( this was supposed to over rule other terms) (D) responded in a phone conversation in which he accepted the offer and formal purchase order was to follow there was a floow up trun on letter for (D) to start building which they had already done. (D) did not deliver the product untila year later (P) did not start testing product for 6 months. o They were defective (D) contends that they agree dto eth 90 day warranty (P) had a no limit warranty.
