                     PRE-K LEAD TEACHER EMPLOYMENT AGREEMENT



This agreement is made and entered into this ______ day of ________, 20___, by and between Child
Development      Schools,    Inc.     (CDS)      and     ___________________________________,

1.      By signing this agreement, the employee accepts employment from CDS for the 2012-2013
        school year as a Pre-K Lead Teacher with an annualized pay rate of $__ __, __ __ __. __ __. The
        pay rate is conditional upon receipt of verification of the employee’s teaching credentials as listed
        in section 11.3 of the Georgia Voluntary Pre-kindergarten Program, 2012-2013 School Year Pre-
        K Providers’ Operating Guidelines. Until such documents are presented, the rate shall be $58
        daily. In addition, payment of the salary is contingent upon the receipt of funds from the Bright
        from the Start, Georgia’s Department of Early Care and Learning.

2.      The CDS Pre-Kindergarten calendar is planned to coincide with the local county/city public
        school district calendar; however, there may be differences. For purposes of this agreement, refer
        to contract attachment for the full and complete employment period beginning and ending dates,
        and number of working days. The beginning and ending dates of this period may be adjusted,
        however, to accommodate any unplanned school closures. Teachers are expected to work all
        scheduled work days, including teacher work days. Any teacher who does not work all scheduled
        work days forfeits his or her right to payment for the day(s) not worked, unless any such days are
        covered by the leave policy. This would include any days eliminated due to budget restraints.

3.      Employees will be paid a daily equivalent of their annualized salary from the “Contract Start
        Date” thru “Pay Ends” on the contract attachment (less unworked days with no available leave
        time). In addition, a portion of each pay will be deferred to pay for an estimated fifty-two (52)
        calendar weeks (adjusted for employees not working the full school calendar). On a regularly
        scheduled school day, in accordance with the CDS Pre-kindergarten calendar, wages will be paid
        for an equivalent of 8 hours. The actual scheduled work hours may be more or less than 8 hours
        per day and teachers are expected to work the full scheduled hours. Any difference to the
        scheduled hours will be posted to vacation leave. Worked hours may combined with leave hours
        to constitute the full daily equivalent. Employees must sign in and out each day in accordance
        with their school’s policy. Employees will receive their deferred pay at the conclusion of the paid
        school year. The deferred pay will be paid bi-weekly until the deferral is exhausted. Deferred
        pay will also be utilized to continue elected benefits during the summer.

4.    By signing this agreement, the employee accepts the job responsibilities of teaching and/or any
      other professional duties at the CDS School. The employee agrees to work the scheduled hours
      each day on the campus with the exception of training sessions and/or Director-approved field
      trips. Each workday will consist of instruction including the children’s meals and naptime and
      student planning and/or preparation. The employee agrees to perform other services on behalf of
      CDS as assigned (and paid accordingly); however, during the scheduled work hours daily, the
      employee may only work in the capacity of Pre-K.

5.    By signing this agreement, the employee understands she/he is to be supervised by and is
      accountable to the School Director. All questions, concerns, and/or problems should be directed
      to the School Director. The employee also agrees and understands that the Pre-Kindergarten
      Teacher position warrants no special privileges and is in an equal position to any and all other
      teaching and staff positions in the CDS School.

6.    By signing this agreement, the employee understands that the CDS Pre-Kindergarten Calendar
      (usually designed to match the public school calendar) will define holidays. Each employee may
      use up to five (5) leave days (maximum of 40 hours, pro-rated based upon portion of school year
      worked) with pay if needed during the scheduled program year. Leave days must be pre-
      approved by the School Director and those days not used before the end of the scheduled program
      year are not payable. First year teachers with CNI may not take any paid leave days until the
      completion of 90 days. Tardiness, time-off for appointments, etc. will be deducted from the five
      (5) leave days allotted during the school year.

7.    By signing this agreement, the employee agrees to follow the policies and procedures of CDS as
      well as the guidelines of Bright from the Start. The School Director upon request will explain the
      policies and procedures.

8.    By signing this agreement, the employee understands there are training requirements mandated by
      Bright from the Start and agrees to abide by these requirements. The employee also understands
      that they are required to attend parent workshops, staff meetings and other special activities
      required of all staff members.

9.    By signing this agreement, the employee agrees and understands that duties are to be shared
      equally with his/her assigned Pre-Kindergarten Teacher/Paraprofessional. The intent is to
      develop the teaching skills of the Paraprofessional and avoid under utilizing her/him with only
      hygiene related tasks.

10.   By signing this agreement, the employee agrees and understands that she/he will be subject to
      frequent performance reviews conducted by the School Director. The employee also understands
      that Bright from the Start will conduct periodic on-site evaluations and failure to abide by CDS/
      Bright from the Start, Department of Early Care and Learning policies and procedures will result
      in the issuance of warnings and citations. Serious violations and continued violations of a similar
      nature can result in termination of employment.

11.     By signing this agreement, the employee agrees and understands she/he is an employee of CDS.

12.     By signing this agreement, the employee agrees and understands that she/he is an “at-will”
        employee of CDS, and nothing in this agreement should be interpreted as altering the employee’s
        “at-will” status, or be construed to create a contract that guarantees employment for a certain
        period of time. Either party to the agreement may terminate the agreement for any reason, with or
        without cause, upon two weeks written notice.

13.     If CDS terminates the employment of any employee, CDS may, in its discretion, also suspend
        that employee’s classroom duties during the two week, paid notice period. If CDS terminates an
        employee for misconduct or for cause, CDS is not obligated to provide that employee with two
        weeks notice. If an employee is terminated by CDS, or resigns his or her employment prior to the
        end of the complete employment period, their pay will be reviewed to ensure they receive the
        proper pay equivalent to the actual number of days the employee worked during the school year.
        The employee will be paid for any deferred salary on a biweekly basis at the conclusion of the
        contracted/paid school year.

14.     If the employee wishes to terminate this agreement, he or she must provide the School Director
        written notice of his/her desire to resign at least two weeks prior to his or her date of resignation.
        Failure to provide a two week notice, work as scheduled, or failure to behave professionally in the
        classroom during the two-week notice period, may subject the employee to a penalty in an
        amount of up to $1000.00 for such failures. This penalty amount will automatically be withheld
        form the employee’s pay.

I have read and understood all sections of this agreement. This contract is binding upon signing by both
parties with each page initialed by employee.
