Whereas, the undersigned John Doe of (street address, city, county, state, zip code),
wishes to rent a bicycle from Acme Bicycles, Inc., a corporation organized and existing
under the laws of the state of (name of state), with its principal office located at (street
address, city, county, state, zip code), referred to herein as Acme; and

Whereas, I acknowledge that cycling is an inherently dangerous sport in which I
participate at my own risk; and

Whereas, Acme will not rent a bicycle to me unless I sign this waiver, release and
assumption of risk agreement; and

Whereas, it is my intention to ride any bicycle I rent from Acme in and around the city of
(name of city and state), hereinafter referred to as City; and

Whereas, I acknowledge that City does not, will not, and has no duty to, insure or
guarantee that I will not have an accident resulting in serious injury or death while
renting or riding said bicycle;

Now, therefore, the undersigned does hereby agree to, covenant to, and represent the
following:

1.      I, on behalf of myself, my heirs, assignees and personal representatives, do
release and forever discharge Acme and City, their employees, officers, and agents (all
of which are hereinafter jointly and severally referred to as Released Parties) from any
and all liability, claim, loss, cost or expense, arising directly or indirectly from, or
attributable in any legal way to, any negligence, action or omission to act of Released
Parties that results from my rental of said bicycle.

2.     I, on behalf of myself, my heirs, assignees and personal representatives, do
hereby waive and promise not to sue on any such claims against Released Parties
arising directly or indirectly from or attributable in any legal way to, any negligence,
action or omission to act of

Description: A waiver or release is the intentional and voluntary act of relinquishing something, such as a known right to sue a person or organization for an injury. The term waiver is sometimes used to refer a document that is signed before any damages actually occur. A release is sometimes used to refer a document that is executed after an injury has occurred. Courts vary in their approach to enforcing releases depending on the particular facts of each case, the effect of the release on other statutes and laws, and the view of the court of the benefits of releases as a matter of public policy. Many courts will invalidate documents signed on behalf of minors. Also, Courts do not permit persons to waive their responsibility when they have exercised gross negligence or misconduct that is intentional or criminal in nature. Such an agreement would be deemed to be against public policy because it would encourage dangerous and illegal behavior. This form is a release and assumption of risk agreement in favor of a business that rents bicycles. This form also seeks to release the city in which the business is located.
