DRILLING OF WELLS
IDENTIFICATION NUMBER: (DACAAR-PUT13/2009) This contract is between DACAAR and “ “ hereafter referred as the contractor for Drilling of two wells in Jalaier area of Faryab province.
Article 1
Details of works to be done: Boring should be drilled by Rotary Rig with 4 inches diameter drilling rod. The drilling diameter of well should not be less than 12 inches diameter to a depth of 200 m. The contractor should do Karataj (well logging geophysics) under the following conditions a) Perform Karataj after drilling of wells under the supervision of DACAAR field engineer b) Should record the most important parameters like SP, SPR , EC and resistively with long and short improvement c) Identify intervals of each layer(strata) according to the well logging record d) Identify intervals of fresh and saline water (aquifers) according to the well logging record (electrical conductivity) e) Provide comprehensive well log design according to the well logging record Permanent 6-inch PVC casing & filter will be installed in the wells. The casing & filter will be supplied by DACAAR. The contractor will be responsible for lowering and installation. The contractor should also monitor and record salinity of water (Electrical Conductivity) during drilling The contractor should provide sorted sand and gravel (2 to 5mm) for back filling of pipe and filters and also provide available suitable clay for sealing around the pipe The contractor should clean the well by compressor and carry out pumping test for seven hours for each well to find its hydraulic properties. Provide a compete soft and hard copy of report
Article 2 RESPONSIBILITIES OF DACAAR 2.1 DACAAR/WSP shall be responsible for timely supplying of 6 inches diameter PVC pipe and filter. 2.2 DACAAR/WSP is responsible to monitor drilling processes according to the Work details in Article 1. 2.3 DACAAR/WSP shall be responsible for well site selection in Jalaier area of Shireen Tagab district of of Faryab province. 2.4 Payments will be made against receipt of the bill of the CONTRACTOR by DACAAR at the end of the job after successful completion of bored wells. Verification on well completion is needed from the DACAAR/WSP monitoring engineer. 2.5 DACAAR shall not be responsible for transportation and accommodation Article 3 3.1 The cost of drilling mentioned in table (I) of page no.5 shall be the sole remuneration Page 1 of 6
owed by the Contracting Authority to the Supplier under the contract. It shall be fixed and not subject to revision. 3.2 Payments shall be made with 15 days after completion of work. Article 4 The contract is made up of the following documents, in order of precedence: this Contract agreement; copy of Invitation to Bid copy of your offer
The documents making up the contract shall be deemed to be mutually explanatory; in case of ambiguity or divergence, they should be read in the order in which they appear above. For all matters not covered by the above provisions, the law applicable shall be Afghanistan law. Article 6 This contract shall be automatically terminated, and the Supplier shall have no right to any form of compensation if there are any changes in quality or if it emerges that the award or execution of the contract has given rise to unusual commercial expenses. Such unusual commercial expenses are commissions not mentioned in the main contract or not stemming from a properly concluded contract referring to the main contract, commissions not paid in return for any actual and legitimate service, commissions remitted to a tax haven, commissions paid to a recipient who is not clearly identified or commissions paid to a company which has every appearance of being a front company. Article 7 The Contracting Authority may under no circumstances be held responsible for damages caused by the contractor, their employees or a third party in connection with the performance of this contract. Article 8 8.1 10% of total contract value will be deposited to DACAAR account as contract performance guarantee before sign of contact. The mentioned amount of guarantee shall be deposited to DACAAR USD Account No 100 120 100 73 80 in Kabul bank. If termination results from inaction or fault on the part of the Supplier, the Contracting Authority shall be entitled to compensation up to a maximum of 10% of the total Contract value. In the case of delay in completion of drilling, the contactor shall be liable to pay damages calculated from the expiry date of the contractual period. For each day of delay in implementation of the project of drilling wells, the damage is fixed at 0.5% of the total value of incomplete work.

Article 9 The contracting parties shall make every effort to settle amicably any dispute which may arise between them but in case it is not resolved then the case can be referred to local court. Article 10 All required machineries and other accessories plus transportation and accommodation will be provided by the contractor. Article 11 Contractor should provide report on each well and all works must be completed within 45 days after sign of contract.
