums of money which may be paid and
   any expenses whether for reinstatement or otherwise which may be incurred and the
   propriety of any such payment, Defense or compromise, and the incurring of any such
   expenses shall not be called in question by the Contractor.

47. Sheds, Stores Houses And Yards: - The Contractor shall at his own expense provide
    himself with sheds, storehouses and yards in such situations and in such numbers as is
    requisite for carrying on the work and the Contractor shall keep at each such sheds, store
    houses and yards a sufficient quantity of materials and plant in stock as not to delay the
    carrying out of the works with due expedition and the Railway and the Railway’s
    representative shall have access to the said sheds, store houses and yards at all
    reasonable times without any prior notice for the purpose of inspecting the stock of
    materials or plant so kept in hand, and any materials or plant which the Railway may
    object to shall not be brought upon or used in the works, but shall be forthwith removed
    from the sheds, storehouses or yards by the Contractor. The Contractor shall at his own
    expenses provide and maintain suitable equipment necessary for the execution of the
    works. However railway may provide one room or shed to the contractor free of charge
    for keeping his equipment and consumables.

48. PROVISION OF STAFF:
 a) The Contractor shall place and keep on the works at all times, efficient and competent
    labourers and Supervisor in each shift as indicated in annexure (A to I) to give the
    necessary direction to Contractor’s workmen and supervisor in-charge or manager for
    mechanized cleaning work who will maintain the closed contract with the railway officials
    for maintaining standard of cleanliness and to see that they execute their work in sound
    and proper manner and shall employ only such supervisors, workmen and Labourers in
    or about the execution of any of these works as are careful and skilled in trades. The
    Contractor shall at once remove from the works any agent, permitted sub Contractor,
    supervisor, workman or Labours who shall be objected to by the Railway for bonafide
    reasons and if and whenever required by Railway, the contractor shall submit a correct
    return showing the names of all staff and workmen employed by him.
 b) In the event of Railway or its representative being of the opinion that the Contractor is
    not employing on the works required number of staff as is necessary for the proper
    execution of service within the time prescribed, the Contractor shall forthwith on
    receiving intimation to this effect provide requisite number of staff and Labour specified
    by Railway or its authorized representative within 24 hrs of being so required and failure
    on the part of Contractor to comply with such instructions will entitle the Railway to
    rescind the contract.

 c) At least one qualified representative should be available at site whenever required by
     the Railway or their representative to take instructions. In case the Contractor fails to
     employ the qualified supervisor as aforesaid he shall be liable to pay a reasonable fine
     to Railway.
49. INSPECTION REGISTERS AND RECORDS:
   The Contractor shall maintain accurate records, plans and charts showing the dates and
   progress of all main operations and the Railway or his representative shall have access to
   this information at all times. Records of observations made shall be handed over to the
   Railway’s representative. The Contractor’s representative will maintain the following
   registers at site.
   a) Site Order Register – The Contractor shall promptly acknowledge orders given therein
      by Railway or his representative and shall make all efforts to comply with them. The
      Contractor shall report to the Railway the compliance so that it can be checked.
   b) Labour Register - This register will be maintained to show daily strength of Labour in
      different categories employed by the Contractor.
   c) Log Book of events – All events are required to be chronologically logged in this book
      date & shift wise.
50. WORKING HOURS:
    Work shall be carried out as specified in Scope of Work of the special conditions of the contract.
    The Contractor will be responsible for fulfillment of this condition during the execution of work for
    safe working of his staff. The work shall be carried out on shift basis. The shift can be unit or split
    depending upon the cluster of trains falling under the working timetable.

51. CLAIMS: Signing of “No claim” Certificate: The Contractor shall not be entitled to make
    any claim whatsoever against the Railway under or by virtue of or arising out of this
    contract, nor shall the Railway entertain or consider any such claim, if made by the
    Contractor after he shall have signed a “No Claim” Certificate in favour of the Railway, in
    such form as shall be required by the Railway after the works are finally measured up
    and paid for by the Railways. The Contractor shall be debarred from disputing the
    correctness of the items covered by “No Claim” Certificate or demanding a clearance to
    Arbitration in respect thereof.

52. QUANTITIES IN SCHEDULE ANNEXED TO CONTRACT:
    The work set out in the accepted schedule of rates with items of works quantified in the
    Scope of work and services are the estimated quantities of the works and they shall not
    be taken as the actual and correct quantities of the work to be executed by the
    Contractor in fulfillment of his obligations under the contract but only as an indication of
    quantum of work to be performed by the contractor.

53. FINAL PAYMENT:
a) Final Payment: On the Chief Medical Superintendent’s certificate of completion in
   respect of the works adjustment shall be made and the balance of account based on the
   Railway or the Railway’s representative’s certified measurements of the total quantity of
   work executed by Contractor up to the date of completion and on the accepted schedule
   or rates shall be paid to the Contractor subject always to any deduction which may be
   made under these conditions and further subject to the Contractor having delivered to
   the Railway either a full account in details of all claims he may have on the Railway in
   respect of the works or having delivered “No Claim” Certificate and the Railway having
   after the receipt of such account given a certificate in writing that such claims are correct,
   that the whole of the works to be done under the provisions of the Contracts have been
   completed, that they have been inspected by him since, their completion and found to be
   in good and substantial order, that all properties, works and things, removed, disturbed or
   injured in consequence of the works have been properly replaced and made good and all

   expenses and demands incurred by or made upon the Railway for or in the respect of
   damage or loss by form or in consequence of the works, have been satisfied agreeably
   and in conformity with the Contract.
b) Post Payment Audit It is an agreed term of contract that the Railway reserves to itself the
   right to carry out a post-payment audit and or technical examination of the works and the
   final bill including all supporting vouchers, abstracts, etc. and to make a claim on the
   Contractor for the refund any excess amount paid to him if as a result of such
   examination any over-payment to him is discovered to have been made in respect of any
   works done or alleged to have been done by him under the contract.
c) Payment of Security Deposit:- The total security deposit shall become due and shall be
   paid to the Contractor after the expiration of the period of contract, specified in the
   Tender reckoned from the date on which the Chief medical Supdt shall have passed the
   certificate of completion comprising the whole of the works to be done under the
   provisions of the contract or any other earlier date subsequent to the completion of the
   whole of such work that may be fixed by the Railway in this behalf, provided that all the
   stipulations of the clause have been fulfilled by the Contractor and all claims and
   demands made against the Railway for and in respect of damage or loss by from or in
   consequence of the works have been finally satisfied.
d) Production of vouchers etc. by the Contractor: - For a contract of more than one crore
   rupees, the Contractor shall, whenever required, produce or cause to be produced for
   examination by the Railway any quotation, invoice, cost or other account, book of
   accounts, voucher, receipt, letter, memorandum, paper of writing or any copy of or
   extract from any such document and also furnish information and returns verified in such
   manner as may be required in any way relating to the execution of this contract or
   relevant for verifying or ascertaining cost of execution of this contract (the decision of the
   Railway on the question of relevancy of any documents, information or return being final
   and binding in the parties). The Contractor shall similarly produce vouchers etc., if
   required to prove the railway that materials supplied by him, are in accordance with the
   specifications laid down in the contract.

54. LIEN IN RESPECT OF CLAIMS IN OTHER CONTRACTS:
    Any sum of money due and payable to the Contractor (including the security deposit
    returnable to him) under the contract may be withheld or retained by way of lien by the
    Railway, against any claim of this or any other Railway or any other Department of
    the Central Government in respect of payment of a sum of money arising out of or under
    any other contract made by the Contractor with this or any other Department of the
    Central Government. It is an agreed term of the contract that the sum of money so
    withheld or retained under this clause by the Railway will be kept withheld or retained as
    such by the Railway till the claim arising out of or under any other contract is either
    mutually settled or determined by Arbitration, if the other contract is governed by
    Arbitration clause or by the competent court as the case may be and Contractor shall
    have no claim for interest or damages whatsoever on this account or on any other
    ground in respect of any sum of money withheld or retained under this clause and duly
    notified as such to the Contractor.

