7-1        LABELING AND IDENTIFICATION

Original Containers

7-101.11      Original Container Label.

     A. Containers of POISONOUS OR TOXIC MATERIALS and PERSONAL CARE ITEMS shall bear a legible
manufacturer's label.

        B. All opened original chemical containers shall be labeled with the common name in English and
in all other languages read and understood by all EMPLOYEEs of the RETAIL FOOD ESTABLISHMENT.

Working Containers

7-102.11      Working Container Label.

     A. Working chemical containers diluted or proportioned from bulk supplies shall be distinctly
marked or labeled with the common name of the materials for easy identification of contents, and

       B. All working chemical containers shall be labeled with the common name in English and in all
other languages read and understood by all EMPLOYEEs of the RETAIL FOOD ESTABLISHMENT.

Storage

7-201.11        Separation.

    A. Chemical containers including POISONOUS OR TOXIC MATERIALS shall be stored so that they shall
    not contaminate FOOD, EQUIPMENT, UTENSILS, LINENS, and SINGLE-SERVICE and SINGLE-USE
    ARTICLES. These materials shall be stored by:

 B. Separating chemical containers by spacing or partitioning; and

    C. Locating the chemical containers in an area that is not above FOOD, EQUIPMENT, UTENSILS,
    LINENS, and SINGLE-SERVICE and SINGLE-USE ARTICLES. This paragraph does not apply to in-use
    detergents and/or SANITIZERS at the 3-compartment sink or mechanical WAREWASHING machine for
    availability and convenience if the materials are stored or installed to prevent contamination of
    FOOD, EQUIPMENT and UTENSILS.

Presence and Use

7-202.11            Restriction.

        A. Only those chemicals that are required for operation and maintenance of the RETAIL FOOD
        ESTABLISHMENT such as for the cleaning and SANITIZING of EQUIPMENT and UTENSILS and the
        control of insects and rodents, shall be allowed in a RETAIL FOOD ESTABLISHMENT. This
        requirement does not apply to PACKAGED POISONOUS OR TOXIC MATERIALS and medicines that are
        offered for retail sale.

        B. In-use working containers of APPROVED SANITIZERS, at the appropriate concentration, stored on
        working surfaces is allowed provided reasonable care is taken to control splash.

        C. Items such as gasoline, lawnmowers, weedeaters, and in-use paints, paint thinners, oils, WD-40,
        or similar products shall be stored outside, in a shed, or exterior room used for no other purpose.

7-202.12        Conditions of Use.

         A. Chemicals including POISONOUS OR TOXIC MATERIALS shall be used according to LAW, the
        manufacturer’s directions for use that state that use is allowed in a RETAIL FOOD ESTABLISHMENT,
        and

        B. Applied so that:

               1)     It does not constitute a hazard to EMPLOYEES or other PERSONs, and

             2)    Contamination including toxic residues due to drip, drain, fog, splash, or spray on
                  FOOD, EQUIPMENT, UTENSILS, LINENS, and SINGLE-SERVICE and SINGLE USE ARTICLES
                  is prevented by and for a RESTRICTED USE PESTICIDE, this is achieved by:

                    (a) Removing the items,

                    (b) Covering the items with impermeable covers, or

                   (c) Taking other appropriate preventive actions, and
                   (d) Cleaning and SANITIZING EQUIPMENT and UTENSILS, after the application.

             3)      Bactericides, cleaning compounds, or other compounds intended for use on
                  FOOD-CONTACT SURFACES       shall not be used in a concentration that leaves a toxic
                  residue on such surfaces or that constitutes a hazard to EMPLOYEES or other PERSONS.

     C. In South Carolina, any pesticide used in structural or public health pest control activities on the
     property of another shall be applied only by an applicator certified as defined in 7 USC 136,
     Definitions, (e) Certified Applicator, of the Federal Insecticide, Fungicide, and Rodenticide Act, The
     Rules and Regulations for the Enforcement of the South Carolina Pesticide Control Act 27-1070 D,
     27-1070J and 27-1085L, or a PERSON under the direct supervision of a certified applicator.

Container Prohibitions

7-203.11      Chemical, Poisonous or Toxic Material Containers.

A container previously used to store chemicals including POISONOUS OR TOXIC MATERIALS may not be
used to store, transport, or dispense FOOD.

Chemicals

7-204.11      Sanitizers, Criteria.

Chemical SANITIZERS, including chemical sanitizing solutions generated on-site, and other chemical
antimicrobials applied to FOOD CONTACT SURFACES shall:

      A. Meet the requirements specified in 40 CFR 180.940, Tolerance Exemptions For Active And
Inert Ingredients For Use In Antimicrobial Formulations (FOOD-CONTACT surface sanitizing solutions),or

     B. Meet the requirements specified in 40 CFR 180.2020 Pesticide Chemicals Not Requiring a
Tolerance or Exemption from Tolerance-Non-food Determinations.

