NOTICE INVITING TENDERS
The Institute of Chartered Accountants of India invites sealed bids from the qualified and reputed
Architects possessing the desired qualification and experience for rendering Project Management
Consultancy services, Architectural services and Allied service for the completion of the civil work of
the construction of the ‘ICAI BHAWAN’ at Shiv Vally, Nokha Road, Bikaner on a plot of area
7383.75 sq ft. Interested Architects may collect the tender form from our Bikaner branch office on
above mentioned address or may download the details from ICAI website www.icaibkn.org. The cost
of the tender documents Rs. 1000/- (Rupees One Thousand Only) in the form of demand draft/pay
order drawn in favour of “Bikaner Branch of CIRC of Account-Land & Building”. The last date of
submission of dully filled in tender is on or before 26/09/2012 up to 4.00 pm at Branch address as

Having examined the Tender Documents, we, M/s_______________________, offer our proposals for
rendering Project Management Consultancy services, Architectural services and Allied service for the
completion of the civil work of the construction of the ‘ICAI BHAWAN’ at Shiv Vally, Nokha Road,
Bikaner and are in full conformity with the said Tender document. We have read the provisions of Tender
documents and confirm that these are acceptable to us. We further declare that additional conditions,
variations, deviations, if any, found in our proposal shall not be given effect to.
I/We herewith deposit demand draft/pay order (minimum validity of 3 months) of Rs. 10000/- (Rupees
Ten Thousands Only) from Nationalised Bank drawn in favour of “Bikaner Branch of CIRC of
Account-Land & Building” as Earnest Money Deposit for the due execution of the works at my/our
tendered rates, together with any variations should the work be awarded to me/us.
In the event of this tender being accepted, I/We agree to enter into and execute the necessary Agreement
required by you. I/We do hereby bind myself/ourselves to forfeit the aforesaid Earnest Money deposit of
Rs. 10000/-(Rupees Ten Thousands Only) in the event of our refusal or delay in signing the Agreement.
I/We further agree to abide by the terms and conditions as stipulated in the tender documents.

Further I/We agree upon as below:
1] I/We, the undersigned, hereby offer to undertake the cited work at the respective rates quoted
by me/us in the financial bid in strict accordance with the contract conditions and instructions
issued / to be issued by ICAI and / or their representatives, from time to time.
2] I/We agree that this tender shall remain open for acceptance for 60 days from the last date for
submission of the tenders.
3] I/We undertake to render Project Management Consultancy services, Architectural services
and Allied service for the completion of the civil work of the construction of the ‘ICAI
BHAWAN’at Siv Vally, Nokha Road, Bikaner, as required by ICAI from time to time, within
the stipulated period as mentioned in the tender documents.
4] I/We further agree that within seven days of issue of intimation of acceptance of my/our
tender, I/We shall be bound to execute the Agreement in accordance with the draft agreement.
I/We also agree that the written intimation of acceptance by ICAI in this regard, shall
constitute a binding agreement between ICAI and me/us, whether such formal Agreement is or
is not subsequently entered into. I/We also agree that our contract shall stand cancelled and
also you shall be at liberty to forfeit the Earnest Money Deposit in case I/We do not undertake
the assigned work within 15 days of intimation of acceptance of my tender.
5] I/We shall not assign the contract nor shall I/We sublet any portion of the contract, except with
ICAI written consent.
6] I / We accept that you are neither bound to accept the lowest tender nor bound to assign any
reason for rejecting or returning of my / our Tender.