55. RIGHT OF RAILWAY TO DETERMINE THE CONTRACT:
    (i) The Railway shall be entitled to determine and terminate the contract at any time
    should, in the Railway’s opinion, the cessation of work becomes necessary owing to
    paucity of funds or from any other clause whatever, in which case the value of approved
    material at site and of work done to date by the Contractor will be paid for in full at the
    rate specified in the contract. Notice in writing from the Railway of such determination
    and the reasons therefore shall be conclusive evidence thereof.
    (ii) Payment of determination of contract: Should the contract be determined under sub

   clause (i) of this clause and the Contractor claims payment for expenditure incurred by
   him in the expectation of completing the whole of the work, the Railway shall admit and
   consider such claims as are deemed reasonable and are supported by vouchers to the
   satisfaction of the Railway. The Railways decision on the necessity and propriety of such
   expenditure shall be final and conclusive.
   (iii) The Contractor shall have no claim to any payment of compensation or otherwise,
   howsoever on account of any profit or advantage which he might have derived from the
   execution of the work in full but which he did not derive in consequence of determination
   of contract.

56.RIGHT OF RAILWAY AFTER RESCISSION OF CONTRACT OWING TO DEFAULT OF
   CONTRACTOR: In the event of rescission of contract owing to default of contractor –
   (a) The Contractor shall have no claim to compensation for any loss sustained by him by
   reason of his having purchased or procured any materials or entered into any
   commitments or made any advances on account of or with a view to the execution of the
   works or the performance of the contract and Contractor shall not be entitled to recover
   or be paid any sum of any work there to for actually performed under the contract unless
   and until the Chief Medical Superintendent shall have certified performance of such work
   and the value payable in respect thereof and the contract shall only be entitled to be paid
   the value so certified.
   (b) The Railway or Railway’s representative shall be entitled to take possession of any
   materials tools implements machinery and buildings on the works or on the property on
   which these are being bought to have been executed and to retain and employ the same
   in the further execution of the works or any part thereof until the completion of the works
   without the Contractor being entitled to any compensation for the use and employment
   thereof or for wear and tear or destruction thereof.
   (c) The Railway shall as soon as may be practicable after removal of the Contractor fix
   and determine ex-parte or by or after reference to the parties or after such investigation
   or enquiries as he may consider fit to make or institute and shall certify what amount (if
   any) had at the time of rescission of the contract been reasonably earned by or would
   reasonably accrue to the Contractor in respect of the work then actually done by him
   under the contract and what was the value of any unused or partially used materials any
   constructional plant and any temporary works upon the site.
   (d) The Railway shall not be liable to pay the Contractor any money on account of the
   contract until the expiration of the period of maintenance and thereafter until the cost of
   completion and maintenance damage for delay in completion (if any) and all other
   expenses incurred by the Railway have been ascertained and the amount thereof
   certified by the Chief Medical Superintendent .The Contractor shall then be entitled to
   receive only such sum or sums (if any) as the Chief Medical Superintendent may certify
   would have been due to him on due completion by him after deducting the said amount;
   but if such amount shall exceed the sum which would have been payable to the
   Contractor, then the Contractor shall upon demand pay to the Railways the amount of
   such excess and it shall be deemed to debt by the Contractor to the Railway and shall be
   recoverable accordingly.
57.ACCOMODATIONS AND RAILWAY PASSES:
   No accommodations shall be given to any contractor(s) or staff/supervisors for the
   purpose of stay. Also, no Railway pass / PTO shall be given to them.

58.DISPUTE: Any dispute arising out of interpretation of Drawings, specifications or any
   terms and conditions including special condition of the contract or arising during the
   execution of the work/contract, shall be settled by Railways and this decision shall be
   final and binding on the contractor/tenderer(s).

59.TAXES/DUTIES:
   Rates quoted should be inclusive of all taxes as is being levied or may be levied in future.
   No increase in Rates will be permissible even if the tax rates are increased.
60.Railway Not to Provide Quarters For Contractors:
    a. Compliance to rules for employment of Labour: The Contractor (s) shall conform to all
    laws, bye laws rules and regulations or the time being in force pertaining to the
    employment of local or imported Labour and shall take all necessary precautions to
    ensure and preserve the health and safety of all staff employed directly or through petty
    Contractors or sub Contractors on the works.
    b. The Contractor shall take requisite precautions and use his best endeavor to prevent
    any riotous or unlawful Behavior by or amongst his workmen and other employed directly
    or through the petty contractors and sub Contractors on the works and for the
    preservation of peace and protection of the inhabitants and security of property in the
    neighborhood of the works. In the event of Railway requiring the maintenance of a
    special Police Force at or in the vicinity of the site during the tenure of works, the
    expenses thereof shall be borne by the contractor and if paid by Railway shall be
    recoverable from the contractor.
     c. Non-employment of Labourers below the age of 18: The Contractor shall not employ
    children below the age 18 as Labourers directly or through petty Contractors or sub
    Contractors for the execution of work.
    d. The contractor shall be responsible for employment of its labour and be liable for
    observance of all statutory provision of Government. No claim for employment of labour
    so engaged by the contractor in Railway whatsoever ground shall be entertained.
    e. The contractor shall keep in force policy/policies of insurance against all liabilities and
    recognized risk in respect of accident to person employed by contractor for purpose of
    carrying out the work under the contract. In respect of all staff engaged by him, the
    contractor shall be responsible against all claims under Work Men Compensation Act,
    labour Contract Act etc.
    f. If Railways costly assets are to be given to the contractor for maintenance, Contractor
    shall ensure its necessary safeguards to protect railway’s property.
     g. All preventive measures are to be taken not only for guarding Railway’s own assets
    given to contractors for maintenance but also to secure from anti social elements.
    Indemnifying of damages to the Railway properties needs to be included as a protective
    measure in the scope of the contract conditions.
61.The submission of a Tender by a tenderer shall be deemed to imply and taken as
   indicating that he has read, understood and abided by the conditions stated therein and

