General Release and Waiver of Liability
Virginia State Title 3.1. Agriculture, Horticulture and Food. Chapter 27.5. Equine Activity Liability
Act. Virginia Code Ann. 3.1-796.130-133 provides that an equine activity sponsor, an
equine professional or any other person shall not be liable for an injury to or death of a
participant resulting from the intrinsic dangers of equine activities.
Engages in an equine activity" means (i) any person, whether mounted or unmounted,
who rides, handles, trains, drives, assists in providing medical or therapeutic treatment
of, or is a passenger upon an equine; (ii) any person who participates in an equine
activity but does not necessarily ride, handle, train, drive, or ride as a passenger upon an
equine; (iii) any person visiting, touring or utilizing an equine facility as part of an event
or activity; or (iv) any person who assists a participant or equine activity sponsor or
management in an equine activity. The term "engages in an equine activity" does not
include being a spectator at an equine activity, except in cases where the spectator
places himself in an unauthorized area and in immediate proximity to an equine or
"Equine" means a horse, pony, mule, donkey, or hinny.
"Equine activity" means (i) equine shows, fairs, competitions, performances, or parades
that involve any or all breeds of equines and any of the equine disciplines, including, but
not limited to, dressage, hunter and jumper horse shows, grand prix jumping, three-day
events, combined training, rodeos, driving, pulling, cutting, polo, steeple chasing,
endurance trail riding and western games, and hunting; (ii) equine training or teaching
activities; (iii) boarding equines; (iv) riding, inspecting, or evaluating an equine belonging
to another whether or not the owner has received some monetary consideration or other
thing of value for the use of the equine or is permitting a prospective purchaser of the
equine to ride, inspect, or evaluate the equine; (v) rides, trips, hunts, or other equine
activities of any type however informal or impromptu that are sponsored by an equine
activity sponsor; (vi) conducting general hoof care, including but not limited to placing or
replacing horseshoes or hoof trimming of an equine; and (vii) providing or assisting in
breeding or therapeutic veterinary treatment.
I hereby release the Passage Creek Stables, Priscilla A. Craig, directors, other horse
owners, trainers, instructors, stable employees and agents from any and all liability which
may hereinafter develop or accrue because of any injury, loss or damage which may be
suffered by me while either working around the horses or while riding.
I understand that:
Horses are animals and may not clearly understand the spoken language or other types of
signals given by humans to the horse. They may behave in a way that may result in
injury, harm or death to persons on or around them. Horses may react unpredictably to
sounds, sudden movement, and unfamiliar objects, persons or other animals.
While riding on pasture land, horses will be walking on ground that may be uneven,
contain holes, dips, rocks, and other materials or animals, which may startle the horse or
cause him to stumble, giving rise to a potential for injury. Furthermore, the roads and
surrounding areas are potentially injurious.
Passage Creek Stables is a privately owned boarding stable and farm, therefore, may
have multiple types of activities going on at any time on the property. Some may involve
farm equipment. There may be construction activity on adjoining property with large
equipment such as cranes and trucks. Such activities may startle horses, giving rise to
potential injury. Neighboring private home owners may also engage in activities which
may startle the horse, for example, outdoor birthday parties.
This Release from Liability includes any injury or harm that may come to me in observing
a horse event if I should place myself in proximity of an animal that is frightened or out of
I have been informed by the owner/director that I should not approach horses that are in
the surrounding pastures or in stalls without supervision of the horse owner or stable
director. There is a possibility that the horse will bite or kick. Not all horses are friendly.
I hereby assume and accept the full risk and danger of any harm, injury or damage which
may occur through or by reason of any event, object or condition, negligence or fault, of
any person or persons whatsoever. This Release extends to any personal
representatives, assigns and heirs and next of kin for any loss or damage or claim or
demands on account of any injury or property damage or death of the undersigned
whether caused by the negligence of the Releases or otherwise.
This waiver remains valid until revoked in writing.
