MOTION made by Supervisor Hoffman, seconded by Councilman Czerniak and
unanimously approved to accept the minutes of the December 9, 2010, Town Board
Meeting as presented.

INSURANCE COMMITTEE REPORT
Councilman Arcara reported that the Town of Colden has received an insurance proposal
from First Niagara Risk Management, Inc. at a cost savings of $6,000.00 for 2011.

CABLE COMMITTEE REPORT

HIGHWAY & PARKS REPORT
Highway Superintendent Edward Wochensky reported that –
-A check for the 2010 CHIPS money has been received.
-The Project Planner from Erie County has advised that they will try to alleviate the
 visibility blind grade problem on Heath Road by moving several poles further back
 from the edge of the road. Ed explained that the problem arises during the winter. The
 Town of Colden is under contract with Erie County to plow Heath Road. The width of
 the snowplow presents a problem with the blind grade. The snowplow must swing out
 because of the location of the poles which puts the plow into the driving lane of the other
 driver. Erie County will address this problem in the Spring.
-Agreement to Spend – MOTION made by Supervisor Hoffman, seconded by
 Councilman Arcara and unanimously approved to accept the Agreement to Spend form
 in the amount of $157,861.00 to be expended on 21.35 miles of Town Highways as
 prepared by Highway Superintendent Edward Wochensky.
-CHIPS Funds – Ed stated that the CHIPS funding is in jeopardy for 2011.
-Burr Road Speed Study – Motion made by Supervisor Hoffman, seconded by
 Councilman Arcara and unanimously approved to send a T-9 form to Erie County
 requesting a speed study be conducted on Burr Road.

YOUTH & ADULT RECREATION REPORT
Recreation Director, Kip Palmateer reported that –
-Approval be granted for a newsletter to be mailed out the end of January or early
 February to announce upcoming programs:
 Spring Soccer - Registration deadline is March 31, 2011.
 Babysitting Course
 Winter Fun Day – A free event held at Kummer Park
 Colden Tubing Night – Thursday, February 24, 2011 from 5pm to 9pm.
                                                  $10.00 Tickets can be purchased
from the         Recreation Director.

PERSONNEL REPORT
Councilman Arcara reported that –
-Approval has been received from Erie County Personnel for a Maintenance Worker and
 Water Maintenance Worker. Both positions are part-time non-competitive. MOTION
 made by Councilman Arcara, seconded by Councilman Czerniak and unanimously
 approved to advertize for these two positions.

SOLID WASTE & NEST REPORT

LIBRARY REPORT
Councilman Czerniak reported that –

-Story Hour resumes on January 6 for children ages 3 to 5 years at no charge.
 Age appropriate stories and crafts and a small snack provided. Children must be
 accompanied by an adult.
-A full page list of activities is posted on the bulletin board in the hallway of the Town
 Hall.

STREET LIGHTING
Councilman Murphy said that John Kotlarsz has been working on the Historical Street
Light problem. He has replaced 11 lamps that were out. John has informed NYSE &
Gas of the problem with no response at this time. NYSE & Gas is responsible for
replacing burned out lamps. John suggested drawing up a map of the historical lights and
numbering each pole in order to keep track of dates lights are replaced.

DOG CONTROL REPORT
DCO, Christa Pouthier reported that-
-Five calls have been received so far in December.
-Several calls about dogs running loose on Blanchard and Route 240. Checked, no sign
 of them.
-Two Bit Bull mix dogs were picked up on Center Street. The owner called. A fine was
 collected and the dogs returned to the owner.
-An anonymous call was received about a barking dog on Holland Glenwood Road. No
 formal complaint was filed.
-A resident called stating that they had lost their cat.

BUILDING/CODE ENFORCEMENT OFFICER REPORT
Report for the month of December, 2010 – Bldg. Insp/Code Enf. Officer Bernie Horschel
gave the following report.

FIRE INSPECTOR REPORT
Fire Inspector, John Kotlarsz reported that there were 24 Fire Inspections conducted for
2010, for both Public Assembly Areas and Businesses. John said that there will be new
forms for 2011. The first training session he will attend in January will be pertaining to
Fire Inspections. Electronic Filing will be required for Annual Reports to NYS.

WATER COMMITTEE REPORT
No Report

CENSUS REPORT
Councilman Czerniak commented on several interesting news articles showing the shift of
the population and the loss of representation for the area. She also found many interesting
facts pertaining to the Town of Colden. Many facts compared the 2000 Census to the
present figures, such as income, family size, mortgage rates and education
levels for various areas in Town.