For the purpose of this tender / contract, unless there is anything repugnant in the subject or
context, the following terms shall have the meanings as defined against each.
1. “Architect” means the successful Bidder entering into contract with the ICAI.
2. “Bid” means the offer submitted by the Bidder in response to this tender Document.
3. “Bidder” or “Tenderer” means the company/ firm or group of companies/ firms (consortium
with one company/ firm acting as lead company/ firm) engaged in the business of providing
the Project Management Consultancy services, Architectural services and Allied service.
4. “Contract” means the Contract to be entered into between the Institute of Chartered
Accountants of India (ICAI) and successful Bidder and all attached exhibits and documents
referred to therein and all terms and conditions thereof together with any subsequent
modifications, addenda thereto.
5. “Contract Documents” shall include the Notice Inviting tenders, the Eligibility conditions, the
Articles of Agreement, the General Conditions of Contract, the Appendices, the Priced
Quotation, Job description, and requirements pertaining to the Project Management
Consultancy services, Architectural services and Allied service and any addenda thereto. All
sections of this Contract Document are to be read together. Further such correspondence
between the ICAI and bidder as admitted by the ICAI before award of work and thereafter
shall also form part of contract documents.
6. “Requirements” shall mean the requirements referred to in the “Scope of work” and any
modifications of such requirements approved in writing by the ICAI officials and such other
requirements as may from time to time be furnished or approved in writing by ICAI officials.
a) “GCC” means the General Conditions of Contract for Bidding.
b) “ICAI” means the Institute of Chartered Accountants of India.
c) “ITB”: shall mean Instructions to Bidders.
d) “Law" or "Legislation": - shall mean any Act, notification, bye-laws, rules and regulations,
directive, ordinance, order or instruction having the force of law enacted or issued by the
Government of India or State Government or Regulatory Authority or instrumentalities their.
e) “Notice in writing” or written notice shall mean a notice in writing, typed or printed
characters, sent by the ICAI (unless delivered personally or otherwise) proved to have been
received by registered post to the last known private or business address or registered office of
the Architect and shall be deemed to have been received by them when in the ordinary course
of post it would have been delivered.
f) “NIB” means Notice Inviting Bids.
g) “Party” means ICAI or Bidder individually and “Parties” shall mean ICAI and Bidder
h) “Security Deposit” shall mean the interest free, refundable and replenishable security deposit
provided by the Vendor/Tenderer to ICAI
i) Words importing persons include firms and Corporations, words importing the singular only
also include the plural and vice versa where the context requires.
INSTRUCTIONS TO BIDDERS
1.0 TENDER DOCUMENTS, CLARIFICATION AND ADDENDUM
1.1 TENDER DOCUMENT
1.1.1 One set of Tender Documents will be issued. Bidder shall submit the Tender Documents duly
signed and stamped on each page of tender in token of his acceptance along with his bid.
1.1.2 Transfer of Tender documents issued by one intending bidder to another is not permissible.
1.1.3 Bid shall remain valid for 60 days from the date of submission of Bid.
1.2 CLARIFICATION REQUESTS BY BIDDER
1.2.1 Although the details presented in this Tender Documents consisting of conditions of contract
and scope of work, technical specifications have been compiled with all reasonable care, it is
the Bidder’s responsibility to ensure that the information provided is adequate and

1.2.3 Any failure by Bidder to comply with the aforesaid requirement shall not absolve the Bidder
from liability, after subsequent award of contract, from performing the work in accordance
with the tender Documents.
1.3 AMENDMENT OF TENDER DOCUMENT
1.3.1 ICAI may, for any reason whether at his own initiative or in response to the clarification
requested by the prospective Bidder, issue amendment in the form of addendum during the
Bidding period and subsequent to receiving the bids. Any addendum thus issued shall become
part of Bidding document and Bidder shall submit ‘original’ addendum duly signed and
stamped in token of his acceptance.
1.3.2 For addendum issued during the Bidding period, Bidder shall consider the impact in his Bid.
For addendum issued subsequent to receiving the Bids, Bidder shall follow the instructions
issued along with addendum with regard to submission of impact on quoted price/revised price,
1.4 CONFIDENTIALITY OF DOCUMENT
1.4.1 Bidder shall treat the Bidding document and contents thereof as confidential.
2.0 EARNEST MONEY DEPOSIT
2.1 The bid must be accompanied by earnest money deposit (interest free) for the amount indicated
in ‘Notice Inviting Tender’ in the form of a Demand Draft drawn on any
Nationalized/Scheduled Bank in favour of ICAI payable at Bikaner.
2.2 If the bidder, after submission, revokes his bid or modifies the terms and conditions thereof
during the validity of his bid except where ICAI has given opportunity to do so, the earnest
money deposit submitted by Bidder shall, in such case, be forfeited.
2.3 ICAI may at any time cancel or withdraw the invitation to bid without assigning any reason
and the earnest money deposit submitted by Bidder shall in such case be refunded to him.
3.1 The Price shall be read in conjunction with all other sections of Tender documents.
3.2 The rates quoted by the bidder shall be firm and fixed for the completion period of the tendered
works, unless stated otherwise. The rates quoted by the Bidder shall include all taxes, duties &
levies including Service Tax and any cess thereon.
3.3 Rates must be filled in format for ‘Price Bid’ enclosed as part of Tender document. If quoted in
separate typed sheets and any variation in description is noticed, the bid is liable to be rejected.
In any case bidder shall be presumed to have quoted against the whole scope of work and the
same shall be binding on the bidder.
3.4 In case any activity though specifically not covered in scope of work but is required to
complete the work, the quoted rates shall be deemed to be inclusive of cost incurred for such

