(a) As part of the negotiated fixed price or total estimated amount of this contract, both the Government and the
Contractor have agreed to waive any entitlement that otherwise might accrue to either party in any residual dollar
amount of $500 or less at the time of final contract closeout. The term "residual dollar amount" shall include all
money that would otherwise be owed to either party at the end of the contract, except that, amounts connected in any
way with taxation, allegations of fraud and/or antitrust violations shall be excluded. For purposes of determining

Section C - Descriptions and Specifications


                               SALIENT CHARACTERISTICS FOR
                        UNASSEMBLED TELECOMMUNICATIONS MONOPOLES

The purpose of this contract solicitation is to award a nationwide Indefinite Delivery, Indefinite Quantity (IDIQ)
contract for commercial off-the-shelf (COTS) telecommunications monopole towers. Installation and assembly will
be performed by the Government.

1     MONOPOLE TOWER SPECIFICATION
1.1     DESIGN PARAMETERS
The monopoles shall comply with the requirements of ANSI/TIA-222-G (and all current addendums). Monopoles
shall be provided to meet each of the ANSI/TIA-222-G Annex B: Site Details design criteria combinations specified
in Table 1 for each monopole height.
1.1.1     Structure Height: Tower heights (in feet): 20, 30, 40, 50, 60, 70, 80, 90, 100, 110, 120, 130,140 and 150.
1.1.2     Structure Type: Monopole
           All monopoles shall be self-supporting (no guy wires)
           All monopoles shall have a base plate for mounting on anchor bolts
1.1.3     Classification of Structure: All monopoles shall be Structural Class III
1.1.4     Exposure Category: All monopoles shall be considered Exposure Category C
1.1.5     Topographic Category: All monopoles shall be considered Topographic Category 1
1.1.6     Antenna Loading: All monopoles shall support the corresponding antenna load configuration listed for each
          tower height as specified in Table 2. All antenna mounts and other appurtenances shall be factored into
          tower loading design calculations.
1.2     MECHANICAL REQUIREMENTS
1.2.1    Structural: All monopoles shall comply with ANSI/TIA-222-G and American Institute of Steel Construction
         (AISC) specifications for installation and assembly.
1.2.2    Material Finish: All monopole components shall be hot-dip galvanized in accordance with American
         Society for Testing and Materials (ASTM) A123 and A153 Standards.
1.2.3    Hardware: All necessary hardware shall be provided with each tower. All hardware connections shall be
         galvanized A325 (or better) bolts, nuts, and locking devices.
1.2.3.1       Anchor Bolts: All monopoles shall include anchor bolts compatible with base plate and capable of
           supporting specified load requirements. Tower manufacturer will need to coordinate with precast concrete
           foundation manufacturer to ensure anchor bolts are compatible with foundation sizing.
1.2.3.2       Hardware Surplus: All monopoles shall include a 3% surplus of hardware
1.2.4    Welding: All welding shall be in accordance with AWS D1.1-04 Structural Welding Code-Steel.
1.2.5    Bonding: Any bonds between dissimilar metals shall be thoroughly sealed against moisture to minimize
         corrosion.
1.2.6    Twist and Sway: All monopoles shall provide twist and sway performance that limits microwave antenna
         losses to no more than 3 dB for 8.5GHz in accordance with ANSI/TIA-222-G Annex D: Serviceability
         Limit State Condition Formula.
1.2.7    Horizontal/Vertical Ratio: The horizontal distance between the vertical centerlines at any two elevations
         shall not exceed 0.25% of the vertical distance between the two elevations
1.3    ELECTRICAL REQUIREMENTS

1.3.1    Continuity: The monopole shall be electrically continuous over the entire structure through the use of either
         direct bonds and/or bonding jumpers.
1.3.2    Grounding: The base of each monopole shall permit an exothermic weld for a bond to the grounding
         electrode system without compromising the rating of the tower.
1.3.3    Lightning Protection: Each monopole shall be equipped with a lightning rod(s) in compliance with NFPA
         780 (2011 edition)
1.4   SPECIAL REQUIREMENTS
1.4.1  Climbing Facility: All monopoles shall be equipped with a climbing facility and a safety climb device,
       continuous over the entire height of the monopole. The cable support system of the safety climb device
       shall have a stamped or engraved metal identification tag affixed at the base of the structure indicating the
       size and type of cable to ensure compatibility with a climber’s safety sleeve,
1.4.2  Item Unique Identification: All monopole components shall be marked in accordance with MIL-STD-130N
       for item unique identification.
1.4.3  Cable Access Port/Strain Relief: All monopoles shall provide the capability of routing feedlines on the
       inside of the monopole (without exceeding the bending radius limits for cabling) and provide a mechanism
       to provide strain relief on cabling and port sealing.

