IMPORTANT INSTRUCTIONS TO ALL THE TENDERERS FOR FILLING UP TENDER
FORM

           Please go through the directives carefully. Any lapses / departure may lead to:
i)         Rejection of your tender and /or
ii)        Forfeiture of your earnest money/ and or
iii)       Cancellation of your registration and /or
iv)        Debarring you form future tenders.

1.         Please fill up the entire tender with one pen only.

2.         If the ink pen bloater on the schedule of quantities, please use dot pen only for the entire
           tender paper.

3.         You must sign in full with date on all pages of this tender document.

4. (a)     Tendered rate against each items should very clearly and legibly written in un ambiguous
           manner.
     (b)   Tendered rate against each item should be quoted both in words and in Rupees ending with
           “ONLY” and if figures in Rupees ending “ = 00”.
                   Example:          Rupees Six only.
                   Rupees 6.00
           If some paise is also to be quoted, it should be quoted like Rupees four and paise fifty only in
           words and Rupees “4.50” in figures.
     (c)   No abnormal gap should be left any where while writing either if figure or words.
           Example:         (1)      Rupees x        60.00
                            (2)      Rupees sixty x          only
                            (3)      Rupees x Eighty x Six x only.
     (d)   While quoting in figures should start as closely as possible.

5.         Amount against each item should be work out.

6.         Total amount of each page of schedule should be calculated and brought forward to next
           page. Lastly grand total of the whole schedule should be shown at the end of schedule both
           in words and figures. Rebate, if any should be deducted here and net amount should be
           indicated both in words and figures.

7.         Each page of the schedule should be signed in full with date.

                 8.    Mode and amount of earnest money deposit should be mentioned at the end of
                               schedule.

9.         The tenderers should read carefully and understand the Special Conditions for the contract,
           Schedule of quantity etc attached with the tender document before actually quoting for this
           work.

10.        All the intending tenderers should note that these works are of extra ordinary urgent nature
           and work at each place is to be completed in 2 (Two) Months for each place. It may also be
           noted that work at all the places may have to be carried out simultaneously. Therefore, only
           those contractors who are financially and technically capable of carrying out the work in the
           stipulated time and all places simultaneously should only quote for the works.

1.     I/We have submitted the tenders in the Performa as downloaded directly from the
       website and there is no change in formatting, number of pages etc.
2.     I/We have submitted tender documents which are same/identical as available in the
       website.
3.     I/We have not made any modification/corrections/additions etc in the tender
       documents downloaded from web by me/us.
4.     I/We have checked that no page is missing and all pages as per the index are available

       deemed fit without any prior intimation to me/us, However, the rates quoted against
       each item shall be treated as the rate quoted against each item provided in the original
       tender form. In the event of any discrepancy between the original and the
       downloaded tender form, original tender form shall prevail.
10.    In case at any stage later, it is found there is difference in our downloaded tender
       documents from the original, the tender / work will be liable to be cancelled and
       Earnest Money/security deposit will be liable to be forfeited at any stage whenever it
       is so noticed. The department will not pay any damages to me/us on this account.
11.    In case at any stage later, it is found there is difference in our downloaded tender
       documents from the original, I/we may also be debarred for further participation in
       the tender in the concerned BSNL Civil Zone and would also render me/us liable to
       be removed from the approved list of contractors of the Department.

1.         The Executive Engineer (Civil), Bharat Sanchar Nigam Limited Civil Division, Dhanbad, Opp.

          Fax : 2280064) invites for and on behalf of Bharat Sanchar Nigam Limited, wax sealed item
          rate tender from approved and eligible contractors registered for building works in BSNL,
          DOP, CPWD, MES, Railways, and Local PWD (Building) for the following works.

     1.2    Tenders will be issued to eligible contractors provided they produce proof of their valid
     enlistment with the appropriate authority.


  1.2.1     The contractors shall submit attested copies of valid registration and list of works
 completed of the required magnitude as indicated in Para (2) above along with the attested copies
 of certificates / testimonials of their satisfactory completion from the department / organization
 concerned obtained from an officer not below the rank of Executive Engineer in-charge of work,
 while applying for issue of tender papers which shall be in the prescribed proforma for this work
 obtained from the O/O the Executive Engineer (C), BSNL, Civil Division, Dhanbad.
 2.     Conditions and non-transferable tender papers can be had, on application, to be made in
 the prescribed format, from the office of the Executive Engineer (Civil), BSNL Civil Division,
 Dhanbad on payment of Rs 500.00 (Rupees Five Hundred ) only per set (non refundable) either
 by cash or Demand draft of a scheduled bank in favour of Account Officer, BSNL Civil Division –II,
 Ranchi.” (Payable at Ranchi). Upto 16.00 hrs on all working days. The last date of receipt of
 application for issue of tender form up to 16.00 hrs on 11.01.11and tender shall be sold up to
 16.00 hrs on 12.01.2011.
 3.    The tender will be received at the O/o the Executive Engineer, BSNL Civil Division, Dhanbad
 up to 15.00 hrs on 15.01.2011 and will be opened at 15:30 hrs on the same day by the
 Executive Engineer, BSNL Civil Division, Dhanbad. If the date of opening of tender happens to fall
 on any holiday, the tender shall be received and opened on the next working day.
 4.    Earnest money of Rs. 3229.00 (Rupees Three Thousand Two Hundred Twenty nine)
 only in cash (up to Rs 2500.00) /deposit at call receipt of a scheduled bank/ fixed deposit receipt
 of a scheduled bank / demand draft of a scheduled bank issued in favour of Accounts officer,
 BSNL Civil Division –II, Ranchi (Payable at Ranchi).
 5.    Tenders, which should always be placed in sealed envelope, in the manner detailed below,
 will be received by the Executive Engineer (C), BSNL Civil Division Dhanbad up to 15.00 hrs
 on 15.01.2011 and will be opened by him or his authorized representative in his office on the
 same day at 15.30 Hrs. After opening of the main envelope 3, the envelope 1 containing the
 Earnest Money along with the cost of the Tender as applicable and eligibility credentials shall be
 opened first. The envelope 2 containing tender shall be opened only after for those tenderers
 whose Earnest Money, cost of tender and eligibility is found in order.
          The unopened tenders shall be returned to the tenderers after final decision on the tender
 is reached.
 5.1      Submission of tender: Tender shall be submitted in following manner;
 5.2      In case the tender document is purchased from Division/ sub division office

5.2.1 Proof for paying the cost of tender documents, proof of payment of EMD and copies of
documents showing eligibility credentials to be placed in sealed envelope no.1

5.2.2   The “Tender” shall be placed in sealed envelope-2 and shall be described as “Tender”

5.2.3   The sealed envelope 1&2 shall be placed in another sealed envelope-3.


5.2.4   All the three envelopes shall be superscripted with following data on it.
        (i)     Name of work
        (ii)    Name of tenderer
        (iii)   Last date of receipt of tender


6. INSTRUCTION FOR TENDERERS USING DOWNLOADED TENDER DOCUMENTS FROM WEB:


6.1      The blank prescribed tender form condition and tender documents can also be downloaded
from the website www.jharkhand.bsnl.co.in . Such tenderers who downloaded the tender
document from web should submit tender cost of Rs. 500.00 (Rupees Five Hundred ) only per set
(non-refundable) in the form of Demand Draft of a scheduled bank in favour of the “Account
Officer, BSNL Civil Division –II, Ranchi” (payable at Ranchi). Earnest money of Rs. 3229.00
(Rupees Three Thousand Two Hundred Twenty nine) only in deposit at call receipt of a
scheduled bank/ fixed deposit receipt of a scheduled bank / demand draft of a scheduled bank
issued in favour of the Accounts officer, BSNL Civil Division –II Ranchi (Payable at
Ranchi).
6.2     The downloaded “tender document” in which rates are quoted should be properly bound
and wax sealed. Loose / spiral bound submission shall be rejected out rightly. The tenderer shall
furnish a declaration to this effect that no addition / deletion / corrections have been made in the
tender document submitted and it is identical to the tender document appearing on website.
6.3     The tenderer should ensure that every page of the downloaded tender documents is
signed by tenderer with seal. In case of any correction/addition/alteration/omission in tender
document vis-à-vis tender document available on website shall be treated as non-responsive and
shall be summarily rejected.
6.4    In   case    the      tender    document       is   down   loaded    form    BSNL    website
www.jharkhand.bsnl.co.in
6.4.1 “Earnest money plus cost of tender and eligibility credentials” shall be placed in sealed
envelopes-1 marked “Earnest Money plus cost of tender and eligibility credentials”