Architect under the scope of work.
3.6 Rates quoted shall be in Indian Rupees Only.
3.7 Bidder shall quote rates both in figures as well as in words.
4.0 DOCUMENTS COMPRISING THE BID
4.1 Bidder is advised that ICAI intends to fully evaluate the technical and commercial

his Bid. If the information with regard to resources and concurrent commitments or any other
information / documentation forming basis of evaluation is found incomplete / incorrect the
same may be considered adequate ground for rejection of the bid.
4.3 Bidder shall arrange his bid in the following order:
i) PART-I TECHNICAL PART (BID)
Technical part shall comprise the attachments, specifying attachment number arranged in the
order as follows:
a) Declaration letter along with Tender document, Earnest Money Deposit and its details,

b) Composition of the firm – Full particulars (whether bidder is an individual, or a partnership
firm, or a company etc.) of the composition of the firm of contractors in detail should be
submitted along with name(s) and address(es) of the partners, copy of the Articles of
Association /Power of Attorney/any other relevant document.
c) Work experience & completion of similar works during the specified period – Copies of
the detailed work orders indicating date of award, value of awarded work, time given for
completing the work, etc. and the corresponding completion certificates indicating actual date
of completion and actual value of executed similar works should be enclosed as proof of the
d) Creditworthiness of the Tenderer and its turnover during the specified period – Balance
sheets of last 3 years should be enclosed.
e) Name(s) & address(es) of the bankers of the Tenderer and their contact details.
f) Details of completed works – The client-wise names of work(s), year(s) of execution of
work(s), awarded and actual cost(s) of executed work(s), completion time stipulated in the
contract(s) and actual time taken to complete the work(s), name(s) and full contact-details of
the officers /authorities /departments under whom the work(s) was/were executed should be

ii) PART-II PRICED COMMERCIAL PART (PRICE BID)
a) Priced commercial Part shall contain “Rates” duly filled in two copies i.e. one ORIGINAL
COPY and one DUPLICATE copy of “Price Bid” shall be submitted.
b) No stipulation, deviation, terms & conditions, presumption, basis etc. shall be stipulated in
Price part of bid. ICAI shall not take cognizance of any such statement and may at their
discretion reject such price bids.
5.0 SUBMISSION OF BID
5.1 SUBMISSION IN TWO SEPARATE ENVELOPS
5.1.1 Technical part and priced part must be submitted in separate sealed envelopes in following 2
I) PART-I- TECHNICAL PART
a) This part shall contain technical bid. This envelope shall comprise the signed copy of Tender
document, addendum (if any), one original and one copy of the information listed for
submission in Part -I under Para 4.3 above. Techno-commercial bid disclosing prices shall be

ii) PART-lI SEALED PRICED COMMERCIAL PART
a) This part of the bid shall contain the Rates, duly filled in all respects and other
information specifically requested for submission in price part under Para 4.3 (ii)
above. The envelope shall have the following information clearly written on outside of
the envelope, failing which ICAI will assume no responsibility for the misplacement or
premature opening of the bid:

b) This part of Bid shall be submitted in original plus one photocopy.
5.2 DATE, TIME & PLACE OF SUBMISSION
5.2.1 Bid must be submitted by the due date and time mentioned in the Notice Inviting Tender or
any extension thereof as duly notified in writing by ICAI at the following address:

