                                    NOTICE INVITING TENDER
          No:-    Plg/AMC-30/EAs/Tender/11-12/3              Dated at Jalandhar the 19-05-2012.

           Properly Sealed (PVC Tape/Sealing Wax) tenders are invited by the Sr.GMTD, BSNL Jalandhar
on behalf of BSNL for each section from experienced contractors having experience of large capacity
Diesel generating Sets (ISI mark) for Annual maintenance and service cum inspection contract of
diesel generators of capacity upto 50 KVA & above in Jalandhar SSA with details as under: -

1.         Tender form including terms and conditions for each section can be obtained on cash payment
of Rs. 500+13.75% Sales Tax = Rs. 569/- (Non-Refundable) from SDE (MM), O/o Sr.GMTD Jalandhar
on any working day during the office hours upto 11-06-2012 till 15:00 Hrs. The form can also be
downloaded from our web site www.punjab.bsnl.co.in for submitting the tender. In such a case, cost
of the Tender form should invariably be paid in the shape of Demand Draft in favour of A.O. (Cash)
BSNL O/O GMT Jalandhar and attached with the Technical Bid and it will be considered that terms
and conditions of the whole tender document have been read and under stood by the Bidder.
     Properly Sealed tender superscribed as “AMC and Service cum Inspection contract of diesel Gen.
Sets in SSA Jalandhar” addressed to AGM (NWP), O/o Sr.GMTD Jalandhar alongwith earnest money
in the shape of Demand Draft in favour of Accounts Officer (Cash) BSNL. O/o Sr.GMTD Jalandhar
payable at Jalandhar will be received upto 15:00 Hrs. of on 12-06-2012. The Tender to be submitted
in two separate properly wax/tape sealed envelopes (superscribed) as under: -
     1.          Technical Bid for AMC of Engine Alternators in SSA Jalandhar.
     2.          Financial Bid for AMC of Engine Alternators in SSA Jalandhar.
Envelope No-A (Technical Bid) will contain the following documents: -
     1.    Tender documents duly signed on each page by the authorised signatory in token of having
           read and accepted all the terms and conditions.
     2.    Copy of PAN duly attested by Gazetted officer/ Notary Public/BSNL Officer not below the rank
           of SDE.

    3. Copy of experience certificates of two works of similar nature each costing not less than Rs.8
       Lacs during the last five financial years upto 31-03-2012 in BSNL/MTNL/PSUs/State or
       Central Govt. issued by class-I officer not below the rank of Divisional Engineer or equivalent
       and should be duly attested by a Gazetted Officer/Notary Public/BSNL Officer not below the
       rank of SDE.
   4. Required Earnest Money.
   5. Copy of latest partnership deed or articles/memorandum of Article of association as the may be
       duly attested by Gazetted Officer/Notary Public/BSNL Officer not below the rank of SDE.
       However, in case of Sole Proprietor, affidavit to this effect will suffice duly attested by Notary
       Public (Photocopy/attested copy of affidavit will not be accepted).
   6. Copy of Registration of firm/company in case of partnership firm/company attested by
       Gazetted Officer/Notary Public/BSNL Officer not below the rank of SDE.
   7. Certificate regarding Non-Employment of family members in BSNL in the prescribed format
       mentioned in Document.
   8. Copy of the Service tax registration certificate duly attested by Gazetted officer/ Notary Public
       /BSNL Officer not below the rank of SDE.
   9. Cost of tender form, if the bidder downloads terms and conditions from website.
   10. Copy of EPF registration with EPF Department duly attested by Gazetted Officer/ Notary Public
       /BSNL Officer not below the rank of SDE.
Envelope No-B (Financial Bid)
       It will contain the schedule of rates and the rates to be quoted in words and figures.
       The Envelopes A&B should be properly wax/tape sealed and then placed in another properly
wax/tape sealed envelope superscribed as “Tender for AMC and Service Cum Inspection Contract
of D/G Sets of telephone exchanges”. The Technical Bid will be opened on 12-06-2012 at 15:15
hrs. in the presence of those tenderers/authorised representative who may wish to be present at their
own cost. The date of opening of Financial Bid will be intimated later on. Financial Bid only of those
bidders will be opened whose Technical Bid will found to be valid by the Committee as nominated for
the purpose. If it happens to be a holiday on any of the date given above the transaction will be held
on next working day. Sr.GMTD Jalandhar reserves the right to reject any or all tenders without
assigning any reasons.