                             SPECIAL CONDITIONS OF THE TENDER
1. Name of work: Mechanised Cleaning of Bangalore City Railway station for a period of one
    year which implies cleaning and Maintenance of Bangalore City Railway station including
    platforms, tracks/ aprons adjoining platforms, waiting halls, retiring rooms, toilets,
    concourse including circulating area, station approach roads, park/ gardens in front of the
    station, Parcel Office, PRS centre, Booking Office, Parking Lots on main and second entry
    Other offices and service buildings etc. as per the scope of the work.
 2. Scope: The successful tenderer will have to use cleaning equipments as detailed in
    Annexure for cleaning activities. The various areas and frequency of cleaning is indicted in
    Annexure. He will have to use biodegradable chemical agents, consumables etc., along
    with equipments to ensure comprehensive cleaning. All the equipments, operators,
    consumables required to carry out cleaning will have to be arranged by the contractor at
    his own cost. All the labour required for cleaning work will have to be engaged by the
    successful tenderer along with equipments. Any repair/ replacement of equipment will
    have to be arranged by the successful tenderer. It has to be ensured that in case of failure
    of any equipment, the same is repaired/ replaced of within six hours from the time of failure
    at contractor’s cost. If not done and if the work is absolutely essential one the same will be
    carried out by the department, and that cost will have to be borne by the contractor
 3. Labourers engaged should be above 18 years old and below 45 years of the age and
    supervisors up to the age of 45 years. The staff should wear clean uniforms with over coat,
    headgear and armband as prescribed by the administration. A name badge with identity
    card issued by the Railway authorities shall also be worn by the successful tenderer. All
    other labourers should be issued with Identity card by the licensee himself. If a person is
    found without proper identity card, the person will not be allowed to work and necessary
    penalty will be imposed.
 4. The contractor shall have to maintain cleanliness and upkeep of the entire station area by
    undertaking manual as well as mechanized system. The contractor shall have to take up
    additional work in the event of extending the area of operation and shall also agree to
    install additional machineries in case there is any requirement. Payment for the additional
    work will be as per the finalized item wise rate of financial bid (Annexure I)
 5. The cleaning work is to be carried out round the clock in all 3 shifts as per scope of this
    work. The contractor shall depute skilled labour force with supervisory staff in all the three
    shift with proper work distribution for prompt execution of the work so as to ensure that the
    services rendered are executed to the satisfaction of railways. The contractor's labour will
    work at the train passing areas and other sensitive areas only with the consent of the
    authorized railway supervisors at site. The contractor shall have to engage additional staff
    in case of requirement at no extra cost.
 6. The contractor will have to use mechanized cleaning equipments as detailed in Annexure
    for undertaking cleaning activities at his own costs. The equipments deployed must fulfill
    the minimum requirement/features as outlined in Annexure. The contractor shall be
    responsible for round the clock availability, serviceability and maintenance of these
    mechanized systems. These mechanized systems should be dedicated to this contract
    and cannot be taken out for any other job. Any repair/replacement of the equipment will
    have to be arranged by the contractor. It has to be ensured that in case of failure of any
    equipment, the same is repaired /replaced within six hours from the time of failure at
    contractor's cost. If this is not done a penalty shall be imposed as per penalty clause under
    special conditions, clause 39. If the repair work is absolutely essential and carried out by
    the Railways, that cost will have to be borne by the contractor. The contractor must
    enclose the proof of possessing technical know-how of the mechanized systems.
 7. The contractor shall be provided with one room for stacking the machineries required for
    undertaking cleaning activities free of cost. However, the safety and security of the
    machineries shall lie upon the contractor. The contractor shall indemnify Railway against

    any accident or loss occurring due to these installations and equipments/machines. It is
    the responsibility of the contractor to keep such place clean and tidy and free from
    nuisance.
 8. The contractor shall have to provide uniforms with distinctive logos and identifications,
    Gum Boots, Hand gloves, Caps, Goggles, Identity cards etc. to all its workers/staff and
    ensure that his men wear these at all the time while working at Railway premises so that
    they can be easily identified by Railway Security/Commercial staff and supervisors. The
    Railway shall give them permission to enter within the railway premises to execute the said
    cleaning work only.
 9. The contractor shall have to furnish photographs and complete details of the labour and
    supervisors to be deployed with details of names, address, Phone No., Age, and Marital
    status, Voter ID No. etc. to enable the Railways to allow them free access to the station
    premises.
10. The contractor shall ensure due periodical Medical Checkup of all its personnel employed
    for carrying out the work and the medical fitness certificate of Doctor to this effect shall
    have to be submitted for records. Railway reserves the right to refuse work by a particular
    employee if he/she is found to be suffering from any infectious diseases and not fit to carry
    out the duties. They shall not be allowed to perform duties till recovery from the diseases
    as a precautionary and preventive measure.
11. The successful tenderer should take all safety measures while staffs are working on
    railway tracks. All the safety equipments like gumboots, hand gloves, goggles, helmet etc.
    should be provided. The Railway Administration will not be responsible for staff sustaining
    any injury or any illness while on duty.
12. The successful tenderer /firm has to comply with the labour laws in force like Minimum
    Wages Act, Employment of Children’s Act, Hours of Employment Regulation’s, Work
    Man’s Compensation Act, Provident fund, Employee State Insurance, Bonus etc. an all
    such laws in force from time to time as applicable to this contract.
13. Continuous cleaning of platforms round the clock to be ensured by deploying staff. The
    minimum required staff as stated should not be reduced on any account. If the number is
    reduced and if cleanliness suffers on this account an approximate cost of Rs.199/- per staff
    per day will be recovered from the bill amount while monthly payments are made.
14. Soon after departure of each and every train the empty track shall be cleaned and tracks
    shall be free from garbage, rubbish solid waste etc. and washing of fecal matters. Two
    times cleaning of tracks per shift to be ensured with liberal use of disinfectants so as to
    keep the area free from odor and flies.
15. All the platforms shall be washed with water once a week by tapping water from hydrant
    conserving the usage of water. Footpath of platforms to be washed daily. All the dadoos
    and corners are to be dusted up to 10 feet and washed with soap and water every week.
    Wet/Dry mopping of tiles, mosaic and granite areas is to be carried out continuously and
    the areas to be kept scrupulously clean using the modern equipments/machineries.
16. Toilets/urinals facilities provided in the above areas for the use of departmental staff
    should be cleaned at regular intervals using good detergent, disinfectant and deodorants.
    Usage should be liberal to upkeep the premises neat and tidy.
17. All the garbage/wastages should be collected and put in thick disposal polythene covers
    with the top tied at the mouth from the place of collection to the dumping point by tyre
    mounted suitable vehicle, it should be ensured that no spillage occurs during
    transportation to administration nominated dumping points. A battery operated cart for this
    would be preferable. However, garbage collected from the Platform/stalls should not be
    dumped in open in the garbage bins which are provided at the end of the platforms. The
    collected garbage should be stored in the litter container. A truck should clear all the
    garbage collected on daily basis, either the litter containers themselves are replaced or
    garbage from containers are cleared in to the truck.

