ELECTRONIC COMMUNICATION AND DATA MANAGEMENT


AVAILABILITY OF            Access to the District’s electronic communication and data
ACCESS                     management systems, including without limit, its telephone system,
                           computer networks, electronic mail systems, videoconferencing
                           systems, and its Internet and intranet access capabilities, shall be made
                           available to students and employees primarily for educational and
                           administrative purposes. Limited personal use of the system shall be
                           permitted if the use:

                           1. imposes no tangible cost on the District;
                           2. does not unduly burden the District’s computer or network
                              resources;
                           3. does not interfere with the employee’s job performance or the
                              student’s academic performance;
                           4. has no for profit commercial use;
                           5. is not for the purpose of political campaigning, or religious
                              worship, or proselytizing; and
                           6. does not otherwise violate the District’s policies or federal, state, or
                              local law.

                           The District reserves the right to use the District’s electronic and data
                           management system for purposes as it sees fit.

USE BY THE                 Access to the District’s electronic communication and data
MEMBERS OF THE             management systems, including without limit, its telephone system,

                           systems, and its Internet and intranet access capabilities, shall also be
                           made available to members of the public, in accordance with applicable
                           administrative regulations. Such use may be permitted so long as the
                           use:

                           1. imposes no measurable cost on the District; and
                           2. does not unduly burden the District’s computer or network
                              resources.

                           Members of the public who are granted access shall be required to
                           comply with all District rules, regulations, and policies governing
                           appropriate use of the system.

ACCEPTABLE USE             The Superintendent or designee shall develop and implement
                           administrative regulations, guidelines, and user agreements, consistent
                           with the purposes and mission of the District and applicable law as
                           necessary to administer this policy. [See CQ (REGULATION)- TOG 2,
                           Electronic Communication and Data Management Acceptable Use Plan
                           (AUP)]

                           Access to the District’s electronic communication and data
                           management systems is a privilege, not a right. All users shall be
                           required to acknowledge receipt and understanding of all administrative
                           regulations governing use of the system and shall agree in writing to
                           comply with any regulations and guidelines as a condition of system
                           access. The District reserves the right to monitor all activity on its
                           electronic communication and data management systems.

                           The District expects that all users will transmit information only in an
                           appropriate and responsible manner. Any display or transmission of
                           sexually explicit images, messages, or cartoons, or any use of the
                           electronic communications systems that contains ethnic or racial slurs
                           or epithets, or any material that might be construed as harassing or
                           disparaging of others on the grounds of race, national origin, sex, age,
                           religion, or disability violates this policy and is strictly prohibited.

                           Standards of student and employee conduct as stated in the existing
                           Student Code of Conduct, Employee Handbook, and Board Policies
                           apply to all on-line activity.

CONFIDENTIALITY            Information transmitted via the District’s electronic communication
OF INFORMATION             and data management systems is considered confidential District
                           information and may not be disclosed to persons other than the
                           intended recipient without prior authorization. Users must closely
                           monitor their system passwords. In order to maintain the integrity of
                           the District’s electronic communication and data management systems,
                           users should not disclose their passwords to any other person. No user
                           should attempt to gain access to another user’s electronic mailbox,
                           telephone voicemail box, computer files, or Internet account unless
                           expressly authorized to do so by the user whose systems are being
                           accessed, or by an authorized representative of the District. Any user
                           who receives information such as electronic mail messages in error
                           should not read the message, but should instead return the message to
                           the sender. Unauthorized access or attempts to access the District’s
                           electronic communication and data management systems are strictly
                           prohibited and will result in appropriate disciplinary action.

MONITORED USE              Electronic mail transmissions and other use of the electronic
                           communication and data management systems by students and
                           employees are not private and may be monitored, reviewed, audited,
                           intercepted, accessed, or disclosed at any time by designated District
                           staff to ensure appropriate use.

OWNERSHIP OF               The District retains all rights and ownership to all programs, data,
INTELLECTUAL               materials, and electronic works created by District employees.
PROPERTY
                           Users of the District’s electronic communication and data management
                           system shall not send (upload) or receive (download) copyrighted
                           materials, trade secrets, proprietary information, software programs, or
                           similar materials except as authorized by the system administrator or
                           designee.

                           System users may not redistribute copyrighted programs or data except
                           with the written permission of the copyright holder or designee unless
                           permitted by the doctrine of fair use.

DISCLAIMER OF              The District shall not be liable for users’ inappropriate use of electronic
LIABILITY                  communications resources or violations of copyright restrictions or
                           other laws, users’ mistakes or negligence, and costs incurred by users.
                           The District shall not be responsible for ensuring the accuracy, age
                           appropriateness, or usability of any information found on the Internet.
                           No warranties of any kind are offered either expressed or implied.

VIOLATIONS/                Non-compliance with this policy may result in suspension of access or
SANCTIONS                  termination of privileges and other disciplinary action consistent with
                           Board policies and state law. [See the Employee Handbook and the
                           Student Code of Conduct, Categories I and II, and Board Policies DH,
                           FN series, and FO series.] Violations of law may result in criminal
                           prosecution as well as disciplinary action by the District. Persons
                           whose violations of this policy result in system disruption or damage
                           may be responsible for reimbursement of costs incurred in system
                           restoration.