5.2.2 Bid received after the time and date fixed for receipt of bid is liable for rejection.
5.3 CHECK LIST FOR SUBMISSION OF BID
5.3.1 To assist bidder in ensuring the completeness of bid, a checklist for submission of various
documents / details in ‘technical part’ of bid has been enclosed at Section 6 of this tender
documents. Bidder, in his own interest, is requested to fill the checklist and submit along with
his bid for ready reference.
5.3.2 In case of incomplete submissions, ICAI shall be under no obligation to give the bidder an
opportunity to make good such deficiencies and ICAI may at its discretion treat such bids as
incomplete and not consider for further evaluation.
6.0 BID OPENING AND EVALUATION
6.1 OPENING OF TECHNICAL BID
6.1.1 On the date and time mentioned in ‘Notice Inviting Tender’, Part-I i.e. Technical Part shall be
opened in the presence of the authorized representative of the Tenderers who choose to be

opened on the next working day at the specified time and location.
6.2 CLARIFICATION & ADDITIONAL INFORMATION
During evaluation, ICAI may request Bidder for any clarification on the bid, additional or
outstanding documents. Bidder shall submit all additional documents in one original and one
copy thereof. However, seeking clarification shall be on sole discretion of ICAI.
6.3 TECHNO-COMMERCIAL DISCUSSIONS
6.3.1 Bid of the Bidder who submits the required EMD shall be taken up for detailed evaluation.
6.3.2 Techno-commercial discussions with Bidder shall be arranged, if needed. Bidder shall depute
his authorized representative(s) for attending the discussion. The representative(s) attending
the discussions shall produce authorization from his organization to attend the discussions and
sign the minutes of meeting on behalf of his organization. The authorized representatives must
be competent and empowered to settle all technical and commercial issues.
6.4 BID EVALUATION CRITERIA
6.4.1 Bid is the responsibility of Bidder and no relief or consideration can be given for errors and
omissions made by the Bidder inadvertently or advertently. Bid with incomplete information is
liable for rejection.
6.4.2 The techno-commercial part of Bid shall be evaluated as per Bid evaluation criteria, wherever
indicated in the bidding document.
6.4.3 Non-submission of details / documents as per Para (4.3.) above may lead to rejection of Bid.
6.4.4 DEVIATIONS TO CRITICAL STIPULATIONS:
I) Deviations to critical stipulations of Tender documents as mentioned below are not acceptable.