2.1    Waveguide Bridge: Waveguide bridge kits shall be provided as separate CLINs. Kits shall include the
       following:
          10-1/2 ft base shoe posts and 14 ft direct burial posts
          24”x10’ and 12”x10’ grated sections
          Triple tee trapeze kits
2.2    Antenna Mounts: Antenna mounts with compatible stand-off pipe mounts shall be provided as separate
       CLINs for all monopole diameters to accommodate the mounting of parabolic dishes and dipole antennas.
          Ring mount
          Chain mount
2.3    Tower Marking: Marking shall be provided as separate CLIN for all monopoles in accordance with FAA
       Advisory Circular 70/7460-1K. The markings shall be priced by linear feet based on the height of the
       monopole and the requirement.
2.4    FAA Lighting: Complete lighting kits shall be provided as separate CLINs for all monopoles. The lighting
       shall use LED technology and comply with FAA Advisory Circular 70/7460-1K and FAA Advisory Circular
       150/5345-43F. 120 VAC single phase light controller.
2.5    Training: The contractor shall provide up to one day of all necessary training at the first job site to (to be
       determined by the Government upon award) to properly assemble monopole tower sections, including
       maintenance. Training will be given to both Government Employees and Support Contractors.


3     AWARD DELIVERABLES
3.1    PE- stamped Drawings: For each purchased tower, drawings shall be certified wet stamped by a licensed P.E.
       in the state of the installation site. The following information shall be provided for all towers:
              o Overturning moment
              o Axial load
              o Uplift reactions
              o Shear reactions
3.2    Documentation: Contractor shall provide a manual detailing complete installation instructions for each
       purchased component (monopoles, mounts, waveguide bridge kits, etc.).


4     SHIPPING
The government will be responsible for transporting the monopoles to the point of installation. The contractor will be
responsible for loading the monopoles at time of pickup.




HQ C-2-0008 ASSIGNMENT AND USE OF NATIONAL STOCK NUMBERS (NAVSEA) (MAY 1993)

To the extent that National Stock Numbers (NSNs) or preliminary NSNs are assigned by the Government for the
identification of parts, pieces, items, subassemblies or assemblies to be furnished under this contract, the Contractor
shall use such NSNs or preliminary NSNs in the preparation of provisioning lists, package labels, packing lists,
shipping containers and shipping documents as required by applicable specifications, standards or Data item
Descriptions of the contract or as required by orders for spare and repair parts. The cognizant Government Contract

HQ D-2-0004 IDENTIFICATION MARKING OF PARTS (NAVSEA) (NOV 1996)

Identification marking of individual parts within the systems, equipments, assemblies, subassemblies, components,
groups, sets or kits, and of spare and repair parts shall be done in accordance with applicable specifications and
drawings. To the extent identification marking of such parts is not specified in applicable specifications or drawings,
such marking shall be accomplished in accordance with the following:

(1) Parts shall be marked in accordance with generally accepted commercial practice.

(2) In cases where parts are so small as not to permit identification marking as provided above, such parts shall be
appropriately coded so as to permit ready identification.

HQ D-2-0006 MARKING AND PACKING LIST(S) (NAVSEA) (NOV 1996)

(a) Marking. Shipments, shipping containers and palletized unit loads shall be marked in accordance with best
commercial practice.

(b) Packing List(s). A packing list (DD Form 250 Material Inspection and Receiving Report may be used)
identifying the contents of each shipment, shipping container or palletized unit load shall be provided by the
Contractor with each shipment. When a contract line item identified under a single stock number includes an
assortment of related items such as kit or set components, detached parts or accessories, installation hardware or
material, the packing list(s) shall identify the assorted items.

Where assortment of related items is included in the shipping container, a packing list identifying the contents shall
be furnished.

(c) Master Packing List. In addition to the requirements in paragraph (b) above, a master packing list shall be
prepared where more than one shipment, shipping container or palletized unit load comprise the contract line item
being shipped. The master packing list shall be attached to the number one container and so identified.

