COLORADO REAL ESTATE COMMISSION
NOTICE OF PROPOSED RULEMAKING
October 3, 2006
Pursuant to and in compliance with Title 12, Article 61 and Title 24, Article 4, C.R.S. as
amended, notice of proposed rulemaking is hereby given, including notice to the Attorney
General of the State of Colorado and to all persons who have requested to be advised of
the intention of the Colorado Real Estate Commission to promulgate rules.
The notice proposes to repeal and reenact Rule E-22 concerning inducements from
providers of settlement services prohibited pursuant to §12-61-113.2, C.R.S., and the
Commission's broad delegation of authority in §12-61-114 (4), C.R.S.. The notice also
amends Rule E-41 concerning change of status disclosure in writing, and amends Rule F-
1 concerning permitted and prohibited form modifications also pursuant to §12-61-114
Further, the notice proposes to add new forms, including a new real estate form for the
disclosure of affiliated business arrangements and repeals and amends other forms
pursuant to §12-61-113.2 (2) (b), and §12-61-114(4) C.R.S. With the addition of the new
rule, conforming changes will be made to Rule F-7 that lists all Commission approved
Last, the notice proposes to add a new rule E-46 concerning affiliated business
arrangements pursuant to §12-61-113.2 (5), C.R.S.
A preliminary discussion of the proposed rules and form will be had at the September 12,
2006 meeting of the Real Estate Commission, 1560 Broadway, Ste. 925, Denver, CO,
80202, at 9 a.m.
The rule-making hearing for these rules shall be on October 3, 2006, at 9 a.m., in a joint
rule-making hearing with the insurance commissioner for rules E-22 and E-46 and the
affiliated business arrangement disclosure form. Any interested person may participate in
the rule-making through submission of written data or testimony to the Real Estate
Commission. The Commission will consider all submissions.
Please be advised that all rules being considered are subject to further changes and
modifications after public comment and formal hearing.