6.4.5 DETERMINATION OF RESPONSIVENESS
i) Prior to the financial evaluation of Bids, ICAI shall determine whether each Bid is
substantially responsive to the requirements of the Bidding document.
ii) For the purpose of this clause, a substantially responsive bid is one, which conforms to
all the terms and conditions and specifications of the bidding document without material
deviation or reservation. A material deviation or reservation is one which affects in any
substantial way the scope, quality, or performance of the works or which limits in any
substantial way, inconsistent with the Tender document, ICAI’s rights on bidder’s
iii) If a Bid is not substantially responsive to the requirements of the Bidding documents, it
may be rejected by ICAI.
6.4.6 Bidders must submit the Bid in line with Bid stipulations without taking any deviation.
6.4.7 UNSOLICITED POST BIDDING MODIFICATIONS
Bidders are advised to quote strictly as per terms and conditions of the bidding document and
not to stipulate any deviations / exceptions. Once quoted, the Bidder shall not make any
subsequent changes, whether resulting or arising out of any technical / commercial
clarifications sought on any deviations or exceptions mentioned in the Bid. Any proposal for
price change is likely to render the Bid liable for rejection.
6.4.8 Bidders must ensure that complete Bid along with all details as sought are submitted as per
provisions of the Tender document. The checklist has been provided in the Tender document to
ensure that any required details are not missed by the Bidders while submitting their offer.
6.4.9 The concurrent commitments of Bidder on various jobs under execution by the Bidder shall be
taken into account to assess the spare capacity available with the Bidder.
6.4.10 Performance of Bidder on work executed / under execution shall be taken into consideration
before selecting the Bidder for opening of his price bid.
6.5 OPENING OF PRICE PART OF BID
Priced commercial part of only those bidder, whose bids are considered techno-commercial
acceptable, shall be opened.
6.6 PROCESS TO BE CONFIDENTIAL
Information related to the examination, clarification, evaluation and comparison of Bids
recommendations for award of contract shall not be disclosed to Bidder or other person not
officially concerned with such process. Any effort by Bidder to influence ICAI processing of
Bid or award decisions may result in rejection of such Bids.
6.7 ICAI’S RIGHT TO ACCEPT OR REJECT A BID
ICAI reserves the right to accept a Bid other than the lowest and to accept or reject any Bid in
whole or part, or to annul the bidding process or to reject all Bids with or without notice or
reasons. Such decisions by ICAI shall bear no liability whatsoever consequent upon such
7.0 AWARD OF WORK AND CONTRACT DOCUMENT
7.1 AWARD OF WORK
7.1.1 The bidder whose bid is accepted by ICAI shall be issued Letter of Intent / Fax of Intent
(LOI/FOI) prior to expiry of Bid validity. Bidder shall confirm acceptance by returning a
signed copy of the LOI /FOI.
7.1.2 ICAI shall not be obliged to furnish any information / clarification / explanation to the
unsuccessful Bidders as regards non acceptance of their Bids. Except for refund of EMD to
unsuccessful Bidders, ICAI shall not correspond with the unsuccessful Bidders.
7.2 CONTRACT DOCUMENT
7.2.1 The successful Bidder shall be required to execute a formal agreement within 7 days of receipt
of LOI/FOI/Detailed Letter of Award specified period.
7.2.2 Contract Documents to be signed between ICAI & selected Bidder shall consist of the
i) Agreement on stamp paper of appropriate value.
ii) Letter of Intent / Fax of Intent
iii) Detailed letter of award / acceptance along with agreed variation and other enclosures.
iv) Original Tender document along with set of drawings
v) Addendum/Corrigendum issued to Bidder, if any.
7.2.3 Stamp paper of appropriate value shall be provided by the successful Bidder.
7.2.4 The statement of agreed variation prepared based on the deviation if any, finally retained by
the Bidder and accepted by ICAI, shall form part of detailed letter of award.
The bidders shall satisfy the following minimum eligibility criteria: -
I. The bidder should also have a full fledged office and should have adequate number of qualified
architects, engineers and other personnel on the payroll / establishment of the company.
II. The bidder should have in-house expertise in various disciplines such as architecture, civil and
structural design, electrical & mechanical and HVAC design, fire alarm and fighting services etc and
should be familiar with the provisions of the relevant BIS Specifications and Codes, the National Building
Code and local municipal Bye-laws applicable to Bikaner.
III. The bidder should have a minimum of 5 years’ experience in the field of planning, designing and
supervising construction of multistoried commercial/institutional buildings including all internal and
external services such as electrical, AC, plumbing, lifts, fire fighting etc as on 31.03.2012.
IV. If the bidder does not have in-house expertise in any of the relevant areas, it should have a tie-up with
associate consultants having required expertise in the areas and minimum experience of 3 years. The
details of such tie-ups with details of the associate consultants shall be furnished.
V. The bidder should have, during last 5 years ending on 31.03.2012, planned, designed & supervised, as
prime Architect/ Consultant, offering all services as in (II) above, any of the following:
(a) at least ONE multi storeyed commercial/ office building of at least 5000 sq. ft. built-up area one of
