Blinn College, the Junior College District of Washington County, is receiving bids for Dry Good
Products for the Cafeteria located on the Brenham Campus.

Bids must be submitted in the Blinn College Purchasing Department, 902 College Avenue, Old Main
Room 204, Brenham, Texas 77833, by 2:00 PM January 11, 2012.. Pursuant to the Provisions of Texas
Government Code Title 10 subtitle D Chapter 2156.121-2156-127, General Services Act rules and
regulations adopted there under, bids will be received until the date and time established for receipt. After
receipt, bids will be read aloud. All bids shall become the property of the College.

Please indicate in the lower left hand corner that this is bid #873 – Dry Good Food Products.

Bids shall be opened in the Administration Building, second floor, room number 230.

Bidders must submit their forms on the bid form which is provided at the end of this document.
The bid may be reproduced if multiple bids are submitted. The bidder (not the carrier/mail
service/other or College) is solely responsible for ensuring the bid is received prior to the bid
opening date and time in the Purchasing Department as specified on the bid form. Late offers
will be returned to Respondent unopened. Faxed proposals are not acceptable.


    III.     BID FORM

                                  I. GENERAL REQUIREMENTS

1.0   Definitions:

      1.0.0   Bidder: The vendor; person offering a price for a product or service.

      1.0.1   Contractor: The vendor who has received the bid award and will enter into a contract
              with Blinn College.

1.1   Blinn College reserves the right to award bids in a manner most advantageous to the College.

1.2   Blinn College reserves the right to reject any and all bids and to waive any formalities connected

1.3   Blinn College is a state-supported public junior college and, as such, is exempt from paying state
      sales tax.

1.4   The contractor may not assign his rights and duties without the written consent of Blinn
      College. Such consent shall relieve the assignor of liability in the event of default by his assignee.

1.5   In case of default by the original contractor, Blinn College may procure the service from another
      source and hold the contractor responsible for any excess cost.

1.6   By submitting a bid, the bidder agrees that all requirements specified are met.

1.7   Blinn College reserves the right to cancel this agreement, with good cause, upon a thirty (30)
      day written notice.

1.8   Insurance: Contractor must furnish Blinn College with a certificate of insurance for
      Commercial Liability, including Personal and Workman’s Compensation (Statutory Limits)

1.9   Contractor will assume full responsibility for any damages to Blinn College’s equipment or
      premises caused by negligent or intentional acts or omissions of the Contractor’s employees,
      agents or officers.

2.0   Blinn College will not be responsible for damage or loss to Contractor’s equipment due to
      vandalism or other causes.

2.1   Blinn College will not enter into any contract where the cost is provisional under such clauses as
      “escalator” or “cost plus”.

                                        II. BID SPECIFICATIONS
1.0   Bid 872 will be awarded as a WHOLE section, not by line item. Bidders are encouraged to bid
      on all items in each section. (See below for substitutions.) The successful bidder will be
      determined by the total overall cost to the college for the entire bid. The total cost to the college
      will be determined by the estimated forecasted usage number multiplied by the cost per unit of
      measure. The estimated forecasted usage number is based on a 6 month history.

1.1   Brand names, preferred packer, and manufacture code, when specified, are required to be
      bid as such. Substitutions will only be considered once a sample is provided to the Blinn
      College Director of Food Services, preferably prior to the bid opening and award. It will
      then be determined if the substitute brand is acceptable. Substitute items should be
      CLEARLY noted on the bid form. If a substitute item is not accepted by Blinn College, that
      particular item/items only may be pulled from the winning bidder and purchased from
      another vendor of choice.

1.2   The duration of Bid #872 will be for six (6) months, March 1, 2012 to August 31, 2012.

1.3   The successful bidder is required to make a minimum of two (2) deliveries per week.
      Deliveries must be made between the hours of 6 a.m. and 11 a.m.

1.4   If the vendor that is awarded the bid for a particular product is not able to fulfill their obligations
      due to availability of that product, Blinn College shall have the right to purchase that product
      from another vendor of choice.

1.5   The successful bidder must furnish Blinn College with a certificate of insurance for Commercial
      General Liability, including personal injury and workman’s compensation (statutory limits)
      within fifteen days of award.

1.6   The bid shall include any and all costs of delivery

State of Texas Legislative Senate Bill No. 1, Section 44.034, Notification of Criminal History, Subsection
(a), states “a person or business entity that enters into a contract with a school district must give
advance notice to the district if the person or an owner or operator of the business entity has been
convicted of a felony. The notice must include a general description of the conduct resulting in the
conviction of a felony.”

Subsection (b) states “a school district may terminate a contract with a person or business entity if the
district determines that the person or business entity failed to give notice as required by Subsection (1)
or misrepresented the conduct resulting in the conviction. The district must compensate the person or
business entity for services performed before the termination of the contract.

This notice is not required of a publicly-held Corporation.