18. The contractor shall have to use environment friendly biodegradable chemical agents and
    other consumables (the best available quality) along with equipments and accessories to
    ensure comprehensive cleaning. The requirement of Monthly cleaning consumables
    should be preferably kept in Health Inspector's office and the same has to be drawn daily
    as per requirement failing which a penalty shall be imposed.
19. The contractor shall also provide a list of chemicals/cleaning solvents at Annexure E,
    which will be used, along with their specification, composition and quantity for undertaking
    different cleaning activities.
20. It will be obligatory on the part of the contractor to keep adequate fire fighting
    arrangements such as fire buckets filled with water or fire sand/fire extinguishers at the site
    at his own cost against the risk of fire. The contractor shall not be entitled to claim against
    the administration for any loss that the contractor may incur on account of fire, any other
    natural calamities or any other cause. The contractor should take all safety precautions
    while his/her staff works on railway track or at other sensitive areas. The Railway
    Administration shall not be held responsible if the staff employed by the contractor sustains
    any injury or any incidental illness.
21. The contractor shall nominate a representative/Supervisor-in-charge who shall maintain
    liaison with the Health Inspector, Station Manager or other Railway representative at site
    for instruction, clarification etc. regarding carrying out the activities of mechanized cleaning
    properly. He should maintain adequate mobile communication with Railway at all times for
    which he should carry mobile phone at all times and the number of which shall be given to
    Railway administration and Supervisors at site. At no point of time his mobile phone should
    be switched off. He shall keep the daily attendance register of the labours engaged, and
    will ensure proper functioning of machineries and availability of cleaning consumables. He
    shall also fill up the Daily Score Card along with the Railway supervisor at site.
22. The quality of work will be closely monitored and shall be inspected daily/at certain
    frequent intervals by Railway Authorities. The contractor will not employ any unethical
    practices to compromise the quality of work. Contractor or his men will not use any such
    means, which will affect the quality of work and may cause damage to Railway
    property/premises due to such practice, for which contractor will be solely responsible. If
    any such incident takes place and the contractor is found responsible, Railway will reserve
    the right to impose fines and / or terminate the contract immediately.
23. The contractor shall place sufficient number of fire resistant good looking neatly painted
    dustbins (with polythene bags inside) and Spittoons covering all the platforms and other
    utility areas covering the entire station premises. All these dustbins and spittoons should
    be emptied every day at frequent intervals and at no point of time these should overflow or
    give a dirty look. All the dirt, litter, rubbish, garbage and other disposables shall be
    collected, put into thick polythene bags, tied at mouth and carried from the place of
    collection to the dumping yard (nominated place by the corporation/Railway administration)
    by suitable vehicles or miniature battery operated golf carts (making no air and noise
    pollution). All moving trollies/vehicles should have rubberized wheels so as not to cause
    damage to flooring of platforms. Utmost care should be taken to ensure that no spillage of
    the garbage occurs during collection or transit.
24. The railway station premises hence proper cleaning and hygiene shall have to be ensured
    at all points of time without any failure. Tracks shall be kept free from solid waste, muck
    and night soil etc. at all points of time. Proper cleaning after departure of each train using
    adequate chemicals/consumables, disinfecting fluid/detergents or deodorants etc. shall
    have to be ensured to keep the area clean and tidy and free from bad smell. It shall have
    to be ensured that all the station premises are free from dirt, stains, bad smell and
    nuisance at all point of time. All fly proof measures shall be undertaken by ensuring that
    night soil and food materials are not accumulated in the railway tracks and platforms and
    necessary environment friendly chemicals and deodorants shall be sprayed on all the
    railway tracks, platforms and other offices to ensure in avoiding fly nuisance. Necessary

    permitted deodorants and disinfectants should be used in the process of cleaning in all the
    areas in general and without failure in toilets/urinals and track areas. Mosquito repellent
    agents should be used without fail.
25. The contractor shall have to maintain a complaint book in such a way that it is easily
    accessible to any person who wishes to record any complaint and the said book shall be
    open for inspection by the Railway Administration.
26. All the Railway officials shall have free access to inspect the station and the associated
    areas enlisted above in context of monitoring cleanliness. The same shall be perused
    regularly and suitable action shall be taken on the deficiencies reported. In addition, there
    will be periodical inspections by various inspecting officials regarding stock and quality of
    cleaning consumables, working conditions of the machinery, availability of staff etc.
27. The successful tenderer has to supply /replace all the litter bins (both departmental /
    supplied) with polythene covers for easy retrieval of litter on daily basis.
28. The equipments in mechanized system should fulfill the minimum requirement outlined in
    Annexure. The contractor shall keep adequate number of spare machines and equipments
    to ensure proper functioning mechanised cleaning work. All types of consumables required
    for smooth functioning of machines e.g. petrol, lubricant, scrubbing machines, squeezes,
    etc will be arranged by the contractor.
29. The minimum scale of cleaning activities is indicted in Annexure-A, which indicates the
    minimum schedule of cleaning and minimum number of men to be deployed. Any extra
    cleaning if required to keep the premises clean will have to be done at contractor’s cost.
30. The Railway shall provide the successful tenderer free electricity and water for operation of
    equipments and cleaning of premises. The Railway shall make available the storage place
    for keeping equipments, tools etc., but the safety and the security of the machinery shall
    be at the risk of the contractor. In case rent for the space provided to be recovered the
    same will be notified for making such payment.
31. The general scope of Mechanised Cleaning of Bangalore City Railway station is indicted in
    Annexure.
32. The cleaning work shall be carried out during the lean traffic hours irrespective of time. It
    will have to be ensured that no major inconvenience is caused to the passengers. The
    cleaning of tracks including aprons will have to be done only when the tracks are free from
    any train. Washing of tracks with high pressure jets, collection of debris, sweeping and
    scrubbing of platforms and other cleaning activities shall be done as per Annexure. The
    contractor shall supervise the mechanised cleaning work on a continuous basis. The
    contractor has to do the work of collection and disposal of solid waste and cleaning of
    drainage system.
33. Validity: The validity of contract will be for a period of one year.
34. Rate: The rates quoted by tenderer shall be inclusive of cost towards all the taxes like
    sales tax, excise work contract tax etc., as applicable, insurance including third party
    liability , service tax etc.,
35. Apart from the applicability of CL (R & A) Act, the contractors are required to follow the
    provision of all labour laws including, the following enactments basing on the number of
    workers engaged by them, and other factors etc.
    a) Minimum Wages Act
    b) Payment of Wages Act
    c) Building & other constructions Workers (Regulation of Employment and condition of
       Service) Act
    d) Payment of Bonus Act
    e) Equal Remuneration Act
    f) Child Labour (Prohibition & Abolition) Act
    g) Inter State Migrant Workmen Act etc.
    h) Employees State Insurance Act..

36. Payment of wages on the date of its disbursement should be witnessed by authorised
    representative of Principal Employer and shall record under his signature a certificate at
    the end of entries in the Register of Wages. Successful tenderer should submit the
    payment details to Railways for verification every month. Apart from this the Principal
    Employer’s have to ensure the maintenance of the following by the contractor engaged by
    them;-
    a) Registers – required to be maintained under various enactments applicable to them.
    b) Display of required notices, abstracts of the Acts & Rules at the work sport.
    c) Issue of wages slips.
    d) Issue of Employment cards.
    e) Provision of first aid box at work spot.
    f) Provision of welfare facilities at the work spot.
37. Any failure on part of the successful tenderer to implement provisions as per the acts
    mentioned above will be treated as a failure and any strictures/penalty so levied by the
    concerned authorities will be realised from the tenderer.
38. As the work of Mechanised Cleaning of Bangalore City Railway station involves more than
    20 labours, the successful tenderer/firm should be a registered one with the Labour Office
    as per the provisions of the act. In case of successful tenderer is not registered the same
    has to be done within 30 days of issue of Letter of Award.
39. Penalty Clause:
 1. The following penalties will be imposed if the cleanliness is found not up to the mark:
    a) Truck not turning up for collecting of garbage -Rs.1000/-per occasion
    b) Tracks not cleaned as per Annexure - Rs.500/- per track
    c) Platforms not cleaned as per Annexure - Rs.500/- per Platform
    d) Dustbins/litterbins not provided with polythene bags: Each failure – Rs.100/- per dust
         bin per occasion
    e) Litter cleared from platform should not be pushed or thrown on to the track. Violation of
         this will attract a minimum penalty of Rs.1000/- each time it is noticed.
 2. All other penalties:
    a) Failure to carry out other provisions of scope of work as per Annexure including non-
         usage of mechanised equipments.
          The minimum required staff as stated should not be reduced on any account. If the
              number is reduced an approximate cost of Rs.199/- per staff per day or minimum
              wages applicable will be recovered from the bill amount while monthly payments
          A maximum of Rs.500/- per occasion per failure by Supervisors/ Inspectors of
              Medical departments & SMR/SBC.
          A maximum of Rs.5000/- per occasion for failure by officers SrDMO / SrDCM.
          A maximum of Rs.25000/- per occasion for failure by CMS.
          A maximum of Rs.50000/- per occasion for failure by ADRM / DRM.
40. Extension Clause: The period of contract may extend for six months from the date of
    expiry of contract subject to satisfactory performance and the same terms, conditions &
    rate accepted in the tender. But the rider agreement is to be done otherwise payment for
    work will not be entertained.
41. The successful tenderer shall indemnify the Railway Administration against any loss or
    damage to the property of the Railway Administration and/or against any claim under any
    Act in force or any Act that may become enforceable hereafter made by the employees of
    the Railway Administration or         Railway Passengers or any other party for death,
    disablement or injury to the persons or loss of damages to the property etc or due to any
    reason whatsoever arising Out of or in connection with this contract including any
    consumer cases. Any sums paid by the Railway Administration by way of
    compensation/charge/expenses in this connection will be considered reasonable and will
    have to be reimbursed by the Agency to the Administration immediately on demand.

