1 SUBCHAPTER E. PROJECT AND PERFORMANCE REPORTING
2 §16.201. Project, [and] Performance, and Funding Reporting
3 Systems.
4 (a) General. The department will establish [a] project,
5 [and] performance, and funding reporting systems that make[s]
6 available in a central location on the department's website
7 information regarding the:
8 (1) delivery of individual transportation projects as
9 provided in §16.202 of this subchapter (relating to Reporting
10 System for Delivery of Individual Projects);
11 (2) operation and condition of the department's statewide
12 transportation system as provided in §16.203 of this subchapter
13 (relating to Performance Reporting on the Operation and
14 Condition of the Statewide Transportation System); and
15 (3) funding available for the department's statewide
16 transportation system and actual expenditures related to the
17 system as provided in §16.204 of this subchapter (relating to
18 Reporting System for Funding and Expenditures).
19 (b) Entry of information. Each district will enter
20 information about each of its transportation projects into the
21 project, [and] performance, and funding reporting systems.
22 (c) Department website. The department will make the
23 statistical information provided under this subchapter available

1 on the department's website in more than one downloadable
2 electronic format. The information will be easily accessible,
3 understandable, and in a format that allows a person to conduct
4 electronic searches for information about a specific district, a
5 county, a highway under the jurisdiction of the department, or a
6 type of road under the jurisdiction of the department.
7 (d) Reports to legislative districts. The department will
8 provide to each member of the legislature a copy of the annual
9 reports required by §16.202 and §16.203 of this subchapter
10 (relating to Reporting System for Delivery of Individual
11 Projects and Performance Reporting on the Operation and
12 Condition of the Statewide Transportation System, respectively)
13 for each department district located within the boundaries of a
14 legislative district, and at the request of a legislator, a
15 senior management employee of the department will meet with the
16 legislator to explain the reports. A copy of each annual
17 district report will also be provided to the political
18 subdivisions located in the district that is the subject of the
19 report, including a:
20 (1) municipality;
21 (2) county; and
22 (3) local transportation entity.
23 (e) Reports to the legislature. The department will

1 provide a copy of the annual reports required by §16.202 and
2 §16.203 of this subchapter (relating to Reporting System for
3 Delivery of Individual Projects and Performance Reporting on the
4 Operation and Condition of the Statewide Transportation System,
5 respectively) to the lieutenant governor, the speaker of the
6 house of representatives, and the chair of the standing
7 committee of each house of the legislature with primary
8 jurisdiction over transportation issues.

10 §16.202. Reporting System for Delivery of Individual Projects.
11 (a) Work program [plan]. The department will develop a
12 four year business work program [plan] for tracking the delivery
13 of each transportation project in a district, including grouped
14 rehabilitation and preventive maintenance projects, that is
15 [are] being developed or under construction and identified in
16 the next fiscal year or any of the following three fiscal years
17 of the unified transportation program (UTP) described in §16.105
18 of this chapter (relating to Unified Transportation Program
19 (UTP)).
20 (1) Each district will develop a consistently formatted
21 work program [plan] based on the UTP that contains all
22 transportation projects that the district intends to implement
23 during the four year period [next fiscal year and the following

1 three consecutive fiscal years].
2 (2) For each project the work program [plan] must
3 contain:
4 (A) the status of the project;
5 (B) each source of funding for the project, the funding
6 category to which the project has been assigned, and the
7 project's priority within the category;
8 (C) an identification of each phase and benchmark of
9 project development, including [planning, route, and]
10 environmental clearance [impact studies, design],right of way
11 acquisition or possession, utility adjustment or coordination,
12 completion of plans, specifications, and estimates, award of
13 construction contract, and completion of construction;
14 [(B) the estimated cost of each phase of project
15 development;]
16 (D) a project schedule with estimated timelines for
17 completing each applicable benchmark of the project as the
18 project progresses;
19 (E) [(D)] a summary of progress on the project that
20 identifies whether the project is being completed on-time and
21 on-budget; and
22 (F) a list of department employees responsible for the
23 project and contact information for each person listed.

1 (3) (2) For each major transportation project identified
2 in §16.106 of this chapter (relating to Major Transportation
3 Projects) the work program [plan] must also contain:
4 (A) the estimated cost of each phase of project
5 development; and
6 (B) the progress on each applicable benchmark of the
7 project that identifies whether the project is being completed
8 on-time and on-budget.
9 [(E) a list of department employees responsible for the
10 project and contact information for each person listed.]
11 (4) (3) The department will use the work program [plan]
12 in:
13 (A) preparing a budget for the district and the
14 department;
15 (B) monitoring the performance of the district; and
16 (C) evaluating the performance of district employees.
17 (5) (4) The department will consolidate the districts'
18 work plans into a statewide work program [plan] and publish it
19 on the department's website.
20 (6) (5) The department will update the information
21 contained in the project and performance reporting system for
22 delivery of individual transportation projects under this
23 section at least monthly.

