The immigration act of 1990 includes a policy that allows foreign nationals who
invest a pre-determined amount of money into qualified investment or in a
regional center that have been determined to have high unemployment rates.
Foreign nationals who make the qualified investments can be eligible for a visa
and a green card.

EB-5 投资移民，即 Employment-based Fifth Preference，中文意思是“第五类优
先就业型移民签证”。它是在 1990 移民法条例中针对海外投资移民所设立的移

The EB-5 immigrant investor visa program is the quite flexible because there are
no requirements for age, business experience, or language skills. EB-
5 Permanent Residents are not required be constantly present in the United
States, and are allowed to maintain business and professional relations in their
country of origin.

The EB-5 program also allows EB-5 investors a great deal of freedom because it
does not require immigrant investors to manage their investment on a daily basis,
but rather, to ‘actively engage’ in a business enterprise, meaning they can be
limited partners and pursue other professional or personal ventures. It is not
necessary for investors to be directly hands on with their investment.

Regional Center Pilot Program “地区中心”移民方案
In order to qualify to be a part of a Regional Center Pilot Program:
      1. Invest at least $500,000 or $1,000,000 in a
         regional center located within an USCIS
         designated area. Details of Regional Centers
         are defined and discussed in detail below.
      2. Generate at least 10 new full-time jobs directly
         or in-directly through the capital investment.
      3. The business you invest in must help grow the
         US economy by providing goods or services.
      4. Investor must prove the money invested is
         lawfully gained.
      5. Minimum involvement in the day to day
         running of the business

A Regional Center is an entity, agency or organization that has been approved as
such by the USCIS. It focuses on a specific geographic area within the United States
and is involved with the promotion of economic growth through increased export
sales, improved regional productivity, creation of new jobs, and increased domestic
capital investment. The Regional Center facilitates the pooling of capital from
multiple EB-5 investors.

One of the fastest ways to get a green card and live in the US is through the EB 5
regional center investment visa. By investing $500,000 or $1,000,000 in a USCIS
approved Regional Centre through the EB 5 Visa program it allows green cards for
you, the investor, your spouse and children under the age of 21.

There are roughly fifty Regional Centers. Considering the number of alleged fraud
cases it is important to take independent specialist advice.

What do I need to apply for a Green Card?

When the immigrant investor application is presented to the INS, the following items
need to be included regardless of the type of investment that has been made:

      Proof that the correct amount of funds has been placed at risk, for example
       bank statements showing the deposit of funds into the business's account,
       proof of tools purchased for use in the business; proof of property transferred
       to the business, and evidence of money transferred to the business in exchange
       for shares of stock. This stock cannot include terms requiring the business to
       redeem the stock at the holder's request.
      Proof demonstrating that the money invested was lawfully gained
      Evidence that the investment has created at least ten full-time jobs this can
       include tax records, I-9 Forms, or if employees have not yet been hired yet, a
       detailed business plan describing the business and the business will involve
       the hiring of ten employees within two years. If the business is a troubled
       business, the applicant must provide evidence that the existing number of
       employees will be kept for at least two years.

Once the application is approved, the immigrant investor is given Conditional
Permanent Residence. The conditions are eligible for removal after two years once the
immigrant investor proves that they have "sustained the actions required for removal
of the conditions" during the time of residence in the United States.

The immigrant investor will have met this condition if he or she has "substantially
met" the capital investment requirement and has always maintained this investment
during the conditional residence period. The immigrant investors residence may be
terminated at the end of the two-year period or earlier if it is found that the business
was not established, or was established solely to evade immigration laws or that the
requirements were otherwise violated.

Once the immigrant investor demonstrates that the business was established, that the
required amount of capital was invested, and that 10 full-time jobs either have been or
will be created, the conditions will be removed and the alien granted full permanent
residence and a permanent Green Card is issued.

Proof demonstrating that the money invested was lawfully gained. This proof can be demonstrated by
the following:

        Overseas business registration records
        Personal and business tax returns, or other tax returns of any kind filed anywhere in the world
         within the previous five years
        Documents identifying any other source of money

Common Questions
Does it matter where the various regional centers are located?
As a part of the EB5 Pilot program you are allowed to live or work anywhere
in the United States regardless of the Regional Center or targeted area where
you make your investment.
 What is the definition of lawfully gained assets?
Under USCIS regulations, the investor must be able demonstrate that his assets
were gained in a lawful manner. The definition of lawfully gained assets includes
monies earned from business, salary, investments, property sales, inheritance, gift,
loan, or other lawful means.
How do I prove that my money invested was lawfully gained?
This proof can be demonstrated by the following:

        Overseas business registration records
        Personal and business tax returns, or other tax returns of any kind filed anywhere in
         the world within the previous five years
        Documents identifying any other source of money
        Evidence that your investment in the Regional Center will create at least 10 direct or

What is the difference between conditional and unconditional green cards?
When an investor is approved for the EB-5 immigrant visa they receive a conditional
green card, it must be reissued after two years, subject to removal of conditions.
Otherwise, the two cards offer the same rights and privileges.
What is a conditional green Card?

EB-5 Visa immigrant investors, their spouses and dependent children receive
conditional permanent residence for a two-year period. Anyone with EB-5 status must
file a petition to remove the conditions during a 90-day period before to the second
anniversary of the person's lawful admission as a permanent resident. The business
will be examined by the INS at the conclusion of the two-year period to verify
whether or not the investor has fulfilled all of the conditions.

What is a targeted employment area?
Targeted Employment Area is defined by law as “a rural area or an area that has
experienced high unemployment of at least 150 percent of the national average.”
What is a Regional Center?
A Regional Center can be described as any organization, public or private that is
involved with the encouragement of economic growth, job creation and increasing
monetary investment in a designated area. In order for a Regional Center to receive
acknowledgement from USCIS as a Regional Center, the following items must be
submitted.
    How the organization will promote growth within its region.

      A realistic and provable business model that includes project costs and timelines.

      How jobs will be created directly/indirectly through the business model and capital investments.

Who qualifies for an EB-5 Green Card?
The EB-5 Green Card program has three basic prerequisites conditions:
  1. The foreign national must establish a U.S. business or invest in an existing
business that was created or restructured after November 19, 1990.
  2. The alien must have invested $1 million (or only $500,000 when investing in a
Targeted Employment Area) in the business.
  3. The business must create full-time employment for at least 10 U.S. workers.

What could disqualify an immigrant from participating in the EB 5 program?

There are very few events that would make you ineligible for the program under the
law. A criminal record involving crimes of moral turpitude is disqualifying, unless
the crime occurred over 20 years prior to the application or it can be demonstrated
that the crime was political in nature.

Major health problems might also make you ineligible. This can be avoided by
proving that the immigrant investor will be supported by others and therefore avoid
being a recipient of government medical assistance.

Applicants should seek advice of their legal counsel to determine what waivers may
be available for eligibility.