6.4.2   The “Tender” shall be placed in sealed envelope-2 and shall be described as “Tender”

6.4.3 The sealed envelope no.1 & 2 as above containing “Earnest Money plus cost of tender and
eligibility credentials” and the “Tender” shall be placed in another sealed envelope -3
6.4.4 All the three envelopes shall be superscripted with following data on it.
        (i)    Name of work
        (ii)   Name of tenderer
        (i)    Last date of receipt of tender.
6.5     The tenderers shall be fully responsible for the genuineness and the correctness of the
information / documents submitted by them for obtaining the tender documents. If it is found
that the tenderer has misrepresented the facts or has submitted any false, forged or wrong
documents, then the Earnest money submitted by the tenderers shall be liable to be forfeited and
such tenderers shall not be allowed to tender in future.
6.6    The tenderer shall furnish a declaration to this effect that no addition/deletion/corrections
have been made in the tender document submitted and it is identical to the tender document
appearing on web site.
6.7    The tenderer should read carefully and sign the declaration given on page no 4 of the
Tender document before submitting the tender.
6.8     In case of any doubt in the down loaded tender, the same should be got clarified from the
Office of the Executive Engineer, Dhanbad before submitting the tender.

6.9     The printout of tender document should be taken on 12” paper only and the printer
settings etc are such that document is printed as appearing in the web and there is no change in
formatting number of pages etc.
7.      Tender with condition / conditional rebate shall be summarily rejected.

1.0     The Executive Engineer (Civil), Bharat Sanchar Nigam Limited Civil Division- Dhanbad

        invites for and on behalf of Bharat Sanchar Nigam Limited, wax sealed item rate tender

        from approved and eligible contractors for building works of BSNL, DOP, CPWD, MES,

        Railways, Local PWD (Building) for the following work.

   1.1 Name of Work: Constn.of damaged compound wall & C.C. Aproach Road i/c
  allied mtce. works to Compound wall at T.E. Maheshpur Raj ( SSA :- DUMKA )

      Estimated cost put to Tender: - Rs 161447.00

  1.2     Tenders will be issued to eligible contractors provided they produce proof of their valid
  enlistment with the appropriate authority.

   1.2.1 The contractor shall submit attested copies of valid registration and list of works completed of
the required magnitude as indicated in Para (1.2.1) above along with the attested copies of certificates /
testimonials of their satisfactory completion from the department / organization concerned obtained
from an officer not below the rank of Executive Engineer in-charge of work, while applying for issue of
tender papers which shall be in the prescribed Performa for this work obtained from the o/o the
Executive Engineer(c),BSNL Civil Division, Dhanbad.

2.0        Agreement shall be drawn with the successful Tenderer on prescribed Form No. BSNL W-8,
which is available as a BSNL Publication/ BSNL Web site www.bsnl.co.in. Tenderer shall quote his
rates as per various terms and conditions of the said form (in case “Tender Documents” are downloaded
from the BSNL Website in which rates are to be quoted should be properly bound and sealed), which
will, from part of the agreement.

3.0        The time allowed for carrying out the work will be 2 (Two) Months from the 7th (Seventh)
 days after the date of issue of letter of award of work, or from the first day of handing over of the site,
 whichever is later, in accordance with phasing, if any, indicated in the Tender Document.

4.0                          The site for the work shall be made available.
5.0       The last date of receipt of applications for issue of tender forms (in prescribed format) can
also be down loaded from BSNL website www.jharkhand.bsnl.co.in and date of issue of tender forms
will be as follows:
          i)      Last date of receipt of application --------------- up to 11.01.11 16.00 hrs.
                ii)      Last date of issue of tender forms --------------- up to 12.01.11 16.00 hrs.

6.0         Tender documents consisting of plans, specifications, the schedule of quantities of the various
classes of work to be done and the set of terms and conditions of the contract to be complied with by the
contractor whose tender may be accepted and other necessary documents, can either be down loaded
from the BSNL website www.jharkhand.bsnl.co.in or be seen in the office of the Executive Engineer
(C), BSNL Civil Division Dhanbad between 11.00 hrs. & 16.00 hrs from 03.01.2011every day except
on Sundays and Public Holidays. Tender documents, excluding standard form will be issued from his
office, during the hours specified above on payment of the following: -

         (i)          Rs. Rs 500.00 (Rupees Five Hundred ) in cash as cost of tender (Non- refundable).
         (ii)         Earnest money of Rs. 3229.00 (Rupees Three Thousand Two Hundred Twenty
                      nine) only in cash (up to Rs 2500.00) / deposit at call receipt of a scheduled bank/

                     fixed deposit receipt of a scheduled bank / demand draft of a scheduled bank issued in
                     favour of the Accounts officer, BSNL Civil Division –II Ranchi (Payable at Ranchi).
                     When the amount of earnest money is more than Rs 5.00 Lakhs, part of the earnest
                     money is acceptable in the form of Bank Guarantee also. In such case, minimum 50% of
                     earnest money (but not less than Rs 5.00 Lakhs) or Rs 25.00Lakhs, whichever is less,
                     will have to be deposited in the shape of prescribed above. For balance amount of earnest
                     money, bank guarantee will also be acceptable.
          (iii)      The tender shall be accompanied by Earnest Money along with cost of tender, If not paid
                     earlier as in the case of down loaded tender from Website in the form as detailed at sub
                     Para ii) above.

      Note: - Money due to contractor in any other work or earnest money of the previous call of the
      same work shall not be adjusted towards earnest money.

7.0           Tenders, which should always be placed in sealed envelope, in the manner detailed at Para 9
              below, will be received by the Executive Engineer (C), BSNL Civil Division Dhanbad up
              to 15.00 hrs on 15.01.2011 and will be opened by him or his authorized representative in his
              office on the same day at 15.30 Hrs. After opening of the main envelope 3, the envelope 1
              containing the Earnest Money along with the cost of the Tender as applicable and eligibility
              credentials shall be opened first.

              The envelope 2 containing tender shall be opened only after for those tenderers whose
              Earnest Money, cost of tender and eligibility is found in order.

               The unopened tenders shall be returned to the tenderers after final decision on the tender is
               reached.
8.0           The description of the work is as follows: -

9.0               Submission of tender:
        Tenders shall be submitted in following manner:
9.1       In case the tender document is down loaded form BSNL website www.jharkhand.bsnl.co.in,

      9.1.1   “Earnest money plus cost of tender and eligibility credentials” shall be placed in sealed
              envelopes-1 marked “Earnest Money plus cost of tender and eligibility credentials”
      9.1.2   The “Tender” shall be placed in sealed envelope-2 and shall be described as “Tender”
      9.1.3   The sealed envelope no.1 & 2 as above containing “Earnest Money plus cost of tender and
              eligibility credentials” and the “Tender” shall be placed in another sealed envelope -3
      9.1.4   All the three envelopes shall be superscripted with following data on it.
                        (i)     Name of work
                        (ii)    Name of tenderer
                        (iii)   Last date of receipt of tender.

9.2       In case the tender document is purchased from Division/ sub division office Proof for paying the
           cost of tender documents, proof of payment of EMD and copies of documents showing eligibility
           credentials to be placed in sealed envelope no.1
          Envelope –2 will be as per Para 9.1.2.
          The sealed envelope 1&2 shall be placed in another sealed envelope-3.
          Same as 9.1.4

         Note: In case the eligibility credentials are not found in order at any stage i.e before award of
         work or during execution of the work or after completion of the work, the contractor will be
         debarred from tendering in BSNL for three years including any other action under the contract or
         existing law.