1 (b) Annual Report. As a component of the project and
2 performance reporting system for delivery of individual
3 transportation projects required by this section, the department
4 will conduct an annual review of the benchmarks and timelines of
5 all transportation projects included in the work program [funded
6 under program funding Categories 2, 3, 4, 5, 6, 7, and 12 as
7 described in §16.153 of this chapter (relating to Funding
8 Categories)] to determine the completion rates of the projects
9 and whether the projects were completed on-time and on-budget.
10 The review will be used to create an annual report on the level
11 of achievement statewide and by district based on the benchmarks
12 and timelines described in subsections (a)(2) and (a)(3) of this
13 section for each transportation project listed in the work
14 program [plan] and included in the program funding categories
15 described in this subsection. The report will include:
16 (1) the status of each project identified as a high
17 priority in accordance with §16.105 of this chapter (relating to
18 Unified Transportation Program (UTP));
19 (2) a summary of the number of statewide project
20 implementation benchmarks that have been completed; and
21 (3) information about the accuracy of previous department
22 financial forecasts.
23 [(c) Legislative districts. The department will make

1 available to each member of the legislature a copy of the annual
2 report required by subsection (b) of this section for each
3 department district located within the boundaries of a
4 legislative district, and at the request of a legislator, a

7 (d) Legislature. The department will provide a copy of the
8 annual report required by subsection (b) of this section to the

14 §16.203. Performance Reporting on the Operation and Condition
15 of the Statewide Transportation System.
16 (a) System performance. The department will develop a set
17 of performance measures for evaluating the effectiveness of its
18 expenditures on the statewide transportation system in achieving
19 the transportation goals identified by the statewide long-range
20 transportation plan under §16.54 of this chapter (relating to
21 Statewide Long-Range Transportation Plan (SLRTP)).
22 (b) Performance measures. At a minimum, the performance
23 measures adopted under subsection (a) of this section will

1 include the:
2 (1) percentage of transportation construction projects
3 for which the [planning, design, and] project development
4 phases, including environmental clearance, right of way
5 acquisition or possession, [and] utility adjustment or
6 coordination, completion of plans, specifications, and
7 estimates, and award of construction contract are completed on
8 or before the planned implementation timelines and on-budget;
9 (2) percentage of transportation construction projects
10 for which construction is completed on or before the planned
11 implementation timelines and on-budget;
12 (3) total dollar amount spent for right of way
13 acquisition as a percentage of the original amount estimated for
14 right of way acquisition;
15 (4) number of vehicle miles traveled;
16 (5) peak hour travel congestion in the eight largest
17 metropolitan areas;
18 (6) number of fatalities per 100 million vehicle miles
19 traveled;
20 (7) percentage of bridges that have a condition rating of
21 good or better;
22 (8) dollar amounts deposited to the credit of the state
23 highway fund and disbursements from the fund compared to the

1 amounts forecasted to be deposited and disbursed, respectively;
2 (9) dollar amounts obligated in connection with contracts
3 or participation in contracts with historically underutilized
4 businesses, disadvantaged business enterprises, and small
5 business enterprises as a percentage of the amounts spent on all
6 contracts; and
7 (10) percentage of lane miles on the state highway system
8 that have a pavement condition rating of good or better.
9 (c) Additional performance measures. The commission, as it
10 deems appropriate, may adopt performance measures in addition to
11 those listed in subsection (b) of this section.
12 (d) Reports on effectiveness of expenditures. As a
13 component of the performance reporting system required by this
14 section, the department will include:
15 (1) reports prepared by the department or an institution
16 of higher education that evaluate the effectiveness of the
17 department's expenditures on transportation projects to achieve
18 the transportation goals identified by the SLRTP;
19 (2) information about the condition of bridges on the
20 state highway system; and
21 (3) information about the condition of the pavement for
22 each highway on the state highway system.
23 (e) (d) Updates. The department will update the

1 information contained in the [project and] performance reporting
2 system [for performance measures] under this section at least
3 annually.
4 (f) (e) Annual Report. As a component of the project and
5 performance reporting system required by this section, the
6 department annually will compile and evaluate the information
7 provided for the performance measures and publish a report
8 describing the results and the effectiveness of meeting each
9 transportation goal that is identified by the statewide long-
10 range transportation plan under §16.54 of this chapter. The
11 department will report on the results and level of achievement
12 statewide and by district.
13 [(f) Legislative districts. The department will make
14 available to each member of the legislature a copy of the annual
15 report required by subsection (e) of this section for each
16 district located within the boundaries of a legislative
17 district, and at the request of a legislator, a senior
18 management employee of the department will meet with the
19 legislator to explain the report.
20 (g) Legislature. The department will provide a copy of the
21 annual report required by subsection (e) of this section to the
22 lieutenant governor, the speaker of the house of
23 representatives, and the chair of the standing committee of each

4 §16.204. Reporting System for Funding and Expenditures.
5 (a) Account information system. The department will
6 develop an account information reporting system for tracking
7 money deposited to the credit of each separate account and
8 subaccount of the state highway fund, including subaccounts for
9 toll projects required under Transportation Code, Chapter 228.
10 The account information will include:
11 (1) the source for the department's funds whether from
12 the state highway fund, bond proceeds, or revenue from a
13 comprehensive development agreement or a toll project, and
14 amount of the deposited funds;
15 (2) the amount and general type or purpose of expenditure
16 as described in the comptroller's statewide accounting system;
17 and
18 (3) the balance credited to each account and subaccount.
19 (b) Reporting. The department will report on the funding
20 and expenditures as applicable by each:
21 (1) district;
22 (2) program funding category as identified in §16.153 of
23 this chapter (relating to Funding Categories); and

2 (c) Updates. The department will update the account
3 information reporting system at least quarterly.

5 §16.205. Department Information Consolidation. To the extent
6 practicable and to avoid duplication of reporting requirements,
7 the department may combine the reports required under this
8 subchapter.
