1.    What is 4G Mobile Blackberry Data Bundles?


       4G Mobile Blackberry Data Bundle is a subscription service that enables prepaid and
      postpaid customers with 4G capable Blackberry smartphones to access the Internet
      (WEB/WAP) from their mobile device.
      There are 4 available prepaid and 4 available postpaid packages, all of which provides
      access to the internet (WEB/WAP). Blackberry phones with an active 4G Mobile
      Blackberry Data bundle will be able to access core services offered by blackberry. This
      includes the use of:
                      Blackberry Messenger
                      Blackberry Internet Service (BIS)
                      Blackberry Enterprise Service (BES)
                      Push Email services to the device (Blackberry or other 3 rd party email)
                      Blackberry AppWorld




 2.   What do I need to access 4G Mobile Data Service?
               A 4G Mobile capable device - Any 3G, 4G, HSPA, HSPA+ Blackbery smartphone
                the 850Mhz band.
               Proper Device Setting – The phone network setting must on 3G&2G or 4G&2G
                or dual mode (depending on the phone) to access Digicel’s 4G network.
               Opt in to 4G – Customers may opt in to 4G Mobile via *136#. Customers will be
                required to complete a battery pull once 4G Mobile data is activated.


3.     What are the available Prepaid & Postpaid Blackberry Internet Packages?


      Blackberry Data Plans are not unlimited on 4G Mobile. Customers may choose from the
      available Blackberry Bundle Plans for prepaid and postpaid

         Customers will be required to complete a battery pull for all devices once a data bundle
         is activated.
         Once a data bundle is exhausted and plan has not expired the customer will be charged
         for browsing at a rate of $15 per MB (prepaid) or $10 per MB (postpaid).


4.        What is a megabyte or gigabyte?


         A megabyte (MB) or gigabyte (GB) is the measurement used for the amount of
         information that is sent and received from the Internet when you browse (WAP or WEB)
         or download content like ringtones, wallpaper, and games.

5.        What are the benefits of the 4G Mobile Blackberry Data bundle Plan?

     Access:

     MB for data usage within the bundle. In addition there is a lower effective per MB rate
     (approx. $15 per MB compared to $40 per MB) for overage charges while on a data plan.

     Controlled data usage and charging. Data plans also have usage notifications that allows
     customer to better control data costs
     Productivity:

     Easily work with large files from your mobile phone or laptop.
     Speed:

     Browse, download and upload stream videos, music and data at amazing superfast
     speeds



6.   Will I have 4G speeds everywhere I go?



     4G mobile has total population coverage of 80%. To view if your location is 4G Mobile
     ready please visit www.digiceljamaica.com
     There is also EDGE/2G coverage to 99% of the population, so you are always connected
     to data service.

7.       How do I activate a 4G Mobile Blackberry Data Bundle?



         Customers will be able to activate 4G Mobile Blackberry Data Bundle plans by using USSD
         codes:
                 Customers will be required to dial *136# send and await instructions via text
                  message
                 There have a thirty (30) minute window within which to complete and submit
                  the activation request after the text instructions are received.
                 Once the customer completes the activation they will receive a text message
                  that confirms activation.


It is advised NOT to browse until a confirmation text message is received advising that the
Data bundle has been provisioned and a battery pull is done for all devices. Use of service
without completion of the activation process will result in charges of $40 per MB.


8.       How long does my plan take to activate?


         The plan will activate immediately for prepaid customers, once the customer enters the
         required USSD codes. A confirmation message will be sent to indicate the completion of
         the activation.
         For postpaid customers, once the activation request is complete the Data Bundle will be
         activated within 5 to 30 minutes of the customer care agent receiving the request.




     It is advised NOT to browse until a confirmation text message is received advising that the
     Data bundle has been provisioned and a battery pull is done for all devices. Use of service
     without completion of the activation process will result in charges of $40 per MB.




9.       How will I know that I am connected to Digicel’s 4G Mobile Network?

      Once you change your phone settings, remove and replace the battery or power off/on
      the device, the coverage icon will change to 3G, 3G+, 4G or H+. What is displayed is
      dependent on the device.