(d) Part Identification. All items within the kit, set, installation hardware or material shall be suitably segregated and
identified within the unit pack(s) or shipping container by part number and/or national stock number.

HQ G-2-0007 INVOICE INSTRUCTIONS (NAVSEA) (APR 2011)

 (a) In accordance with the clause of this contract entitled “ELECTRONIC SUBMISSION OF PAYMENT
REQUESTS” (DFARS 252.232-7003), the Naval Sea Systems Command (NAVSEA) will utilize the DoD Wide
Area Workflow Receipt and Acceptance (WAWF) system to accept supplies/services delivered under this contract.
This web-based system located at https://wawf.eb.mil provides the technology for government contractors and
authorized Department of Defense (DoD) personnel to generate, capture and process receipt and payment-related
documentation in a paperless environment. Invoices for supplies/services rendered under this contract shall be
submitted electronically through WAWF. Submission of hard copy DD250/invoices may no longer be accepted for
payment.

((b) It is recommended that the person in your company designated as the Central Contractor Registration (CCR)
Electronic Business (EB) Point of Contact and anyone responsible for the submission of invoices, use the online
training system for WAWF at http://wawftraining.com. The Vendor, Group Administrator (GAM), and sections
marked with an asterisk in the training system should be reviewed. Vendor documentation is available under
Resources at http://wawftraining.com.

(c) The designated CCR EB point of contact is responsible for activating the company’s CAGE code on WAWF by
calling 1-866-618-5988. Once the company is activated, the CCR EB point of contact will self-register under the
company’s CAGE code on WAWF and follow the instructions for a group administrator. After the company is set-
up on WAWF, any additional persons responsible for submitting invoices must self-register under the company’s
CAGE code at https://wawf.eb.mil.

Attachments created in any Microsoft Office product may be attached to the WAWF invoice, e.g., backup
documentation, timesheets, etc. Maximum limit for size of each file is 2 megabytes. Maximum limit for size of files
per invoice is 5 megabytes.

(e) The Contractor agrees to segregate costs incurred under this task order at the lowest level of performance, either
task or subtask, rather than on a total task order basis, and to submit invoices reflecting costs incurred at that level.
Supporting documentation in WAWF for invoices shall include summaries of work charged during the period
covered as well as overall cumulative summaries by individual labor categories, rates, and hours (both straight time
and overtime) invoiced; as well as a cost breakdown of ODCs (materials and travel), by line item task or subtask.
Subcontractors are also required to provide labor categories, rates, and hours (both straight time and overtime)
invoiced; as well as, a cost breakdown of ODCs, materials, and travel invoiced. Supporting documentation may be
encrypted before submission to the prime contractor for WAWF invoice submittal. Subcontractors may email
encryption code information directly to the Contracting Officer and Contracting Officer Representative. Should the
subcontractor lack encryption capability, the subcontractor may also email detailed supporting cost information
directly to the Contracting Officer and Contracting Officer Representative; or other method as agreed to by the
Contracting Officer.

(f) Before closing out of an invoice session in WAWF, but after submitting the document(s), you will be prompted
to send additional email notifications. Click on “Send More Email Notification” and add the acceptor/receiver email
addresses noted below in the first email address block, and add any other additional email addresses desired in the
following blocks. This additional notification to the government is important to ensure that the acceptor/receiver is
aware that the invoice documents have been submitted into WAWF.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall
have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to
this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other
evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any
shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If
this contract is completely or partially terminated, the records relating to the work terminated shall be made available
for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to
litigation or the settlement of claims arising under or relating to this contract shall be made available until such
appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data,

52.216-18     ORDERING. (OCT 1995)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or
task orders by the individuals or activities designated in the Schedule. Such orders may be issued from TBD through
TBD.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict
between a delivery order or task order and this contract, the contract shall control.

(c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the
mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the
Schedule.

52.216-19     ORDER LIMITATIONS. (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of
less than 1 (insert dollar figure or quantity), the Government is not obligated to purchase, nor is the Contractor
obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor:

(1) Any order for a single item in excess of $1,000,000;

(2) Any order for a combination of items in excess of $1,000,000; or

(3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the
limitation in subparagraph (1) or (2) above.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal
Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the
Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) above.

(d) Notwithstanding paragraphs (b) and (c) above, the Contractor shall honor any order exceeding the maximum
order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 60 days after
issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons.
Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-22     INDEFINITE QUANTITY. (OCT 1995)

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in
the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not
purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering

clause. The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in
the Schedule up to and including the quantity designated in the Schedule as the "maximum". The Government shall
order at least the quantity of supplies or services designated in the Schedule as the "minimum".

