9:00 AM Plenary Session: Michael Colatrella - Negotiation Strategies for Mediators
2 hrs MCLE including 1.2 hrs ethics
Mediators can help parties avoid common negotiation pitfalls that lead to deadlock. Using cutting
edge negotiation research, illustrative video clips, and role plays, the training explores strategies
and tactics mediators can use to increase the likelihood that the parties will engage in an efficient
negotiation process and make rational decisions concerning settlement.
11:00AM Plenary Session: Michael Colatrella - Addressing Power Imbalances in Mediation
1 hr MCLE including ethics
Whether and to what extent a mediator should address unequal bargaining power between
mediation participants is an increasingly common dilemma in our diverse and complex society.
Through lecture and discussion this presentation will explore the sources of negotiation power
imbalance and examine the ethical concerns when attempting to address power imbalances,
especially the ethical standards of impartiality and party self-determination. The extent of a
mediator’s responsibility to address power imbalances will be discussed, as well as techniques to
balance power and their ethical implications.
Michael T. Colatrella, Jr. is Associate Director at Southern Methodist
University’s Center for Dispute Resolution & Conflict Management in Dallas,
Texas, and on the adjunct faculty of the Dispute Resolution Graduate Program
at Baker University in Overland Park, Kansas. He received his J.D. in 1991
from Seton Hall University School of Law and an LL.M. in ADR from New York
University School of Law. Before pursuing a full-time career as a teacher and
mediator, Mr. Colatrella was a litigator in the New Jersey law firm of Reed Smith
Shaw & McClay, listed among The American Lawyer's top 100 law firm's in the
United States. He has mediated disputes involving employment contracts,
commercial contracts, consumer fraud suits, personal injury, and commercial
and residential leases. He is co-author of Mediation Skills and Techniques
released this year.

“Communication, Mediation, and the Brain”
The brain’s structure and processes influence how people handle stressful situations. This
presentation will address the brain’s processing of emotions and logic and the effect on listening
and understanding. Gender and cultural differences and their effect on listening, speaking, and

and Respond to Hardball Tactics;” Martha Halvordson, JD, LLM, Managing partner of

Ver Dught, JD, Executive Director of Missouri Mediation Services, president emeritis of
the Association of Missouri Mediators and Heartland Mediation Association.