which should be located within Bikaner District., OR (b) at least TWO multi storeyed commercial/ office
buildings of at least 8000 sq. ft. built-up area each out of which at least ONE should be a building within
SCOPE OF WORK
A. ARCHITECTURAL SERVICES
The architect shall provide services in respect of the following works:
1.01 Conceptual Design & Planning
1.02 Preparing Architectural working drawings ‘Good for construction’ such as Foundation details
with center line layouts and other foundation details with sections
1.03 Structural engineering work
1.04 Sanitary, plumbing, drainage, water supply and sewerage work
1.05 Electrical work
1.06 Heating, ventilation and air-conditioning work (HVAC)
1.07 Fire protection and detection services
1.08 Building management services including Access Control & Security Alarm
1.09 Acoustical work
1.10 Landscape work
1.11 Interior designing including furniture & furnishing, signage etc.
1.12 Telecommunication System.
1.13 Rain Harvesting Scheme.
1.14 Working plans of all floors with opening schedules
1.15 3 D view and model of proposed building
1.16 Stairs details and necessary sectional details
1.17 All sides building elevations with required working details
1.18 Details for joinery (doors & windows)
1.19 Details for iron work i.e. grills, railings & gate.
B. PROJECT MANAGEMENT CONSULTANCY SERVICES
1.01 Set up a site office for handling the project on a daily basis (Space and facilities to be
provided by the contractor)
1.02 Have a Project-in-Charge being Qualified Engineer and appropriate support staff at site.
1.03 Review all Drawings, Details, and Documents from all consultants / contractors and approve
them for construction.
1.04 Review Shop Drawings submitted by the Contractors for suitability of construction.
1.05 Interact with ICAI, the Consultants and the Contractors and review the incorporation of
comments on the final Construction Drawings.
1.06 Obtain, and after approval, maintain a sample board of all critical components for ongoing
1.07 Plan daily activities of all works and services. Sequence operations so as to ensure that work
fronts are available for all contractors.
1.08 Attend to site related problems and offer solution in co-ordination with ICAI, Consultants and
1.09 Conduct weekly meetings at site with all Contractors, consultants and the ICAI to review the
Progress of Work.
1.10 Discuss Time/Cost Over-runs and report the same to ICAI through a system of appropriate
Tables/Charts. Monitor management of manpower, material and financial resources with the
assistance of ICAI’s authorized official of Works and sound precautionary warning signals to
1.11 Supervise the Quality of Work and ensure that it is done as per approved specifications and
drawings. Report any exceptions and problems, in a timely manner, to ICAI.
1.12 Identify, witness, and approve the various Material Tests as would be stipulated in the Tender
documents either at vendor’s factory or at site.
1.13 Review and Approve any New Items/ Extra Items or Change in Specifications in conjunction
with ICAI & Consultants. Prepare detailed Rate Analysis for this purpose.
1.14 Certify Contractors’ Running Bills and Final Bills with the assistance of ICAI’s authorized
official of Works in Quantity Measurements and Log data.
1.15 Issue virtual work completion certificate and Final Bill in co-ordination with ICAI and
1.16 Soil testing by competent authority for the purpose to evaluate soil bearing capacity
1.17 Detailed project report (DPR) for the purpose of tender of the project.
1.18 Tenders calling, revolution of tenders and awarding work with consultation of building
committee, Inviting quotations from vendors for various services of building, Co-ordinate
various submittals and get the required approvals from Statutory/ Municipal Authorities at
different stages of the project. The responsibility of the approvals lies with the Architect.
1.19 Any other work not specially mentioned but may be required for completing the building &
making it habitable.
GENERAL CONDITIONS OF CONTRACT
1. The Tender should be signed by the Bidder or his authorised signatory only.
2. Each Bidder shall furnish earnest money of Rs. 10000/- through a demand draft/ pay order drawn
in favour of “Bikaner Branch of CIRC of Account-Land & Building”. payable at Bikaner. The
earnest money shall be returned to the unsuccessful Bidders without any interest thereon after
award of works. The earnest money of successful Bidder shall be retained which shall not carry
any interest and treated as security deposit (without interest) for 1 year from the date of
completion of work.
3. Every Bidder is expected before quoting his rates to assess the scope of work.
4. The Tender form should be filled in English and legible entries made by hand and written ink. Any
Tender in which there is overwriting or erasure is liable to be rejected. All corrections should be
attested with Bidder’s dated initials as many times as the corrections occur. Tenders which
propose any alteration in the work specified in the said Tender or in the time allowed for carrying
out the work or which contains any condition of any kind shall be rejected.
5. The Bidders shall fill the quoted rates in figure as well as in words. The Bidders who do not fulfill
these requirements are liable to be summarily rejected.
If on check, differences are found between the rates given by the Bidder in words and figures or in
the amounts worked out by him, then the rates quoted by the Bidder in words shall be taken as