10.      Who to sign up for a 4G Mobile Blackberry Data Bundle?



      All Digicel customers with a 4G Blackberry phone and an active postpaid/prepaid account
      may activate a Data Bundle.4G Mobile Blackberry Data Bundle plans can be accessed
      from any Blackberry phone that is GSM/EDGE, 3G/4G or HSPDA and compatible with the
      Digicel network.
      Customers with Blackberry devices that are not 3G/4G compatible should not subscribe
      to the 4G Mobile Blackberry Data Bundle service. . Customers with 2G devices should be
      encouraged to sign up to our 2G Data packages that are available OR upgrade their
      phone to 3G/4G compatible device and then activate 4G Mobile Data Plan.


11.      Am I able to activate a 4G Mobile Blackberry Data bundle using a Non Blackberry
phone?


      No. Customers will not be able to activate any of the 4 available 4G Mobile Blackberry
      Data bundles using a Non Blackberry phone.
      Attempting to activate customers will receive a text message advising that the phone is
      incompatible.




12.      What happens if a customer exhausts the allotted bundle allowance (MB/GB) of the
package purchased, before the plan time ends?
            Option 1:


      If a customer exceeds their allotted bundle usage for their selected 4G Mobile Blackberry
      Data bundle they will be charged at a rate of $15 per MB (prepaid) or $10 per MB
      (postpaid) once their purchased plan has not expired.

       This overage charge will apply for all usage over the bundle allowance until the end of
       the plan once the customer does not re-subscribe (to the same plan or change the plan).


           Option 2: Prepaid Customers only

       Once the bundle is exhausted, the customer may choose to re-subscribe to the same
       plan or upgrade to a higher plan.
               The customer is required to dial *136*5*plancode# to renew current plan (early
                renewal).
               The customer is required to dial *136# send to a plan change.
       The customer is immediately given a new plan with a full bundle allocation and time on
       the new plan. The unused bundle allowance does not roll over from the old plan to the
       new plan.
           Postpaid Customers only

       Customers are able to continue browsing until they have reached their credit limit after
       which they will NOT be able to browse (or use voice or SMS).
       A new bundle allowance is allocated in the next billing period




13.    How does a customer renew his current 4G Mobile Blackberry Data bundle service?


       Prepaid and Postpaid Blackberry data renewal is automatic.
       Prepaid customers will receive a warning message 2 days and 1 day before expiry
       notifying that the plan will be automatically renewed at the start of the new period.
       Postpaid customers will receive a warning message 4 days and 1 day before expiry
       notifying that the plan will be automatically renewed at the start of the new period.
       If the customer does nothing, the plan will renew at the start of the next period and the
       customer will receive a text message confirming that the plan has been renewed.
All plans will auto renew excluding the 1 day 500MB plan (PREPAID). The customer will be
required to reactivate this plan at the end of the current plan.

14.   How do I check my 4G Mobile Blackberry Data bundle balance?


      In order to query the 4G Mobile Blackberry Data bundle balance the customer will be
      required to either dial a USSD code once registered.

15.   Using the 4G Mobile Blackberry Data bundle will I only be able to browse WEB sites?


      Customers may browse both WEB and WAP sites. There will be no charges for the WAP
      or WEB browsing using 4G Mobile Prepaid Blackberry Data bundles while within the
      bundle allowance.
      Blackberry phones with an active 4G Mobile Blackberry Data bundle will ALSO be able to
      access core services offered by blackberry. This includes the use of:
                      Blackberry Messenger
                      Blackberry Internet Service (BIS)
                      Blackberry Enterprise Service (BES)
                      Push Email services to the device (Blackberry or other 3rd party email)
                      Blackberry AppWorld




16.   Will I receive a message to tell me when the bundle is completely used?


      Yes, Customers will receive the following text message:

   17.    What happens if a customer does not use all the data allotted for the period?


          The customer’s MB/GB data allowance will expire at the end of the plan period. This
          therefore means that remaining/unused data will be removed from the account and a
          new bundle attached at the start of the new period i.e. NO ROLL OVER.
          Postpaid Blackberry plans will expire at the end of the billing period




   18.    Can I download ringtones, wallpaper or games using the 4G Mobile Prepaid Data
   bundle?

        These charges are not covered by the Data Bundle plan. Customers will be charged for
        downloading premium content from premium WAP or WEB sites at the prevailing
        premium rate for each transaction type.