9.3      The tender in which item rates are to be quoted should be properly bound and sealed. Loose/
         spiral bound submission (in case the tender is down loaded from website) shall be rejected out
         rightly. In case of any correction/ addition/ alteration/ omission in tender document Vis –a- Vis
         tender document available on website shall be treated as non-responsive and shall be summarily
         rejected.

10.      Copies of other drawings and documents pertaining to the work will be open for inspection by the
         tenderers at the office of the above-mentioned officer.

      10.1 Tenderers are advised to inspect and examine the site and its surroundings and satisfy
          themselves before submitting their tenders as to the nature of the ground and sub – soil
          (so far as is practicable), the form and nature of the site, the means of access to the site,
          the accommodation they may require and in general, shall themselves obtain all
          necessary information as to risks, contingencies and other circumstances which may
          influence or affect their tender. A tenderer shall be deemed to have full knowledge of the
          site whether he inspects it or not and no extra charges consequent on any
          misunderstanding or otherwise shall be allowed. The tenderer shall be responsible for
          arranging and maintaining at his own cost all materials tools & plants, water, electricity,
          access facilities for workers and on all other services required for executing the work
          unless otherwise specifically provided for in the contract documents. Submission of
          tender by a tenderer implies that he has read this notice and all other contract documents and
          has made himself aware of the scope and specifications of the work to be done and of conditions
          and rates at which stores, tools and plant, etc will be issued to him by the BSNL and local
          conditions and other factors having a bearing on the execution of the work.

11.       The competent authority on behalf of Bharat Sanchar Nigam Limited does not bind himself to
          accept the lowest or any other tender, and reserves to himself the authority to reject any or all of
          the tenders received without the assignment of a reason. All tenders, in which any of the
          prescribed conditions are not fulfilled or any condition including that of conditional rebate is put
          forth by the tenderer, shall be summarily rejected.

12.       Canvassing whether directly or indirectly, in connection with tenders is strictly prohibited and
          the tenders submitted by the contractors who resort to canvassing will be liable to rejection.

13.       The competent authority on behalf of the Bharat Sanchar Nigam Limited reserves with himself
          the right of accepting the whole or any part of the tender and the tenderer shall be bound to

14.       The Company or firm or any other person shall not be permitted to tender for works in BSNL
          civil Zone in which his near relative(s) (directly recruited or on deputation in BSNL) is/ are
          posted in any capacity either non executive or Executive employee, near relative (s) for this
          purpose is/are defined as:
             (i)      Member of Hindu Undivided family (UHF).
             (ii)    They are Husband and wife.
             (iii)   The one is related to other in the manner as father, mother, son(s) & son’s wife
                     (Daughter in law), Daughter(s), Daughter/s husband (son-in-law), brother (s),
                     brother’s wife, Sister (s), Sister’s husband (brother in law).

       The contractor shall also intimate the names of persons who are working with him in any
       capacity or are subsequently employed by him and who are near relative to any executive
       employee/gazetted officer in the BSNL or Department of Telecom or in the Ministry of
       Communications.

       All the intending tenderers will have to give a certificate that none of his/her such near
       relative (s) as defined above is /are working in the concerned BSNL civil Zone where he is
       going to apply for tender/ work. The format of the certificate is as under.

       “I --------------- S/O Shri ----------------------------------- resident of --------------------------------
       ------------------------------------- hereby certify that none of my relative (s) as defined above is/
       are employed in concerned BSNL Civil Zone, In case at any stage, it is found that the
       information given by me is false/ incorrect, BSNL shall have the absolute right to take any
       action as deemed fit without any prior intimation to me”.

       The certificate in case of proprietorship Firm shall be given by the proprietor, for Partnership
       firm certificate shall be given by all partners and in case of Limited Company, by all
       Directors of the company. However, Government of India / Financial institutions nominees
       and independent non


       official part time Directors appointed by Govt. of India or the Governor of the state are
       excluded from the purview of submission of this certificate while submitting tenders by
       Limited Companies. Any breach of these conditions by the company or Firm or any other
       person, the tender/ work will be cancelled and Earnest Money/ security Deposit will be
       forfeited at any stage, whenever it is so noticed. The company or Firm or the person will also
       be debarred for further participation in the tender in the concerned BSNL Civil Zone stage.
       BSNL will not pay any damages to the company or Firm or the concerned person but
       damages arising on account of such cancellation to be borne by the contractor. Further, any
       breach of this condition by the tenderer would also render him liable to be removed from the
       approved list of contractors of BSNL. If however the contractor is registered in any other
       Department he shall also be debarred from tendering in BSNL for any breach of this
       condition.

 15.   No Engineer of Gazetted rank or other Gazetted Officer employed in engineering or
       administrative duties in an Engineering Department of the Government of India/ State
       Government or PSU’s is allowed to work as a contractor for a period of two years after his
       retirement from Govt. Service, without previous permission of the Govt. Of India or BSNL in
       writing. This contract is liable to be cancelled if either the contractor or any of his employees
       is found any time to be such a person who had not obtained the permission of the Govt.Of
       India/ State Government or PSU’s as aforesaid before submission of the tender or
       engagement in the contractor’s service.

16.    The tender for the work shall remain open for acceptance for a period of 30 (Thirty) days
       from the date of opening of the tenders. If any tenderer withdraws his tender before the said
       period or issue of letter of acceptance/ intent, whichever is earlier, or, makes any
       modifications in the terms and conditions of the tender which are not acceptable to the BSNL,
       then the BSNL, shall without prejudice to any other right or remedy, be at liberty to forfeit
       50% of the said earnest money as aforesaid.

17.    In case of works having estimated cost below Rs. 15,00, 000/-, the successful tenderer shall
       be required to execute an agreement with the Engineer in charge in the Performa annexed to
       the tender document within 10 (Ten) days of the issue of letter of award by the BSNL. In the

      event of failure on the part of the successful tenderer to sign the agreement, the Earnest
      Money will be forfeited and tender cancelled.

      In case of works of estimated to cost Rs. 15,00,000/- and above, the successful tenderer shall,
      upon issue of letter of acceptance of Tender, shall be required to furnish Performance
      Guarantee@ 5% of tendered value in the form irrevocable Bank Guarantee of requisite
      amount to the Engineer in charge in the Performa annexed to the tender document, within 10
      ( Ten) days of the issue of letter of acceptance of Tender by the BSNL. In the event of
      failure on the part of the successful tenderer to furnish the Bank Guarantee within 10 (Ten)
      days, the earnest money will be forfeited and tender cancelled.

18.   The Notice Inviting Tender (BSNL W -6) shall form a part of the Contract Document in
      accordance with clause 1 of the contract; the letter of acceptance shall be issued first in favour
      of
      the successful Tenderer/ Contractor. After submission of the performance guarantee, the letter
      of award shall be issued. The contract shall be deemed to have come into effect on issue of
      letter of
      acceptance of the tender. On issue of letter of award, the successful Tenderer/ Contractor
      shall, within 30 days from such date, formally sign the agreement consisting of: -

      (a)     The Notice Inviting Tender, all the documents including additional conditions,
              specifications and drawings, if any forming part of the tender, and as issued at the
              time of invitation of tender and acceptance thereof together with any correspondence
              leading thereto.

      (b)     Standard BSNL W - 8 as on website www. bsnl.co.in

      (C)     The Agreement signed on non- judicial stamp paper as per proforma annexed to the
              tender document.

19.   Payment to the contractors shall be made through e – payment system like ECS & EFT as
      detailed below:

      (a)     In cities/ areas where ECS/ EFT facility is provided by Banks, the tenderer must have
              Account in such ECS/ EFT facility providing Banks and that Bank A/C no. shall be
              quoted in the tender by the tenderer.

      (b)     The cost of ECS/ EFT will be borne by BSNL in all cases where the payment to
              contractor is made in a local Branch i.e. tenderer is having bank account in the same
              place from where the payment is made by BSNL unit.

