                                     SECTION A
                              INTRODUCTION, REFERENCES

The First Amendment to the United States Constitution provides that “Congress shall make no
law respecting an establishment of religion, or prohibiting the free exercise thereof.” This
amendment applies to all governmental entities, not merely the Federal Government or Congress,
and has been interpreted to mean, in its most basic form, that government should neither sponsor
nor endorse any religious activity, nor discriminate against religion or religious expression.

Holiday displays in or on public property involves both of these First Amendment principles. In
order to respect both principles, Pasco County and the employees of the Board of County
Commissioners observe the following policy concerning displays in County buildings and on
County property during the winter holiday season.

The following policy will be observed in County-owned buildings and on County-owned
property operated by the Board of County Commissioners and in which County business is
conducted. Private persons or businesses leasing or renting space in a County owned building are
not subject to this policy.

The West Pasco Judicial Center, located at 7530 Little Road, New Port Richey, and the Pasco
County Courthouse, located at 38053 Live Oak Avenue, Dade City, are specifically excluded
from this policy.

Individual departments may have additional holiday display policies as necessary for the goals
and purposes of the department. Such policies may not be in opposition to this policy.

                                 SECTION B
  HOLIDAY DISPLAYS IN PUBLIC AREAS INSIDE COUNTY BUILDINGS AND ON
COUNTY PROPERTY (Other than Public Meeting rooms and Elderly Nutrition Dining Rooms)

         All displays will be limited to secular items such as snowmen, reindeer, santas, garlands,
          wreaths, gingerbread houses, lights, etc. A traditional evergreen tree may be used but all
          decorations must be secular in nature.

         No tax funds will be spent on holiday displays with the exception of Holiday events
          conducted by the County.

         The amount of time used by employees to erect displays should be limited and should not
          interfere with normal job duties. It is recommended that lunch hours be used for erecting
          holiday displays.

         Members of the public will not be permitted to add to the displays or to erect displays
          inside the buildings except as described in Section C.

         Donations of holiday display items may be accepted if they are not of a religious nature.
          All donations become the property of the County and may be displayed or discarded at
          the discretion of the County Administrator or designee.

         A donated menorah may be displayed, but must have the following message displayed
          with it.
                                            “Salute to Liberty.
          During this holiday season Pasco County, Florida, salutes liberty. Let these festive lights
          remind us that we are the keepers of the flame of liberty and our legacy of freedom”


                                     SECTION C
                     HOLIDAY DISPLAYS IN PUBLIC MEETING ROOMS AND
                           ELDERLY NUTRITION DINING ROOMS


         Public meeting rooms and Elderly Nutrition dining rooms are not to be decorated by
          employees except in a case where the space is to be utilized for a department sponsored
          public program. Decorations will be limited to secular items as noted in Section B.

    Employees may utilize regular work time to decorate for programs that will be presented
    to the public. All decorations are to be removed as soon as is reasonable after the
    program is done.

   Groups using the public meeting rooms and Elderly Nutrition dining rooms may use their
    own holiday decorations for their purposes within the guidelines for the use of such area.
    Decorations may not be attached to walls or furniture in such a way as to cause damage.
    Decorations must not create a health or safety hazard. All decorations must be removed
    after the meeting or program. Any decorations not removed may be discarded or stored at
    the discretion of the Department Director or designee.


                               SECTION D
               HOLIDAY DISPLAYS OUTSIDE OF COUNTY BUILDINGS


   County-owned property or the outside of County-owned buildings will not be decorated
    by employees except in specific circumstances as approved by the Board of County
    Commissioners. Holiday Card Lane, held in various parks, is and event of long-standing
    tradition and will continue as is has through the years.

   Private individuals or groups of individuals may erect holiday displays outside County-
    owned buildings, if the County authorizes “open displays”, only in specific areas as
    designated by the County Administrator or designee and only from December 15 to
    January 15.

   Space for displays will be allocated on a first come, first served basis. The amount of
    space available for each display may be limited to allow equitable access. The total
    amount of space available for public displays may be limited. Buildings that are
    designated as construction sites, or other sites that may have restrictions due to safety or
    security, will not be allowed to be utilized for displays.

   Persons wishing to erect a display must notify the County prior to erecting the display by
    completing and submitting a “Public Holiday Display Form” to the department doing
    business in the building or on the property where the display is to be erected. Displays
    that are erected without proper notification or displays that are erected in areas other than
    those designated for that purpose may be removed and discarded at the expense of the
    person erecting the display.

   Displays may not be illegal, defamatory, or obscene. Determination of this status will be
    referred to the County Attorney’s Office.

   Displays may not present a health or safety hazard to the public and must be securely
    anchored. Displays may be inspected for safety by County Facilities Management or the
    Department of Health. Displays that do not conform to this status will be removed and
    discarded at the expense of the person erecting the display.

   Any necessary repairs as a result of property damage caused by a display will be at the
    expense of the person erecting the display.

   No electric service paid through tax funds may be utilized for displays erected by private
    individuals.

   No sound amplifiers or machinery that causes a disturbance to surrounding residents may
    be utilized in displays.

   The County assumes no responsibility for the preservation, security or possible damage
    or theft of any item displayed.

   It is the responsibility of each County Department affected to place a sign in the area of
    displays erected by members of the public as follows:

                “Display Created, Erected, and Sponsored by Private Citizens.
                       Not endorsed or sponsored by Pasco County.”


                              SECTION F
    HOLIDAY DISPLAYS IN SPACES UNIQUE TO INDIVIDUAL EMPLOYEES
                   OR SHARED EMPLOYEE AREAS

   Employees may erect holiday displays in their areas of any nature for their personal
    enjoyment.

   Displays may not be illegal, defamatory, obscene, distracting to other employees in the
    performance of their work, or pose a health or safety hazard.

   The amount of time used by employees to erect displays should be limited and should not
    interfere with normal job duties. It is recommended that lunch hours be used for erecting
    such holiday displays.

Instructions: This form is to be completed by members of the public seeking to erect a winter
holiday display on County-owned property. Such displays are governed by the Pasco County
Board of County Commissioners’ Holiday Display Policy, Section D. A copy of this policy is
available upon request.
     Please provide all information requested. Incomplete forms will be rejected.
     Please submit the completed form to the appropriate Department headquarters or as
       instructed by the on-site County employees.
     You will be contacted when the form is approved. Displays may not be erected prior to
       form approval.
     Displays may not be erected before December 15 and must be removed by January 15.