42. The general condition of contract (Works contract of South Western railway ) (GCC) as in
    force for the time being and amended from time to time is applicable to this contract to the
    extent it is not inconsistent with the terms and conditions contained herein or the special
    conditions or the same is repugnant in the context of this contract. The term ‘Engineer’
    wherever appears in the General conditions of contract (Works Contract) of South Western
    Railway (G.C.C) in the context of the present contract may be read as Chief Medical
    Superintendent, Bangalore City and shall include all superior officers of the medical
    department of the South Western Railway”.
43. In the event of any difference of opinion or dispute between the Railway Administration
    and the contractor as to the respective rights and obligations of the parties hereunder as to
    the true intention of condition thereof such difference of opinion shall be referred to the
    arbitration in accordance with the provisions of Clauses 63 and 64 of G.C.C and arbitration
    and conciliation act, 1996 or its statutory modifications, arbitrator appointed by the South
    Western Railway as per the procedures in vogue, shall be final and conclusive and binding
    on both the parties.
44. All disputes are subject to the jurisdiction of Karnataka State High Court or its subordinate
    courts at BANGALORE CITY CITY only. Before approaching the court, the existing internal
    mechanism of arbitration should be explored as a mandate.
45. The successful tenderer shall comply with all the provisions of Contract labour (Regulation
    and Abolition) Act 1970, any subsequent amendments thereof and the rules made there
    under.
46. The contractor is responsible for any damage caused to the Railway property or
    passersby/passengers or to persons who come with contact while fixing the panels and
    also any damage caused by his panels to the Railway property or passersby or to persons
    who come into contract during the period of contract.
47. In case of exigencies, the contractor should deploy additional work force at a short notice.
48. The contractor shall behave in courteous manner with passenger and railway personnel
    and the contractor supervisor / labour need to have cordial and mutual respectful
    relationship.
49. Whenever fish or any perishable items is loaded or is unloaded, that area should be
    washed and disinfected immediately.
50. The Railway Health officials, Health inspectors reserve the right to reject any person found
    unsuitable for the work.
51. HEALTH AND SAFETY STANDARDS:
     a) The service provider shall ensure that the vehicles and equipment used for performing
          the activities envisaged in the contract are cleaned / washed / disinfected at least once
          a week.
     b) The service provider should facilitate regular health checkups of its employees.
     c) The service provider shall provide to persons working on the contract appropriate
          safety gears.
52. The inspecting officer shall have the following powers:
    i) The Mechanised Carrier and all auxiliary and ancillary equipments / tools, submitted for
         inspection, to certify that it is not in accordance with the contract.
    ii) To reject the Mechanised Carrier and all auxiliary and ancillary equipments / tools,
         submitted as not being in accordance with the requirement of the tender document.
    iii) To mark the rejected Mechanised Carrier and all auxiliary and ancillary equipments /
         tools with a rejection mark so that they may be easily identified if re-submitted.
     The inspecting officer’s decision as regards rejection shall be final and binding on the
     contractor.
53. Other Conditions:

     a) The Railway administration does not bind itself to accept lowest or any other tender or
        to give explanation for such action.
     b) The final acceptance of tender rests with the Railway Administration.
     c) Tenderer (s) must not quote any special conditions in their offer, violating which the
        offer is liable to be rejected.
     d) The contractor shall be responsible for diligent performance of the duties of his
        employees and for their conduct and behavior. He shall be solely liable for any injury
        sustained by his employees
     e) The contractor shall not use the name of Railways in any manner either for credit
        arrangements or otherwise and it is agreed that the Railways shall not in any way be
        responsible for the debits, liabilities or obligations of vendor and/or his employees.
     f) The volume of cleaning work and disposal of garbage required to be handled as
        shown in the annexure B & E is approximate and it should be clearly understood that
        this information is furnished to the tenderer without prejudice and without commitment
        on the part of the Railway Administration. The volume of work is likely to fluctuate
        (increase or decrease).
     g) Tenderer (s) should inspect the site of work at the Station and satisfy themselves
        regarding local conditions, nature and volume of work to be dealt with to enable them
        to quote the rate.
     h) Tendered (s) further is/are advised in his/ their own interest to inspect the place of
        work at the station in question to acquaint himself / themselves of local conditions
        applicable.
     i) Tenderer (s) must ensure that the conditions laid down for submission of offers
        detailed in the preceding paras are completely and correctly fulfilled. Tenders which
        are not complete in all respects, as stipulated above, may be summarily rejected.
     j) Regarding quality of cleanliness and imposition of penalty due to non execution of
        work wholly or in part, Railways decision would be final and binding on the contractor.
     k) Contractor shall not in any capacity employ any person of bad character or any person
        whose antecedents have not been investigated by the police and shall issue an
        appointment certificate, which shall contain a photograph of the employee specifying
        the employee’s name, father’s name address and the place at which employed, with
        his/her left/right thumb impression affixed thereon in printer’s ink which he will carry
        with him/her while on duty. The expenses for such verification as is necessary shall be
        borne by the contractor. Contractor will not deploy child labour.
     l) Removal of damaged parcels, goods packages & other perishable goods certified to
        be unfit for human consumption by a Railway Doctor should be dumped at the
        nominated dumping ground by the contractor as and when required by Railway at no
        extra cost.
     m)All the above conditions shall be read in conjunction with the Special Terms and
        Conditions as followed by the Railway’s terms & condition. The above terms will,
        however, override any similar clauses mentioned in the General Terms and Conditions
        applicable on South Western Railway. All the latest General conditions of contract
        issued by Railway Board/ HQ SWR will be binding on both the parties i.e. Railways &
        tenderer/contractor
     n) The contractor shall not subject, assign or transfer this contract or any rights or
        benefits here under to any other person or persons, nor shall the contractor take any
        partners without prior consent of Chief Medical Superintendent, SBC.
54. Execution:
    a) Railway reserves the right to make any changes at any time during the contract period.
        If such changes cause an increase or decrease in contractor’s price an equitable
        variation shall be agreed. Railway Administration’s competent authority (MEDICAL
        Department Officers only) has full power to make any changes/terminate/modification
        in the contract without assigning reasons.

