Service-Learning and Volunteer Opportunities
MEMORANDUM OF UNDERSTANDING (MOU)
Between
Tennessee Wesleyan College
and
Insert Name of Agency
This is an agreement between Tennessee Wesleyan College hereinafter called “TWC” and [Insert
Name of Agency] hereinafter called “Program”.
I. PURPOSE and SCOPE
The purpose of this MOU is to clearly identify the roles and responsibilities of each party as
they relate to the implementation of the service-learning and volunteer opportunities through
the Center for Servant Leadership at TWC. The Center for Servant Leadership is intended to
help provide service-learning and volunteer opportunities to TWC students through
partnerships with various agencies. To support this goal, TWC and Program will work together
to conduct service that meets legitimate needs of our communities.
Both TWC and Program should ensure that program activities are conducted in compliance
with all applicable Federal laws, rules, and regulations.
In particular, this MOU is intended to establish clear guidelines regarding the service work that
will be conducted at the site of the Program.
II. BACKGROUND
This [Insert Program] will be the [Insert first, second, third, etc.] service-learning and volunteer
opportunity coordinated between Tennessee Wesleyan College and [Insert Name of Agency].
III. Tennessee Wesleyan College RESPONSIBILITIES UNDER THIS MOU
TWC volunteers shall undertake the following activities:
• Activity One
• Activity Two
• Activity Three
IV. [Insert Name of Agency] RESPONSIBILITIES UNDER THIS MOU
Program shall undertake the following activities:
Provide any necessary training required.

Provide all safety equipment required to complete each project.
Provide all supplies necessary to complete each project.
Be in attendance for any events coordinated through this partnership.
Provide guidance and supervision to participants.
Verify hours completed by each TWC participant.
Complete an evaluation of each TWC participant and return to the Center for Servant
Leadership no later than May 1, 2011.
V. IT IS MUTUALLY UNDERSTOOD AND AGREED BY AND BETWEEN THE PARTIES THAT:
RELEASE AND WAIVER OF LIABILITY: Having the authority to do so, I, on behalf of the
Program, our representatives, heirs, executors, administrators, agents, and assigns, HEREBY
RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Tennessee Wesleyan
College, its Board of Trustees, Directors, officers, employees, agents, volunteers, and any
students (hereinafter referred to as “Releasees”) for any and all liability, including any and all
claims, demands, causes of action (known or unknown), suits, or judgments of any and every
kind (including attorneys’ fees), arising from any injury, property damage or death that I may
suffer as a result of my participation in the Program, REGARDLESS OF WHETHER THE
INJURY, DAMAGE OR DEATH IS CAUSED BY THE NEGLIGENCE OR FAULT OF THE
RELEASEES, OR OTHERWISE, WHILE IN, ON, UPON, OR IN TRANSIT TO OR FROM THE
PREMISES WHERE THE PROGRAM, OR ANY ADJUNCT TO THE PROGRAM, OCCURS
OR IS BEING CONDUCTED.
INDEMNITY: Having the authority to do so, I, on behalf of the Program, our representatives,
heirs, executors, administrators, agents, and assigns, agree to hold harmless, defend and
indemnify the Releasees from any and all liability, including any and all claims, demands,
causes of action (known or unknown), suits, or judgments of any and every kind (including
attorneys’ fees), arising from any injury, property damage or death that I may suffer as a result
of my participation in the Program, REGARDLESS OF WHETHER THE INJURY, DAMAGE
OR DEATH IS CAUSED BY THE NEGLIGENCE OR FAULT OF THE RELEASEES OR
OTHERWISE.
CERTIFICATE OF LIABILITY INSURANCE: I agree to provide Tennessee Wesleyan College
with a Certificate of Liability Insurance and add Tennessee Wesleyan College as a certificate
holder in respects to general liability.
VI. FUNDING
This MOU does not include the exchange of funds between the two parties.
VII. RECORD RETENTION
All records must be retained for seven (7) years following this event. This requirement applies
to all information regarding this Program. Supporting documentation may be kept at the Center
for Servant Leadership and must be available for review for seven (7) years from the date of
MOU.
VIII. EFFECTIVE DATE AND SIGNATURE

This MOU shall be effective upon the signature of Tennessee Wesleyan College and [Insert
Name of Agency] authorized officials. It shall be in force from Date to Date (Minimum of One
Year Time Period).
Tennessee Wesleyan College and [Insert Name of Agency] indicate agreement with this MOU
by their signatures.
