Older Americans Act Elder Abuse Listening Session

On behalf of the non-partisan 850 member Elder Justice Coalition, I thank you for the
opportunity to participate in this listening session today. I begin by noting that we come to share
ideas, and pose some questions for consideration in reauthorization. We would follow this with
more formal positions and proposed legislative language.

The only previous time the Coalition has addressed existing and possible future elder abuse
provisions in the OAA was in February of 2010 at an AoA listening session.

Since then, the landmark Elder Justice Act was passed and signed into law. Therefore my first
point today would be that the reauthorization should contribute to better coordination between
what is currently in Title VII and all elder justice systems and funding streams that grow out of
the EJA or any other legislation. I would note that the 2006 reauthorization, according to CRS
did add responsibility for AoA “to develop and implement systems for elder justice”. To our
knowledge, this responsibility was not exercised but should be in light of the progress made on
elder justice since 2006.

This should also include consistency in definitions and coordination in data collection with
comparable provisions of the Elder Justice Act. I note that the 2006 amendments did also call
for AoA to conduct an elder abuse national incidence study and that needs to be conducted as the
benchmark for meaningful data collection.

Another provision of the Elder Justice Act we expect to be implemented is for the Secretary to
assign a first time federal home for APS. Our Coalition supports that home being at AoA.
Should that occur, we also recommend that the GAO do an evaluation on the role and capacity of
the entire aging network to administer elder justice services, including APS. This evaluation
should include recommendations on capacity building and training and examine the extent and
nature of potential and actual conflicts of interest. Such an evaluation should also consider the
role and capacity of states’ human services agencies in administering APS.

We would also note the possible implementation of the provisions to create an Advisory Board
on Elder Abuse, Neglect and Exploitation--- and the Elder Justice Coordinating Council and how
that too could thrust AoA into a more substantive role in elder justice.

We also recommend that authority be provided to the Assistant Secretary to be able to use funds
from the Older Americans Act on Elder Justice Act related implementation activities.

We believe one important outcome of reauthorization should be greater integration between the
Title VII education and public awareness provisions and the other service programs in Title III,
especially the nutrition programs and I&R services and Title VI. We were pleased to work
closely with LCAO to have this reflected in their consensus document. In addition, we support
the LCAO’s call for the assistant secretary to ensure that all programs funded by the OAA have
received appropriate elder abuse-related training for those staff and volunteers who come in
direct contact with seniors.

We suggested in our Feb 2010 statement that we explore a recommendation from the 2001
National Summit on Elder Abuse that the National Family Caregiver Support Program promote
the development of abuse sensitive services for caregivers.

Briefly we also ask that consideration be given to the following:

Cultural sensitivity in the provision of elder rights services, including training in cultural issues
associated with abuse.

With respect to the ombudsman program, over the time of the next reauthorization, move closer
to having the Institute on Medicine recommendation on the ratio of ombudsman to nursing home
beds be addressed. We support the full independence of the ombudsman program and create the
authority to direct Medicare and Medicaid funds into the program.

More use of existing and future translational elder abuse research focused on treatment of
victims, safeguards to help in prevention and identification of circumstances that give rise to
abusive situations.