    b) The whole contract is to be executed in the most approved, substantial and
         workmanlike manner to the entire satisfaction of the Railway Administration or its
         nominee, who, both personally and by his deputies, shall be free to inspect the work at
         such times as he may deem fit, and on any question of the true intent and meaning of
         the specification, railways’ decision shall be final and conclusive.
    c) If the Contractor deliberately gives wrong information in his tender or creates
         circumstances for acceptance of his tender, the Railway Administration reserves the
         right to reject such tender and in the case of the successful tenderer to cancel the
         contract at any stage.
    d) The whole contract is to be executed in the most approved, substantial and workman
         like manner to the entire satisfaction of the S.W Railway or his nominee, who, both
         personally and by his deputies shall be free to inspect the work at such times as he
         may deem fit and to thereof, and on any question of the true intent and meaning of the
         specifications and its decision shall be final and conclusive.
    e) A confirmation from the contractor accepting that all the material supplied to be used
         are guaranteed for satisfactory performance for a entire contractual period from the
         date of ensure 100% availability of mechanized system /installation,
    f) If the contractor expires/dies after submission/acceptance of his tender, the South
         Western Railway, Bangalore shall deem such tender as cancelled. If a partner of a firm
         expires after the submission of the tender or after the acceptance of the contract the
         “South Western Railway” shall deem such tender as cancelled unless the firm retains
         its character.
55. The tenderer must submit their credentials along with the tender documents before
    opening of the tender and no document shall be allowed to be submitted after opening of
    tender.
56. Indemnity: The contractor shall at all times indemnify the “South Western Railway” against
    all claims which may be made in respect of the said work for infringement of any right
    protected by patent registration Design or trade mark, provided always that in the event of
    any claim in respect of an alleged breach of patent. Registration or trade mark being made
    against the South Western Railway be shall notify the contractor of the same and the
    contractor shall be at liberty, but at his own expense to conduct negotiation for settlement
    of any litigation that may arise there from.
57. Liability under Workmen’s Compensation Act or otherwise:
      a) The contractor shall all time indemnify the Railway Administration against all claims
         which may be made under the Labour Laws and Workmen’s Compensation Act 1923
         for any statutory modification thereof or rules made there under or otherwise for or in
         respect of any damages or compensation payable in consequence of any accident
         injury sustained by the contractor for any workmen, labourers for any person or
         persons in the employment of the licensee and engaged in the performance of the
         business relating to this license, except Railway employees. The licensee at all times
         shall also take all risk of accident or injury which may cause of failure or the
         performance of the said business arising out of such accidents to such workmen,
         labourers or servants except Railway staff and against all costs and expenses incurred
         by the Railway administration in connection there with and (without prejudice to any
         other means of recovery) the Railway Administration shall be entitled to deduct from
         any money due or become due to the licensee whether under this agreement or any
         other agreement, all moneys paid or payable by the Railway administration by way of
         compensation aforesaid or for cost or expenses in connection with any claim thereto
         and the licensee shall abide by the decision of Railway administration as the sum
         payable by the licensee under the provision of this clause.
      b) The contractor shall note that no compensation due to loss of life or loss of material
         shall be payable by the Railway administration and contractor shall have to pay all the
         claims due as compensation in case of accident, injury to the labourers for whatsoever
         reason.

58. Any damage to the Railway equipments/property caused on account of negligence of
    contractor or his representative shall be recoverable fully from his bill and decision of the
    Railway administration shall be final and binding with the contractor.
59. Water and electricity required for the works will be supplied free of cost by Railways.
    However, in case of any break down in water & Power ensure 100% availability of
    mechanized system Railways is not liable to pay towards any loss incurred by the
    contractor on this account. Necessary space will be provided by Railways free of cost for
    storage of material. However, Railways shall not be responsible for safety of the items.
    The space shall under no circumstances be used for any other purpose.
60. General and Special terms & conditions, work schedule, machines specifications, & related
    details mentioned in tender form will be part of agreement.
61. Any notice to be served on the licensee(s) shall be deemed to be sufficiently served, if
    delivered at his/their registered office or last known place of business in
    …………………………..………………………………………………………………………. .Any
    notice to be served by the contractor licensee(s) of the Railway Administration shall be
    deemed to be sufficiently served, if delivery at the Office of Chief Medical Superintendent,
    Bangalore City or sent by the registered post addressed to the Chief Medical
    Superintendent, Divisional Railway Hospital, South Western Railway Bangalore City.
62. The cleaning activities undertaken by the contractor shall also be evaluated by the
    members of SIG (Services Improvement Group) during its course of inspection of the
    station and their remarks shall be recorded.
63. The minimum wages payable to the labour should be as per the rate prevailing and issued
    by the Central Labour commissioner from time to time under the minimum wages Act. In
    the event of any revision in the labour rate, the same shall be borne by the contractor.

Annexure - A

     GENERAL SCOPE OF WORK AND SERVICES OF MECHANIZED CLEANING OF
                    BANGALORE CITY RAILWAY STATION
1. The contractor has to undertake the cleaning activities in accordance with the scope of
   work specified in Annexure (A to I). The contractor will have to use mechanized cleaning
   systems and other equipments as detailed at Annexure (A to I) for undertaking
   mechanized cleaning services.
2. Availability of consumables and other accessories as specified at Annexure E for running
   of the mechanized system has to be ensured.
3. Thorough cleaning of tracks having washable aprons by picking of garbage and cleaning
   of night soils, muck and other waste materials after departure of each train from the
   adjacent platforms.
4. Cleaning of non-apron areas of tracks involving rag picking, brooming and sprinkling of
   disinfectants and cleaning of night soils, muck and other waste materials after departure of
   each train from the adjacent platforms. As and when non-apron area is converted into
   washable apron, water jet cleaning with high-pressure water jet cleaning machines shall
   have to be undertaken.
5. Rag picking of open track areas and adjacent land on either side of the track of the station
   by scrapping, rag picking, brooming and sprinkling of disinfectants.
6. Using of necessary permitted environment friendly deodorants and disinfectants in the
   process of cleaning in all areas in general and without failure in toilet blocks and track
   areas including drains for avoiding fly nuisance.
7. Cleaning of open and covered drains involving manual and mechanized cleaning of the
   drains using the drainage cleaning machines with the help of safaiwalas. The silt to be
   removed to the nearest garbage clearing point.
8. Removal of stains from water booths and cleaning and declogging by using chemicals and
   disinfecting fluid and disposal of wastes collected from the underneath of the washbasins.
9. Removal of bird droppings, stains and cobwebs from the roofs and corners of PF sheds, all
   service buildings including corridor, staircase, FOB, Subway, and Concourse etc. both
   manually and mechanized devices as per requirement.
10. Removal of stains/spitting marks from the walls of platforms, Concourse area, service
    buildings, corridors and staircase using chemicals and disinfectants.
11. Maintenance of gardens by watering the plants, picking of garbage, and cutting of
    unwanted bushes from inside.
12. The mechanized cleaning and maintenance of Bangalore City railway station requires
    provision of mechanized systems and other equipments as per Annexure (C & D). The
    contractor shall guard the mechanized systems against theft and sabotage. The Railway
    shall not be responsible for loss or damage of the mechanized systems either during the
    operation or in store. However, the Railway shall have the right to inspect these as and
    when required.
13. It is the responsibility of the contractor to ensure safety of the railway property while using
    the machineries and in case of any damage the same has to be
    rectified/repaired/replaced, as the case may be, at his own cost.
14. The contractor must hold the license from the State Government for Labour License
    or any other License required from State/Central Government.
15. During platform cleaning garbage and litter should be swept and lifted from platform itself
    and at no point of time the sweeping should be thrown on to the track.

