Issues: The High Court disposed of WP No. 321/2010 with a judgment dated 12/08/2010
where it recorded the solemn assurances on oath by the Goa Cricket Association that it will
not commence construction of its project of building an international cricket stadium until it
procures necessary clearances. However, without obtaining the mandatory environmental
clearance GCA has commenced with construction of phase 1 of its construction of the
stadium in the 2nd week of December 2010 and 125 trees have been felled in the non-Forest
area and excavators and trucks have begun to excavate the land for purpose of
construction of the stadium.
Hence the Goa Foundation filed a petition for the second time against the GCA challenging
the Government of Goa’s approval for felling 125 trees under the Goa Trees Act 1984by its
NOC dated 2/12/2010 and seeking termination of all activities at the site.
During the pendency of the petition the court recorded on 27th December 2011 a statement
made by counsel for GCA that it has discontinued all work at the site. No further work was
thereafter done at the site. On the 3rd February 2011 the MoEF wrote a letter dated 3rd
February 2011 to the Secretary (Forests) Government of Goa to inform them that approval
for project has been held in abeyance till further notice. On 24th February 2011 the Goa
State Environment Impact Assessment Authority granted the GCA prior conditional EC
subject to NOC from the MoEF regarding the diversion of forest land. Hence, until forest
clearance was received no further wok could be done at the site.
29th March 2011: The Court decided to dispose of the petition in view of the letter of the
MoEF dated 3rd February 2011 holding the forest approval in abeyance and the Goa –SEIAA
letter dated 24th February 2011 granting the GCA prior conditional EC subject to NOC from
MoEF regarding diversion of forest.