      (c)     In case payment is made to outside branch i.e. tenderer is having bank account not
              in the same place form where the payment is made by BSNL unit, the crediting
              cost will have to be borne by the tenderer only.
      (d)     The payments to contractors will compulsorily be made through ECS/ EFT in respect
              of all contracts where the value of the contract is more than Rs.10 Lakhs.

20.   First running Account bill shall be paid only after
      (a)     Signing of the Agreement/ Contract by both the parties, and
       (b)    Progress chart has been prepared as required under Clause 5 and approved by the
              competent authority.

21.    If a contractor after purchasing the tender does not quote consecutively on three occasions,
      the contractor may be debarred for further purchase of tenders for a period of six months.

 22.       General conditions of contract for works in BHARAT SANCHAR NIGAM LIMITED are
           available on website www.bsnl.co.in as well as in the Divisional office.

 23.       Tender with condition / conditional rebate shall be summarily rejected.

 24.       The tenderer shall furnish a declaration to this effect (in case of downloaded tender) that no
           addition/ deletion / correction have been made in the tender document submitted and it is
           identical to the tender document appearing on website. Every page of down loaded tender
           shall be signed by the tenderer with stamp (seal) of his firm/ organization.

A:       The blank prescribed tender form conditions and tender documents can also be downloaded
         from the website www.jharkhand.bsnl.co.in. Such tenderers who downloaded the tender
         document from web should submit tender cost of Rs. Rs 500.00 (Rupees Five Hundred )
         only per set (non refundable) in the form of Demand Draft of a scheduled bank in favour of
         the “Accounts Officer, BSNL Civil Division-II, and Ranchi”(payable at Ranchi). Earnest
         money of Rs Rs. 3229.00 (Rupees Three Thousand Two Hundred Twenty nine) only in
         deposit at call receipt of a scheduled bank/ fixed deposit receipt of a scheduled bank / demand
         draft of a scheduled bank issued in favour of the Accounts officer, BSNL Civil Division –II

B:         The downloaded “tender document” in which rates are quoted should be properly bound and

                              ADDITIONAL CONDITIONS
                                       AND
                      ADDITIONAL & PARTICULAR SPECIFICATIONS

GENERAL:-
        The quoted rates for various items in the tender shall be inclusive of all the additional
conditions and Particular specifications and for adherence to all these conditions and specifications,
no extra payment shall be made to the contractor. Any infringement and/or breach of these
specification and condition(s) etc. shall render the contractor liable to action(s) under various clauses
of the contract and such action stipulated in conditions therein.

“A” ADDITIONAL CONDITIONS
1.      The Contractor shall maintain safe custody of materials brought to the site. The contractor
shall also employ necessary watch and ward establishment for the work and other purposes as
required at his own cost.

2.      For cement and steel and other materials, as prescribed, the quantities brought at site shall be
entered in the respective material at site accounts and shall be treated as issued for maintenance of
daily consumption.
3. The procurement of Cement and Reinforcement Steel, and, their issue and consumption shall be
governed as per conditions laid down hereunder.

3.1.     Cement
3.1.1.A The contractor shall procure Portland Slag cement, as required in the work, from reputed
        manufacturers of cement having a production capacity of one million tonnes per annum or
        more such as A.C.C., L&T, Vikram, Shri Cement and La-farge etc. as approved by Ministry
        of Industry, Government of India, and holding license to use ISI certification mark for their
        product whose name shall be got approved from Engineer-in-charge. Supply of cement shall
        be taken in 50 Kgs. bags bearing manufacturer’s name and ISI marking. Samples of cement
        arranged by the contractor shall be taken by the Engineer-in-Charge and got tested in
        accordance with provisions of relevant BIS codes. In case test results indicate that the
        cement arranged by the contractor does not conform to the relevant BIS codes, the same
        shall stand rejected and shall be removed from the site by the contractor at his own cost
        within a week’s time of written order from the Engineer-in-Charge to do so. Removal time
        of “form work” shall be as per provision of Para 11.3.1 of IS: 456-2000 vis-à-vis the curing
        time as per the decision of the Engineer-in-charge which shall be final and binding on the
        contractor.

3.1.1.B The cement shall be brought at site in bulk supply of sufficient quantity or as decided by the
         Engineer-in charge. But in no case quantity of cement in a lot brought to the site shall be less
         than least of 10 (Ten) tonnes or the Total quantity required for the work.

3.1.2   The Cement godown of the capacity to store about 500 bags of cement or as decided by
        Engineer-in-Charge shall be constructed by the contractor at site of work for which no extra
        payment shall be made. Double lock provision shall be made to the door of the cement
        godown. The keys of one lock shall remain with the Engineer-in-Charge or his authorised
        representative and the key of other lock shall remain with the contractor. The contractor shall
        facilitate the inspection of the cement godown by the Engineer-in-Charge at any time.

3.1.3. The contractor shall supply free of charge the cement required for testing. The cost of tests
       shall be borne by the contractor/ department in the manner indicated below:

(i)    By the contractor, if the results show that the cement does not conform to relevant BIS
codes.

(ii)    By the Department, if the results show that the cement conforms to relevant BIS codes.


3.2     Steel
3.2.1   The contractor shall procure steel reinforcement bars conforming to relevant BIS codes from
        main producers as approved by the Ministry of steel or from secondary producers and re-
        rollers having BIS License to produce CTD bars as specified in schedule – F subject to
        following stipulations: (i) If it is provided in the agreement that the steel is to be procured
        from primary producers and procurement of steel from secondary producers is allowed then
        deduction based on the difference in market rate of steel from primary producers and
        secondary producers shall be made in the running/final bills. (ii) However , if the stipulation
        is for procurement of steel from secondary producers than if the contractor uses steel from
        primary producers the same shall be allowed but nothing extra shall be payable on this
        account .

        The procurement of TMT Bars conforming to relevant BIS codes shall be made from main
        producers as approved by the Ministry of steel or from secondary producers having BIS
        License to produce TMT bars as specified in schedule – F subject to following stipulations:
         (i)     If it is provided in the agreement that the steel is to be procured from primary
                  producers and procurement of steel from secondary producers is allowed then
                  deduction based on the difference in market rate of steel from primary producers and
                  secondary producers shall be made in the running/final bills.
(ii)    However , if the stipulation is for procurement of steel from secondary producers than if the
        contractor uses steel from primary producers the same shall be allowed but nothing extra
        shall be payable on this account.. The contractor shall have to obtain and furnish test
        certificates to the Engineer-in-Charge in respect of all supplies of steel brought by him to the
        site of work. Samples shall also be taken and got tested by Engineer-in-Charge as per the
        provisions in this regard in the relevant BIS codes. In case test results indicate that the steel
        arranged by the contractor does not conform to the BIS codes, the same shall stand rejected
        and shall be removed from the site by the contractor at his own cost within a week’s time of
        written order from the Engineer-in-Charge to do so.
        * Deduction item made on account of use of steel from secondary producers instead of
        primary producers shall not be treated as substandard work.

3.2.2   The steel reinforcement shall be brought to the site in quantity of lots as approved by
        Engineer-in-Charge.

3.2.3   The steel reinforcement shall be stored by the contractor at site of work in such a way as to
        prevent distortion and corrosion and nothing extra shall be paid on this account. Bars of
        different sizes (diameters) and lengths shall be stored separately to facilitate easy counting
        and checking.

3.2.4   For steel procured from main producers or secondary producer, for checking nominal mass,
        tensile strength, bend test etc. specimen of sufficient length shall be cut from each diameter of
        the bar at random at frequency not less than that specified below.

3.2.5   In case of works costing more that 2 Crores and when the steel is procured from other
        than main producers, additional tests such as, retest, re-bend test, elongation test,
        proof stress may also be conducted.

3.2.5.   The contractor shall supply free of charge the steel bars required for testing. The cost of tests
         shall be borne by the contractor/ Department in the manner indicated below:
         i)        By the contractor, if the results show that the steel does not conform to relevant
                   BIS code.
         ii)       By the Department, if the results show that the steel conforms to relevant BIS
                   code.

