                                             Agreement
                   Conditions and Guidelines for Hiring
All parts & schedules of this document comprise the AGREEMENT.
PLEASE READ CAREFULLY BEFORE SIGNING.
HIRING AGREEMENT                                                                         Part 1.
1   GENERAL

    (1) All applications for hiring the Performance Space shall be addressed to the Co-ordinator.

    (2) Any reference to The Arts Centre-Pt Noarlunga or any area therein by a Hirer in any media
    release or any publication shall use the full title but in this document is referred to as the facility.

    (3) The Corporation of the City of Onkaparinga, hereinafter called “the Council” has delegated its
    powers in respect to hiring and managing the Centre to the Co-ordinator. The Co-ordinator has the
    right to refuse any booking without the necessity of giving reasons for such refusal to the Hirer.

    (4) The Co-ordinator must be informed of the purpose for which the area(s) of the facility is (are) to be
    used at the time of negotiating any booking.

    (5) The Co-ordinator does not warrant that the area(s) being hired is (are) suitable for the type of
    function(s) being conducted by the hirer.

    (6) The terms and conditions contained herein may be varied from time to time but any such variation
    shall nor negate this Hiring Agreement (herein after called “The Agreement”) and the Council shall not
    be obliged to explain the reason for such variation(s) in the terms and conditions.

    (7) To ensure maximum comfort, safety and enjoyment of the venue we ask that Arts Centre
        management be consulted before any final arrangements are made for the holding of any
        function.
    (8) Under no circumstances are the hirers permitted to fix anything (sets ,props, etc) to the walls or
        grid. Any sets/props hanging from the grid need to utilize an approved hanging bracket and all
        hung items must be safety chained.

2    HIRE CHARGES
     Part 5 hereof lists the facilities and services including in the basic hiring fee and those for which
    additional charges will be made.

3    TENTATIVE BOOKINGS
     Tentative booking(s) may be made by phone or in writing subject to confirmation by the
      Co-ordinator that the date(s) required is (are) available and that the function(s) is (are) suitable for the
    . Except at the discretion of the Co-ordinator tentative bookings will not be held longer than seven (7)
    days.

4    CONFIRMED BOOKINGS
     On receipt of the Hirer’s wish to confirm a booking an Agreement will be forwarded to the Hirer
    stipulating the charges and the Deposit Payable and the date by which the signed agreement and
    deposit must be returned to the Co-ordinator.

5   CANCELLATION OF BOOKING
     A Hirer wishing to cancel a booking after the Agreement has been signed must
    pay a cancellation fee, which shall be the deposit paid.

6    TECHNICAL AND BOX OFFICE FACILITIES
    Part 2 contains details of equipment and technical facilities available and details of the numbers of persons
    who may be accommodated in each area of the facility.
    The Council prior to going on sale must approve seating plans and tickets, however it is the Hirer’s
    responsibility to sell those tickets.
    Professional technical assistance is available at the rates specified.
    Technical staff and technical requirements are to be resolved prior to the date of hire.
    Please pay careful attention to the rates regarding technical staff call and overtime.
HIRING AGREEMENT
7   REHEARSALS
    A competent technician must supervise the function and any technical rehearsals.
   A three (3) hour rehearsal on the same day is included in the hiring fee. Extensions to this time will be
charged to the Hirer at the rate discussed in Part 3.

8   ADVERTISING FACILITIES
    Limited front of house display areas is available upon request.

9    MERCHANDISE SALES
     A Hirer shall not put on sale any items in the facility or in any area thereof, without first having obtained the
    approval of the Co-ordinator. The cost of employing sellers shall be borne by the Hirer.

10 TELEVISION - FILMS - RADIO COVERAGE: RECORDING FEE
   (1) Where the Co-ordinator approves television transmission, filming, radio broadcasting or recordings from
   the facility the Co-ordinator at its discretion may charge an additional fee in respect of direct costs for use
   of staff and amenities.

    (2) The Co-ordinator shall have an absolute discretion in permitting any function held in the facility being
    broadcast or televised and shall be entitled to impose any conditions it sees fit in relation to the televising of
    broadcasting of a function.

    (3) The cost of additional staff and/or overtime incurred as a result of the Hirer’s requirement to
    televise, broadcast or record any performance shall in all cases be charged to the Hirer.

     (4) Any additional lighting or other specific requirements together with all related costs shall be the
    responsibility of the Hirer.

    (5) All technical staff and others required by the Hirer are responsible to ensure that the performance
        retains the quality appropriate for good stage presentation and that standard shall be at the sole
        discretion of the Co-ordinator.

11 HIRER’ S OWN EQUIPMENT

    Hirer’s wishing to use sound, lighting or other electrical devices and mechanical equipment other than
    provided by the Council shall warrant that it is sound and safe. This means that the equipment must
    have been SIGHTED as having been tested and tagged making it compliant with the Australian
    Electrical Standard AS/NZS 3760:1996

     Any damage or loss of private equipment used in the venue shall be the responsibility of the hirer. The
    facility will bear no responsibility nor costs involved regarding repairs or replacement unless due to
    facility’s staff or practices causing the damage.

12 OBEDIENCE TO THE LAW OF THE STATE

     A Hirer shall abide by all relevant Statutes, Ordinances, Regulations and by-laws with particular
    reference to the Occupational Health Safety and Welfare Act and The Noise Control Act.