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the
number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations
or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be
completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and
Government's rights and obligations with respect to that order to the same extent as if the order were completed
during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries
under this contract after 61 days AEDO of the final delivery order issued.

52.219-28    POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (APR 2009)

(a) Definitions. As used in this clause--

Long-term contract means a contract of more than five years in duration, including options. However, the term does
not include contracts that exceed five years in duration because the period of performance has been extended for a
cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other
appropriate authority.

Small business concern means a concern, including its affiliates, that is independently owned and operated, not
dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business

extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the

Section L - Instructions, Conditions and Notices to Bidders


GENERAL INSTRUCTIONS

PART A

GENERAL INSTRUCTIONS

Offerors are required to submit sufficient information concerning the following areas to enable Government
personnel to fully ascertain capabilities of the offeror to perform the requirements. The proposal must be sufficient
in detail and scope to permit evaluation and provide the evaluators a clear understanding of the offerors approach,
expertise, experience and capability as required by the solicitation. All proposals must clearly and convincingly
demonstrate that the offeror has a thorough understanding of the requirements and associated risks, and is able,
willing and competent to devote the resources necessary to meet the requirements and has valid and practical
solutions for all requirements and potential risk areas. Respond to all requirements of the solicitation. Do not alter
or rearrange the solicitation. The burden of proof for all the evaluation factors identified in this solicitation rests
with the offeror. The offerors are advised that the Government may incorporate into the final contract enhancing
features included in the offerors proposal deemed beneficial to the Government. With the exception of the Price
volume, no cost or pricing information should appear in any other volume. Alternate proposals are not acceptable.

In presenting material in the proposal, the offeror is advised that quality of information is more important than
quantity. Clarity, brevity, and logical organization should be emphasized during proposal preparation. It is the
responsibility of the offeror to present enough information to allow the various work efforts, support, and
management approaches, as well as price, to be meaningfully evaluated without discussions. Statements that the
prospective offeror understands, can or will comply with the specifications, and paraphrasing the requirements or
parts thereof without supporting information are considered inadequate and may render a rating of unsatisfactory.
For the purpose of this acquisition, relevance is defined as something that has a logical connection with the matter
under consideration. Such aspects or relevance include the type of effort (e.g. development, production, repair), the
type of requirements (e.g. weapon systems, information systems, engineering services, scheduled depot
maintenance), service similarity, service complexity, contract type, contract dollar value, the division of the company
that will perform the work, and participation of Principal Subcontractors, Team Members, or Critical Team
Members.

The offeror must include any data necessary to illustrate the adequacy of the various assumptions, approaches, and
solutions to problems. Failure to clearly and positively address a specific factor or sub-factor may be considered a
deficiency. There is no need to repeat information in more than one volume if an overlap exists; the detailed
information must be included in the most logical place and summarized and referenced in other areas. Unnecessarily
elaborate brochures or other presentation materials beyond that sufficient to present a complete and effective
proposal is neither necessary nor desired.

Offerors are also required to submit Tower Drawings. An AutoCAD drawing file (in accordance with ANSI/TIA-
222-G, design parameters and loading scenarios) shall be provided for each tower model as part of the proposal. The
following information shall be provided for all towers:
                    Overturning moment
                    Axial load
                    Uplift reactions
                    Shear reactions

Offerors are expected to comply with all requirements of the RFP. The Government advises offerors that taking
exception or deviating from any term or condition of the RFP may make an offer unacceptable, and the offeror
ineligible for award, unless the RFP expressly authorizes such an exception or deviation with regard to that specific

term or condition. The Government may consider any exception or deviation to any term or condition of the RFP

2.0 PROPOSAL FORMAT

Written proposals must be formatted using a Times New Roman 12 pt normal font (no reduction permitted), single-
spaced with 1-inch margins all around, and formatted for standard 8.5 x 11 inch paper. All pages should be
numbered with section and page numbers. When foldout pages are used they must not exceed 11 x 17 inches and
will be counted as 1 page. Drawings may be provided separately and may be any size but should be folded to
approximately 8.5 x 11 inch standard size and will count as 1 page. Graphs shall be presented in no smaller than a
10 pt font and should contain a grid, which allows values to be read directly from the graph to the same accuracy that
a 10 x 10 to the ½ inch grid provides. Graphic resolution should be consistent with the purpose of the data
presented.