3.2.6    Coefficient of weight i.e. the weight per unit length of the steel procured by the contractor
         shall be ascertained at site before using it and certified by the Engineer-in-Charge. In case
         weight per unit length is beyond the rolling margin as laid down in BIS: 1786, the steel will
         be rejected and shall be removed from the site of work within a week’s time from written
         order                                                                                      from
         the Engineer-in-Charge to do so. In case weight per unit length is more than the standard
         coefficient of weight for the diameter, but is within the rolling margin, then the payment shall
         be made as per the standard weight per unit length, and, where the weight per unit length is
         lesser than the standard coefficient of weight for the diameter, but is within the rolling
         margin, the payment shall be restricted with respect to the actual weight per unit length of the
         diameter.

3.3.     The standard sectional weights referred to in standard table under Para 5.3.3., page 75 of the
         revised CPWD Specifications 2002 for Cement Mortar, Cement Concrete and RCC works, are
         to be considered for conversion of length of various sizes of Steel Reinforcement bars into
         weight and are reproduced below for ready reference.

3.4.     The actual issue and consumption of steel and cement on work shall be regulated and proper
         accounts maintained as provided in clause 10 of the contract. The theoretical consumption of
         steel shall be worked out as per procedure prescribed in clause-42 of the contract and
         governed by the conditions laid therein.




3.5.     Steel and cement brought to site and steel remaining unused after completion of work shall
         not be removed from site without the written permission of the Engineer-in-charge.

3.6.     Cement used in Ready Mix Concrete shall be evaluated based on the certification by the in-
         Charge of the RMC Plant in accordance with design approved by the Engineer-in-Charge.

4.       No payment shall be made to the contractor for any damage caused during the execution of
         work because of cause(s) not covered under clause 43 of the Contract. The damage to work
         will be made good by the contractor at his own cost, and no claim on this account shall be

         entertained.

5.        Some restrictions may be imposed by the security staff etc. on the working and/or movement
          of labour, materials etc. and the contractor shall be bound to follow all such
          restrictions/instructions and nothing extra shall be payable on this account.

6.        The contractor shall comply with proper and legal orders and directions of the local or public
          authority or municipality and abide by their rules and regulations and pay all fees and charges
          which he may be liable and nothing extra shall be payable on this account. The work shall be
          carried out without infringing on any of the local Municipal Bye-Laws.

7.        The contractors shall given a performance test of the entire installations as per standard
          specifications before the work is finally accepted and nothing extra what so ever shall be
          payable to the contractor for the tests.

8.         The contractor shall engage licensed plumber for sanitary, water supply, drainage work and
          also get all the materials and system (including the materials supplied if any, by the
          department) tested by the Municipal Authority, Whenever required, at his own cost including
          testing fees, transport etc. according to Municipal by Laws. The contractor shall produce
          necessary certificate from the Municipal authorities after completion of work. Nothing extra
          will be paid on this account. The Contractor shall execute guarantee for removal of defects
          after completion in respect of water supply and sanitary installation.

9.        The water supply sanitary installation and drainage work shall be carried out in a manner
          complying in all respects with the requirement of relevant by laws of the local municipal
          authority of the place at no extra cost of the department.

10.       The rate for every item of work to be done under this contract shall be for all heights, depths,
          lengths and widths of the structure (except where specially mentioned in the item) and
          nothing extra will be paid on this account.

      10. The contractor shall take all precautions to avoid all accidents by exhibiting necessary caution
          boards such as day and night boards, speed limit boards and flags red lights and providing
          barriers etc. He shall be responsible for all damages and accidents caused due to negligence
          on his part. No hindrance shall be caused to traffic during the execution of work. Nothing
          extra shall be paid on this account.


12.       The contractor will work in close liaison, during the works, with other contractors of water
          supply, sanitary, drainage arrangements, electrical installation and any other works and adjust
          his work plan accordingly.

13.     Other Taxes and Royalties

13.1     Income Tax and surcharges over Income Tax etc. at the rates fixed by the Ministry of
          finance, Government of India, shall be deducted from all the running and final bills of the
          contractor. Should there be any increase in rate of Income Tax and surcharge during
          execution of the contract, the same be payable by the contractor.

13.2. Works Contract Sales Tax as prevalent as per statutory orders of State/central Government
      and shall be charged on gross value of all the bills and shall be recovered from each bill of the
      contractor as ‘works contract sales tax’. Should there be any increase in rate of Works
      contract sales tax during execution of the contract, the same shall also be payable by the
      contractor.

13.3    Royalty shall have to be paid by the contractor on all materials such as stone, bricks,
        boulders, metal, shingle, bajri, stone aggregate, coarse sand and fine sand etc. or any other
        materials used for the execution of the work direct to the revenue Authority of the
        District/State Govt. concerned. The contractor shall obtain “No demand” certificate from the
        District/State Govt. authority concerned before the final bill is paid, failing which necessary
        recovery will be effected at the applicable rates in the final bill.

14.     Secured Advance:

14.1.   Secured advance on bricks, stone, stone aggregate brought at site for use in the work shall be
        paid only after receipt of satisfactory test results from the laboratory and provisions under
        rules.

14.2    Secured advance on steel door, steel windows etc shall be paid only after the Engineer-in-
        charge has personally verified that the materials brought at site of work for use in work
        conforms to the sample approved by him.

14.3    Secured advance wherever admissible on water supply, sanitary installation materials and
        fittings shall be allowed only after the Engineer-in-charge has verified personally that
        materials brought at site are in conformity with the samples approved by him.

14.4    Secured advance for terrazzo tiles shall be paid only after satisfactory results are received
        from the laboratory.

15.     ISI Marked Materials

15.1    Whenever ISI marked materials are used, in that case, proper documentary proof of
        procurement of total quantity of those materials shall be submitted by the contractor to the
        Engineer-in-Charge as and when materials are brought to the site of work.

B”      ADDITIONAL SPCIFICATIONS

1.      GENERAL:

              1.1   The Work shall, in general, conform to the CPWD Specification. The CPWD
                            specification shall mean CPWD Specifications-1996 Vol. 1 to VI with
                            up-to-date correction slips and Revised CPWD Specifications 2002 for
                            Cement Mortar, Cement Concrete and RCC works which supersede
                            chapter 3, 4 & 5 of CPWD specifications 1996 Vol.-II.

1.1.1   Should there be any difference between the specifications mentioned above and the
        specifications give in the schedule of quantities, the later shall prevail.

1.1.1   If the specifications for any item are not available in the CPWD Specifications cited above,
        relevant BIS specifications should be followed given in writing based on acceptable sound
        engineering practice and local usage shall be final and binding on the contractor.

1.1.3 The work will be carried out in accordance with the architectural drawings and structural
       drawings to be issued buy the Engineer-in-Charge. The structural and architectural drawings
       shall have to be properly correlated before executing the work.

1.2.1 In case of any difference noticed between Architectural and Structural drawings, the contractor
       shall obtain final decision in writing of the Engineer-in-Charge.

1.2.2 In case of any discrepancy in the item given in the schedule of quantities appended with the
       tender and architectural drawings relating to the relevant item, former shall prevail unless
       otherwise given in the writing by the Engineer-in-Charge.

1.3       For items where so desired, samples shall be prepared before starting the particular items of
          work for prior approval of the Engineer-in-Charge and nothing extra shall be payable on this
          account.

1.4       Materials brought at site of work shall not be used in the work before getting satisfactory
          Mandatory test results. For details, relevant provisions in the CPWD specification shall be
          referred to.

1.4.1     Wherever it is desired to procure factory-made materials, such factory-made materials shall
          be procured from reputed and approved manufacturers or through their authorized dealers.
          The
          contractor shall obtain the approval from the Engineer-in-Charge of such firms prior to
          procurement of such factory-made materials. The Engineer-in-charge may, at any stage,
          inspect such factories/manufacturing units. The contractor shall have no claim if the factory-
          made materials brought to the site are rejected by the Engineer-in-charge in part or in full due
          to bad workmanship/quality etc. even after the inspection of the manufacturing units.