                                       TERMS AND CONDITIONS

1.      Total estimated cost of the tender is Rs.22.35 Lacs including the cost of replacement of major
        parts.

2.      Tender should be submitted complete in all respects in properly sealed cover superscribed as
        “Tender for AMC and Service cum Inspection contract of Diesel Generator Sets of
        Telephone Exchanges” in Jalandhar SSA. The sealed tender should be addressed to AGM
        (NWP) % Sr.GMTD Jalandhar and should be delivered either in person in this office or sent by
        registered post so as to reach this office by 15:00 hrs on 12-06-2012.

3.      The Tender to be submitted in two separate properly wax/tape sealed envelopes (Superscribed)
        as under:-
(A)     Technical Bid for AMC of Engine Alternators.
(B)     Financial Bid for AMC of Engine Alternators.
Envelope No-A (Technical Bid) will contain the following documents: -
i.      Tender documents duly signed on each page by the authorised signatory in token of having
        read and accepted all the terms and conditions.

Envelope No-B (Financial Bid)
       It will contain the schedule of rates and the rates to be quoted in words and figures.
       The Envelopes A&B should be properly wax/tape sealed and then placed in another properly
wax/tape sealed envelope superscribed as “Tender for AMC and Service cum Inspection Contract
of D/G Sets of Telephone Exchanges”. The Technical Bid will be opened on 12-06-2012 at 15:15
Hrs. in the presence of those tenderers/authorised representative who may wish to be present at their
own cost. The date of opening of Financial Bid will be intimated later on. Financial Bid only of those
bidders will be opened whose Technical Bid will found to be valid by the Committee as nominated for

Eligibility
4.      Tenderer signing the tender should in case of firm clearly specify whether they are signing as
        (a) Sole proprietor (b) Partner (c) Under the owner of attorney (d) Director, Manager, Secretary
        etc. as the case may be. Copies of the documents authorizing the tenderers signing the tenders
        on behalf of such companies firms or persons should be attached with the tender.

5.     There should be no over writing/correction in schedule of rates. If any, that must be initialed.
       Conditional tenders are also liable to be rejected The rates must be inclusive of all taxes
       including sale tax, octroi and local charges etc. However service tax on AMC charges will
       be paid extra as applicable from time to time.

6.     The accepted rates will be operative for one year from the date of acceptance. Sr.GMTD
       Jalandhar may extend or reduce the period, as per administrative convenience. However
       extension of period can only be upto 2 years. Quantity and capacity of DG Sets/Operation sites
       may also vary under the changed circumstances.

7.     The tenderer whose tender is accepted shall deposit with AO (Cash), BSNL % Sr.GMTD
       Jalandhar as security equivalent to 10% of cost of work awarded in the shape of demand draft
       in favour of AO (Cash), BSNL% Sr. GMTD Jalandhar or FDR duly pledged to AO (Cash), BSNL
       % Sr.GMTD Jalandhar valid for 18 months (Less earnest money automatically converted into
       security) within 10 days from the date of intimation of acceptance of tender in writing.

              Sr.GMTD Jalandhar reserves the right to extend the date for deposit security in
       deserving cases. In case of failure to furnish the requisite security or non execution of
       agreement within the above specified period, the officer will be treated as withdrawn and
       earnest money will be forefeited.

8.     If any tenderer withdraws before the final acceptance of the tender or if any fails to deposit the
       security as prescribed, with in stipulated period the earnest money of the tenderer is liable to
       be forefeited.

9.     General Manager Telecom Jalandhar reserves the right to reject/accept any tender or tenders
       without assigning any reason thereof and may or may not accept the lowest or any of the
       tender as the authority to accept the tender rests with the GMT Jalandhar. He further reserves
       the right to accept all for any tender in part/parts.