19.      Am I able to access more than one Blackberry data bundle at the same time?


        No. Once on an active 4G Mobile Blackberry Data bundle another bundle will not be able
        to be activated.
        Customers will be able to change (upgrade) from an active 4G Mobile Blackberry Data
        bundle to another.
        There is no proration of bundles. Therefore all remaining/unused bundles will be
        removed at the time of the plan change.
        Customers will be required to dial *136# send while being on an active plan or
        *136*oldplancode*newplancode# send. Instructions will follow to complete the change
        of plan process.
      NOTE

        Postpaid customers change plan request can be made at any time, but does not take
        effect until the start of the new period
        Once the request is completed the customer will receive a message that the plan will
        begin at the start of the new period.

20.      Will I be able to change from one 4G Mobile Blackberry Data Bundle plan to ANY
              other?



        Yes. Customers will be able to change their 4G Mobile Blackberry Data bundle plan at any
        time.
        There is no restriction as to which plan the customer will be allowed to change to
        (Upgrades or downgrades are possible).
        There is no proration of bundles. Therefore all remaining/unused bundles will be
        removed at the time of the plan change.

        Customers will be required to dial *136# send while being on an active plan or
        *136*oldplancode*newplancode# send. Instructions will follow to complete the change
        of plan process.
        On completion of the plan change, the customer will then receive a text message
        confirming that the plan has been changed and the details of the new plan.

        Postpaid customers change plan request can be made at any time, but does not take
        effect until the start of the new period
        Once the request is completed the customer will receive a message that the plan will
        begin at the start of the new period.


21.      How does a customer renew their 4G Mobile Blackberry Data Bundle plan?


        Postpaid and prepaid plan renewal is automatic.
        Postpaid customers will receive a warning message 4 days and 1 day before expiry
        notifying that the plan will be automatically renewed at the start of the next month.
        Prepaid customers will receive a warning message 2 days and 1 day before expiry
        notifying that the plan will be automatically renewed at the start of the new period.
        If the customer does nothing, the plan will renew at the start of the next period and the
        customer will receive a text message confirming that the plan has been renewed
All plans will auto renew excluding the 1 day 500MB plan. The customer will be required to
reactivate this plan at the end of the current plan



22.      How does a customer cancel a 4G Mobile Blackberry Data Bundle plan?


        There is no plan cancellation option for prepaid to cancel a plan.
        Customers can choose to opt-out of the renewal of the plan. If the customer wishes to
        opt out they will be required to dial *136*400*9# 4 days (Postpaid) or 2 days (Prepaid)
        before the plan ends up until the end date of plan.
        All plans will auto renew excluding the 1 day 500MB plan (prepaid). The customer will be
        required to reactivate this plan at the end of the current plan.

23.       How does a customer prevent their data plan from auto-renewing?


          Customers must opt-out to discontinue their 4G Mobile Blackberry Data Bundle data
          plan.
          Prepaid customers will receive a warning message 2 days and 1 day before expiry
          notifying that the plan will be automatically renewed at the start of the next period.
          Postpaid customers will receive a warning message 2 days and 1 day before expiry
          notifying that the plan will be automatically renewed at the start of the next period.
          Customer’s will be required to dial *136*400*9# to discontinue subscription to the 4G
          Blackberry Data Bundle service Plan cancellations take effect at current plan expiry.
          The customer will then receive a text message confirming that the plan has expired.


      All plans will auto renew excluding the 1 day 500MB plan (prepaid). The customer will be
      required to reactivate this plan at the end of the current plan.


24.       What rate do I pay if I use my phone as a modem with a computer (i.e. Tethering)?


          Tethering is charged from the 4G Mobile Prepaid Data bundle plan.
          Tethering is at the PAYG rate of $40/MB for customers without a Digicel Internet Bundle
          plan.