The offeror will provide one complete copy of the written proposal to the PCO as electronic files fully compatible
with Microsoft Office.

3.0 PROPOSAL CONTENT AND VOLUMES

Each volume of the proposal shall be submitted as one original in electronic format as specified in the table below.
Submission of all volumes of the Original proposal to the email address provided in section 4.0 will determine
timeliness of receipt. Page limitations for each volume if any, are also specified in the table below as follows (title
and table of contents pages do not count towards page limit). Proposal pages beyond a specified maximum limit, if
any, will not be reviewed as part of the evaluation.

             Although Technical Proposals are not required, contractors are required to provide any literature or

             Each proposal shall include a table delineating each specification, and certify that the product proposed
              meets or does not meet the Government's minimum requirements. The table can be submitted in any
              format.

             Technical Description - Include overall dimensions, salient characteristics, major component
              identification, required options and accessories, material used in manufacturing the equipment, and a
              sample of the proposed commercial equipment technical manual(s)/data sheet(s). Identify all software
              and system components that meet specification in Section C requirements. A cross reference matrix
              (CRM) is required that links to each Navy technical specification element to the proposed hardware
              that will fill the requirement. Reference information is required in the CRM that shows where in the
              proposal literature the information can be found that demonstrates compliance for each technical
              element.

             Describe the warranties provided, technical certifications, calibration/certificate of conformance and
              any specialized equipment used to test and calibrate. Provide any additional information required to
              service, support and calibration of all system components, adapters, cables and/or kits. Identify those
              items (sub-assemblies, circuit cards) that are uniquely recommended for return to vendor (service,
              repair or calibration). NOTE: The intent is for the Navy to be able to service this equipment to the
              maximum extent possible.


2.0 VOLUME 2: PAST PERFORMANCE:

Past performance data submitted must have a logical connection to the requirement set forth in the Statement of
Work/Specification. Offerors shall submit the following information as part of their proposal for both the offeror
and proposed major subcontractors. List performance data on three (3) most recently completed current Federal
government contracts (not to have exceeded 3 years since completion) for similar equipment. If offerors do not have
three Federal contracts, State, local or commercial contracts can be used to complete this requirement. Offerors that
are newly formed without prior contracts should list contracts and subcontracts as required above for all personnel
with significant roles in contract performance. Use Attachment (1) to supply data.

Attachment (1) Past Performance Evaluation Data Sheet shall be completed by the offeror in its entirety for each
contract.

         • Quality
         • Timeliness
         • Customer Satisfaction

Attachment (2) Present/Past Performance Evaluation Questionnaire Form. The offeror shall send out and track
completion of the Present/Past Performance Evaluation Form to each of the offerors relevant past performance
contracts Point of Contacts (POCs). The responsibility to send out and track the completion of the Present/Past
Performance Questionnaires rests solely with the offeror. The offeror shall exert its best efforts to ensure that at least
one POC, per relevant contract, submits a completed Present/Past Performance Evaluation Form to the Government
at the same time the solicitation closes. Each form shall contain the contract number, POC and phone number. Each
offerors POC shall fax or email its completed Present/Past Performance Questionnaire directly to (951) 273-4013 or
vanessa.labyzon@navy.mil. The Government reserves the right to verify/confirm all form information.

Failure to submit the data sheet, with the proposal, shall be considered certification (by signature on the proposal)
that the contractor has no past performance for similar items. The Government reserves the right to use past
performance information obtained from these sources or from sources other than those identified by the offeror, such
as the Navy’s Contractor Performance Assessment Reporting System (CPARS). Since the Government may not
necessarily interview all sources provided by the offeror, it is incumbent upon the offeror to explain the relevance of
the data provided. The burden of providing thorough and complete past performance information remains with the
offeror. If you are aware of any situation that may negatively impact your past performance ratings please discuss
the situation and how it was remedied.


3.0 VOLUME 3: PRICE:

If a proposal has been determined acceptable under each of the non-price factors listed above, the Government will
evaluate each proposal on a lowest price basis.

The Government may award a contract on the basis of initial offers received, without discussions. Therefore, each
initial offer should contain the offerors best terms from a price and technical standpoint. However, if considered
necessary by the Contracting Officer, discussions will be conducted with only those offerors determined necessary to
ensure efficient competition.