10.    Earnest money will be refunded to the unsuccessful tenderers in due course in accordance
       with the rules of the department.

11.    BSNL will not be liable to pay any interest on the earnest money or security deposit, which
       remain in its custody.

12.   BSNL also reserves the right to forfeit the earnest money and the security deposit, if after the
      acceptance of the tender, the successful tenderer, fails to comply with any of the terms &
      condition set out in agreements which may be drawn up as a consequence of the acceptance of
      the tender, In such cases, the right to cancel the tender/contract is also retained by the
      Corporation and the decision of the General Manager Telecom, Jalandhar (including forfeiture
      of the earnest Money/Security deposit) will be final and binding.

13.   Income Tax/Sale Tax will be recovered on the Gross amount payable for the work done
      as applicable from time to time.

14.   If there is any dispute in the interpretation of any clause/clauses in the terms & condition of
      the contract or in case of any other dispute, the matter will be referred to the sole arbitrator
      nominated by CGMT, Punjab Circle Chandigarh whose decision in this regard will be final &
      binding to both the parties.

15.   If the contractor refuses to accept the work order for any specified work or fails to give the
      specified output, BSNL reserves the right to get work done by other agency/contractor even at
      higher rates and difference of the cost will be deducted from the contractor’s pending bills or
      security alongwith penalty, as the case may be.

16.   The contractor shall receive all letters addressed to him by General Manager Telecom or
      DETs/SDEs/JTOs either personally or through his authorised agents failing which letters will
      be posted to him. Department will not be responsible for non-receipt of letters & contents of
      such letters shall be binding on the contractor as if these letters have been received by him on
      the date of posting.

17.   The work will be done as per directions/specification given by the DEs/SDEs concerned. All
      the consumable as well as parts replaced should be of original make of that E/A.

18.   The contractor shall submit his bills on quarterly basis to AGM (NWP) % Sr.GMTD Jalandhar
      duly verified by SDO & C/S by concerned DEs, where the bills be processed to make payment
      normally within 30 Days of the receipt of bills subject to availability of funds and proper
      submission of bills.

19.   Any attempt direct or indirect on the part of the tenderer to influence by any means for the
      acceptance of a particular tender will render the tender liable to exclusion from consideration.

20.   Next working day shall be applicable in case there happens to be a holiday on any of the dates
      above for sale and receipt of the tenders.

21.   Incomplete tender, conditional tender or tender without earnest money is not likely to be
      considered.

22.   In unavoidable circumstances like war, Civil Commotion, Fires, Floods Strikes or lock outs
      either party can intimate within 21 days of occurrence and upto 60 days on option to terminate
      the contract

23.   The contractor will be responsible & liable to make good any losses, which may be caused to
      the Deptt. or/and other agency due to negligence of the contractor and of his any employees.

24    The contractor will ensure a visit of trained technicians at all the sites of E/As at least once in
      every month and will get his inspection report signed from the officer/official authorized by
      concerned DE. The contractor will be bound to have at least one contact Telephone No. in
      Jalandhar city which will have to be attended round the clock and there must be some
      technicians available at this number who will move immediately in case of any fault/

       emergency. The contractor will also give his FAX no. and EMAIL ID where the complaints will
       be sent by the field units.

       PENALITY
25.    The fault must be attended and repaired within 24 hours of receipt of intimation failing which
       a penalty of Rs. 500/- per day per E/A shall be imposed on the contractor. If the E/A remained
       unattended for more than three days the E/A will be got repaired from open market and bill
       will be adjusted to his running bills or security. This will be in addition to penalty imposed for
       the whole period for which the E/A had remained out of order till it is repaired by contractor or
       third party. The maximum penality will be 10% of the total tender cost.

26.    The contractor will submit proof of payment viz challan etc for service tax with the subsequent
       bills. The payment of bills will be made on availability of funds after sanction by the competent
       authority.

27.    The corporation shall not be responsible for any type of losses caused to him, or to his
       employees due to any mishap or accident during the course of the work agreement.