HISTORICAL SOCIETY/BICENTENNIAL COMMITTEE
Councilman Arcara said that a meeting will be set for early in February in preparation
for the 2011 Festival. Volunteers are needed.

OLD BUSINESS
Approve Erie County Personnel’s Acceptance for the Town Hall Maintenance Worker
Position – Supervisor Hoffman explained that hiring a part-time maintenance worker
would save the Town money. Repairs could be made to the Town Hall without paying
prevailing wages for maintenance concerns.
MOTION made by Councilman Arcara, seconded by Supervisor Hoffman and
unanimously approved to accept the Town Hall Maintenance Worker Position as
approved by Erie County Personnel.

Approve Erie County Personnel’s Acceptance for the part-time Water Maintenance
Worker
MOTION made by Supervisor Hoffman, seconded by Councilman Arcara and
unanimously approved to accept the part-time Water Maintenance Worker position as
approved by Erie County Personnel.

NEW BUSINESS
Purchase New Printer/Copier/Fax/Scanner – Supervisor Hoffman requested Town Board
approval to purchase a Printer/Copier. She said this machine would be purchased on
State bid, total cost $3619.00. Monthly payment will be $100.53 with no interest.
Training will be provided. This machine will be capable of making copies, faxing and
scanning. All Town Hall computers will be networked to this new machine.

Councilman Arcara asked what would happen to the present copy machine?
Supervisor Hoffman said that the old machine is a dinosaur and needs to be replaced.
MOTION made by Supervisor Hoffman, seconded by Councilman Murphy and
unanimously approved to purchase a new Printer/Copier/Fax/Scanner as stated above.

Networking Cable Installation for the new Printer Equipment - Supervisor Hoffman
requested approval to hire the IT person to come in to hook up all computers to the
new printer/copier. Cost not to exceed $600.00.
MOTION made by Supervisor Hoffman, seconded by Councilman Czerniak and
unanimously approved to hire the IT person to hook up the new printer/copier, cost not to
exceed $600.00.

Ice Problem on Town Hall -Supervisor Hoffman said that North Wind Insulation will be
coming out on Monday to address the ice and insulation problem at the Town Hall. Price
quoted was $1,700.00.
MOTION made by Supervisor Hoffman, seconded by Councilman Czerniak and
unanimously approved to have North Wind Insulation address the ice problem by
adding additional insulation over the old and new sections of the Town Hall. Cost not to
exceed $2,000.00.

Senior Center Front Door – Supervisor Hoffman advised that another portion of North Wind
Insulation will be conducting a pressure test on the Senior Center front door. They will seal
up the door and do a pressure test and take infrared pictures to determine where the heat loss
is. This service will be provided at no charge.

Create a new Constable position with Erie County Personnel
MOTION made by Supervisor Hoffman, seconded by Councilman Murphy and
unanimously approved to create a new Constable position with Erie County Personnel.

SUP Inspections – Gordon Bennett Tower

Supervisor Hoffman advised that she visited the Tower site. Protectors are in place.
Reflective tape is being added to the guy-wires on the Tower. This will address the
safety concerns voiced at the Annual Special Use Permit Inspections held on June 6,
2010.
Supervisor Hoffman said that she has put a call in to the Subcarrier regarding these safety
concerns. She is still waiting for a return call.
MOTION made by Supervisor Hoffman, seconded by Councilman Czerniak and
unanimously approved to advise that the safety concerns regarding this Tower have been
addressed.

Dog Licensing – The new computer dog program has been installed and is up and running.

January renewal notices were mailed out on January 3 . License fees remain
unchanged for 2011.
Passport Renewal Courses – Courses have been completed by the Town Clerk and
Deputy.
2011 Training School and Annual Meeting – This 2011 session will be held in NYC on
February 20-23, 2011.

Christmas Tree Decorating Contest – Supervisor Hoffman said that a Christmas Tree

RESOLVED that the regular monthly meeting of the Colden Town Board shall be held on the
second Thursday of each month at 7:00 pm for the regular time and date of the Town Board
meeting unless otherwise resolved to change and that the October Board Meeting be held

before the 5 day of October and November Board Meetings be held the first Thursday after
the election. (Dates will be October 4, 2011 and November 10, 2011)

AGENDA 72 HOURS PRIOR TO MEETING
RESOLVED any business to be brought to the attention of the Colden Town Board by any
elected or appointed official or by the public be submitted for the agenda 72 hours prior to
a meeting.

APPOINT OFFICIAL NEWSPAPER
RESOLVED that the Springville Journal be the official newspaper for the Town of
Colden for the year 2011.