16. The contractor will engage requisite no. of skilled staff (machine operators) and
    supervisors for round the clock execution and supervision of the cleaning activities, who
    will work in the train passing areas and other sensitive areas only with the consent of
    authorized railway supervisors at site. He should also ensure deployment of supervisors
    round the clock at station one supervisor In-charge i.e. one for each shift to supervise the
    track area, platform, Service Building, circulating areas and disposal of garbage & Rag
    picking work.
17. The contactor shall personally and exclusively supervise the work so as to ensure that the
    services rendered are as per the guidelines and to the satisfaction of the Railway
    Administration.
18. The contractor must provide fire resistant good looking 120 dustbins at different areas of
    the station in consultation with the railway supervisors at site. All the dustbins should be
    lined with polythene bags at frequent intervals. As soon as the dustbins are filled with
    garbage / litter, these should be emptied by picking up the polythene bags along with the
    garbage, these should be tied at the mouth and taken away. All these dustbins and
    spittoons should be emptied every day at fixed frequent intervals also and at no point of
    time these should overflow or give a dirty look. All the rubbish, garbage and disposables
    shall be collected, put into thick polythene bags, tied at the mouth and carried from the
    place of collection to the dumping yard by pushcarts or any other suitable vehicles. Utmost
    care should be taken to ensure that no spillage of the garbage occurs during collection or
    transit. Under no circumstances, the used polythene bags should be re-used.
19. The garbage/waste materials collected shall have to be dumped at nominated place
    (earmarked place by the Municipal Corporation) after due permission of the Corporation.
    The cost of such is to be borne by the contractor. Plastic scrap and biodegradable
    materials have to be separated before clearance.
20. The contractor must provide uniforms with distinctive logo and identifications, caps,
    shoes/gum boots, hand gloves and goggles etc. to all its workers/machine operators.
21. Available of consumables such as Brush, Brooms, Rubber skirts, Gaskets, filters and
    rubber hose, lubricating oil for running of these mechanized system has to be ensured
22. The Dry cleaning of platforms, FOB, Subway, Offices, waiting hall, main hall, reservation
    office, booking office and other such areas involve picking up of garbage and cleaning with
    the help of mechanized sweeper.
23. Wet cleaning of PF, FOB, Subway, Offices, waiting hall, main hall, reservation office,
    booking office and other such areas etc., will involve picking of garbage, wet cleaning of
    the surface using the scrubber drier.
24. Mechanised Cleaning of Retiring room involve wet cleaning on daily basis and also
    immediately after vacation by occupants.
25. Wet cleaning of all toilets is to be done on continuous basis at least twice a day using high
    pressure water jet machine with adequate quantity of disinfectants toilet cleaning
    materials.
26. All furniture, sofas, carpets, show piece, glass surface etc., should be vacuum cleaned
    once every day. These items should be wet cleaned using suitable sprays with the help of
    wet and dry cleaning vacuum cleaner once a month.
27. Removal of cobwebs from ceiling of platform shelters, concourse hall, waiting halls,
    Retiring rooms, Reservation office, luggage office, parcel office etc., on regular basis.
28. The curtains, jalees of window, grills etc., should be cleaned once a week using the wet
    and dry vacuum cleaner.
29. Dry cleaning of tracks involve manual cleaning of the track and picking of all garbage

30. Wet cleaning of tracks involves manual cleaning of the track and aprons using high
    pressure water jet machine, chemicals and disinfectants.
31. Cleaning of open and covered drains involve manual and mechanical cleaning of the
    drains using the drainage cleaning machine and with the help of Safaiwalas. The silt will be
    removed to nearest garbage collection point.
32. Any special cleaning work required at station or within the circulating area required by the
    Railway Administration to be attended by the contractor.
33. Railways shall not be responsible for damages done on the mechanized system either
    during the operation or in store. The contractor shall guard the mechanized systems
    against theft and sabotage. It is the responsibility of the contractor to ensure safety to the
    railway property while using the machinery & in case of any damage the same has to be
    rectified/ replaced as the case may be.
34. Cleaning is an ongoing process. The contractor has to ensure and take up complete
    cleaning and maintenance of the station and associated areas as indicated in the schedule
    of services and scope of work and maintain hygiene at stations. He must attend the areas
    promptly when found dirty or as reported by Railway Officials or other Rail Users at any
    point of time. It shall have to be ensured that all the station premises are free from
    garbage, rags, dirt, stains, bad smell and nuisance at any point of time, so that any
    area/place of the station premises at any time may be visible neat and clean.

A minimum of 100 laborers, 20 Machine operators & 10 Supervisors are to be utilized in three
shifts. The above is only the minimum requirement. The contractor has to however quote for
complete cleaning of the station and associated areas as indicated in schedule of services and
scope of work and therefore, if additional manpower is required to ensure cleanliness, the same
would be provided within the tendered cost without any extra charge. Similarly requirement of
labour given is also minimum and in case Contractor has to deploy more labour’s to ensure
cleaning as per scope of services, he would undertake the same. Picking of papers and litter shall
be on continuous basis as and when required. Plastic scrap and biodegradable materials have to
be separated before clearance.

Note:
Machinery/Vehicles used for garbage clearance should not cause air, visual and Noise pollution.
Number of machinery may be increased in case of requirement and type of machinery may be
changed if it is felt essential.
All dustbins both departmentally & tenderer supplied should be inlaid with polythene covers for easy
removal of collected litters. Garbage should be cleared from each dustbins as and when required to
avoid overflowing / unsightly appearance. The dustbins are to be kept clean by scrubbing and
washing regularly

7. manual sweeper for a platform & concourse area:
          The walk behind sweeper shall be fuming free machine ideal for sweeping small and large area of
           Railway station. This machine should have a main broom, a hopper and a flexible side brush.
          The mechanized system should have a hoper capacity of min. 40 liters and shall be able to sweep of
           minimum of 2000 sq.meters./hour.
          The mechanized system should have a flexible side brush, which pulls side debris away from walls,
           curbs and counters and cleans even hard to reach corners and crevices, which hide dirt. It can be
           raised when not needed.
          The mechanized system should have the enclosed broom chamber, the rubber skirt around the
           hopper, the main brush and the high efficiency filter ensures that only clear clean air is discharged as
           exhaust.
          The mechanized system should have comfortable handle and large wheels. It should be lightweight
           and sturdy, making it easy to maneuver around even congested areas.

     Annexure- H

 Garbage collection and disposal:

 1. SCOPE OF WORK: The Contractor shall undertake the work for daily collection of garbage from
    Bangalore City Railway Station and final disposal to the nominated dumping ground of Bruhath
    Bangalore Mahanagara Palike (BBMP) by engaging a Mechanised carrier along with Driver, Fuel,
    Labour, equipments, etc., required for the same, for a period of one year. The scope of services
    will be as specified in the work schedule. The scope of work as mentioned is only indicative and
    not exhaustive in any respect.
 2. WORK SCHEDULE: The Conservancy contractual work shall be carried out in the frequency
    preferably without affecting the movement of colony residents and vehicles. The work shall also be
    done on a daily basis. Chief Health Inspector of the respective areas or his nominated
    representative of the Railways shall be responsible for daily inspection and supervision of this work
    and for certifying the quantum and quality of work done by recording the same in the log book for
    purposes of payment of the Contractors bills.
 3. QUANTITY: Accumulated Garbage / Refuse along with debris, muck should be completely
    removed and disposed every day. The quantities entered into” QUANTITY” column of the
    Schedule of Work are only approximate and the President of India acting through Chief Medical
    Superintendent, Bangalore City, does not bind himself to give into the whole or any of the quantity
    or enumerated in the schedule nor does not guarantee that the quantities will be evenly distributed
    throughout the period or any part thereof.
 4. RATE: The rates quoted are inclusive of the following.
     a. Cost of Hiring of the mechanized carrier and cost of its operation.
     b. Cost of all auxiliary and ancillary equipments, consumables for the mechanized carrier and all
         operations for completing the job.
     c. Cost of all maintenance of the mechanized carrier.
     d. Cost of consumables required for conservancy work i.e., labour, tools, tackles and
         Supervision.
     e. Cost of Collection of garbage including all solid waste, muck & debris etc., and finally
         transportation & dumping of these garbage / waste materials / at the nominated places in the
         municipal area of BBMP at Bangalore City.
     f. All taxes and levies etc. such as sales tax, excise duty / CST, works contract tax, income tax
         and VAT, etc. as applicable, as well as insurance, including third party liability, Service tax will
         also be borne by the contactor.
 5. VEHICLE: The Service provider shall provide Mechanised carriers for implementation of the
    contract as per the following specifications
     a) One Tipper Lorry is to be provided.
     b) The tenderer should have the ownership / term lease of the One Tipper Lorry. The period of
         lease shall be for at least 12 months from the date of submission of this bid. The tenderer shall
         furnish the details of ownership / term lease of the tipper Lorries.
     c) The capacity of the Tipper Lorries shall be of at least 375 Cft.
     d) The tipper Lorries has to be modified with MS sheets and angle so as to suit to suit to carry
         garbage and they shall meet emission norms as per the extant rules.
 6. Transportation of Refuse / Garbage for final disposal to the nominated dumping area of Bruhath
    Bangalore Mahanagara Palike during the day time, as per the directions given by the concerned
    authorities.
 7. The contractor shall supply mechanized Carrier strictly as detailed in the schedule of work for
    collection and disposal of garbage.
 8. The contractor shall supply all consumables required for running of the mechanized Carrier.
 9. The contractor shall provide regular maintenance of the mechanized carrier to be utilized for this
    contract and ensure 100% availability of the same in all the days. If required, stand by mechanized
    carrier should be available for uninterrupted service.
10. The use of mechanized carrier and the work should be carried out in such a manner that it will not
    affect the movement of the colony residents / vehicles.