28.    The contractor shall himself be responsible for completing all due formalities as applicable
       under labour act in respect of employees employed by him for the job against this contract and
       BSNL will in no way will be responsible for their pay/dues etc.

29.    The contractor shall intimate to the department the particulars of the technical staff employed
       by him for the job and no person other than the said employees shall be allowed to enter the
       exchanges. The contractor himself however, may visit the exchanges only in connection with
       the job entrusted to him.

30.    The contractor will arrange servicing of each E/As by his trained technician as per the
       schedule given in attached annexure and the consumable like M.Oil, filter etc. required to be
       replaced during servicing of E/As shall be supplied by the contractor.

                                   Special Terms and Conditions
31.    All the works are to be carried out as per company specification and to the entire satisfaction of
       DET/SDE/JTO incharge of the unit.

32.i   The exchange incharge shall maintain a log-book of maintenance of DG set and required to
       make entry of all the visits of the contractor/authorized representative with a mention of
       inspection made by him in the prescribed format/schedule.

ii.    New contractor will take over all the DG sets from the old contractor/BSNL, as the case may be
       in good working condition and their AMCs will start from the date of takeover. After the expiry
       of the contract, it will be the personal responsibility of the contractor to hand-over all the DG
       sets under AMC in healthy/ running condition to the new contractor/department, as the case
       may be. Failing which the department will make good the loss by forfeiting security
       deposit/from running bills of the firm & the firm will be black-listed.

iii.   The DG sets will be repaired/serviced at the site itself and a job card to be printed by the
       contractor as per annexure-IV will be signed by the contractor as well as by BSNL Staff.
       Job card must accompany the bill for payment.

33.    The scope of this work covers the following work/check as per schedule given in attached
       annexure.
        a. Check hose pipe & tighten hose clamps.
        b. Check and tighten V belts tension & replace belts when necessary.
         c. Check and tighten DC wiring terminal ends on engine and engine production unit.
        d. Carry out air cleaner maintenance.

       e.    Check and adjust tappet clearance.
        f.   Check and record engine performance parameters.
       g.    Check the engine protection unit for proper functioning.
       h.    Inspection and maintenance of electric AMF/ manual control panels i.e. checking of
             wiring etc.
        i.   Battery checking.
        j.   The contractor will do the complete service within two months from the signing of the
             agreement including engine oil change, air filter change, oil filter change etc.
       k.    Draining of lubricating oil from the sumps, lub oil cooler. Cleaning the lub oil straisner as
             per schedule attached in Annexure.
        l.   Renew lubricating oil prime lubricating system.
       m.    Providing replacement of lub oil filter/fuel filter element as per schedule attached in
             Annexure.
       n.    Any other related work required to keep the E/A in good running condition.

34.   The maintenance contract is comprehensive i.e. all the spare parts (excluding major parts given
      in Annexure-III) required to be replaced during the scope of work as per clause 33 and
      otherwise shall be supplied by the contractor at his own cost. The material supplied/replaced
      will be of manufacturer’s specifications and no separate labour charge shall be paid for
      replacement of these parts. Consumables like lubricants and filters will also be supplied by the
      contractor during the replacement of these parts. The work order for replacement of major
      parts will be issued by the concerned DE.

35    To ensure the genuineness of the spare parts replaced, the contractor shall submit original
      bill/cash memo from the authorised dealer from whom these parts have been procured. The
      contractor will also get genuineness of these spare parts certified from the concerned
      JTO/SDO/DE before replacement.

36.   In any case, replacement cost of major parts (as Annexure-III) will not increase 25% of the
      estimated cost of items under Annexure-III. The material supplied/replaced will be of
      manufacturer’s specifications and no separate labour charge shall be paid for replacement of
      these parts. Any damage made to the building, any equipment DG, set etc. during the
      execution of work shall be the contractor’s liability. It shall be made good by them free of cost.

37.   The contractor shall have to arrange all tools, T&P, old dhoti, jute detergent etc. required
      during maintenance/service. No such material shall be supplied by the corporation.

38.   No skilled/unskilled staff shall be provided to the contractor for carrying out the maintenance/
      service of DG Sets.