UNAPPROVED MINUTES AND AGENDA
RESOLVED that all Boards receive a copy of the unapproved Board Minutes for public
review within 10 business days from the date of such meetings. (Open Meetings Law 106)
All Boards to receive a copy of the agenda 48 hours prior to the meeting.

TOWN BOARD WORK SESSIONS
RESOLVED that the Town Board will hold a work session the first Thursday of each
month at 6:00 pm at the Town Hall. If a work session is not necessary and the Town
Board does not meet, a notice will be posted on the front door of the Town hall.

APPOINT PEACE OFFICERS
RESOLVED that Michael Schneider be appointed Constable to serve in Justice
Montgomery’s Court and Paul Sobkowiak be appointed Constable to serve in Justice
Zach’s Court for the year 2011. Robert Chilson to be appointed as an assistant Constable
for both Justices when needed. All Constables to serve with compensation of $16.10 an
hour to be paid bi-weekly. (Duties-Court time, Special Events)

MOTION made by Supervisor Hoffman, seconded by Councilman Czerniak and
unanimously approved to accept the appointments as stated on Page 1 as listed above.

On The Question
Councilman Arcara stated that he wanted to make his opinion clear regarding some of the
positions in this Organizational Meeting. He said that he did not agree with the way the
Town Board handled posting for the positions. Some employees were unaware that they

needed to reapply. He feels that some employees were blind-sided. In the future, he
feels the Town Board should be more pro-active as far informing employees of any
changes the Town Board intends to make.
Supervisor Hoffman said phone calls were placed to employees that did not submit a
letter.

RESOLVED that Ronald Bennett be appointed as Attorney for the Town in accordance
with Section 20(2)(b) to serve as needed at a fee of $124.00 per hour for general municipal

of appointment on a 2 year appointment)

RESOLVED that Mark Adamchick be the Certified Public Accountant for the Town of
Colden for the year 2011.

APPOINT HIGHWAY ACCOUNT CLERK TYPIST
RESOLVED that Alice Wangelin be appointed as Highway Account Clerk Typist at a
salary of $2,371.04 yearly to be paid bi-weekly.

APPOINT SECRETARY TO THE SUPERVISOR
RESOLVED that Supervisor Hoffman appoints Peggy O’Brien as Secretary to the
Supervisor at a salary of $22,682.66.

APPOINT DEPUTY TOWN CLERK
RESOLVED that Town Clerk Alice Wangelin appoints Christina Kerlin as Deputy
Town Clerk at a salary of $22,682.66.

APPOINT DOG CONTROL OFFICER
RESOLVED that Christa Pouthier be appointed as Dog control/Dog Census Officer with a
salary of $4,227.00 yearly to be paid bi-weekly. The DCO shall assume responsibility for
preparing a report of appraisal for damage due to Domestic Animals according to Town
Code for Kennel and other fees and shall be compensated for mileage at $ .505 per mile.

RESOLVED that John Kotlarsz be appointed as Code Enforcement Officer in charge of

RESOLVED that John Antkowiak be appointed to the Planning Board, with said term to

APPOINT ZONING BOARD OF APPEALS MEMBER
RESOLVED that Barry Vizena be appointed on the Zoning Board of Appeals with said
term to expire on December 31, 2015.

APPOINT CHAIRMAN TO VARIOUS BOARDS
RESOLVED that Roy Bergman be appointed as Planning Board Chairman, Ron
Kazmiereczak be appointed as Zoning Board of Appeals Chairman, Michelle Roberts be
appointed as Environmental Board Chairman and Peter Frank appointed to fill a
remaining term on the Zoning Board of Appeals.

MANDATORY TRAINING AND MEETING ATTENDANCE FOR VARIOUS
BOARDS
RESOLVED that attendance at board sessions is an essential responsibility of board
members. Failure to attend 80% of sessions is grounds for revocation of appointment.
Similarly, failure to meet minimum standards for annual training as established by State
Law is considered cause for removal.

APPOINT SECRETARY FOR VARIOUS BOARDS
RESOLVED that Fran Smith be appointed as Secretary of the Board of Assessment
Review, Planning and Environmental Boards with a wage of $12.10 per hour. Minimum
payment one hour to be paid bi-weekly.

APPOINT WATER BOARD SECRETARY
RESOLVED that Terri Kloiber be appointed as Secretary to the Water Board with a wage
of $12.10 per hour. Minimum payment one hour when the Board meets to be paid
bi-weekly.

