ORDINANCE NO. 83 - 2007
AMENDING THE ZONING CODE OF THE CITY OF MAUMEE,
OHIO, RELATIVE TO SIGNAGE FOR THE F-T-0 DISTRICT,
REPEALING CERTAIN SECTION, AND DECLARING AN
EMERGENCY.
WHEREAS, the amendments set forth below to the Zoning Code of the City of Maumee, Ohio,
have been requested by the administration of the City of Maumee; and
WHEREAS, proper notices have been given and public hearing thereon held by the Municipal
Planning Commission as required by this Zoning Code; and
WHEREAS, the Municipal Planning Commission has recommended approval of the
amendments presented; and
WHEREAS, the administration of the City of Maumee has requested and Council has
determined that a modification of the amendments presented to the Municipal Planning Commission is
warranted:
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Maumee, Ohio, that:
SECTION 1. Section 1135.01 of Chapter 1135 of the Maumee Revised Code be, and the same
hereby is, amended so that, as so amended, the same shall read as follows:
“1135.01 STATEMENT OF PURPOSE.
(a) The purpose of this chapter is to permit such signs as will not, by reason of their size,
location, construction, or manner of display, endanger life and limb, confuse or mislead
traffic, obstruct vision necessary for traffic safety, or otherwise endanger the public
morals, health, or safety; and further, to regulate such permitted signs in such a way as
to create land use patterns compatible with other major land use objectives and to
prevent such signs from causing annoyance or disturbance to the citizens and residents
of the City.
(b) The provisions of section 1135.22 through 1135.26 below shall control signage within
the F-T-O District. All other sections within this chapter shall be applicable with the
F-T-O District only to the extent that the provisions of that section do not conflict with
sections 1135.22 through 1135.26. In the event of a conflict, the provisions of sections
1135.22 through 1135.26 shall supersede the conflicting provision of this chapter.”

SECTION 2. The Maumee Revised Code be, and the same hereby is, amended by adding
thereto new Sections 1135.22 through 1135.24 so that, as so amended, the same shall read as follows:
“FALLEN TIMBERS OVERLAY DISTRICT RETAIL SIGNS
1135.22 SECTION 1 SCOPE, GENERAL PROVISIONS AND DEFINITIONS
(a) The provisions of this Fallen Timbers Overlay District Retail Sign Ordinance shall
only affect signs related to “retail uses” (as such term is defined in Section
1127.27(a) and supersede all conflicting provisions of this Zoning Ordinance.
(b) Placement of all signs shall be approved by the Applicable Administrative
Committee (as defined in that certain Declaration of Restrictions for Fallen Timbers
C-M Zoning District dated as of April 29, 2004 and recorded with the Lucas
County Recorder on April 29, 2004 at Lucas County Official Record 20040429-
0033761, as the same may be amended from time to time); provided, however, if
there is no Applicable Administrative Committee, placement shall be approved by
the F-T-O Architectural Committee as required in accordance with Section 1135.08.
(c) Illumination of signs shall be in accordance with Section 1135.13.
(d) In determining the size of a structure, the size shall be the ground-level footprint of
such structure based upon the exterior walls.
(e) In determining the square footage of a sign, the definition of “surface area of a
sign” defined in Section 1103.01(158) shall be used.
(f) In measuring the “linear foot of façade”, the total length of the façade which is open
and accessible at grade level shall be used.
(g) Marquee signs may only be used as Entrance Identification Signs and must meet all
requirements of 1135.24 (a)
1135.23 SIGNS PROHIBITED IN THE F-T-O OVERLAY DISTRICT
(a) The following signs are prohibited in the F-T-O District, unless a variance is
granted by the Administrative Board as otherwise provided in this Zoning
Ordinance:
(1) All of those signs set forth in Section 1135.12.
(2) Pole or Freestanding signs as defined in Section 1103.01.
1135.24 SCHEDULE OF REGULATIONS FOR SIGNS IN THE F-T-O DISTRICT

I. Wall signs shall not exceed one (1) square foot per linear foot of frontage of the façade the sign
is mounted upon, up to the maximum size allowed under section 1135.24 (a). Wall Signs may
only be placed upon the building which houses the business they advertise. In the case of
multi-tenant structures, wall signs may only be placed upon an exterior wall of the leased space
which houses the business they advertise. Wall Signs shall be a minimum of eight (8) feet
above grade and shall not extend above the parapet, if any, or roofline.
II. An applicant shall be entitled to utilize two (2) Entrance Identification Signs for a public
entrance or service window so long as each Entrance Identification Sign does not exceed fifty
percent (50%) of the size limitations set forth in 1135.24 (a).
III. No single occupant structure or tenant space shall have more than two (2) projecting signs and
no more than one (1) projecting sign per façade. Each projecting sign placed upon a building
shall reduce the total number of allowable wall signs by one (1) for that occupant, unless such
projecting sign is the Entrance Identification Sign. Projecting signs shall be at least eight (8)
foot above grade, not more than fifteen (15) feet above grade and shall not extend more than
six (6) feet from the façade.”
SECTION 3. Section 1135.01 of Chapter 351 of the Maumee Revised Code, as the same is
currently written, be, and the same hereby is, repealed.
SECTION 4. It is hereby found and determined that all formal actions of this Council
concerning and relating to the passage of this Ordinance were adopted in an open meeting of this
Council, and that all deliberations of this Council and any of its committees that resulted in such
formal action, were in meetings open to the public, in compliance with all legal requirements,
including Section 121.22 of the Revised Code of Ohio.
SECTION 5. This Ordinance is hereby declared to be an emergency measure and shall take
effect and be in force immediately from and after its passage. The reason for the emergency lies in
the fact that this Ordinance is necessary for the immediate preservation of the public peace, health
and safety in that construction of improvements in the F-T-O District are already in process and the
immediate modification of such signage restrictions is necessary to avoid delay and to avoid
additional cost in the construction schedule.