7.204.12     Chemicals for Washing, Treatment, Storage and Processing Fruits and Vegetables.

     A. Chemicals, including those generated on-site, used to wash or peel raw, whole fruit and
vegetables shall meet the requirements specified in 21 CFR 173.315, Chemicals Used In Washing Or To
Assist In The Peeling Of Fruits And Vegetables.

     B. Ozone as an antimicrobial agent used in the treatment, storage, and processing of fruits and
vegetables in a RETAIL FOOD ESTABLISHMENT shall meet the requirements specified in 21 CFR 173.368,
Ozone.

7-204.13       Direct Steam Injection and Boiler Water Additives, Criteria.

Boilers that supply direct steam injection to FOOD or FOOD-CONTACT SURFACES shall be free from any
materials or additives other than those products approved in 21 CFR 173.310, Boiler Water Additives.

7-204.14       Drying Agents.

     A. When SANITIZATION is with chemicals, drying agents shall be specifically for use with chemical
SANITIZING solutions, they shall contain only components that are APPROVED as FOOD ADDITIVES or
generally recognized as safe, and are listed in the Code of Federal Regulations.

    B. Drying agents used in conjunction with SANITIZATION shall contain only components that are
APPROVED  as FOOD ADDITIVES or generally recognized as safe, and are listed in the Code of Federal
Regulations.

Lubricants

7-205.11       Incidental Food Contact, Criteria.

Only lubricants specified in 21 CFR 178.3570, Lubricants with Incidental Food Contact, shall be used on
EQUIPMENT designed to receive lubrication on or within FOOD-CONTACT SURFACES. EQUIPMENT
containing bearings and gears requiring unsafe lubricants shall be designed and fabricated so that the
lubricant cannot leak, drip, or be forced into FOOD or onto FOOD-CONTACT SURFACES.

Pesticides

7-206.11       Restricted Use Pesticides, Criteria.

    A. Restricted use pesticides specified under § 7-202.12C. shall meet the requirements specified in
40 CFR 152, Subpart I-Classification of Pesticides.

     B. If after a routine inspection and subsequent follow-up inspection a pest control VIOLATION is re-
occurring, a certified pest control operator may be required by the DEPARTMENT to control infestation and
to provide documented proof of abatement. Failure to provide adequate measures to correct the
VIOLATION will be considered an IMMINENT HEALTH HAZARD and the facility shall immediately cease
operation.

7-206.12       Rodent Bait Stations.

Rodent bait shall be contained in a covered, tamper-resistant bait station.

7-206.13      Tracking Powders, Pest Control and Monitoring.

     A. Pesticide tracking powder shall not be used in a RETAIL FOOD ESTABLISHMENT.

       If used, a nontoxic tracking powder such as talcum or flour shall not contaminate FOOD,
      B.
EQUIPMENT, UTENSILS, LINENS, and SINGLE SERVICE and SINGLE-USE ARTICLES.

Medicines

7-207.11       Restriction and Storage.

    A. Except for medicines that are stored or displayed for retail sale, only those medicines that are
necessary for the health of EMPLOYEES shall be allowed in a RETAIL FOOD ESTABLISHMENT.

     B. Medicines that are in a RETAIL FOOD ESTABLISHMENT for the EMPLOYEES’ use shall be labeled
as specified under § 7-101.11 and located to prevent the contamination of FOOD, EQUIPMENT, UTENSILS,
LINENS, and SINGLE SERVICE and SINGLE-USE ARTICLES.

7-207.12      Refrigerated Medicines, Storage.
Medicines belonging to EMPLOYEES that require refrigeration and are stored in a FOOD refrigerator shall
be stored in a package or container and kept in a covered, leakproof container that is identified as a
medicine storage container.

First Aid Supplies

7-208.11        Storage.

     A. First aid supplies shall be stored in a kit or a container that is located to prevent the
contamination of FOOD, EQUIPMENT, UTENSILS, LINENS and SINGLE SERVICE and SINGLE-USE ARTICLES.

       B. First aid supplies shall be labeled as specified under § 7-101.11.

Other Personal Care Items

7-209.11        Storage

EMPLOYEES     shall store their PERSONAL CARE ITEMS in lockers or APPROVED designated areas.

7.3        STOCK AND RETAIL SALE

7-301 Storage and Display

7-301.11        Separation.

Chemicals including POISONOUS OR TOXIC MATERIALS shall be stored and displayed for retail sale so they
can not contaminate FOOD, EQUIPMENT, UTENSILS, and LINENS AND SINGLE SERVICE and SINGLE-USE
ARTICLES by:

      A.   Separating chemicals and POISONOUS OR TOXIC MATERIALS by spacing or partitioning; and

   B.  Locating chemicals and POISONOUS OR TOXIC MATERIALS in an area that is not above FOOD,
EQUIPMENT, UTENSILS, and LINENS and SINGLE SERVICE and SINGLE-USE ARTICLES.