1.4.2 The manufactured materials brought at site of work shall, in general, conform to the relevant
       specifications. The source for supply of the manufactured materials shall be approved by the
       Engineer-in-Charge. The contractor shall have no claim if the manufactured materials brought
       to the site are rejected by the Engineer-in-Charge in part or in full due to bad
       workmanship/quality etc.

1.4.3 The preference amongst the various alternative materials available shall be as follows: -
    (a) The materials shall be as per the brand specified to be used in the work.
    (b) If the brand specified material is not available then the material shall be ISI marked.

      (c) If ISI marked item is not available then it should be form ISO certified company.
       (d) If the ISI marked or ISO certified items are not available then the best available items in the
           market to be procured.

1.4.4     Equivalent for the various materials and the materials of the approved make shall be got
          approved from the Engineer-in-charge of work in writing before using them on the work.

2. The following modifications to the above specifications shall, however, apply.

2.1       EARTH WORK: -

2.1.1     During excavation and trenching work etc., the contractors shall ensure compliance to the
          guidelines in such matters laid down by the local body/ bodies to ensure that there is
          minimum hazard to the operating personals and users, minimum inconvenience to the users,
          minimized damage to the underground plant/services of other utilities in a coordinated way,
          in the interest of public convenience and overall safety.

2.1.2     Any trenching and digging for laying sewer lines/waterlines/cables etc. shall be commenced
          by the contractor only when all men, machinery’s and materials have been arranged and
          closing of the trenches thereafter shall be ensured within the least possible time.

2.1.3     Surplus excavated earth which is beyond the requirement of the Bharat Sanchar Nigam
          Limited shall have to be disposed of by the contractor at his own cost beyond the municipal
          limits or at places identified by the local bodies or as directed by the Engineer-in-Charge after

             obtaining written permission of the Engineer-in-charge and no payment will be made by the
             BSNL for such disposal of this surplus excavated earth.

   2.1.4     The contractor shall, at his own expense and without extra charge, make provision for all
             shoring, pumping, dredging or bailing out water, if necessary, irrespective of the source of
             water. The foundation trenches shall be kept free from water, while all the works below
             ground level are in progress, without any extra payment.

   2.2       PLAIN CEMENT CONCRETE AND REINFORCED CEMENT CONCRETE WORK:

       Stone Aggregate: -Stone aggregate to be used in the work shall be hard broken stone to be
   obtained from source approved by the Engineer- in-Charge and shall conform to the relevant
   provisions in the C.P.W.D. Specifications.

   2.2.2     Coarse Sand / Fine Sand: - Coarse sand / Fine sand to be used in the work shall be obtained
             from source approved by Engineer-in- Charge and shall conform to the relevant provision in
             the C.P.W.D. Specifications.

    2.2.2.1 Where only one variety of sand is available, the sand will be sieved for use in finishing work
   to achieve the required particle size distribution, as per CPWD specifications in order to obtain
   smooth surface and nothing extra shall be paid to the contractor on this account.

2.2.3    Water: - It shall conform to requirements laid down in IS: 456-2000 and CPWD Specification.

   2.3       R.C.C work (Design Mix Concrete)- Wherever the RCC work is specified to be done with
             Design Mix Concrete, The particular specifications, as applicable, shall apply.

   2.4       R.C.C. work (Nominal mix concrete) - Water Cement Ratio:- For RCC Works, wherever
             nominal mix of concrete is stipulated in the items for work, for maintaining proper quality
             and durability requirements of the structure, maximum water cement ratio shall be restricted
             to 0.55. If in normal course of work, the required workability is not achieved; suitable
             plasticizers/admixtures may be used for improving the workability of concrete with the
             approval of Engineer-in-Charge for which nothing extra shall be paid.

   2.5       Non-destructive Testing for Concrete/R.C.C work: - The Engineer-in-Charge shall, at his
             discretion, get the non-destructive testing (Such as Ultrasonic Pulse velocity Test etc.) done
             and the Contractor shall make all necessary arrangements for getting such tests done and
             make good the same after the test, for which nothing extra shall be paid. The results of such
             tests shall be binding on the Contractor. In case of non-conformity of the test to the standards,
             the contractor shall be liable to re-do the concrete work at his cost including the cost of test,
             subject however, to the acceptability of the work as laid down in the mandatory test defined
             in the relevant CPWD specifications.

   2.6       Cement slurry, if any, added over base surface or for continuation of concreting for better
             bond is deemed to have been in built in the items (Unless other wise explicitly stated) and
             nothing extra shall be payable or extra cement considered in consumption on this account.

   2.7       Centering and Shuttering for R.C.C Work: - The concrete surface shall be free from
             honey combing, offsets, superfluous mortar, cement slurry and foreign matter. The formwork
             shall be assembled in such a way as to facilitate removal of their parts in proper sequence
             without any damage to the exposed cement concrete surfaces and corners etc. The contractor
             shall keep skilled staff for special care and supervision to check the formwork and concreting
             so that every member is made true to its size, shape, level and alignment so that it does not
             result in any deformation, snug, bulges etc. The contractor shall also take suitable
             precautionary measure to prevent breaking and chipping of corners and edges of completed

        work until the building is handed over. The size of shuttering plates for slab shall not be less
        than 0.6mx0.9m in general. However, contractor has to provide tape or wooden fillets or
        rubber gaskets to seal the joint properly to get smooth surface. Further shuttering shall be of
        such quality that there are no undulations and surfaces will be fairly even and extra thick
        ceiling plaster shall be permitted to make the surface even. Any honeycombed or poorly
        formed. Concrete shall be repaired with polymer concrete of any suitable design by the
        contractor at his own cost, in accordance with the specifications laid down in hand book of
        repairs and rehabilitation of RCC Buildings by CPWD

2.8     BRICK WORK: - Bricks used in the work shall be F.P.S. to be obtained from kilns
        approved by Engineer-in-Charge. In all other respect they shall conform to the provisions in
        C.P.W.D. specifications.

2.9     STONE WORK: - Stone used in stone masonry work shall be hard granite/basalt/quartz
        stone/sand stone to be obtained from quarries approved by the
        Engineer-in-Charge and shall conform to the relevant provision in the C.P.W.D.
        Specifications.

2.10   All above materials like stone aggregates, coarse sand, fine sand, Bricks, Surkhi, stone etc.
        confirming to the CPWD specifications to be brought from the sources approved by
        Engineer-in-Charge. In case, at any stage during execution of work, the material from the
        approved source being not available or otherwise, and, is required to be arranged from other
        sources conforming to relevant CPWD specifications and duly approved of Engineer-in-
        Charge, involving extra lead etc. nothing extra shall be paid on this account.

2.11    WOOD WORK: -Timber required for manufacture of chowkhats and shutters for doors,
        windows, ventilators and partitions etc. in the work shall be kiln seasoned and preservative
        treated. The timber shall be kiln seasoned before applying preservative treatment. The rate
        quoted for various items shall be inclusive of kiln seasoning and preservative treatment. The
        wood used in the work shall conform to the provisions in the CPWD Specifications for
        works.

2.12    FACTORY MADE SHUTTERS ETC.: - The shutters for doors, windows & ventilators,
        and, chowkhats etc. shall be factory made and obtained from suppliers, approved by the
        Engineer-in-Charge.

2.13    STEEL WORK: - All steel doors, steel windows, steel ventilators, wire gauge, steel glazing,
        steel grill shall be according to the Architect's detailed drawings and factory made and
        obtained from approved suppliers.

2.13.1 In the case of composite steel windows the rate shall include the cost of coupling mullions and
        transom etc. Where windows with inside open able shutters are fixed along-with windows
        with shutters open able outside, such inside open able windows shall be fitted with suitable
        friction hinges, and open able outside with box type hinges, lever handles or otherwise as
        approved by the Engineer-in-charge of the work. For       such windows, cement concrete
        blocks of size 15 cm x 10 cm x 10 cm shall be provided. Nothing extra shall be paid on this
        account.

