Terms and Conditions of Entry for the
"WIN BIG NRL Footy 2010 Promotion" (Promotion)
1. These terms and condition of entry, including information on how to participate
and prize details (Terms), apply to the Promotion and entry into the Promotion is
deemed acceptance of these Terms.
2. The Promoter is Australian Leisure & Hospitality Group Limited, (ABN 37 067 391 511)
of Ground Floor, 16-20 Claremont Street, South Yarra Vic 3141 (Promoter).
3. The Venues participating in the Promotion (Participating Venues) are ALH Group
Venues including 135 ALH Group Venues located in New South Wales, Western
Australia, and Queensland listed at www.cokepromos.com.au/alhrugby.
4. The Registration Period will be open from 12:01am Australian Eastern Daylight
Savings Time (AEDST) on 01 February 2010 until 7:10pm (AEDST) on 10 March 2010
(Registration Period). The Early Registration Period will be open during the
Registration Period and will be open from 12.01am (AEDST) on 01 February 2010
until 11.59pm AEDST on 28 February 2010 (Early Registration Period).
5. The Promotion will be open from 7:10pm (AEDST) on 10 March 2010 for the first
round of the National Rugby League (NRL) Home and Away Season commencing
12 March 2010 until 7:30pm AEST on 03 September 2010 for the final round of the
NRL Home and Away Season (Promotion Period).
6. Entry in the Promotion is only open to residents aged 18 years and over, excluding:
(a) management, employees, directors and contractors of the Promoter, its related
entities, the Participating Outlets and other agencies, firms or companies
associated with the Promotion (including suppliers of prizes);
(b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred
to in paragraph 6(a) of these Terms;
(c) persons who have won a prize or prizes valued either individually or collectively
at more than $5,000 (including GST) in any Promotion run by or on behalf of the
Promoter, within the 12 months prior to the commencement of the Promotion
(d) persons who have used or attempted to use any more than one name in order
to qualify to win a promotion run by or on behalf of the Promoter (except in the
case of a legal change of name); and
(e) persons who have breached the terms and conditions of any promotion run by
or on behalf of the Promoter,
(Eligible Entrants). The persons referred to in paragraph 6(b) of these Terms includes
natural and non-natural relations (in the opinion of the Promoter) and the Promoter
is responsible for determining whether a person is an Eligible Entrant in its absolute
7. In these Conditions of Entry, unless the contrary intention appears, the following
words and phrases have the meanings set out opposite them:
(a) “Home and Away Season” means the series of Games of National Rugby League
conducted by the NRL between member Teams of the NRL over the 2010 Season
(b) “Game” means a single game, of and conducted during the Home and Away
Season, between member Teams of the NRL;
(c) “Competition” means this Promotion whereby winning games are based on the
results of games at the conclusion of the Home and Away Season;
(d) “Game of Chance” relates to Draw Prizes;
(e) ”Draw Prizes” means the prizes that are awarded based on the Game of Chance;
(f) “Results” are the results of Games as officially determined by the NRL in
accordance with the rules of the NRL following the completion of each Round;
(g) “Round” means a round of the Home and Away Season conducted during the
Home and Away Season as published by the NRL;
(h) “Round Score” means the number of Points achieved by an Eligible Entrant in
(i) “Season” means the 2010 NRL Home and Away Season;
(j) “Points” means the allocation of points to an Eligible Entrant for the correct
selection of winning Teams;
(k) “Away Team’ means the Team that is listed by the NRL as playing away from their
(l) “Captain” means the Promoter nominated person at each Participating Venue
that is responsible for the management of the Competition within the
Participating Venue and ensures that Eligible Entrants with the highest Points
information is passed onto the Promoter at least seven (7) working days before
each respective prize draw is to be made. The Captain will also need to ensure
that all Early Registration Entrants details are inputted into the online form located
at www.footytipping.alhgroup.com.au no later than 08 March 2010;
(m) “Perfect Points” means that the Eligible Entrant has correctly selected all 8
winning Teams in a given Round;
(n) “Membership Amount” means the amount an Eligible Entrant must pay in the
Participating Venue to become a Qualified Member in that Participating Venue
and receive a Venue Membership (“Venue Membership). The Venue
Membership is ongoing and will give Qualified Members the opportunity to win
the Draw Prizes and receive 10 x 285mL credits of Coca-Cola. The Membership
Amount as nominated by a Participating Venue should not exceed $50 per
Eligible Entrant in New South Wales.
(o) “Qualified Member” means an Eligible Entrant that has paid the Membership
Amount at the Participating Venue.
