Duplicate questions were received. Read all the questions and responses that follow. Your question may
 not appear precisely as you wrote it but is contained by similar content from another potential contractor
                                  and addressed by the Government.

                                  Since all on-site construction activities must occur during the dry, low-
         Questions/               flow season from 1 August through 31 October we interpret that to

                                  2011. Please verify.
                                  1. Answer will require CES to change the note on the plan sheets that
                                  addresses this construction restriction. The note on the plans is too
                                  restrictive, since the limitation is only on work below the ordinary high
                                  water level outside of the stated dates. Additionally, work must be
                                  done by the end of the calendar year in order to meet the bona fide
                                  need rule.
                                  REVISION: some work must be completed to meet bona fide need.
  1                               The type of work that must be started and how much needs to be
                                  completed within 90 days after October 1 in order to meet the bona
                                  fide need rule will need to be determined by contracting, but there is
         Government               some work that can be performed outside the ordinary high water line

                                  The new note reads:
                                  “CONSTRUCTION ACTIVITIES BELOW THE ORDINARY HIGH
                                  WATER LINE MUST OCCUR DURING A DRY/LOW FLOW PERIOD
                                  OR BETWEEN 15 JULY THROUGH 15 SEPTEMBER. IN ADDITION,
                                  FOLLOW GUIDELINES AND RESTRICTIONS STATED IN THE
                                  JARPA PERMIT PROVIDED BY THE GOVERNMENT.”

                                  Also revised was one of the sheets to remove a straw bale barrier that
