Sick leave may be earned and used pursuant to State Board of Education policy and regulations and
this policy. The provisions of this policy are intended to be consistent with State Board of Education
regulations. If any such provision conflict with State Board requirements, the State Board
regulations will control.

A.     PURPOSE FOR WHICH SICK LEAVE MAY BE USED

       Sick leave may be used for:

       1.      Any actual period of temporary disability caused or contributed to by any personal
               illness, injury, or other temporary disability which prevents an employee from
               performing his or her usual duties. In accordance with Title VII's policy on equal
               employment opportunity, female employees shall not be penalized in their condition
               of employment because they require time away from work for a disability caused or
               contributed to by pregnancy, miscarriage, abortion, childbirth, or recovery. This
               leave will be treated in the same manner as any other temporary disability. Up to 30
               days of sick leave may be used to care for a child placed with an employee for
               adoption. Sick leave also may be used during the 60-day waiting period for short-
               term disability, in lieu of short-term disability benefits or in lieu of workers’
               compensation to maintain 100% salary.

       2.      Illness in the employee's immediate family and medical appointments that necessitate
               the employee's attendance. For purposes of this policy, the immediate family is
               defined as spouse, children, parents, brother, sister, grandparents, grandchildren and
               dependents living in the employee’s household. Also included are step, half and in-
               law relationships.

       3.      Medical appointments for employee.

       4.      Death in the immediate family. The length of leave granted for illness or death in the
               immediate family is determined by local administration and based on individual
               employer need.

       5.      Sick leave, including extended sick leave, shall be exhausted before going on leave
               without pay for extended illness.

       6.      Sick leave previously earned may not be used when an employee is in an interim
               position of less than six months, a temporary position or a position of less than 20
               hours per week.

B.   SICK LEAVE EARNED

     All permanent, full-time employees who are working or on paid leave for one-half or more of
     the workdays in any monthly pay period shall earn sick leave computed at the rate of one (1)
     day per month or the number of hours worked daily by a full-time employee in that class of
     work, up to a maximum of eight hours.

     Part-time permanent employees working or on paid leave for one-half or more of the
     workdays in any monthly pay period earn sick leave computed on a pro rata basis of the
     amount earned by a full-time employee in that class of work. Part-time permanent
     employees previously employed in a full-time position retain the balance of sick leave earned
     in that position in prior years on transferring to a part-time position.

C.   USE OF SICK LEAVE

     Sick leave must be used in one-half or whole day units. Only sick leave taken on actual
     workdays shall be charged in calculating the amount of sick leave taken. Sick leave may be
     used on any day during the regular term of employment, including the first day that
     employees are to report to work, with the exception of any scheduled annual leave days,
     holidays or while on leave without pay.

D.   SICK LEAVE ACCUMULATION

     Sick leave is accumulated indefinitely.

E.   TRANSFER OF SICK LEAVE

     Unused sick leave must be transferred between school systems. Sick leave may also be
     transferred in whole or part to and from a state agency or institution, community college, or
     technical institute or a county agency of mental health, public health, social services or
     emergency management if the receiving agency is willing to accept the level.

F.   ADVANCEMENT OF SICK LEAVE

     Employees may have advanced to their credit at the beginning of each year the number of
     days of sick leave that may be earned during the current year. The decision to advance sick
     leave within these defined limits will be considered an administrative one for which the
     superintendent must assume full responsibility.

G.   VERIFICATION OF SICK LEAVE

     Whenever an employee's absence for reasons for which sick leave may be granted does not

     exceed ten consecutive working days, the employee's statement usually will be accepted as
     proof that he or she was unable to work. However, as deemed necessary, the superintendent
     may require a statement from a medical doctor or other acceptable proof that the employee
     was unable to work due to illness or other purposes for which sick leave may be granted.
     Whenever an employee's absence for reasons for which sick leave may be granted exceeds
     ten working days or the superintendent in his/her discretion deems it necessary, the employee
     must provide to the superintendent acceptable proof of illness or of other purposes for which
     sick leave may be granted.

H.   REPAYMENT FOR EXCESSIVE SICK LEAVE

     If an employee separates from service before earning all sick leave which has been advanced,
     a deduction must be made from the final salary check for the total unearned sick leave used.

I.   NOTICE OF PLANS TO USE SICK LEAVE

     Whenever possible, and particularly in the case of temporary disability connected with
     elective medical or surgical procedures or maternity, employees shall give 30 days advance
     notice of plans to take sick leave and where applicable the same notice shall be given for
     family leave.

J.   REINSTATEMENT FOLLOWING SICK LEAVE

     When the period of temporary disability does not exceed thirty (30) working days, the
     employee shall be reinstated in his or her position at the termination of the period of
     temporary disability. When the period of temporary disability exceeds (30) working days,
     the local superintendent shall determine when the employee is to be reinstated, based on a
     consideration of the welfare of the students and the need for continuity of instruction.

K.   REINSTATEMENT OF ACCUMULATED SICK LEAVE

     A former employee shall be credited with all sick leave accumulated up to the time of
     separation from a school system provided that the employee is reinstated as a permanent
     employee within sixty (60) calendar months from the date of separation. Sick leave also may
     be reinstated from a state agency or institution, community college, or technical institute or a
     county agency of mental health, public health, social services or emergency management
     when an individual is employed within 60 calendar months of separation from one of these
     agencies.

L.   EXTENDED SICK LEAVE

     Extended sick leave is available to classroom teachers and media specialists in a permanent

       full- or part-time position who require substitutes. For absences due to personal illness or
       injury in excess of available sick or vacation leave, extended sick leave is available for one or
       more days up to 20 teaching days in a school year. All teachers newly employed by the
       school unit must report to work before becoming eligible for this extended sick leave.
       Teachers absent for this reason shall receive full salary during the days absent less the
       appropriate substitute teacher pay for each working day so absent. The superintendent shall
       determine whether a doctor's certificate or other acceptable proof of the need for extended
       sick leave is required.
