The laws that currently govern collection practices across the industry are not completely relevant to loss mitigation, default and foreclosure procedures used by mortgage servicers, and their application to mortgage enforcement results in unnecessary delays and increased costs and confusion. "What we're dealing with is a very emotional issue - the default collections process and subsequent foreclosure on a mortgage, and it is further complicated by the mere fact that a person's home is in jeopardy of being repossessed," Alt said. "There is a huge difference in both the mentality and scope of the situation surrounding collection activity on a residential mortgage as opposed to collecting a delinquent credit card debt. The homeowner certainly has a vested interest in 'making good' on the loan, and the industry should be able to operate more in accordance to the reality of these volatile situations. Alt also contends that the notice requirements of the FDCPA are not consistent with the federal bankruptcy laws, as well as many state regulations. In attempting to satisfy both the FDCPA and other laws, the attorney often creates more confusion for homeowners and frustrates their efforts to reinstate the mortgage loan.