APPOINT ZONING BOARD OF APPEALS SECRETARY
RESOLVED that Carolyn Maybach be appointed as Secretary of the Zoning Board of
Appeals with a wage of $12.10 per hour. Minimum payment one hour when the Board
meets to be paid bi-weekly.

AUTHORIZE RE-LEVY OF UNPAID WATER BILLS
RESOLVED that the Town of Colden Tax Assessor be authorized to re-levy any unpaid
water bills.

APPOINT SUBSTITUTE SECRETARY TO THE PLANNING BOARD,
ENVIRONMENTAL BOARD AND WATER BOARD
RESOLVED that Carolyn Maybach be appointed as substitute secretary to the Planning
Board, Environmental Board and Water Board with a wage of $12.10 per hour. Minimum
payment on hour to be paid bi-weekly.

The next appointment was to be made in September of 2010, but will be made at this time
because this board meets in June. The Town Clerk shall notify the County of this
appointment.

APPOINT BOARD OF ASSESSMENT REVIEW MEMBER
RESOLVED that John Pasco be appointed on the Board of Assessment Review with
said term to expire on September 30, 2014.

Councilman Arcara asked why the Chairman of the various boards were not included in the
interviews? Were there any open positions?
Supervisor Hoffman said that no one applied for them.

RESOLVED that Carolyn Beuler be appointed as Court Clerk with a wage of $12.46 per
hour. Minimum payment one hour to be paid bi-weekly.

RESOLVED that Paula Bielat be appointed as Court Stenographer with a wage of
$100.00 for three hours worked to be paid contractually.

APPOINT RECREATION SUPERVISOR
RESOLVED that Kip Palmateer be appointed as Recreation Supervisor at a yearly
salary of $9,687.16 to be paid bi-weekly with no benefits.

APPOINT RECREATION ASSISTANT SUPERVISOR

APPOINT RECREATION ASSISTANT SUPERVISOR
RESOLVED that Pat Hirtzel be appointed as Recreation Assistant Supervisor at a yearly
salary of $4,843.58 to be paid bi-weekly with no benefits.

APPOINT PARKS DEPARTMENT EMPLOYEES
RESOLVED that Tere Feidt be appointed as Parks Department employee at a rate of
$15.50 per hour and Michael Herbison be appointed as part-time Parks Department
employee at a rate of $11.47 per hour. (See discussion at end of this page)

APPOINT CLEANER FOR SENIOR CENTER
RESOLVED that Tere Feidt be hired as part-time cleaner for the Senior Center at a rate
of $16.39 per hour.

APPOINT CLEANER FOR TOWN HALL
RESOLVED that Carolyn Maybach be hired as part-time cleaner at an hourly rate of
$15.00 per hour Hours for Town Hall cleaning shall be established as 10.5 hours per
week.

NORTHEAST SOUTH TOWNS SOLID WASTE MANAGEMENT BOARD
MEMBER
RESOLVED that Kenneth Heiler be appointed to the Northeast South Towns Solid
Waste Management Board.

APPOINT DISASTER COORDINATOR AND SUBSTITUTE
RESOLVED that Jody Feidt be appointed as Disaster Coordinator and Edward
Wochensky be appointed as Assistant Disaster Coordinator.

APPOINT REGISTRAR OF VITAL STATISTICS
RESOLVED that Alice Wangelin be appointed as Registrar of Vital Statistics at a salary of
$468.00 yearly to be paid bi-weekly. (This term runs concurrent with the Town Clerk term
which expires in 12/31/11)

ONE YEAR PAID APPOINTED POSITIONS
RESOLVED that all one year paid appointed positions will be posted each year.
All said employees will be required to submit in writing a request to be interviewed for any
position each year. Letters must be submitted to the Supervisor’s office no later than
November 15, 2011. (This practice will apply each year)

Councilman Czerniak asked if it was past practice to require all appointed positions to
apply each year?
Supervisor Hoffman said that past administrations did interview every year for all
positions. Then it changed. Now policy has been set and interviews for all “paid”
appointed positions will be conducted each year.


Highway Superintendent Edward Wochensky said that he was unaware that the Parks
Department employees, Tere Feidt and Michael Herbison, were appointed employees. He
said he never knew that Tere Feidt had to re-apply for her job.
Supervisor Hoffman said that she was always considered an appointed employee. She
said that she changed this and made both cleaners “hired” positions this year. She said
she left Michael Herbison as an appointed position.
Highway Superintendent, Edward Wochensky objected to this saying that since the Parks
Department is under his supervision, he would be the one to hire these employees. He said
that if he has adequate funds in his budget, he has the right to hire without Board approval.

