Welcome and Introductions

The meeting was called to order at 11:10 a.m. on Friday, March 25, 2011, by the Guardianship
Advisory Board (GAB) Chair, John Norris. Introductions were made as we had many new
Board members that attended this meeting.

Approval of Minutes of 10/15/10 GAB Meeting

Minutes of 10/15/10 meeting were unanimously approved with one minor change (date of
previous meeting was incorrect).

Staff Update

Kathleen Anderson discussed the new duties of the Guardianship and Collections Unit. She also
informed the Board that at the present time there is no money in the current state budget proposal
for Guardianship Grants or for the Guardianship Advisory Board.

Nomination and Election of Vice-Chairperson of Guardianship Advisory Board

Suzanne Cobb nominated Anthi Pavlicek to serve as Vice Chair. There was a vote and Anthi
Pavlicek was unanimously approved to serve as the Vice Chair of the Guardianship Advisory
Reports from Grantees

The following grantees gave reports on their programs:
    Monica Bonilla, Catholic Charities, Archdiocese of San Antonio, Inc.
    Jim Welch, Texoma Council of Governments
    Bruce Bower, Alternatives to Guardianship
    Suzanne Cobb, Senior Citizens of Greater Dallas, The Senior Source in Dallas

Moving Date of Next Guardianship Advisory Board Meeting

There was discussion to move the next Guardianship Advisory Board Meeting from the
previously scheduled date of June 24, 2011 to May 20, 2011 to coincide with the Texas
Guardianship Association conference that will be held in Austin May 19 – May 20, 2011. It was
unanimously voted to move the next GAB meeting to May 20, 2011 from 1:00 p.m. to 5:00 p.m.
at the Omni Southpark Hotel in Austin.

Discussion of Legislative Recommendations for the 82nd Session

Kathleen Anderson discussed a bill by Senator Nelson that would change the reporting
requirements for the GAB to once every two years rather than yearly.

Aaryce Hayes discussed the process of getting Riders added to the Appropriations Bill. The
possibility of seeking a Rider to use Medicaid Estate Recovery Program (MERP) money to fund
the Guardianship Program was also discussed.

Brief discussion of HB 2759 by Hartnett and SB 1299 by Duncan regarding changes to the
Probate Code.

Brief discussion of HB 1325 by Hartnett regarding payment of the costs for services of a
guardian ad litem and attorney ad litem in a guardianship proceeding.

Also a brief discussion of SB 1198 regarding decedent’s estates.

Tim McGinnis discussed SB 220 at length in regards to it’s effect on Department of Aging &
Disability Services (DADS). He indicated three key elements of the bill were: 1) obtaining
copies of records for no fee; 2) clarification in Human Resources Code regarding who the
records can be released to; 3) to allow volunteers to help in the guardianship program with life
enhancement issues such as helping with parties, buying Christmas gifts, etc.

Discussion on How To Create Guardianship Videos

Brief discussion by newest member, Ruben Garcia on how it is of extreme importance to have
video recordings on the fundamentals of guardianships that would be of great use to the grantees
and other guardianship service providers.