11. The contractor shall arrange all equipment, Tools & Plants, Consumables, etc., at his own cost for
    operating the mechanized carrier to undertake the above schedule of work. Materials required for
    the execution of the work will have to be carried at the public rates and no Concessional Rate of
    Railway Freight is applicable.
12. The contractor shall be responsible for maintenance of equipment / machineries supplied by him.
    Railway Administration is not liable to pay any extra charge for this purpose.
13. The Mechanised Carrier along with Driver, Labour, Fuel, tools & tackles, equipments and
    consumables etc., required for the contractual work will be supplied by the contractor.
14. The Mechanised Carrier should report daily at the office of the CHI, at 06-00 Hrs, and perform the
    work between 06-00 Hrs, to 17-00 Hrs.
15. The work will be carried out on a daily basis to a fixed programme approved by the Railway. The
    method and system of carrying out the works will be prescribed to the official in charge of the work
    or his representative.
16. Anti fly & Anti Larval measures should invariably be undertaken in and around the dust bins and
    other places of garbage heaps after disposal of the garbage.
17. All labour must be provided with distinct uniforms as approved by the Railways at the contractor‘s
    own cost.
18. All laborers are to be supplied soap daily for washing at the cost of contractors.
19. Name badges, duly authenticated by the CHI / SBC have to be prominently displayed by the
    labour. Cost of such incurrence would be borne by the contractor and no extra cost would be paid
    by the Railway.
20. Contractor has to keep their tools and plants and machineries in their own custody. Theft or any
    unusual occurrence will be the full responsibility of the contractor.
21. Contractor has to submit a ‘no claims certificate’ every month.
22. In case of increase of quantity of work during the Special Occasion / Festivals, Rallies, Visit of
    VVIPs, other natural calamities, etc., extra payment will be made as per the actuals after
    certification from the respective HI / CHI or any other nominated Railway Official duly
    countersigned by Sr.DMO (H&FW).
23. Apart from routine cleaning and maintenance work detailed in scope of work, some occasional
    work like removal of animal dead bodies / carcass, etc. from within the Railway colony premises to
    the nominated areas, will also have to be done.
24. During inspections, on receipt of complaints about non-execution of the quantity of work, the areas
    identified have to be attended at once for which no extra payments would be made by the
    Railways.
25. Contractor shall not in any capacity employ any person of bad character or any person whose
    antecedents have not been investigated by the police and shall issue an appointment certificate,
    which shall contain a photograph of the employee specifying the employee’s name, fathers name,
    address and the place at which employed, with / his/ her left / right hand thumb impression affixed
    thereon in printers ink which he will carry with him / her while on duty. The expenses for such
    verification as is necessary shall be borne by the contractor.
26. Contractors should comply with all the obligations (have general insurance policy or ESI for their
    labour engaged for this work), as per the extant labour laws / rules, in respect of labour engaged
    for this work.
27. The contractor shall be responsible for availability, serviceability and maintenance, of the
    mechanized carrier. This mechanized carrier should be dedicated to this contract and cannot be
    taken out for any other job.
28. Railway authorities or its nominated representative will supervise the work on daily basis and a
    record will be maintained for the work completed. The contractor will be penalized for the quantity
    of work not done or if the quality of work is of substandard specifications.
29. The Contractor has to register initially with the Greater Bangalore City Municipal Corporation
    (BBMP) for the above work, for the purpose of dumping garbage at nominated dumping grounds of
    BBMP.
30. The garbage meant for transport shall be provided with closed doors and tight lids over top to avoid
    exposure and spill, etc.

31. The vehicle that visit the dumping yard shall be subjected to inspection by the official / officer kept
    In charge of dumping yard to accord approval of emptying.
32. Any Hazards materials in the garbage shall not be transported for disposal to the dumping yard
    except with proper treatment to render it from infection.
33. Hire charges and running expenses for machineries and plants if supplied by the Railways shall be
    borne by the contractor and the same shall be deducted from his / their dues.
34. The contractor/firm has to comply with The Karnataka Pollution Control Board Norms and the
    labour laws in force like Minimum Wages Act, Employment of Children’s Act, Hours of Employment
    Regulation’s, Work Man’s Compensation Act, Provident Fund, Employee State Insurance, Bonus
    etc. and all such laws in force from time to time as applicable to this contract.
35. Precautions to be taken while plying of vehicles adjacent to running lines to prevent accident to
    trains
    a. No Contractor's Lorries or road vehicles shall be operated so as to affect the safety of trains.
        They should work well outside the moving dimensions
    b. Road vehicles employed by the contractor should have the certificate for its road worthiness and
        each vehicle numbered and the license particulars maintained. Contractors should ensure that
        the drivers permitted by them to work on such road vehicles are identified counseled, certified
        and are provided with photo Identity cards.
    c. Wherever the work requires the movement of road vehicle within a distance of 3.5 to 6m from
        the centre line of the nearest track, such work shall be done only in the presence of Railway
        employees authorised by the Engineer-in-charge
    d. The driver of the vehicle shall always face the track when reversing the vehicle and whenever
        he cannot face the track, for whatever reason, he shall be invariably assisted by a helper with a
        whistle who should guide him and ensure safety
    e. The contractor shall also be bound by the provisions of this agreement to ply the road vehicles
        only with adequate margin of safety, well clear of the fixed structure profile of infringements, as
        stipulated in the rules made under the Indian Railways Act and to seek and be guided by the
        signals and other directions of any lookout men or other personnel retained for the purpose of
        ensuring safety and to ensure extra care and vigilance while turning, reversing or moving the
        road vehicles in any other manner at an inclination to the running railway track or the siding as
        the case may be. The contractor shall employ necessary look out men also at his own cost,
        irrespective of any other arrangement that railway may make in this regard
    f. Any breach of these conditions by the contractor and/or his agents affecting the safety of
        movement of trains, engines, or other rolling stock of the Railway, shall constitute a breach of
        contract by the contractor entailing liability for termination of contract for default on the part of
        the contractor
    g. The contractor shall be fully responsible for ensuring safety at all times and shall bear the cost
        of all damages in cases of accidents/unusual occurrences resulting in damages to Railway
        property and passengers.

36. The Railway administration has the liberty to draft the contractor’s vehicles and equipments on use
    in case any accident/natural calamities involving in human lives.