Supervisor Hoffman said that she would have to check into this. She asked if he wanted to
change Mike Herbison to a “hired” position.
Highway Superintendent Edward Wochensky said both Tere Feidt and Michael Herbison
should be classified as “hired” employees.

RESOLVED that Tere Feidt be “hired” as Parks Department employee at rate of $15.50 per
hour and Michael Herbison be “hired” as a part-time Parks Department employee at a rate of
$11.47 per hour.

DESIGNATE OFFICIAL DEPOSITORY
RESOLVED that the Bank of Holland be designated as the official depository for all Town
of Colden funds. ALSO RESOLVED that Supervisor Hoffman is authorized to endorse
checks, withdraw or transfer funds with the Bank of Holland and Patrick Murphy is
authorized to endorse checks in the event the Supervisor is absent.

AUTHORIZE PHONE TRANSFERS
RESOLVED that Peggy O’Brien is hereby authorized by the Supervisor to obtain
information and direct telephone transfers for all Town of Colden Checking and Savings
accounts.

INVESTMENT POLICY
RESOLVED that the Investment Policy for the Town of Colden be adopted.

PROCUREMENT POLICY
RESOLVED that the Procurement Policy for the Town of Colden be adopted.

PERSONNEL POLICY
RESOLVED that the Personnel Policy for the Town of Colden be adopted.

INVEST SURPLUS FUNDS
RESOLVED that the Supervisor & Tax Collector be authorized to invest any surplus
monies and tax monies as prescribed by law, wherever most advantageous rates are
available.

PAYMENT OF CLAIMS
RESOLVED that pursuant to Section 118 of NY Town Law, the Town Board authorizes
payment of claims presented to the Town Board and such voucher shall be accompanied by
a statement by the officer who originates the claim that he approves the claim and the
services were actually rendered or supplied and the equipment actually delivered in lieu of
the verification of the creditor.

PAYMENT OF UTILITIES, POSTAGE, FREIGHT AND EXPRESS CHARGES
RESOLVED that pursuant to Section 118 of NY Town Law, the Town Board may permit the
Supervisor to pay claims for public utilities, postage, freight and express charges before they
are audited or reviewed by the Town Board.

HIGHWAY VOUCHERS
RESOLVED that the Highway Superintendent be requested to present with all vouchers,
signed invoices showing who received what material and on what date.

CONFERENCES, DUES & REIMBURSEMENT TO TOWN OFFICIALS
RESOLVED that all officers be permitted to attend meetings of a legal nature and be
reimbursed for the costs. Conferences should be told to the Town Board prior to attendance.
Dues for national, state and county associations shall be paid by the Town of Colden from
General Funds.

REIMBURSEMENT REQUESTS
RESOLVED that all employee reimbursement requests are submitted within 60 days of
said expenditures to be eligible for payment

CONFERENCES, DUES & REIMBURSEMENT TO TOWN OFFICIALS
RESOLVED that any official using his automobile on Town Business shall be reimbursed on
the basis of $ .50.5 per mile, upon submission of a duly executed voucher, stating the date,
reasons for travel and the number of miles. Food allowance for employees who attend
business meetings or seminars for the Town of Colden be allowed to $70.00 per day. Food
allowance for NYC will be $125.00 a day. Receipts will be required for reimbursement.

RESOLVED that Meals on Wheels volunteers for the Town of Colden be reimbursed on the
basis of $.50.5 per mile, upon submission of a duly executed voucher, stating the date(s) and
number of miles.

PETTY CASH FOR SUPERVISOR, TOWN CLERK/TAX COLLECTOR, WATER
CLERK
RESOLVED that the Tax Collector & Town Clerk retain a petty cash fund of $100.00
each during 2011, Supervisor retain a petty cash fund of $200.00 during 2011,
Water District Clerk retains a petty cash fund of $150.00.

WATER DISTRICT #1 PETTY CASH - PAYMENTS TO TOWN CLERK
RESOLVED that the Town Clerk retain a petty cash fund of $100.00 during 2011 for the
collection of Water District payments for water usage.

PAYMENT OF VOUCHERS
RESOLVVED that the Supervisor be authorized to have the General Fund and Highway
bills and payrolls paid and the Town Board shall audit the bills every month.

REPORT TO THE STATE COMPTROLLER
RESOLVED that the Supervisor shall submit to the Town Clerk within 60 days after the
close of the fiscal year a copy of the report sent to the State Comptroller as required by
Section 30 of the General Municipal Law; and thereafter a summary of such report to be
published pursuant to law. Upon written request from the chief fiscal officer, the
comptroller may extend the period for filing such report for an additional sixty days.
