Chapter 403:     RULES FOR THE DISTRIBUTION OF FUNDS TO SUPPORT REGIONAL
                 RIDESHARE PROGRAMS



1.       Scope

         These rules shall govern the distribution of funds provided by the Maine Legislature to the
         Energy Conservation Division for the purpose of promoting and supporting regional rideshare
         programs.


2.       Definitions

         a.      "Eligible activity." Eligible activity shall include, but not be limited to, such activities as
                 marketing, publishing of promotional brochures, conducting workshops, or administering
                 or operating regional rideshare programs conducted by an eligible party.

         b.      "Eligible party." Eligible party shall mean any individual, corporation (profit or
                 nonprofit) cooperative or governmental entity.

         c.      "Regional rideshare programs" shall include, but not be limited to programs designed to
                 operate or assist in the operation of car pools, van pools, bus pools, and increased use of
                 public transportation services.


3.       Disbursement of Funds

         The Director of the Energy Conservation Division shall disburse funds in support of regional
         rideshare programs included as components of the overall rideshare program of the Energy
         Conservation Division. In general, he shall distribute funds in the following categories of eligible
         activities:

         a.      Administrative costs incurred by the Energy Conservation Division;

         b.      marketing programs directed by the Energy Conservation Division; and

         c.      Regional Rideshare Programs, unless the distribution of funds to such a program has
                 been specifically determined by the Federal government to be ineligible for federal
                 funds.

4.    Advice

      Prior to disbursement, the Director shall solicit the advice of community leaders of the region or
      community affected as to the most appropriate and effective use of funds towards the
      development of rideshare programs.


5.    Use of funds

      Funds may only be used to pay for eligible activities as described in part 3 above. Specifically,
      these may include professional and clerical services, consumable supplies, copying, printing,
      telephone, travel, media public service and paid announcements or advertisements, and computer
      time and services. Additional costs not listed above but which the Director determines to be
      appropriate and effective towards the development of effective rideshare programs are also
      authorized.


6.    Funds, reductions

      The Director may reduce the amount of funds disbursed for particular activities on a regularly
      declining basis in order to encourage the eventual independence and self-supporting nature of
      regional rideshare activities.