13 PARKING

     Parking is available in and near the facility. The Car park at the side of the building is accessed via
    Ward St or Saltfleet St. Gawler St parking must comply with the signs posted. Other parking is
    available on the grassed area on the eastern side of the facility. The car park at the rear of the building
    contains 2 parks for people with disabilities. Hirers parking in this spot must display the appropriate
    disability permit.

HIRING AGREEMENT
14 ACCESS
   The Hirer shall ensure that access to the hired facility is through the designated entrances. Please
   ensure that all fire exits are kept clear of any objects, which may cause an obstruction. All exits from
   the Performance Space open outwards.
15 DAMAGE

      The Hirer shall not affix any matter or thing to, or hang any matter or thing from, any part of the facility
      or fixture or any other item therein without the prior written consent of the Co-ordinator.

       The hirer shall not damage any property of the Council and shall on becoming aware of any damage
      report that damage immediately to the Co-ordinator.

16 KEYS

      The keys to the facility shall be provided by prior arrangement and shall be kept in the charge of only
      such person or persons as are nominated by the Co-ordinator.

17 CONDUCT OF FUNCTION

      The Hirer shall conduct and manage the function/performance in a proper, orderly and lawful manner
      and shall not permit any Act, matter or thing, which may injure the reputation of the facility or the
      Council.

18 LIQUOR LICENCE

      The hirer shall arrange a current Liquor License where such is required, and display that license
      accordingly.

19 PROHIBITIONS

(1) The following are prohibited within the facility:
     Smoking Confetti         Candles      Flammable liquids or other dangerous substances. See
    attachment

(2)        Prior written consent of the Co-ordinator is needed for any of the materials previously mentioned,
           to be allowed in the facility: The decision is based on the unqualified discretion of the Co-
           ordinator. The cost for the use of such materials shall be billed to the Hirer and must be
           supervised by a fire officer engaged by the Council.
(3)        In the event of permission being granted for the use of smoke machines, special effects or
           candles being used at a function, special fire provisions need to be made.
(4)        As the alarms in the particular area will be switched off, a member of the Arts Centre staff will act
           as a fire warden. The warden will need to monitor the activities constantly and their decision
           regarding safety will be final. The cost of the fire warden will be borne by the hirer.

20 INSURANCE
(1) The Hirer shall be responsible for the insurance of all equipment and items brought onto the facility by
    the Hirer and whilst it remains on the facility.

(2)        The Hirer shall arrange public liability insurance for the period of hiring for the amount nominated
           by the Council. The insurance must be in the name of the Hirer and the Council insuring against
           all actions, costs, claims, damages charges and expenses whatsoever which may be brought or
           made or claimed against the Council or the Hirer or both in relation to the function or event under
           taken by the Hirer.

(3) The Hirer acknowledges that the Council shall not be liable, nor shall the Council have any obligation
    to insure against any loss of cash whether by theft or otherwise on the facility.

HIRING AGREEMENT
21 INDEMNITY

      The Hirer agrees to indemnify and keeps indemnified the Council against the loss or damage of any of
      the Hirer’s equipment, property, or personal belonging in conjunction with the Hiring of the facility by
      the Hirer.
22 CONTRACT ALTERATIONS

      This agreement constitutes the entire understanding of the parties. Its terms cannot be modified
     except by further agreement in writing signed by both parties.

23 JURISDICTION

     This contract shall be construed in accordance with the laws of South Australia.

24 DISORDERLY PERSONS
   That the Council may refuse to admit to the facility any persons who in the opinion of the Council its
   officers, agents or nominees, is not conducting himself or herself in a proper, orderly or lawful manner.

25 EVACUATION OF BUILDING
  In the unlikely event that the building may need to be evacuated, please follow the fire safety diagrams
  in the performance space and at the rear door.
   DO NOT, UNDER ANY CIRCUMSTANCES, ATTEMPT TO FIGHT THE FIRE
   Please contact the Fire Brigade to attend by breaking the glass in the red fire boxes located in the
  Performance space.
   If the alarm is sounding then they will already be alerted to the emergency.

26        POWER CHARGE
     Please note there will be a power and lamp replacement charge made for functions / performance
     seasons with use of The Arts Centre’s theatrical lamps/ 3 phase power outlets. This charge will be
     calculated on power used and passed onto the hirer.

27       G.S.T.
     Please note that all prices quoted are inclusive of G.S.T.

   attract a call out fee, which the hirer will be obliged to pay.

28. EMERGENCY EVACUATION
  This is to certify that I have had the Arts Centre’s emergency procedures explained to
  me.
  The position of all extinguishers, alarms and emergency exits has been indicated.
  I have been made aware of the emergency /evacuation assembly point for The Arts
  Centre and the priorities when making an emergency exit from the building.
  DO NOT ATTEMPT TO FIGHT A FIRE.
  RAISE THE ALARM-RING FOR FIRE ASSISTANCE.
  PLEASE ENSURE THAT YOU EVACUATE THE BUILDING IN A QUICK ORDERLY
  MANNER
  DO NOT REENTER THE BUILDING FOR ANY REASON UNTIL A WARDEN OR
  FIRE/ COUNCIL OFFICER SIGNALS THE ALL CLEAR.

THE ARTS CENTRE-PT NOARLUNGA

The Council hereby agrees to hire the Performance Space to the hirer pursuant to the conditions of hiring