2.13.2 In the case of steel windows, steel doors, steel glazing, wire gauge steel ventilators, rolling
        shutters & M.S. grill etc. an approved quality priming coat of zinc chromate shall be applied
        over and above a shop coat of primer. Nothing extra shall be payable for providing shop-coat
        primer.

2.15    Approval of sample work of repetitive/typical nature prior to general execution of work
        shall be as enumerated hereafter.

      2.15.1     Samples of typical portion of work of repetitive nature such as typical room, toilet
                 room or any other work shall be prepared by the contractor under the direction and to
                 the complete satisfaction of the Engineer-in-charge and got approved from him in
                 writing before the commencement of these items for the entire work.

  2.15.2         The work shall be so arranged to be carried out that the requirement for preparation
                 of samples are observed and fulfilled without any detriment to the general progress of
                 work. In other words, this will not be allowed to have any effect on the general
                 progress of work or on any of the terms and conditions of the contract. No claim of
                 any kind whatsoever including the claim of extension of time will be entertained due
                 to the incorporation of this requirement.

2.17      TEST RESULTS & RELATED ASPECTS: -

  2.17.1         Normally, part rate payment shall be allowed in the running account bills only if the
                 materials conforming to C.P.W.D. Specifications for works as mentioned in the work
                 are tested and test results are found to be satisfactory by the Engineer-in-charge.

  2.17.2 The Engineer-in-charge of work shall check the test results and satisfy himself before
         allowing any payment in the running/ final bill.
“C” PARTICULAR SPECIFICATIONS

1.1        CHECK LIST FOR QUALITY ASSURANCE: - For works with estimate cost Rs.10
           Lakhs and above, quality Assurance Check list for Back Filling, Plain Cement Concrete,
           Shuttering, Reinforced Cement Concrete and Structural Steel fabrication as annexed in
           BSNL W – 8 shall from a part of the Tender Document. Compliance of this quality
           Assurance Check List shall be before released of the payment.

                         SPECIAL CONDITIONS FOR THE CONTRACT

          The following special conditions shall be applicable in addition to all other conditions given
in this tender from. However, nothing extra shall be paid on this account unless otherwise mentioned.
1.        The work shall be carried out as per CPWD specifications-1996 with up to date correction as
per instruction of Engineer in Charge. The layout plan and other details/drawings shall be supplied
with individual work order (sub-agreement) issued under this contract by the Engineer –in-Charge.
The drawing Enclosed with tender document are reference drawings only.
2. BSNL reserves the right to accept tender quantities in part or whole without assigning any reason.
3. The period of contract shall be 2 (Two) Months.
4.        Quantities in schedule of works in the tender document are indicative. Actual quantities may
be reduced to any extent and can be increased up to 50% over stipulated quantities available and
decision of the engineer – in – charge in this regard shall be final and binding on the contractor /
agency. No claim on Non – execution of certain item (s) will be entertained like loss of profit,
idle labor, wastage of material etc.
5.        Rates shall be valid for quantities stipulated in the agreement including deviation up to a limit
of 50% (Fifty percent) during the contract period of 2 (Two) Months and also up to extended period
if any beyond 2 (Two) Months.
6.        For quantities beyond 50% (Fifty percent) of the stipulated quantities (over and above the
stipulated quantities), payment shall be made at market rates as per clause 12.
7.        The contractor shall carryout the work at the different sites made available to him / them by
doing all the works simultaneously.
8.        In case the contractor fails to commence the work of a particular site within 7 days of making
over of site / Stipulated date of start, that particular site shall be withdrawn from him / them and will
be handed over to other agency for doing the same at risk & cost of the original contractor. The tower
foundation shall be invariably completed in 30 days from the date after handing over of the site /
stipulated date of start.

9.       In case of failure of the contractor for any reason specified in clause-3 of the contract the
Engineer-in-Charge will give 5 (five) days notice to the contractor to rescind that work. If the reply to
the notice is received within 5 days by the Engineer-in-charge which is not satisfactory or if no reply
is received then the Engineer-in-charge shall be liberty to rescind that work without any further
reference to the contractor and decision of the Engineer-in-charge for rescinding that work order shall
be final and binding on the contractor. Once the work is rescinded, the Engineer-in-Charge have
liberty to get that work executed through any contractors of any adjoining area under his charge after
taking the consent letter from the contractor of adjoining area. Failure of the contractor of the
adjoining area to complete the job for any reason whatsoever, the Engineer-in-Charge shall have
liberty to call separate tender for that work and get the work executed/completed at the risk and cost
of the contractor of the adjoining area.
10.      Work shall be finalized after taking A/T certificate from the competent authority.
11.      The intending tenderer shall note that the work is of urgent nature and is to be positively
completed within the stipulated period. Therefore, only those Contractors who are confident and
capable of carrying out the work within the stipulated period should apply for the work. Due to the
urgency of
the work, failure to commence the work within 7days of the award of the work, would result in
forfeiture of the amount of the EMD without any notice to the contractor. However, if the
commencement of the work is held up on account of reasons beyond his control, it shall be the sole
responsibility of the contractor to bring the matter to the notice of the Engineer- in-Charge
immediately and obtain permission in writing for delay in commencement of the work.
12.      The tenderer shall take into consideration the Drawings and Specifications and quote the rates
accordingly. The quoted rates shall be comprehensive complete including all charges such as
Insurance, transportation, taxes fixed by the Central/State Government etc. Nothing extra shall be
payable over the quoted rates.
13.      It is likely that the work shall be executed in restricted areas and therefore a few
restrictions may be in force for security purposes. The contractor shall be bound to follow all such

restrictions and nothing extra shall be payable. The tenderer shall make necessary enquiries relating to
such restrictions before quoting their rates and nothing extra will be payable on this account.

14.      Departmental materials for tower shall be issued to the contractor for the work. In the event
of any loss/damage of the departmental materials for which the certificate of the Engineer -in-Charge
shall be final and binding, the Engineer-in-Charge have the right to recover @ Rs 1, 00,000.00 per
MT.

15.      The completed work shall be inspected for approval by the “Acceptance Testing Unit of
the “Telecom. Circle”. It shall be the responsibility of the contractor to offer the completed work
for inspection and approval of the A/T in co-ordination with and as per the directions of the
Engineer-in-Charge and nothing extra shall be payable on this account. If the completed work is not
found satisfactory as per the prescribed specifications by the A/T unit corrective measures ordered
by the Engineer-in-Charge shall be carried out immediately by the contractor without any additional
liability to the BSNL.
20.       The contractor shall within7 (Seven) days of issue of award letter intimate to the concerned
sub – Divisional Engineer & Executive Engineer regarding the make / brand / manufacturer of the
cement, steel etc, he intends to use in the work.
 21.      The make / brand once approved shall not be changed during the currency of the agreement.
 22.       No corrections / Modification in the prescribed tender from / document are permissible. All
           corrections / additions / alterations in the quote percentages / amounts rebates etc shall be
           signed in full by the tenderer with date. Erasures and / amounts rebates etc. shall be signed
           in full by the tenderer with date.

23.     If it is found that the tender is not submitted in proper manner or conditions or has too many
corrections or absurd percentage or amounts, it would be open to BSNL to reject the tender and or / to
take any other action against the contractor as deemed fit.