7. No alteration which is made by the Architect in the Notice of the Tender, instructions to the
tenderer, the conditions of the Contract, the accompanying the same shall be recognized, if any
such alterations are made or any special conditions are attached, the tender is liable to the rejected.
8. The acceptance of the Tender shall rest with ICAI which does not bind itself to accept the lowest
tender and reserves to itself the authority to reject any or all Tenders received, without assigning
any reason. All Tenders in which any of the prescribed conditions are not fulfilled or are
incomplete in any respect are liable to be rejected.
9. Canvassing in connection with Tenders is strictly prohibited and Tender submitted by the Bidders
who resort to canvassing shall be liable to rejection.
10. Schedule of Services for Architecture Work
Receive brief on all architectural and functional requirements from the ICAI.
Organise site survey and subsoil investigation
Prepare conceptual scheme(s) and preliminary project report & obtain approval of ICAI.
Submit budget estimate.
Appoint consulting engineers and specialists
Obtain data related to public utility services and requirements of Authorities.
Prepare scheme, report, cost estimate layout drawings, sections etc. & submit the same to
various statutory authorities for approval and obtain ICAI's approval to proceed.
Get the required approvals.
Assist ICAI in preparing details of finishes.
Direct and co-ordinate architectural, engineering and quantity surveying services
Prepare co-ordinated construction drawings, schedule of quantities and specifications.
Price the schedules of quantities.
Stage D - (Tendering Stage)
Prepare and obtain ICAI's approval to tender documents.
Assist ICAI in pre-qualification of contractors, suppliers and specialist agencies.
Assist ICAI in technical evaluation of contractors and assist ICAI in selection of contractors /
Stage E - (During Construction stage)
Prepare and issue any additional working drawings and details.
Check and approve shop drawings submitted by contractors and specialist agencies.
Make periodic site visits to keep overall check on quality and conformity with drawings and to
resolve site problems.
Check and approve as built drawings with the assistance ICAI.
Assist ICAI in obtaining utility connections and Occupation / Completion Certificate.
11. Mode of Payment
For each stage of the services in the Scope of Work, the Architect shall be paid on the following
basis consistent with the work done. Payments made to the architect are on account and shall be
adjusted against the final fee payable.
Stage I - Concept a) Retainer Amount ____% of total fees based on

