Notice of rulemaking was published in the Oklahoma Register on February 15, 2011. Copies of
the Notice of Rulemaking, text of the proposed rules amendment 630:10-1-9. Non-commercial fee
procedures [NEW] and the Rule Impact Statement dated February 25, 2011, are posted on the
OSRC website www.oklahomascenicrivers.net. Additionally, copies of the documents were
distributed to interested persons on the OSRC electronic mailing list on February 11, 2011 (except:
Rule Impact Statement) and again on March 14, 2011. Copies of the Rulemaking Notice, text of
the proposed rules amendment and Rule Impact Statement are attached. The rulemaking notices
provided a public comment period of February 15 through March 22, 2011, and for a rulemaking
hearing as part of today’s public meeting, in conformance with the Oklahoma Administrative
Procedures Act. No oral or written rulemaking comments have been received by the Oklahoma
Scenic Rivers Commission as of Monday, March 14, 2011.

   Permanent Amendments to Chapter 10 – Non-commercial fee procedures [NEW]

In 2009, the Oklahoma Scenic Rivers Act (“the Act”) was amended to remove the non-
commercial user fee. In 2010, the Act was amended to institute a fee on non-commercial
vessels, or privately owned flotation devices (see paragraph B of Title 82 Oklahoma Statutes §
1470). The Act directs the Oklahoma Scenic Rivers Commission to promulgate rules for the
collection and administration of the statutory fees. This rulemaking will cover the procedures for
collecting and administering non-commercial fees set by statute.

06. Update, discussion, consideration, vote to approve, amend or take other action related
    to House Bill #1496 authored by Rep. David Brumbaugh and introduced within the 1st
    Session of the 53rd Oklahoma Legislature to reduce the present annual $35.00
    commercial flotation device license to $5.00 per commercial flotation device and impose
    $1.00 user fee per person floating per commercial flotation device. The proposal
    removes the present annual $10.00 or $1.00 per day per vessel non-commercial,
    privately owned user fee.

07. Update, discussion, consideration, vote to approve, amend or take other action related
    to proposed House Bill #1541 authored by Rep. Jason Murphey and
    introduced/amended within the 1st Session of the 53rd Oklahoma Legislature to
    consolidate the Oklahoma Scenic Rivers Commission into the Oklahoma Conservation
    Commission.
