Elements and performance criteria
Element 1
Describe New Zealand anti-discrimination law.
Performance criteria
1.1 Description includes the purposes of the Human Rights Act 1993, the New
Zealand Bill of Rights Act 1990, and the Employment Relations Act 2000 in
terms of their provisions relating to discrimination.
1.2 Description identifies grounds of unlawful discrimination as covered by the
Human Rights Act 1993.
Range five grounds from – gender (including pregnancy and childbirth),
marital status, religious belief, ethical belief, colour, race, ethnic
origins, disability (physical and psychological), age, political
opinion, employment status, family status, sexual orientation.
1.3 Description identifies examples of lawful discrimination, and provides reasons in
accordance with the Human Rights Act 1993.
Range at least two examples, which may include but are not limited to –
disability, gender, political affiliation, religious belief.
Element 2
Describe a legally recognised process and remedies to deal with unlawful discrimination.
Range one of – Human Rights Act 1993, Employment Relations Act 2000.
Performance criteria
2.1 Description outlines a legally recognised process for dealing with discrimination.
2.2 Description includes possible remedies with regard to having a complaint
upheld.
Please note
Providers must be accredited by NZQA, or an inter-institutional body with delegated
authority for quality assurance, before they can report credits from assessment against
unit standards or deliver courses of study leading to that assessment.
Industry Training Organisations must be accredited by NZQA before they can register
credits from assessment against unit standards.
Accredited providers and Industry Training Organisations assessing against unit standards
must engage with the moderation system that applies to those standards.

Accreditation requirements and an outline of the moderation system that applies to this
standard are outlined in the Accreditation and Moderation Action Plan (AMAP). The
AMAP also includes useful information about special requirements for organisations
wishing to develop education and training programmes, such as minimum qualifications for
tutors and assessors, and special resource requirements.