24.     In case, the work cannot be started due to reasons not with in the control of the contractor
   within 1/8th of the stipulated time for completion of work, either party may close the contract .In
   such an eventuality, the Earnest Money Deposit and the Performance Guarantee of the contractor
   shall be refunded, but no payment on account of interest, loss of profit or damages etc shall be
   payable at all.
1.0 RATES:
1.1 Unless otherwise specified, the rates quoted for the items shall include all labour, material,
      Octori, taxes including service tax and labour cess, insurance, ward, necessary T & P required
      for the work, tests, all weighing / measuring equipments etc all complete. Nothing extra shall be
      paid in addition to the quoted for the items.
1.2 The contractor shall           pay Octroi wherever applicable. The form ‘C’ / ‘D’, Octori
     exemption certificates etc will not be issued by BSNL for any materials required in the work.
     The contractor shall quote all-inclusive rates only. Nothing extra shall be paid over the quoted
     rates.
2.0 The workers on the execution site should be adequately insured so also third party insurance for
     any unforeseen injury to passer by – or occupants of adjoining buildings.
3.0 INSURANCE:

      Without limiting the contractor(s) obligations and responsibilities stated elsewhere in the
      contract, the contractor shall at his own cost arrange, secure and maintain insurance in the joint
      names of the BSNL and the contractor with any of the subsidiary of the general insurance
      corporation of India in such a manner that the BSNL and the contractor are covered for all time
      during the period of contract i.e. the time period allowed for completion of the work, extended
      period and the defect liability period. The insurance shall be effected in accordance with terms
      approved by the BSNL and the contractor shall submit the insurance policies to the Engineer –
      in – charge within one week of signing of the agreement along with the receipt of premium. The

      contractor shall timely pay and submit the receipts of payment of premiums for extensions of
      policies, if any. The insurance shall cover the followings: -
3.1            CONTRACTOR’S ALL RISK INSURANCE:
    i)       The contractor shall insure the work for a sum equivalent to the contract value or such
             additional sums as specified and the interests of the BSNL against ALL RISK claims,
             proceedings, loss or damages, costs, charges and expenses from whatsoever cause arising
             out or in consequence of the execution and maintenance of the work for which the
             contractor is responsible under the contract. All the insurance polices as mentioned below
             shall be submitted by the contractor along with the acceptance of APO / performance
             Bank Guarantee.

      ii)     Third party insurance to cover for any damages to third party. This shall be up to the end
              of the defects liability period and shall include for any damage to the properties and / or
              injury (including death) to the persons of the general public and any one else deemed to
              third party. The contractor shall be responsible for making good to the satisfaction of the
              Engineer – in – charge any loss or any damage to all structures and properties belonging
              to the BSNL or being executed or procured or being procured by the BSNL or of the
              other agencies within the premises of all work the BSNL if such loss or damage is due to
              fault and or the negligence or willful acts or omissions of the contractor, his employees,
              agents, representative.

      iii)    Civil commotion, Riots, War and other disturbances.
      iv)     Earthquake or any other natural calamities.

      v)      Policy to cover contractor’s liability and to indemnify BSNL against all claim’s damages
              and compensation under the provisions of payment or wages Act 1936, Minimum Wages

      vi)     Act 1948, Employers Liability Act 1938, the workman’s compensation Act
              1947,industrial Disputes Act 1947 and Maternity Benefit Act 1961, or any modification
              under thereof or any other law relating thereof and rules made there under from time to
              time. This shall be for the period up to final completion of work, including the defects
              liability period. This insurance shall be affected for all the contractor’s employees
              engaged in the performance of the contract. The BSNL shall not be liable in respect of
              any damages or compensation payable at law in respect of or in consequence of any
              accident or injury to any workman or any other person in the employment of the
              contractor and the contractor shall indemnify and keep indemnified the BSNL against all
              such damages and compensation and against all claims, demands, proceedings, costs,
              charges and expenses, whatsoever in respect or in respect or in relation thereof.
      vii)    Insurance cover against damage, theft or any other loss of all the materials and
              equipments brought to site for which advance is claimed – Limit of liabilities not less
              than the value or such material at any stage of the contract. The contractor shall insure
              against all such liabilities and any stage of the contract. The contractor shall insurance
              during the currency of the agreement including defects, liability period.
      viii)   Premium for all insurance policies shall be paid and born by the contractor and shall NOT
              be reimbursable.

3.2           Contractor shall also at his own cost carry and maintain any and all other insurance(s)
              which he may be required to take out under any law or regulation from time to time. He
              shall also carry and maintain any other insurance, which may be required by the Engineer
              – in – Charge. In addition to the liability imposed by law upon the contractors for injury
              (including death) to persons or damage to property by reason of negligence of the
              contractor or his against, which liability is not impaired or otherwise affected hereby, the
              contractor herby assumes liabilities for and agree to save the USO harmless and
              indemnifies USO from every expense, liability or payment by reason of any injury
              (including death) to persons or damage to property suffered through any act or omission

             of the contractors or any persons directly or indirectly employed by any of them or from
             the conditions of the premises or any part of the premises which is in the control of the
             contractor or anyone directly or indirectly employed by either of them or arising in any
             way from the work called for by this agreement.
 3.3         The contractor shall prove to the Engineer – in – Charge from time – to – time he has
             taken out all the insurance polices referred to above and has paid the necessary premiums
             for keeping the policies alive till expiry of the defects Liability period.
 3.4         The aforesaid insurance policies shall provide that they shall not be cancelled till
             the Engineer – in – Charge has agreed for cancellation.
 3.5         Remedy on the contractor’s failure to insure:

             If the contractor shall fail to effect and keep in force the insurance referred to above or
             any other insurance which he / they may be required to effect under the terms of the
             contract then and in any such case Engineer – in – charge may without being bound to,
             effect and keep in force any such insurance and pay such premium or premiums, as may
             be necessary
             for that purpose and from time to time deducted the amount so paid by the Engineer – in
             –charge from any money due or which may become due to the contractor or recover the
             same as a debt due from the contractor.


 3.6        INDEMNITIES

 3.7         The contractor shall at all times hold the BSNL harmless and identify from against all
             actions, suits, proceedings, works, cost, damages, charges, claims and demands of every
             nature and descriptions brought or procured against the BSNL, its officers and employees
             and forthwith upon demand and without protest or demur to pay to the BSNL any and all
             losses and damages and cost (inclusive between attorney & client) and all costs incurred
             in endorsing this or any other indemnity or security which the BSNL may now or at any
             time have relative to the work or the contractor’s obligations or in protecting or endorsing
             it’s right in any suit or other legal proceedings, charges and expanses and liabilities
             resulting or incidental or in connection with injury, decease or disablement to or death of
             any person(s) including employee(s) of the Contractor or damage to property resulting
             from or
             arising out in any way connected with or incidental to the operations caused by the
             contractor Documents. In addition, the contractor shall reimburse the BSNL or pay to the
             BSNL forthwith on demand without protest or demure all cost, charges and
             expanses and losses and damages otherwise incurred by it in consequence of any claims,
             demands and actions which may be brought against the BSNL arising out of or incidental
             contract.
3.8          The Contractor shall at his own cost at the BSNL request defend any suit or other
             proceeding asserting a compound or compromise any suit or other finding without first
             consulting the BSNL.

4.0    ACCEPTANCE TESTING:

       The “Acceptance Testing Unit of DOT or BSNL “ shall inspect the completed work for
       approval. It shall be the responsibility of the contractor to offer the completed work for
       inspection and approval of A/T in coordination with and as directions of the Engineer – in –
       charge and nothing extra shall be payable on this account. If the completed work is not found
       satisfactory as per the prescribed specifications, the contractor shall carryout corrective
       measures ordered by the Engineer – in – charge immediately without any additional expenditure
       liability to the BSNL

and independent enquiries and obtained complete information as to the matters and things referred to or implied in the tender documents or

interferences to or with the execution and completion of the work to be carried out under the contract, and has examined and considered all
other matters, conditions and things and probable and possible contingencies, and generally all matters incidental thereto and ancillary
thereof affecting the execution and completion of the work and which might have influenced him in making his tender.

be made at such time in such manner as prescribed in the contract.

It is specifically and distinctly understood and agreed between the BSNL and the contractor that the

contractor shall have no right, title or interest in the site made available by the BSNL for the

specifically belongs to the contractor) and the contractor shall not have or deemed to have any lien

whatsoever on charge for unpaid bills will not be entitled to assume or retain possession or control of

of the site and to remove the contractor, their servants, agents and materials belonging to the

contractor and lying on the site.
