 This monthly Bulletin is a service of Construction EcoServices, LLC. It is provided to inform our clients and friends of new
  regulatory developments and new ideas in storm water pollution prevention, and is aimed at those members of your
          organization involved in Estimating, Project Management, Operations and Corporate Management.

                                      IT’S H ER E
THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY (TCEQ) WILL ISSUE THE TEXAS POLLUTANT DISCHARGE
ELIMINATION SYSTEM (TPDES) CONSTRUCTION GENERAL PERMIT ON MARCH 5TH., REPLACING THE EPA’S
NPDES PROGRAM. ARE YOU PREPARED TO BE IN COMPLIANCE ON MARCH 10TH WHEN TPDES TAKES EFFECT?
HERE’S A BRIEF SUMMARY OF THE KEY STEPS TO COMPLIANCE ON BOTH PHASE I (5 ACRES AND LARGER), AND
PHASE II (1–5 ACRE) PROJECTS, EVEN THOSE ALREADY UNDER WAY. NEW REQUIREMENTS, I.E., THOSE THAT ARE
IN ADDITION TO, OR DIFFERENT FROM THE PREVIOUS EPA REQUIREMENTS ARE HIGHLIGHTED

          PHASE I CONSTRUCTION SITES WHICH DISTURB FIVE ACRES OR MORE
          ■       File a new NOI with the TCEQ. If you are in a position to stabilize your
                  site and file an NOT with the EPA prior to June 10th (90 days after the
                  Texas system is implemented), you can avoid this step, otherwise you must
                  file a new NOI.
          ■       Pay the $100 NOI fee.
          ■       Have an SWPPP written and implemented
          ■       Make, record and maintain records on your SWPPP inspections and
                  modifications
          ■       Post a TCEQ job site notice.
          ■       Notify the local MS-4 in which your site is located, that your project is
                  underway.
          PHASE II CONSTRUCTION SITES WHICH DISTURB BETWEEN 1 AND 5 ACRES (PHASE II)
          ■        Post a TCEQ job site notice
          ■        Have an SWPPP written and implemented.
          ■        Make, record and maintain records on your SWPPP inspections and
                   modifications
          ■        Notify the local MS-4 in which your site is located that your project is
                   underway.
NOTE THAT NO NOI FILING OR FILING FEE ARE NECESSARY FOR PHASE II SITES. BEYOND THOSE TWO ELEMENTS,
PHASE II SITES ARE SUBJECT TO ALL OF THE SAME REQUIREMENTS THAT WERE PREVIOUSLY APPLICABLE ONLY TO
SITES OF 5 ACRES OR MORE.