      NOTE

      When tethering customers must use “web.digiceljamaica.com” as their APN settings to be
      charged from the 4G Mobile Blackberry Data bundle. With any other APN used customers
      will be charged the regular Pay-As-You-Go (PAYG) rate of $40/MB

25.       Will I automatically be on the 4G network once I purchase a plan?

      No. Customers will be required to complete a battery pull for all devices once a data
      bundle is activated.
      To access 4G data speeds a 3G/4G device is required.
      3G phones must be set to ‘2G/3G’,‘automatic’, ‘dual’ or ‘2G/3G/4G’ to get 4G data
      speeds even though the phone is 3G/4G compatible.
      Customers may be required to do a manual search to be able to access 4G services from
      their 3G/4G phone. It is recommended to:
                             Select network mode as 2G and 3G
                             Carry out a manual network search
                             Select the Digicel network


26.   Can I activate the data bundle on two SIM cards using the same phone?


      NO. Customers can only activate one 4G Mobile Blackberry Data plan per Blackberry
      device.



27.   Can I use my noon-data compatible phone to 4G Mobile data bundles?


      No. Only GPRS/EDGE and 3G/4G (WAP and WEB) compatible devices can be used to
      access data Bundles.


28.   Can I use a Data Card, USB modem to access 4G Mobile Blackberry data bundles?


      No. 4G Mobile Blackberry data bundles are for Blackberry devices only.


29.   As a Blackberry customer am I able to data roam?
      Data charges will NOT be taken from the 4G Mobile Data bundle. Customer will be
      charged at the prevailing roaming rates for all data usage while roaming..
      Data roaming rates remain unchanged. Customers roam at the prevailing rates
      Digiroaming to Digicel territories is at a reduced rate of US$4.99 /MB.

30.   How will postpaid customers know how much data they have used while roaming?


      Customers will be notified of data usage at the specified thresholds below Customer will
      receive the following advisory text messages:

        Warning Message 4         You have spent JMD10,000 on data browsing while roaming
                                  this month. Thank you for roaming with Digicel




31.   Will my device work if it was not purchased from Digicel?
      Only 3G or 4G devices with the HSPA 850Mhz band will work on Digicel 4G Mobile.

                      Blackberry Prepaid – Terms & Conditions

1. Agreement
These terms and conditions shall govern the relationship between Digicel (Jamaica)
Limited (hereinafter referred to as “we”, “us”, “our” and “the Company”) and the user
(hereinafter referred to as “you”, “your” “the Customer”) of the Blackberry Prepaid
Service (hereinafter referred to as “Service(s)”, “Digicel Mobile Service”) and shall
constitute legal and binding obligations on the parties once you have made or received
your first call from your prepaid phone. Where applicable your registration form shall
form part of these terms and conditions. These Terms & Conditions annul all prior
understandings between you and us. By using Services, you have agreed to these Terms
& Conditions. We reserve the right to amend or unilaterally change any of Digicel
Mobile Service products and/or Digicel Mobile Service services and/or the Terms and
Conditions of this Agreement subject to notifying you of such amendments. Such
notification may be by way of advertisement in the national media, SMS text messaging
and/or our website. If the Service is used after notice of amendment, then it shall be
deemed accepted. This agreement is governed by the Laws of Jamaica.

2. Maintenance of Existing Terms & Conditions
You agree to continue to observe and abide by the Standard digiFLEX and digiSELECT
terms and conditions of service established at the activation of prepaid and postpaid
mobile service. For the avoidance of doubt, these Terms andConditions are in addition to
any other terms and conditions of use of any of the Company’s other services.


3. Service Charges
The Company’s tariffs for the Service, as amended from time to time, also form part of
the Agreement. We reserve the right to alter such tariffs and will notify the Customer of
such a change by notice in writing via advertisement in the national media, SMS text
messaging and/or via our website. All tariffs are exclusive of GCT.