(p) “State Group” means the allocated State Groups to where prizes are awarded
for State specific prizes. There are two State Groups being New South Wales /
Western Australia; and Queensland.
(q) Each respective “Mid-Season Venue Winner” and “End of Season Venue Winner”
will be determined as the Eligible Entrant with the highest accumulated Points at
the conclusion of Round 13 on 07 June 2010 (Mid Season Prizes) or Round 26 on
05 September 2010 (End of Season Prizes) in each Participating Venue as
determined by the Captain at the Participating Venue. Where Eligible Entrants
have identical accumulated Points after Round 13 or Round 26, a Countback
process will be followed;
(r) “Countback” means if at the end of Round 13 or Round 26 of the Competition
two (2) or more Eligible Entrants have the same amount of Points a Count back
will occur. A Countback will rank Eligible Entrants according to the frequency
with which they selected the most winning Teams in a Round over the respective
13 or 26 Rounds of the NRL Season specific to the prize allocation.
An elimination process based solely on that Countback will occur. The
Countback will firstly identify the Eligible Entrant(s) who most frequently selecting
8 winning Teams from 8, then 7 winning Teams from 8, then 6 winning Teams from
8 and so on (down to and including 1 winning Team from 8 if required) until
Eligible Entrants are determined to be ranked higher than all of the others. All
entries taken up in the calculation will be based on a total of 8 Games in a
Round regardless of whether 8 Teams were selected by the Eligible Entrants.
If a Countback process two (2) or more Eligible Entrants are still equal, then the
prize will be equally shared between those Eligible Entrants.
(s) The “Voucher” is a specific Venue Voucher that can be redeemed for food and
beverages to the face value noted on the respective Venue Voucher within
twelve (12) months of issue. The Voucher is only valid at the Registration Location.
There are no restrictions on the food or beverages that can be redeemed with
the Voucher and the Voucher can be redeemed in multiple transactions until the
Voucher is exhausted. You can use your voucher as many times as you want until
the balance reaches zero. The Promoter will not refund cash for any unused gift
card amount. The Promoter and the Participating Venue has no responsibility for
Vouchers that are lost, stolen or damaged. There is no cost for using the Voucher.
HOW TO BECOME A QUALIFIED MEMBER
8. To become a Qualified Member, an Eligible Entrant must:
(a) Fully complete an Early Membership Form (Early Member Form); and
(b) Submit it at a Participating Venue (Registration Location); and
(c) Make full payment of the Membership Amount
Early Member Forms must be received at the Participating Venue by no later than
28 February 2010.
9. After 28 February 2010, an Eligible Entrant must:
(a) Fully complete a Membership Form (Member Form); and
(b) Submit it at a Registration Location; and
(c) Make full payment of the Membership Amount
Member Forms must be received in the Registration Period.
HOW TO ENTER
10. To enter the Competition, Eligible Entrants must, during the Competition Period and
up to one hour prior to the scheduled starting time of the first Game of each
(a) Collect their Footy Card (Footy Card) from the Registration Location; and
(b) Make a selection of the Teams they believe will win the Games for that Round;
(c) Submit their Footy Card at the Registration Location (only).
11. An Eligible Entrant may make or change a Team selection for a given Game in a
Round up until one hour prior to the scheduled starting time of the first Game of the

14. A draw cannot be selected as a Game result selection.
15. Selection can only be made at the Eligible Entrant’s Registration Location on a
Footy Card and can not be made over the telephone, via SMS (Short Message
Service) or email.
16. The Eligible Entrants will be allocated one (1) Point towards their Score for each
correct selection of a winning Team.
17. If an Eligible Entrant does not submit an entry for a given Game in a Round, then
the Eligible Entrant’s selection for each Game in that Round will be deemed to be
the “Away Team”. If the Away Team is the winner of that Game, then Eligible
Entrant will receive 1 (one) Point for that Game.
18. If an Eligible Entrant does not submit an entry into the Competition for a given
Round, the Eligible Entrant’s selection for each Game in that Round will be
deemed to be the Away Team. The Away Team is the winner of that Game, then
the Eligible Entrant will receive 1 (one) Point for that Game.

19. In the event of a Game in a given Round being drawn, cancelled, abandoned,
not completed or not played for any reason and / or Results are not officially
declared within three (3) days of the date of the Game was originally scheduled to
be played, it is treated as a win for both Teams competition in that Game.