13. Architect's Liabilities
13.01 The liability of architect for his failure to exercise all reasonable skill care and diligence in the
discharge of his duties shall be limited to 3 years after virtual completion of the works.
13.02 The architect has no liability whatsoever for any part of the works not designed by him or not
under his responsibility or not constructed under his supervision.
13.03 The architect has no liability whatsoever for any part of the work for which the liability rests
with a contractor or suppliers.
13.04 The Architect shall ensure quality control of material used in the construction of the project. In
case, any defect is found in the quality of material used or any damage liability is inflicted on the
ICAI with regard to the same, the same shall be borne by the Architect.
13.05 The Architect shall obtain all the necessary statutory approvals from the concerned authorities.
In case, any liability or damage is caused to the ICAI for not obtaining the required approvals by
the Architect, the same shall be borne by the Architect.
14. Construction Cost
The construction cost of the Project shall be Rs.194 Lakhs
15. Use of Architect’s Drawings, Specifications & Other Documents
If the Architect abandons the work in whole or in part or becomes incapacitated from acting as
the Architect as aforesaid, the ICAI may make full use of all or any drawing and designs
prepared by the Architect
Copyright of all drawings and designs prepared by the Architect for the project will rest with the
17. Alternation in Scope of Work and Change Order Calculation
If the ICAI deviates from the original scheme which involves for its proper execution, extra
services, expenses and extra labour on the part of the Architect for making changes and addition
to the drawing, specification or other documents, the Architect shall be compensated for such
extra services as may be mutually agreed.
12. Liquidated Damages
If the performance of work/services is delayed beyond time schedule due to reasons attributed
to the Architect, the Architect shall pay the liquidated damages to ICAI for delay but not by way
of penalty to the ICAI, an amount calculated at the rate of ¼ % of the total fees/charges payable
under the contract for every week for delay or part thereof, and the ICAI will be at liberty to
deduct the said amounts from any amount due to Architect from the ICAI. The total amount of
such compensation for delay will, however, be limited to a maximum of 10% payable under the
contract. This is without prejudice to any other remedy available to the ICAI under the
That the Architect shall keep ICAI indemnified against all actions, suits and proceedings and all
and any costs, charges, expenses, loss or damage incurred, suffered, caused to/sustained by ICAI
by reason of any default or breach or lapse or negligence or non-observance or non-performance
on behalf of the Architect.
The Agreement shall be co-extensive with the contract to be entered with the prospective
contractor undertaking the work of construction of ICAI Bhawan, Bikaner.
Either party has liberty to terminate the Agreement by giving two months prior notice of
termination to the other without assigning any reason.
In case the work done by the Architect is found not to be satisfactory, ICAI reserves the right to
terminate the agreement by giving one month prior notice to the Architect. The Architect shall
maintain good quality to avoid such occurrence.
Even after the termination of its employment, the Architect shall remain liable and be
responsible for due certification/approval of any bills submitted by the Contractors at any time,
in respect of the work, executed before the termination of the Architect’s appointment; but shall
not be entitled to additional remuneration therefor. If the Architect closes its business or die or
become incapacitated from acting as such Architect, the Agreement shall stand terminated. If the
Architect fails to adhere to the time Schedule stipulated herein or the extended time which may
be granted by the ICAI in its sole discretion, or in case there is any change in the constitution of
the firm of the Architect for any reason whatsoever, the ICAI shall be entitled to terminate the
agreement and entrust the work to some other Architect without prejudice its rights available
under the law for the time being in force.
In case of any dispute or difference arising out in relation to meaning or interpretation of the
agreement, authorized officials of both the parties shall try to resolve the same through
discussions and conciliation, failing to which the matter shall be referred to a sole arbitrator to
be appointed by the President of the ICAI. The Arbitration and Conciliation Act, 1996 shall be
applicable to the arbitration proceedings and the venue of the arbitration shall be at Bikaner.
The award of the arbitrator shall be final and binding on the parties.
17. Force Majure
If at any time during the currency of this Agreement, the performance in whole or part by the
Architect in respect of any obligation under this agreement is prevented or delayed by reasons of
any act of public, enemy, civil commotion, sabotage, fire, flood, explosion, epidemic, strikes or
act of god, and provided notice of the happening of any such event is given to the owner by the
Architect within 21 days from the date of occurrence thereof, the Architect shall not be held
responsible for delay occurring due to the above mentioned events.
The Architect shall not assign, sublet or transfer its interest in this agreement, without the written
consent of the ICAI.
19. Entire Agreement
This Agreement contains the entire Agreement between the two parties concerned. Any
previous written or oral agreement, letter of intent, relating to this subject matter is hereby
superseded and cancelled. No representation, guarantee, modification or agreement shall affect
this Agreement unless made in writing and executed with the same formalities.
