                          MINUTES OF PROCEEDINGS

At a meeting of the Planning Applications Sub-Committee No 2 on Thursday 21 April
2005 at 6.30pm, at City Hall, Victoria Street, SW1.

1.    MEMBERSHIP

      There were no changes in membership.

2.    DECLARATIONS OF INTEREST

      Councillor Frances Blois declared, in respect of application 3 (17 Wilton
      Street, SW1), that she had a prejudicial interest because the Revd.
      Prebendary Desmond Tillyer had been her Chaplain when she was Lord
      Mayor of Westminster and that she would leave the room when this
      application was considered.

      Councillor Michael Brahams declared that he no longer had an interest in
      respect of any applications relating to Shaftesbury PLC because his friend
      had ceased to be Chairman of this company.

      The Chairman declared, in respect of application 4 (1 Bessborough Gardens,
      SW1), that he would stand down from the Sub-Committee and make an oral
      submission as a Ward Member.

3.    MINUTES

      The Chairman, with the assent of the members present, signed the minutes of
      the meeting held on 17 March 2005.

4.    TREE PRESERVATION ORDER No. 530 (2004) – 145 HAMILTON
      TERRACE, NW8

      RESOLVED: That Tree Preservation Order No 530(2004) be confirmed
      without modification with immediate and permanent effect.

5.    PLANNING APPLICATIONS

      The Director of Planning and City Development submitted reports in relation to
      the following applications for determination by the Sub-Committee, copies of
      which are included in the Register in the custody of the Director of Legal and
      Administrative Services.
(1)   128 EBURY STREET, SW1 (TP 15650) Erection of a half depth rear
      extension to existing closet wing at second floor level.

      RESOLVED: That, in accordance with the recommendation of the
      Director of Planning and City Development, conditional planning
      permission be granted.

(2)   SERPENTINE GALLERY, KENSINGTON GARDENS, EXHIBITION
      ROAD, W2 (TP 22085) Erection of a temporary pavilion for a period
      between 20 June and 2 October 2005.

      Additional representations were received from English Heritage
      (12/04/2005).

      RESOLVED: That, in accordance with the recommendation of the
      Director of Planning and City Development, conditional planning
      permission be granted.

(3)   17 WILTON STREET, SW1 (TP 12386) Alterations including erection
      of a mansard roof extension, rear extensions at basement to second
      floor level.

      Having declared a prejudicial interest, Councillor Frances Blois left the
      room prior to consideration of this application and took no part in the
      discussion or decision.

      RESOLVED: That, in accordance with the recommendation of the
      Director of Planning and City Development, conditional planning
      permission and conditional listed building consent be granted.

(4)   1 BESSBOROUGH GARDENS, SW1 (TP 15173) Installation of four
      air conditioning units, acoustic barrier, ducting and five satellite dishes
      at roof level, CCTV cameras, oil tank and generator enclosure and
      seven wall-mounted lights at rear basement level, front entrance
      screen and door and rear security gates.

      Additional representations were received from Richard Haythornthwaite
      (12/04/2005) and Yvonne Renouf Smith (19 and 20/04/2005).

      Councillor Duncan Sandys stood down and addressed the Sub-
      Committee as a Ward Member.

      RESOLVED: That consideration of this application be deferred to seek
      from the applicant:
      a) a revised gate design and position;
      b) the gate to be silent;
      c) resolution of the television and computer interference problems
         experienced by residents with, if necessary, the applicants funding
         an independent analysis of this interference;
      d) screening of the air conditioning units and satellite dishes;
      e) details of the vehicular movements;
      f) the establishment of a liaison group and contact point for the
         residents; and
      g) coverage of the wall-mounted lights to prevent light spillage.

(5)   86 HORSEFERRY ROAD, SW1 (TP 8361) Erection of infill extension
      at first to third floors on Monck Street frontage to rear of White Horse
      and Bower public house and conversion of upper floors of public house
      to provide five residential units comprising 4x1 bedroom units and 1x3
      bedroom unit.

      RESOLVED: That, in accordance with the recommendation of the
      Director of Planning and City Development, conditional planning
      permission and conservation area consent be granted.

(6)   SOUTH WEST DELIVERY OFFICE, 9 HOWICK PLACE, SW1 (TP
      9489) Redevelopment behind retained (part) façade to provide main
      building comprising basement, ground and six upper floors and corner
      building of basement, ground and four upper floors with pedestrianised
      street between main and corner builiding. Buildings to provide five retail
      units (Class A1/A3) at ground and mezzanine floor, 122 residential
      units including 36 affordable units on upper floors and 78 car parking
      spaces, bike park and refuse storage at basement level.

      Additional representations were received from Dominion Housing
      Group (07/04/2005) and DTZ Pieda Consulting (19 and 21/04/2005).