20. In the event of a dispute between the Participating Venue and an Eligible Entrant
in relation to a Point selection, the outcome will be determined at the Participating

All Qualified Members are able to take part in all Prize Draws
Early Registration Prize Draw (Early Prize)
21. An electronic random prize draw will be conducted per State Group at Prime
Focus, Suite 104/ 55 Beach St, Port Melbourne, VIC 3207 (Draw Location) by one of
its representatives at 12:00pm AEDST on 24 March 2010 from all Eligible Early
Registration Forms (only) received during the Early Registration Period (Early Draw).
22. The first Eligible Entrant with a valid Eligible Entry drawn in the Early Draw per State
Group will win a $1,000 Venue Voucher (Early Prize). There are two ‘Early Prizes’ to
be won in total.
MID-SEASON PRIZES (Mid-Season Venue Winners and Mid-Season State Winners)
23. Specific Participating Venue Mid-Season Prize Winners (Mid-Season Venue Winners)
will be determined by 5pm AEST on 11 June 2010 in each Participating Venue by
the Captain. Each Mid-Season Venue Winner will win a Venue Voucher (Voucher)
to the value of $100 (inc. GST).
24. Specific State Mid-Season Prize Winners (Mid-Season State Winners). An electronic
random prize draw will be conducted per State at the Draw Location by one of its
representatives at 12:00pm AEDST on 23 June 2010 from all Eligible Entries that are
Mid-Season Venue Winners as determined by the Captain (Mid-Season Draw).
25. The first Eligible Entrant with a valid Eligible Entry drawn in the Mid-Season Draw per
State Group will win an ALH Venue Voucher (Venue Voucher) to the value of $500
END OF SEASON PRIZES (End of Season Venue Winners and End of Season State Winners)
26. Specific Participating Venue End of Season Prize Winners (End of Season Venue
Winners) will be determined by 5pm AEST on 10 September 2010 in each
Participating Venue by the Captain. Each End of Season Venue Winner will win
one (1) Steeden Match Sized Football (Steeden) valued at $89.95 RRP (including

electronic random prize draw will be conducted per State at the Draw Location by
one of its representatives at 12:00pm AEST on 15 September 2010 from all Eligible
Entries that are End of Season Venue Winners as determined by the Captain (End
of Season State Draw).
28. The State End of Season State Group Winners will each win one (1) framed signed
Jersey (Jersey) from a Team determined by the Promoter that is a participant in the
2010 NRL competition to the value of $350 RRP (inc. GST). The Jersey will be signed
by at least two (2) Senior Players from the Team that the Jersey represents.
29. Specific End of Season Prize Winners (End of Season Major Prize Winners). An
electronic random prize draw will be conducted per State Group at the Draw
Location by one of its representatives at 12:00pm AEDST on 15 September 2010
from all Eligible Entries that are End of Season Venue Winners as determined by the
Captain (End of Season Draw).
30. The first Eligible Entrant with a valid Eligible Entry drawn in the End of Season Draw
per State Group will win a cheque to the value of $5,000 (inc. GST) made payable
to the End of Season State Winner.
31. An electronic random prize draw will be conducted at the Draw Location by one
of its representatives at 12:00pm AEDST on 15 September 2010 from all Eligible
Entries received during the Competition that have correctly made a Perfect Point
in any Round of the Competition. For every Perfect Point that an Eligible Entrant has
made during the Competition Period the Eligible Entrant will receive one (1) entry
into the Bonus Draw (Bonus Draw).
32. The first Eligible Entrant with a valid Eligible Entry drawn in the Bonus Draw will win a
2010 NRL Grand Final Experience for four (4) adults, valued at up to AU$6,250
(including GST) (RRP) (depending on point of departure) (Bonus Prize) including,
(a) return economy airfares for four (4) adults from the prime domestic airport in the
Australian Capital City nearest the winner's residence to Sydney departing on 01
October 2010 AEST and returning on 04 October 2010 AEST, on an airline
determined by the Promoter valued at up to $2,700 (inc. GST) ;
If the Major Prize winner resides within New South Wales, then return economy
airfares only will not form part of the Bonus Prize and no cash will be offered in lieu
of the value of this component of the Bonus Prize.
(b) All airline and airport taxes.
(c) Three (3) nights accommodation for four (4) adults in a twin share standard room
at a four star hotel determined by the Promoter in Sydney (Accommodation)
valued at $2,750 RRP (inc. GST), including breakfast daily to the value of $35 (inc.
GST) per person per day.
(d) Road transfers to and from the airport in Sydney and the Accommodation;
(e) Tickets for four (4) people to attend the 2010 NRL Grand Final event on Sunday 03
October 2010, including return private chauffeured vehicle transfers to and from
the ANZ Stadium, Sydney , valued at $800 (inc. GST); and
33. The total value of the Game of Chance prizes available to be won in the
Promotion is $19,950 (including GST). The total value of the Game of Skill prizes
available to be won in the promotion is $25,643.25 (including GST).
