Dear Interested Parties:

I am a Legal Studies professor in Georgia State University's Robinson College of Business. In
this capacity, I teach MBA students a variety of legal topics, including the analysis of commercial
and consumer transactions.

This summer, my MBA law class was assigned a project where they needed to assess the business
and legal issues relevant to eminent domain cases. They were divided into teams and undertook
opposing points of view:

GROUP 1 – Not only is it ethical, the New York case law supports the local government’s
exercise of eminent domain over Brooklyn residents and businesses, to build an arena to house
the New Jersey Nets basketball team.

GROUP 2 - Not only is it unethical, the New York case law does not support the local
government’s exercise of eminent domain over Brooklyn residents and businesses, to build an
arena to house the New Jersey Nets basketball team.

Enclosed for your review are the two best and most original opposing papers. I purposely
enclosed both the Nets and Tenants’ perspectives for you to ponder. My hope is to bring the two
parties together to explore novel solutions to this very stressful business problem.