      RESOLVED: That consideration of this application be deferred to seek
      from the applicant:
      a) a community safety office on site;
      b) a management statement for the pedestrianised street;
      c) the financial contribution for public art to be put towards community
         facilities instead;
      d) redesign of the closest new windows to minimise overlooking;
      e) the incorporation of a public recycling facility within the scheme;
      f) the provision of the private and social housing ready for occupation
         at the same time;
      g) changes to the housing mix to reduce the number of 1 bedroom
         units and increase the number of 2 or 3 bedroom units and bring
         the mix of affordable and key worker housing in line with the
         requirements of the Unitary Development Plan;
      h) an increase in the number of car parking spaces and an operational
         statement for how car parking will be managed; and
      i) a financial contribution towards educational facilities.

(7)   16 BERKELEY STREET, W1 (TP 1252) Use as personal training
      centre for physical training, physiotherapy, nutritional consultation and
      yoga at basement and part ground floor levels.
       RESOLVED: That, in accordance with the recommendation of the
       Director of Planning and City Development, conditional planning
       permission be granted.

(8)    KINGLY COURT, W1 (TP 1452) Erection of a temporary fabric roof
       over the courtyard at Kingly Court for a number of periods throughout
       the year.

       Additional representations were received from The Soho Society
       (08/04/2005), Shaftesbury Carnaby Ltd (19/04/2005) and Rolfe Judd
       (21/04/2005).

       RESOLVED: That, against the recommendation of the Director of
       Planning and City Development, planning permission be granted
       subject to:
       a) the roof being erected for a maximum of 36 days per year;
       b) the planning permission being for 5 years; and
       c) an informative requiring regular maintenance.

       The Sub-Committee agreed that with the reduction from a possible 120
       days to 36 days per year and the limit on the permission to five years,
       any detriment to the appearance and character of Kingly Court would
       be acceptable.

(9)    13 SHERWOOD STREET, W1 (TP1211) Use of second floor as health
       club (Class D2). (Site includes bridge link at second floor level).

       Additional representations were received from Environmental Health
       Consultation Team (11/04/2005) and The Soho Society (09/04/2005).

       RESOLVED: That, in accordance with the recommendation of the
       Director of Planning and City Development, conditional planning
       permission be granted.

       The Sub-Committee asked that the temporary use of the eighth floor of
       the building as office space without planning permission be resolved
       swiftly.

(10)   THE LONDON PAVILION, 1 PICCADILLY, W1 (TP 5800) 1. Use of
       part ground, first, second, third, third mezzanine and fourth floors as an
       event venue including provision of 420 seat auditoruim and facilities for
       conferences, trade shows/exhibitions and corporate hospitality with
       dining capacity for 500 persons (sui generis). 2. Internal alterations in
       conjunction with use of part ground, first, second, third, third mezzanine
       and fourth floors as an event venue (sui generis).

       An operational management plan from the applicants was circulated to
       the Sub-Committee as an additional representation.
            RESOLVED: That, in accordance with the recommendation of the
            Director of Planning and City Development,
            1a) conditional planning permission be granted subject to a legal
            agreement to secure the following:
             A management agreement;
             A financial contribution greater than £5,000 towards temporary
                public conveniences in Soho. The Chairman of the Sub-Committee
                is to be consulted on the amount;
             A scheme to be submitted to and agreed by the City Council for
                CCTV cameras before any work starts on site; and
             A scheme to be submitted to and agreed by the City Council for
                lighting under the Great Windmill Street covered walkway before
                works start on site.

            1b) If within six months of the resolution to grant conditional planning
            permission the legal agreement has not been completed or there is no
            immediate prospect of the agreement being completed, the application
            may be reported back to Sub-Committee.

            2) listed building consent be granted.

     (11)   LONDON BUSINESS SCHOOL, SUSSEX PLACE, REGENTS PARK,
            NW1 (TP 3332) Removal of existing part rear roof of the Sainsbury
            building (1-26 Sussex Place) in connection with the erection of a new
            rear roof extension to create additional office/research space for the
            London Business School.

            RESOLVED: That, in accordance with the recommendation of the
            Director of Planning and City Development, conditional planning
            permission and conditional listed building consent be granted subject to
            English Heritage’s authorisation.

     (12)   175 PRAED STREET, W2 (TP9914) Continued use as a hot food take-
            away (Class A5) on ground and first floor and installation of extract
            duct at the rear of the building terminating at roof level.

            Additional representations were received from Councillor Anne
            Mallinson (17/04/2005) and South East Bayswater Residents’
            Association (20/04/2005).

            RESOLVED: That, in accordance with the recommendation of the
            Director of Planning and City Development, conditional planning
            permission and conditional listed building consent be granted.

6.   TERMINATION OF MEETING

     The meeting ended at 8.37pm.