34. The Early Prize Winner will be:
(a) notified by telephone and mail.
(b) published in The Australian on 20 April 2010.
35. The Mid-Season State Winners will be:
(a) notified by telephone and mail.
(b) published in The Australian on 20 July 2010.
36. The End of Season State Winners, End of Season Major Prize Winners and Bonus
Draw Winner will be:
(a) notified by telephone and mail.
(b) published in The Australian on 20 September 2010.
37. If a prize is won by:
(a) If a prize remains unclaimed by 22 September 2010, a random electronic
re-draw will be conducted on that date at the Draw Location by one of its
representatives from all remaining Eligible Entries received in the Promotion.
38. The Re-Draw winner[s], if any, will be:
(a) notified by telephone and mail; and
(b) published in The Australian on 29 September 2010.
39. Acceptance and use of the Bonus Prize, that the Prize winner and their nominated
(a) obtaining travel insurance for the duration of their participation in the Prize in an
amount and from an insurer acceptable to the Promoter; and
(b) agreeing not to act or fail to act in a manner which brings or may in the Promoter's
opinion bring the Promoter or its related entities into disrepute, during the course of
their participation in the Prize.
40. The Bonus Prize must be booked for travel between 01 October 2010 and 04
41. Travel and Accommodation are subject to availability at the time of booking.
42. All components of the Bonus Prize must be taken together in a single trip and
cannot be redeemed separately.
43. Any components of the Bonus Prize not used by the winner or their nominated
travel companion are forfeited and the Promoter is not obliged to provide the
winner or their nominated travel companion with the cash equivalent of or any
substitute for any Bonus Prize component in those circumstances.
44. The Bonus Prize Winner must hold a valid credit card and present it at the
Accommodation to cover any incidental charges they include during their stay.
45. In order to claim and/or participate in the Bonus Prize, the Prize winner are required
to sign a Promotion Participation Agreement on terms determined by the Promoter,
(a) confirming their eligibility to enter the Promotion and compliance with these
(b) providing a release and indemnity in favour of the Promoter in respect of
their participation in the Promotion and acceptance and use of their Prize.
46. If requested by the Promoter, provisional prize winners must produce, within the
time requested by the Promoter at its absolute discretion appropriate photo
identification or other documentation, required by the Promoter to verify their
identity, age, eligibility to enter the Promotion and claim a prize and compliance
with these Terms and before the Promoter issues their prize. If the items required by
the Promoter are not received or a provisional winning entry has not been verified
to the satisfaction of the Promoter within the time period required by the promoter,
the provisional winner's entry will be invalid and, at the Promoter's absolute
discretion, all of the provisional winner's remaining entries will be invalid. Prizes will
only be awarded following all validation and verification requirements of the
Promoter being met to its satisfaction.
47. If more than one person attempts to claim a particular prize, the Promoter has sole
and absolute discretion to determine which of those persons the winning entrant is.
48. Each Eligible Entrant may enter the Promotion once only at any given Registration
49. All costs associated or arising in connection with prizes are the responsibility of the
prize – If there is more than one level of prize winners.
50. Entrants can only enter the Promotion in their own name.
51. Prizes are not transferable, exchangeable or redeemable for cash. Prizes must be
taken as offered and may not be varied.
52. The Promoter shall not be liable for prizes being lost, stolen, damaged or tampered
with in any way before they reach the winners.
53. The Promoter accepts no responsibility for any variation in the value prizes.
54. If the Promoter is unable to provide a winner with a nominated prize, the Promoter
reserves the right to supply an alternative prize of similar monetary value to the
nominated prize, subject to any directions given by State and/or Territory Gaming
55. The Promoter accepts no responsibility for any entries not received for any reason
during the Promotion Period. No responsibility will be taken for lost, late or
misdirected entries. The Promoter does not warrant that the entry mechanism will
be available, or [he Participating will be open, at all times during the Promotion
56. If, for any reason, the Promotion is not capable of being run as planned, including
due to infection by infection by computer virus, bugs, tampering, unauthorised
intervention, fraud or any other causes beyond the control of the Promoter, which
corrupt or affect the administration, security, fairness, integrity or proper conduct of
the Promotion, the Promoter reserves the right in its absolute discretion to take any
action that may be available to it, subject to State and Territory regulations,
including cancelling, terminating, modifying or suspending the Promotion.
57. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry
mechanism or Draw in any way, engages in any unlawful or improper conduct
which jeopardises or is likely to jeopardise the fair or proper conduct of the
Promotion, or who does not properly comply with the entry process, will be
ineligible to win.
