AFFIDAVIT OF NOTICE

1. On ___ I sent the attached letter to ____, Director of the ____ Housing Authority,
advising her that if by ____ __'s unit in Public Housing was not repaired to the satisfaction of
the Building Department of the City of ____ and the Department of Children and Family
Services, or an alternative accommodation had not been provided for her, I would take legal
action to enforce ____ rights under her lease.
2. On ___, after viewing the premises in question, I spoke with___ on the phone and
informed her I would be seeking a Preliminary Injunction in this case on ____ at ____ in
3. On __ soon after my conversation with ____, I spoke on the phone with ____, the
attorney for the ___ Housing Authority, and informed him of my intention to seek a Preliminary
Injunction in this case on ____ at __ in Courtroom __.
4. If called upon to testify as a witness, I could testify competently to the matters and facts
set forth herein.

Ms. ____ recently contacted me regarding a problem she is having with the Housing Authority.
As I imagine you are aware, ____ home is one of several that were condemned by the City of
____ on ____. ____ indicated to me that she has repeatedly complained to the Housing
Authority regarding the bad conditions since ____. Now, as a result of these terrible conditions,
_____ children and grandchildren have been taken from her home and for the past two and one
half weeks, she has been forced to live separate and apart from them. As I am sure you
understand, this has caused her extreme emotional turmoil.
Section 11 of the Housing Authority's lease with ___ governs the Housing Authority's
responsibilities and duties when one of their units becomes uninhabitable and hazardous to the
life, health or safety of its occupants. It is my opinion that the reasonable period of time which
this provision gives the Housing Authority to restore the unit to a habitable condition has passed.
The Housing Authority has a duty, therefore, to ____ and her family to either immediately repair
her unit or provide her alternative accommodations. Please be advised that if by ___, ____ unit
has not been repaired to the satisfaction of the Building Department of the City of ___ and the
Department of Children and Family Services, or she has not been provided alternative
accommodation by the Housing Authority, I will be forced to take legal action to enforce ___
rights under her lease agreement with the Housing Authority.