52.212-1     INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (JUN 2008)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS
code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF
1449). However, the small business size standard for a concern which submits an offer in its own name, but which
proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the
exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as
otherwise specified in the solicitation. As a minimum, offers must show--

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the
requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts
for the same or similar items and other references (including contract numbers, points of contact with telephone
numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all
terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or
information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from
the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time
specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no
expense to the Government, and returned at the sender's request and expense, unless they are destroyed during
preaward testing.

(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or
commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated
separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers:

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the
Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the
solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers
or revisions are due.

(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in
the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is
received before award is made, the Contracting Officer determines that accepting the late offer would not unduly
delay the acquisition; and--

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the
initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date
specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for
receipt of offers and was under the Government's control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the
Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp
of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral
testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received
at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent
Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date,
the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the
solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers,
offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to
the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an
offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person
requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a
contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms
from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later

Section M - Evaluation Factors for Award


BASIS FOR CONTRACT AWARD
THE METHOD OF AWARD IS LOWEST PRICE TECHNICALLY AVAILABLE (LPTA)

As stated in the solicitation, the Government intends to evaluate proposals and award a contract without
discussions with offerors (except clarifications as described in FAR 15.306(a)).

An overall technical rating must “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE”
rating in any factor results in the overall technical proposal being rated “UNACCEPTABLE” unless corrected
through clarifications. An overall technical rating of “UNACCEPTABLE” makes a proposal ineligible for award.

The Factors considered for award:

                  Factor 1 – Technical Approach
                  Factor 2 – Past Performance
                  Evaluated Price

EVALUATION CRITERIA

The proposal will be evaluated in accordance with FAR 52.212-2 and supplemented by the following:

Basis of Evaluation and Submittal Requirements for Each Factor;

Factor 1, Technical Approach:

Contractor proposed equipment shall be in accordance with the PWS.

Contractors are required to provide sufficient literature or data that will allow the engineers to review and determine
whether the proposed products meet or exceed the Government’s requirement. The contractor will submit a table
delineating each specification, and certify that the product proposed meets or does not meet the Government’s
minimum requirements. The table can be submitted in any format.

Factor 2, Past Performance:

The Government will evaluate Past Performance information on the degree to which the offeror has satisfied its
customers in the past and complied with Federal, State, and Local Laws and Regulations. The Government may, at
its discretion, contact none, some or all of each offeror’s customers provided in enclosure (1) to ask whether or not
they believe: (1) The offeror was capable, efficient and effective; (2) That the offeror’s performance conformed to
the terms and conditions of its contract; (3) That the offeror was reasonable and cooperative during performance; (4)
That the offeror was committed to customer satisfaction; and (5) If given an chance would they select the same or
different contractor. In evaluating Past Performance, experience that is more relevant to the systems and tasking
described in the PWS shall consider this information, as well as information obtained from any other sources when
evaluating the offeror’s past performance.

The degree to which past performance evaluations and all other past performance information reviewed by the
Government (e.g., PPIRS, performance recognition documents, enclosure (2), and information obtained for any
other source) reflect a trend of satisfactory performance considering:
         - A pattern of successful completion of tasks;
         - A pattern of deliverables that are timely and of good quality;
         - A pattern of cooperativeness and teamwork with the Government at all levels
         (task managers, contracting officers, auditors, etc.);
         - Tasks that are identical to, similar to, or related to the task at hand; and

(3) Evaluated Price:

The Government will evaluate price based on the total price. Total price consists of the basic requirements and all
option items (see Section B of the solicitation). The Government intends to evaluate all options and has included the
provision FAR 52.217-5, Evaluation of Options (JUL 1990) in Section M of the solicitation. In accordance with
FAR 52.217-5, evaluation of options will not obligate the Government to exercise the option(s). Analysis will be
performed by one or more of the following techniques to ensure a fair and reasonable price:

                            (i) Comparison of proposed prices received in response to the RFP.

                            (ii) Comparison of proposed prices with the IGCE.

                            (iii) Comparison of proposed prices with available historical information.

                            (iv) Comparison of market survey results.

52.212-2    EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer
conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The
following factors shall be used to evaluate offers:

Factor 1: Technical Approach
Factor 2 : Past Performance
Evaluated Cost

Technical and past performance, when combined, are significantly less important than price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the
total price for the basic requirement. The Government may determine that an offer is unacceptable if the option
prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the
option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within
the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not
there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