4. Service Description
The Company shall provide the Prepaid Blackberry Service as described in Schedule 1.


5. Service Period
The service period is either:
       a. Daily (1 day) counted from the time of day that the Customer is activated (for
           instance, if the Service is activated at 9:00 am the Service will be deactivated
           at 8:59 am 1 day later).
       b. Weekly (7 days) counted from the time of day that the Customer is activated
           (for instance, if the Service is activated at 9:00 am the Service will be
           deactivated at 8:59 am 7 days later).

       c. Bi-Weekly (14 days) counted from the time of day that the Customer is
          activated as per (a) above.
       d. Monthly (30 days) counted from the time of day that the Customer is activated
          as per (a) above.


6. Roaming
Digicel’s Data Roaming rates, as amended from time to time, will apply when the
Customer is roaming. The tariffs for this Service only apply to usage in Jamaica.

7. Payment
The payment for the Service will be deducted from the Customer’s account balance when
the Customer subscribes to the Service. If there is an insufficient balance on the account
the Service will not be activated.

8. Customer Obligations
You consent to and agree to:
      a. abide by all the terms and conditions of use of the Service as outlined herein;
      b. comply with laws and regulations governing this network and service;
      c. utilize the Service for personal use only and not for commercial and/or
          business purposes;
      d. immediately report and confirm in writing, loss, theft, damage of handset
          and/or SIM Card preventing your use of the Service;
      e. comply with all reasonable requests by us, or others on our behalf, particularly
          in relation to the investigation of fraud or other offences or as required by law
          or in legal proceedings. Should the Company deem it necessary to enforce its
          rights hereunder in any legal action you will reimburse the Company for all
          costs and expenses including reasonable attorney’s fees as a result of such
          legal action.
      f. This Service is subject to a Fair Usage Policy which prescribes that the
          Services are shared and Digicel reserves the right to manage the Network to
          ensure that all Customers get fair access to the Network. If Customers are
          deemed by Digicel to make excessive use of their Service, the Service may be
          (i) restricted, either in terms of general access or the download speeds at
          which the Customer is permitted to access the Service, or (ii) the Customer
          may be asked to subscribe to an alternative Service package more suitable to
          their usage. Digicel, at its sole discretion, will determine from time to time
          what constitutes excessive use of the Service. In the event that the Customer
          refuses to comply or neglects Digicel’s Fair Usage Policy, Digicel has the
          right to unilaterally terminate or modify the Service to the Customer.


9. Suspension & Termination
This Agreement may be suspended and/or terminated without the need for prior written
or verbal communication:
       a. if any information supplied by you is found to be false or misleading;

       b. if you do not comply with and/or breach any of the Terms and Conditions of
          this Agreement;
       c. if we have any reasonable cause to believe that you are abusing the service or
          are unable to pay for Service;
       d. if you notify us that your handset has been lost or stolen;
       e. if we have reasonable cause to believe that Service was obtained fraudulently
          or fraudulent or improper use of your handset or SIM card is taking place
          against us or a third party;
       f. if you commit a trespass on the Network or any equipment owned by the
          Company
       g. if you conspire to defraud the Company
       h. if, in the sole opinion of the Company, you should do anything which could be
          or is detrimental to the operation of the Network or the Company
       i. if Services rendered to you in the sole opinion of the Company may cause the
          Operation of the Network to be jeopardized or impaired, or allow others to do
          any of the foregoing with your equipment or any act that does not comply
          with relevant legislation and regulation;
       j. if we are unable to provide Service to you;
       k. if you do anything which in the opinion of the Company is intended to result
          in the evasion or avoidance of the Company’s charges or defraud the
          Company;
       l. if you do anything which is intended to, or results in or likely to bypass the
          Service;


10. Customer Information
Digicel will send you information from time to time that is deemed relevant to you. If
you do not wish to receive this information you may notify Digicel in writing.

11. Unenforceability
If any part of this Agreement shall be deemed invalid, illegal or unenforceable, the
validity, legality or enforceability of the remainder of this Agreement shall not in any
way be affected or impaired.