58. Incomplete, illegible, indecipherable or incorrect entries are not eligible to win.
59. The Promoter reserves the right to disqualify entries in the event of non-compliance
with these Terms. The Promoter's decisions in relation to all aspects of the Promotion
are final and binding on each entrant and no correspondence will be entered into.
60. The Promoter collects (and the Participating collects on the Promoter's behalf)
personal information about entrants to include entrants in the Promotion and
where appropriate award prizes. If the personal information requested is not
provided, the entrant cannot participate in the Promotion. By participating in the
Promotion, each entrant consents to the Participating Venues disclosing their
personal information to the Promoter and the Promoter and the Participating
Venues using, and disclosing their personal information to the Promoter's related
entities, the Promoter's or the Participating Venues' agencies and other third parties
engaged to provide services in connection with the Promotion (including suppliers
of prizes for use for, the following purposes:
(a) contacting the entrant in relation to the Promotion;
(b) improving the Promoter's, the Promoter's related entities' or the Participating
Venues' goods and services;
(c) contacting the entrant in the future for the Promoter's, the Promoter's
related entities' or the Participating Venues' marketing purposes via any
medium including mail, telephone and commercial electronic messages
(SMS (Short Message Service), MMS (Multimedia Message Service), IM
(Instant Messaging) and email) or any other media including media not yet
in existence at the time of the Promotion; and
(d) in the Promoter's and its agencies case, the purposes set out in the
address set out in paragraph 2 of these Terms).
The entrant provides this consent until such a time as they withdraw their consent
by giving notice to the Promoter. Entrants can gain access to, update or correct
any personal information held by the Promoter by contacting the Promoter at the
address set out in paragraph 2 of these Terms. Entrants can also gain access to,
update or correct any personal information held by the Participating Venues by
contacting the Participating Venues. All personal information will be stored at the
office of the Promoter and/or the Participating Venues as the case may be.
61. By entering the Promotion, entrants agree and acknowledge:
(a) that the Promoter (or an agent of the Promoter) and/or, with the Promoter's
consent (including consent subject to any conditions), the Participating
Venues (or an agent of the Participating Venues, may:
(i) obtain comments from them about the Promotion and take photos
or recordings of them (and contacting them for those purposes);
(ii) use any of the comments, photos or recordings obtained from them,
their name, and/or likeness (the Materials) for the Promoter's and/or,
with the Promoter's consent (including consent subject to any
conditions), the Participating Venues', future promotional and
marketing purposes without further reference or compensation to
(iii) may duplicate, alter, adapt and utilise the Materials in any manner
at any time, anywhere, and by any means (including
communicating them to the public in any media, including media
not yet in existence); and
(iv) may license, authorise or otherwise transfer the rights in the Materials
to others to do the things outlined in paragraph 61(a)(iii) of these
(b) on creation of the Materials, they:
(i) grant to the Promoter a royalty free, perpetual, non-exclusive and
irrevocable licence to use the Materials for whatever purpose the
Promoter determines; and
(ii) where the Promoter consents, they grant to the Participating
Venues a royalty free, perpetual, non-exclusive and irrevocable
licence to use the Materials for whatever purpose the Promoter
(c) they unconditionally and irrevocably:
(i) consent to any act or omission that would otherwise infringe any of
their moral rights in the Materials (as defined in Part IX of the
Copyright Act 1968 (Cth)) and present and future rights of a similar
nature conferred by statute anywhere in the world whether
occurring before or after this consent is given (Moral Rights); and
(ii) waive all Moral Rights in the Materials that arise outside Australia;
(d) they agree not to institute, maintain or support any claim or proceeding for
infringement of their Moral Rights in the Materials.
(a) Promoter, the Promoter's related entities,[the Participating Venues, and all
agencies associated with the Promotion; and
(b) the employees, agents, directors and contractors, of all entities referred to
in paragraph 62(a),
shall not be liable for any loss or claim, action, demand, liability, damage, cost,
expense or personal injury whatsoever (including but not limited to any direct,
indirect or consequential loss), incurred, suffered or sustained by any person or
entity (without limitation) in connection with, or arising from, the Promotion or the
acceptance or use of, or participation in, prizes, except that which cannot be
excluded by law (in which case that liability is limited to the maximum extent
allowable by law).
63. The Promoter accepts no responsibility for any tax liabilities that may arise from
winning or receiving the benefit prizes.
64. Entrants agree and acknowledge that all entries and any intellectual property
rights subsisting in their entries become and remain the property of the Promoter.