39.   Payment shall be made on quarterly basis.

40.   List of E/As to be covered under AMC’s Sub Division wise and capacity is attached. However
      more E/As with capacity can be added during the AMC period and payment to such added
      E/As will also be made proportionately.
41.   In case, any clause is not mentioned, prevailing departmental rules will apply.
42.   The jurisdiction of Civil Court shall be at the Headquarters of GMT Jalandhar.

43.   The tenderer will not be permitted to sublet the work to other agencies on commission basis. In
      such circumstances if it is found that the work has been subletted, the earnest money &
      security of the tenderer will be forefeited and no further work will be allotted to him.

44.   Sr.GMTD Jalandhar reserves the right to award the work to other tenderer if the performance
      is found satisfactory or he fails to start work after signing agreement and GMT Jalandhar also
      reserve the right to terminate the contract and earnest money and security will be forefeited

45.    If any of the information furnished by the tenderer is found to be incorrect, the contract is
       liable to be terminated without notice and the earnest money and security deposited is liable to
       be forefeited.

46.    That in the event of tenderer being adjudged insolvent or otherwise legally incapable of fulfilling
       this contract, GMT Jalandhar shall have power to terminate the contract immediately without
       giving any notice to the tenderer and security will be forefeited.


47.    Any unit not found in working condition at the time of making over will be got repaired by
       BSNL.

48.    The contractor will also follow the following acts/laws:-
       (i)    Employees provident and Miscellanies Provision Act-1952.
       (ii)   ESI, Wages & Other contributions etc.
       (iii)  Any other relates Act/Law enacted from time to time

49.    Other Labour Welfare Measures.
       (i)   The contractor shall implement the labour welfare measures enunciated in clause 19B,
             19C,19E,19G,19H, 19L & 19J of he condition contract in the PW8.
       (ii)  The contractor shall also follow the safety method enunciated in the C.P.W.D. safety
             code.
       (iii) The contractor shall comply with all the provision of the minimum wages Act,1948
             contract labour (R&A) Act,1970 and the rules framed and other labour laws, affecting
             contract labour that may be brought into force time to time.

50.    1.     Certificate regarding none of his/her near relative is working in the BSNL
       Note: The format of the certificate (as per BSNL H.Q. Letter no: 151-08/2002-O&M/38 Dt. 11-
       9-2002) to be given is :-
              “I     _________________________S/o       ____________________________   r/o_________
       __________________proprietor/partner/authorised signatory of M/s _______________            hereby
       certify that none of my relative(s) as defined in the tender document is / are employed in BSNL
       Unit as per details given in the tender document. In case, at any stage it is found that the
       information given by me is false / incorrect, BSNL shall have the absolute right to take any
       action as deemed fit / without any prior intimation to me”
       The near relatives of this purpose are defined as:
       (a)     Members of a Hindu Undivided family.
       (b)     They are husband and wife.
       (c )    The one is related to the other in the manner as father, mother, son(s) & son’s wife
               (daughter-in-law) Daughter(s) & daughter’s husband (son-in-law), brother(s)       &
               brother’s wife, sister(s) & sister’s husband (brother-in-law)
     Note:-
         In case of proprietorship firm certificate will be given by the proprietor, for partnership firm
certificate will be given by all the partners and in case of limited company by all the Directors of
company.


51.    Bid shall remain valid for 150 days from the date of opening of the bid (qualifying bid) A bid
       valid for a shorter period shall be rejected by the department as non-responsive.


52.    Any breach of these conditions by the company or firm or any other person the tender/work
       will be cancelled and earnest money/ security deposit will be forfeited at any stage whenever it

is so noticed. BSNL will not pay any damages to the company, firm or the concerned person.
The company or firm or the person will also be debarred for further participation in this SSA.

1.     The rates should be inclusive of all the taxes including sale tax, octroi and local charges etc.
       However service tax on item in annexure-1 will be paid extra as applicable from time to time.

2.     The quoted rates should be properly sealed.

4.     The evaluation of the tender shall be done on complete package basis as quantities mentioned