SCHEDULE 1
Service Description

   1. The Blackberry Prepaid Service gives Customers the following service options
      from which to select:
         a. 2G/EDGE Blackberry Service - For Customers choosing to only utilize
            Digicel’s 2G/EDGE network and data services then such Customers will
            be permitted to avail of unlimited data access during the Service Period
            associated with their Blackberry Internet Service plan which allows the
            Customer access to personal email accounts (maximum of 10) and
            internet/web browsing; or
         b. 4G Blackberry Service - For Customers choosing to utilize Digicel’s 4G
            Mobile network and data services then such Customers will be permitted
            to avail of data services subject to such usage cap limitations, during the
            applicable Service Period, as stipulated in the Customer’s 4G Blackberry
            Internet Service Plan. Such Blackberry Internet Service will allow
            Customer access to personal email accounts (maximum of 10) and
            internet/web browsing subject to the usage cap detailed in their plan
            subscription.

   2. Customers who are subscribed to the 2G/EDGE Blackberry Service will not be
      permitted to stream content via their data connection. Customers who are
      subscribed to the 4G Blackberry Service will be permitted to stream content via
      their data connection.

   3. Customers who are subscribed to the 4G Blackberry Service and have exhausted
      the full amount of their data usage cap within any service period will continue to
      receive data services subject to being charged the applicable data overage rate as
      prescribed in their service plan. The data usage cap will prescribe the amount of
      MB/GB allocated for usage by the Customer within the defined period. Unused
      Bundle allocations do not roll over and will expire at the end of the defined
      period.

   4. Customers subscribed to any of Digicel’s 7,14,or 30 day Blackberry Prepaid
      Service Plans shall have their plans automatically renewed at the end of the
      relevant period subject to the Customer having on their account the appropriate
      value of credit available for deduction by Digicel. In the event that the Customer
      has insufficient credit on their account at the time of renewal then the renewal
      will fail and the Blackberry Prepaid Service Plan plan will expire. Customers
      will then be required to re-subscribe to reactivate their Blackberry Prepaid
      Service Plan


   5. The Blackberry Prepaid 2G/EDGE Service does not include premium WAP
      browsing including Digicel Live.

6. The Blackberry Prepaid Service does not include the provision of voice services,
   SMS text messaging or roaming.

7. The Blackberry software also includes the following features:
      a. Maps
      b. Organiser
      c. Games
      d. Media Player
      e. Camera
      f. Applications and more

8. You must own or purchase a Blackberry handset and a Digicel SIM card prior to
   applying for the Service.

9. There are four (4) types of plans available under this Service and new plans may
   be added at any time:

            Type of Plan        Length of Plan
        Daily                   1 day
        Weekly                  7 days
        Bi-Weekly               14 days
        Monthly                 30 days


10. The Customer must ensure that they have sufficient credit on their account before
    accessing the Service and Customers should note that GCT will be charged at the
    point of purchasing credit.

11. The Customer understands that the Service is subject to the Blackberry Network
    which Digicel has no control over and as such:

       a. If the customer has a Blackberry device that is locked to another network,
          Digicel will be unable to provide Prepaid Blackberry service to that
          customer.
       b. If the customer has an unlocked Blackberry device from another provider
          with an email account already setup on that network, the customer will not
          be able to set up a new email account on Digicel’s Prepaid Blackberry
          service. As such, the customer may not be able to receive his or her email
          directly on the Blackberry device (i.e. his or her email may not be
          accessible from the Message icon). The customer will be able to receive
          email by using the Internet Browser to directly access the website of the
          respective Email Service Providers (e.g. browsing for Hotmail, Gmail,
          Yahoo). All other Blackberry Services will be provided.

       c. In the event that the Blackberry Network fees are increased, Digicel
          reserves the right to increase the cost of the Service, however Digicel will

   notify the Customer beforehand, such notification may be by way of
   advertisement in the national media, SMS text messaging and/or our
   website.
d. The Customer understands that the Service is subject to the Blackberry
   Network being operational and the Customer will not hold Digicel liable
   in any way for the lack of Service due to the Blackberry Network being
   out of commission for whatever reason.

