REGULATORY GUIDE: What to expect during an ARPANSA inspection The CEO of ARPANSA has appointed inspectors in accordance with Part 7 of the Australian Radiation Protection and Nuclear Safety Act 1998 (the Act). The inspectors are granted a range of powers so that they can appropriately monitor compliance with the Act. It is a condition of all licences that the licence holder or person covered by the licence allow ARPANSA inspectors to enter and inspect the site or a facility, apparatus or material at reasonable times. Additionally, Part 7 of the Act allows inspectors to enter premises with a monitoring warrant or an offence related warrant should this be necessary. In the case of announced inspections, the licence holder will receive written notification of the scope of the inspection approximately two weeks before. In the case of unannounced inspections, up to one days notice may be given but the scope may not be provided. Generally, an inspector will expect to examine the workplace, assess work activities and review management practices relevant to the health and safety of people and protection of the environment. The inspector may gather information by talking to employees, taking measurements, conducting tests, inspecting and copying documents, and taking photographs, video recordings or samples. In circumstances which involve hazardous situations, the inspector has the power to seize equipment or materials or may direct others to take appropriate actions (see section 65 of the Act). Information provided to and received by the inspector on a confidential basis from an employee, will be kept in confidence, unless ARPANSA is required to disclose the information as part of its statutory functions and duties or where disclosure is required by law. In the event that such information must be disclosed, the identity of individuals providing the information will not be released unless required by law. At the completion of an inspection, the inspector will provide the CEO of ARPANSA (or his delegate) with information gathered during the course of the inspection, including any evidence indicating that a licence holder is not complying with their licence conditions. Generally, the inspector will raise any compliance issues with the licence holder’s representatives during the inspection. The information is then assessed by the CEO of ARPANSA to determine if the licence holder has been compliant with the Act or regulations. Licence holders will be given the opportunity to comment on the findings of the inspection prior to a final decision being made.