                     Blackberry Postpaid – Terms & Conditions

12. Agreement
These terms and conditions shall govern the relationship between Digicel (Jamaica)
Limited (hereinafter referred to as “we”, “us”, “our” and “the Company”) and the user
(hereinafter referred to as “you”, “your” “the Customer”) of the Company’s Blackberry
Postpaid Service (hereinafter referred to as “Service(s)”, “Digicel Mobile Service”) and
shall constitute legal and binding obligations on the parties once you have made or
received your first call from your postpaid phone. Where applicable your registration
form shall form part of these terms and conditions. These Terms & Conditions annul all
prior understandings between you and us. By using Services, you have agreed to these
Terms & Conditions. We reserve the right to amend or unilaterally change any of Digicel
Mobile Service products and/or Digicel Mobile Service services and/or the Terms and
Conditions of this Agreement subject to notifying you of such amendments. Such
notification may be by way of advertisement in the national media, SMS text messaging
and/or our website. If Service is used after notice of amendment, then it shall be deemed
accepted. This agreement is governed by the Laws of Jamaica.

13. Connection & Activation
Connection and activation are subject to satisfactory risk assessment, credit rating and/or
receipt of monthly payments. The monthly payments required will be determined at the
sole discretion of the Company. These Terms and Conditions annul all prior
understanding and/or agreements (if any) between you and us with regards to the
Blackberry Postpaid Service.

14. Maintenance of Existing Terms & Conditions
You agree to continue to observe and abide by the Digicel Select/Postpaid terms and
conditions of service established at the activation of postpaid mobile service. For the
avoidance of doubt, these Terms and Conditions are in addition to any other terms and
conditions of use of any of the Company’s other services.


15. Service Charges
The Company’s tariffs for the Service, as amended from time to time, also form part of
the Agreement. We reserve the right to alter such tariffs and will notify the Customer of
such a change by notice in writing via advertisement in the national media, SMS text
messaging and/or via our website. All tariffs are exclusive of GCT.


16. Service Description
The Company shall provide the Blackberry Postpaid Service as described in Schedule 1.


17. Service Period
The Service Period is monthly (30 days) counted from the day that the Customer is
activated. The tariffs for the Service will be calculated on a pro rata basis.

18. Roaming
Digicel’s Data Roaming rates, as amended from time to time, will apply when the
Customer is roaming. The tariffs for this Service only apply to usage of the Service in
Jamaica.

19. Payment
Your monthly subscription charge for the Service will be included in your monthly
invoice and are payable as set out in the Digicel Select Terms & Conditions.

20. Customer Obligations
You consent to and agree to:
       a. abide by all the terms and conditions of use of the Service as outlined herein;
       b. comply with all laws and regulations governing this network and the Service;
       c. not resell the Service as a commercial or business venture;
       d. accept responsibility for all activities undertaken through the use of your
          handset to access the Service;
       e. understand that you will be liable for any activities carried out by third parties
          including employees using the Service which we have provided to you;
       f. protect any passwords which you have installed on your handset;
       g. not use the Service in a manner which could damage, disable, overburden or
          impair the Service or our network;
       h. not to attempt to gain unauthorised access to our network;
       i. not publish, post, upload or distribute or disseminate any inappropriate,
          profane, defamatory, infringing, obscene, indecent or unlawful material
       j. immediately report and confirm in writing, loss, theft, damage of handset
          and/or SIM Card preventing your use of the Service;
       k. comply with all reasonable requests by us, or others on our behalf, particularly
          in relation to the investigation of fraud or other offences or as required by law
          or in legal proceedings.
       l. This Service is subject to a Fair Usage Policy which prescribes that the
          Services are shared and Digicel reserves the right to manage the Network to
          ensure that all Customers get fair access to the Network. If Customers are
          deemed by Digicel to make excessive use of their Service, the Service may be
          (i) restricted, either in terms of general access or the download speeds at
          which the Customer is permitted to access the Service, or (ii) the Customer
          may be asked to subscribe to an alternative Service package more suitable to
          their usage. Digicel, at its sole discretion, will determine from time to time
          what constitutes excessive use of the Service. In the event that the Customer
          refuses to comply or neglects Digicel’s Fair Usage Policy, Digicel has the
          right to unilaterally terminate or modify the Service to the Customer.


21. Third Parties

Use of the Service will connect you to third party webpages and material. We are not
responsible for the content, usage or performance of any third party services. In the event
that you access third party services you agree to abide by their respective usage policies.


22. Indemnity
Should the Company deem it necessary to enforce its rights hereunder in any legal action
you will reimburse the Company for all costs and expenses including reasonable
attorney’s fees as a result of such legal action.

23. Suspension & Termination
This Agreement may be suspended and/or terminated without the need for prior written
or verbal communication:
       a. if any information supplied by you is found to be false or misleading;
       b. if you do not comply with and/or breach any of the Terms and Conditions of
           this Agreement;
       c. if we have any reasonable cause to believe that you are abusing the service or
           are unable to pay for Service;
       d. if you notify us that your handset has been lost or stolen;
       e. if we have reasonable cause to believe that Service was obtained fraudulently
           or fraudulent or improper use of your handset or SIM card is taking place
           against us or a third party;
       f. if you commit a trespass on the Network or any equipment owned by the
           Company
       g. if you conspire to defraud the Company
       h. if, in the sole opinion of the Company, you should do anything which could be
           or is detrimental to the operation of the Network or the Company
       i. if Services rendered to you in the sole opinion of the Company may cause the
           Operation of the Network to be jeopardized or impaired, or allow others to do
           any of the foregoing with your equipment or any act that does not comply
           with relevant legislation and regulation;
       j. if we are unable to provide Service to you;
       k. if you do anything which in the opinion of the Company is intended to result
           in the evasion or avoidance of the Company’s charges or defraud the
           Company;
       l. if you do anything which is intended to, or results in or likely to bypass the
           Service;


24. Effect of Termination
Notwithstanding termination of service as herein provided, you shall remain liable to pay
the monthly service charges for the initial contract period.

25. Customer Information
Digicel will send you information from time to time that is deemed relevant to you. If
you do not wish to receive this information you may notify Digicel in writing.

26. Unenforceability
If any part of this Agreement shall be deemed invalid, illegal or unenforceable, the
validity, legality or enforceability of the remainder of this Agreement shall not in any
way be affected or impaired.

       BLACKBERRY POSTAID DATA SERVICE TERMS & CONDITIONS

SCHEDULE 1
Service Description

   12. The Blackberry Postpaid Service gives Customers the following service options
       from which to select:
          a. 2G/EDGE Blackberry Service - For Customers choosing to only utilize
             Digicel’s 2G/EDGE network and data services then such Customers will
             be permitted to avail of unlimited data access during the Service Period
             associated with their Blackberry Internet Service plan which allows the
             Customer access to personal email accounts (maximum of 10) and
             internet/web browsing; or
          b. 4G Blackberry Service - For Customers choosing to utilize Digicel’s 4G
             Mobile network and data services then such Customers will be permitted
             to avail of data services subject to such usage cap limitations, during the
             applicable Service Period, as stipulated in the Customer’s 4G Blackberry
             Internet Service Plan. Such Blackberry Internet Service will allow
             Customer access to personal email accounts (maximum of 10) and
             internet/web browsing subject to the usage cap detailed in their plan
             subscription.

   13. Customers who are subscribed to the 2G/EDGE Blackberry Service will not be
       permitted to stream content via their data connection. Customers who are
       subscribed to the 4G Blackberry Service will be permitted to stream content via
       their data connection.

   14. Customers who are subscribed to the 4G Blackberry Service and have exhausted
       the full amount of their data usage cap within any service period will continue to
       receive data services subject to being charged the applicable data overage rate as
       prescribed in their service plan. The data usage cap will prescribe the amount of
       MB/GB allocated for usage by the Customer within the defined period. Unused
       Bundle allocations do not roll over and will expire at the end of the defined
       period.

   15. Customers subscribed to any of Digicel’s 30 day postpaid Blackberry Service
       Plans shall have their plans automatically renewed at the end of the relevant
       period.

   16. The Blackberry Postpaid Service allows individuals to use their Smartphones to
       access the Blackberry software which includes:
          a. Maps
          b. Organiser
          c. Games
          d. Media Player
          e. Camera

17. The Blackberry 2G/EDGE Postpaid Service does not include premium WAP
    browsing including Digicel Live,

    handset and a Digicel SIM card prior to applying for the Service.

          Digicel will be unable to provide Postpaid Blackberry service to that
          customer.
